In accordance with sub-paragraphs 19), 21) of Article 44, paragraph 1 of Article 45 of the Constitution of the Republic of Kazakhstan, paragraph 2 of Article 17-1 of the Constitutional Law of the Republic of Kazakhstan "On the President of the Republic of Kazakhstan", I HEREBY DECREE:

1. To approve the attached Regulations on the Administration of the President of the Republic of Kazakhstan (Appendix 1).

2. To approve the list of state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan (Appendix 2).

3. Invalidate:

1) Decree of the President of the Republic of Kazakhstan dated February 11, 2002 No. 805 "On approval of the Regulations on the Administration of the President of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2002, No. 6, Article 40; 2003, No. 20, Article 201; 2004, No. 19, Article 235; 2006, No. 23, Article 229; 2007, No. 34, Article 372);

2) subparagraph 6) of paragraph 1 of Decree of the President of the Republic of Kazakhstan dated May 16, 2003 No. 1094 "On Amendments and additions to certain Decrees of the President of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2003, No. 20, art. 201);

3) Decree of the President of the Republic of Kazakhstan dated April 23, 2004 No. 1351 "On Amendments and additions to Decree of the President of the Republic of Kazakhstan dated February 11, 2002 No. 805" (SAPP of the Republic of Kazakhstan, 2004, No. 19, art. 235);

4) Subparagraph 2) of paragraph 1 of Decree of the President of the Republic of Kazakhstan dated March 23, 2005 No. 1528 "On Amendments and additions to certain Decrees of the President of the Republic of Kazakhstan";

5) Subparagraph 4) of paragraph 1 of Decree of the President of the Republic of Kazakhstan dated June 6, 2006 No. 131 "On Amendments and additions to certain Decrees of the President of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2006, No. 23, art. 229);

6) Subparagraph 2) of paragraph 2 of Decree of the President of the Republic of Kazakhstan dated September 21, 2007 No. 413 "On measures to ensure the right of legislative initiative of the President of the Republic of Kazakhstan and to bring certain acts of the President of the Republic into line with the Constitution of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2007, No. 34, art. 372).

4. This Decree shall enter into force from the date of signing.

Position of the Administration of the President of the Republic of Kazakhstan

The footnote. The Regulation is amended by Decree of the President of the Republic of Kazakhstan dated December 28, 2010 No. 1129.

These regulations, in accordance with the Constitution of the Republic of Kazakhstan, legislative and other normative legal acts of the Republic of Kazakhstan, define the status, mission, main tasks and functions, powers, and organization of work of the Presidential Administration of the Republic of Kazakhstan.

1. General provisions

1. The Administration of the President of the Republic of Kazakhstan (hereinafter referred to as the Administration) is a state body formed by the President of the Republic of Kazakhstan (hereinafter referred to as the President), directly subordinate to and accountable to him.

2. The Administration and its employees in their activities are guided by the Constitution, laws, acts of the President of the Republic of Kazakhstan, this regulation, as well as other regulatory legal acts.

3. The Administration is a legal entity in the organizational and legal form of a state institution, has seals and stamps with its name in the state language, letterheads of the established sample, as well as bank accounts, including currency accounts, in accordance with the legislation of the Republic of Kazakhstan.

4. The structure and staffing of the Administration are determined by the President.

5. Full name of the Administration: "State institution "Administration of the President of the Republic of Kazakhstan".

6. Legal address of the Administration: Republic of Kazakhstan, Astana city, Yesil district, Akorda Residence.

7. The Administration's activities are financed from the republican budget.

2. The mission and main tasks of the Administration

8. The Administration's mission is to provide high-quality and timely information, analytical, legal, protocol, organizational, documentation, and other support for the President's activities.

9. The main tasks of the Administration are:

1) ensuring the exercise of the President's powers:

in the field of foreign policy;

in the field of socio-economic and other areas of domestic policy;

in the field of national defense and security;

in the field of legal policy, law and order;

in the field of personnel policy;

in relation to the Parliament of the Republic of Kazakhstan (hereinafter referred to as the Parliament);

in relation to the Government of the Republic of Kazakhstan (hereinafter referred to as the Government);

in relation to the Constitutional Court of the Republic of Kazakhstan;

in relation to courts and judges;

in relation to the Central Election Commission of the Republic of Kazakhstan;

in relation to local representative and executive bodies, akims of regions, cities of republican significance and the capital, and in the field of regional policy;

in relation to government agencies directly subordinate to and accountable to him;

2) ensuring the activities of the State Adviser of the Republic of Kazakhstan (hereinafter referred to as the State Adviser), the Assembly of the People of Kazakhstan and the consultative and advisory bodies under the President;

3) other tasks established by the legislation of the Republic of Kazakhstan and (or) determined by the President.

3. Main functions of the Administration

10. To ensure the implementation of the President's powers in the field of foreign policy, the Administration performs the following functions::

1) carries out monitoring, analysis and forecasting of global development processes, as well as topical issues of international relations, and develops recommendations to the President on the implementation of his foreign policy powers;

2) organizes the substantive part of international events with the participation of the President;

3) ensures the President's interaction with government agencies of foreign countries and their officials, foreign political and public figures, international and foreign organizations;

4) submits proposals to the President:

on the main directions of foreign policy, improvement of political and economic cooperation with foreign countries and improvement of the image of the Republic of Kazakhstan abroad;

on the implementation of decisions of international organizations;

regarding the conclusion, suspension and termination of international treaties of the Republic of Kazakhstan.

11. To ensure the implementation of the President's powers in the field of socio-economic and other areas of domestic policy, the Administration performs the following functions::

1) submits proposals to the President:

on the formation and improvement of socio-economic and other internal policies of the state, including state youth and information policy, education, science, health, migration, demography, culture, language policy and sports, the concept of Kazakhstani patriotism;

to ensure internal political stability in the country, including in matters of interethnic and interfaith relations;

2) carries out monitoring, analysis and forecasting of the processes of development of the economic and socio-political situation in the country;

3) ensures interaction with civil society institutions.

12. To ensure the implementation of the President's powers in the field of ensuring the defense capability and security of the state, the Administration performs the following functions:

1) submits proposals to the President on the main directions of the country's military policy, policy in the field of ensuring the defense capability and national security of the state, mobilization and mobilization training;

2) ensures the activities of the President when making a decision on conscription of citizens of the Republic of Kazakhstan for military service and on the discharge of conscripted military personnel;

3) carries out monitoring, coordination and control over the activities of the Armed Forces, other troops and military formations of the Republic of Kazakhstan, law enforcement and other state bodies to ensure national security.

13. To ensure the implementation of the President's powers in the field of legal policy, law and order, the Administration performs the following functions::

1) submits proposals to the President:

on the main directions and improvement of legal policy;

to improve the effectiveness of legal regulation mechanisms;

to strengthen the rule of law and ensure law and order;

on the legal regulation by its decrees of issues not falling within the legislative competence of the Parliament, as well as those not falling within the competence of the Government and other state bodies established by the laws of the Republic of Kazakhstan.;

2) organizes work on the development of state policy documents in the field of legal policy, ensuring law and order in the Republic of Kazakhstan for the relevant period.

14. To ensure the implementation of the President's powers in the field of personnel policy, the Administration performs the following functions::

1) submits proposals to the President on personnel policy in the Republic of Kazakhstan;

2) coordinates interaction and monitors the activities of government agencies to implement the personnel policy of the President;

3) coordinates the activities for the formation of the personnel reserve of political civil servants;

4) organizes the resolution of issues related to the passage of public service by officials appointed and coordinated with the President, maintains their personal affairs.

15. To ensure the exercise of the President's powers in relation to Parliament, the Administration performs the following functions::

1) in order to implement the right of legislative initiative of the President, organizes the development, carries out legal and other expertise and develops draft legislative acts, ensures their submission to the Mazhilis of Parliament and submits them to Parliament;

2) submits proposals to the President:

to determine the priority of consideration of draft laws by Parliament;

on participation in joint or separate sessions of the Chambers of Parliament;

meetings of the President with the leadership of the Parliament, party factions and parliamentary groups, individual members of Parliament;

3) carries out legal and other expertise of the laws of the Republic of Kazakhstan submitted for signature to the President;

4) ensures that, by decision of the President, the laws or their individual articles are returned to Parliament for re-discussion and voting.;

5) represents the interests of the President in Parliament, including the position of the President in Parliament on objections to laws submitted for signature;

6) regularly informs the President about the state of the legislative process in Parliament and the issues he is considering, clarifies the President's position on draft laws.

16. To ensure the exercise of the President's powers in relation to the Government, the Administration performs the following functions:

1) organizes and ensures that an assessment of the effectiveness of the ministries' activities is carried out in accordance with the established procedure;

2) submits proposals to the President:

on improving the Government structure;

on giving instructions to the Government;

on the issuance of acts according to which the Government is entrusted with the exercise of executive functions, except those established by the Constitution and laws of the Republic of Kazakhstan;

on the need for the President to preside over Government meetings on particularly important issues;

3) coordinates the draft decisions of the Government developed at the meetings of the Government under the chairmanship of the President;

4) ensures the coordination of draft acts of the Government and state bodies in cases established by the legislation of the Republic of Kazakhstan;

5) conducts legal and other expertise in accordance with the established procedure and coordinates draft legislative acts developed by the Government before they are submitted to the Mazhilis of Parliament.;

17. To ensure the exercise of the President's powers in relation to the Constitutional Court, the Administration performs the function of preparing presidential appeals in cases provided for in Article 72 of the Constitution of the Republic of Kazakhstan, as well as subparagraph 10-1) of Article 44 of the Constitution of the Republic of Kazakhstan.

18. In order to ensure the exercise of the President's powers in relation to courts and judges, the Administration performs the following functions::

1) ensures the activities of the President:

upon presentation to the Senate of the Parliament for election and dismissal of the Chairman and judges of the Supreme Court of the Republic of Kazakhstan on the recommendation of the Supreme Judicial Council;

when the President, on the recommendation of the Supreme Judicial Council, appoints and dismisses the chairmen and judges of local and other courts, the chairmen of the collegiums of the relevant courts.;

when, on the recommendation of the Supreme Judicial Council, a decision is taken to consent to the arrest of a judge, bring him in, apply administrative penalties imposed by court, and bring him to criminal responsibility.;

2) submits proposals to the President on improving the judicial system.

19. To ensure the implementation of the President's powers in relation to the Central Election Commission, the Administration performs the function of making proposals to the President on improving the electoral system of the Republic of Kazakhstan.

20. To ensure the implementation of the President's powers in relation to local representative and executive bodies, akims of regions, cities of republican significance, the capital, and in the field of regional policy, the Administration performs the following functions:

1) organizes an assessment of the effectiveness of the activities of local executive bodies of regions, cities of republican significance and the capital and ensures that it is carried out in accordance with the established procedure;

2) conducts monitoring and analysis of the socio-economic development of the regions and informs the President about the state of affairs in the regions;

3) monitors the conduct of reporting meetings of heads of local executive bodies with the public;

4) submits proposals to the President:

on improving the activities of akims and local executive bodies of regions, cities of republican significance and the capital;

on the cancellation or suspension, in whole or in part, of acts of akims of regions, cities of republican significance and the capital;

according to the strategy and programs of regional development, constructive joint work of local representative and executive bodies, their interaction with the central authorities of the country;

if necessary, on the issue of early termination of the powers of the maslikhat.

21. To ensure the exercise of the President's powers in relation to government bodies directly subordinate and accountable to him (according to the approved list), the Administration performs the following functions:

1) organizes an assessment of the effectiveness of these state bodies and ensures that it is carried out in accordance with the established procedure;

2) submits proposals to the President on improving the activities, formation, abolition and reorganization of these state bodies;

3) ensures the coordination and control of the activities of these state bodies.

22. To ensure the implementation of other powers of the President, the Administration performs the following functions::

1) ensures the inviolability of the honor and dignity of the President;

2) submits proposals to the President:

to ensure the coordinated functioning of all branches of government, to improve the activities of government agencies;

on awarding state awards and conferring honorary, higher military and other ranks, class ranks, diplomatic ranks, qualification classes; deprivation of state awards, titles, ranks, ranks and classes;

on issues of citizenship of the Republic of Kazakhstan, preservation and withdrawal from it, restoration of citizenship of the Republic, granting political asylum;

3) ensures that the President grants pardons to citizens;

4) ensures the preparation of the draft annual Address of the President to the people of Kazakhstan on the situation in the country and the main directions of domestic and foreign policy of the Republic of Kazakhstan;

5) provides information, analytical, protocol and organizational support for the President's activities, including holding events with his participation;

6) organizes and participates in the development of acts of the President, including strategic and program documents;

7) carries out coordination, monitoring and control of strategic and program documents, as well as analysis of the functioning of the state planning system;

8) monitors the implementation of state policy by state bodies, the execution of acts and orders of the President, the State Adviser, including through inspections;

9) coordinates and directs the activities of individual state bodies and organizations in accordance with the established procedure;

10) explains the internal and foreign policy pursued by the President, ensures coverage of the President's activities in the mass media, and the President's interaction with them;

11) keeps records of laws signed by the President, as well as acts issued by the President, ensures their publication, distribution and storage;

12) considers the appeals of individuals and legal entities addressed to the President, analyzes them, organizes and carries out the reception of citizens;

13) provides preparation for consideration by the President of the results of the activities of the Government, central state bodies, local executive bodies of regions, cities of republican significance and the capital, officials;

14) provides documentation support to the President, including through the organization of proper document management, the introduction and development of information technologies, ensuring the functioning of the Analytical Complex of the Administration, the activities of the official website of the President, monitoring compliance with office rules and expanding the scope of the state language;

15) provides information and analytical, organizational and documentation support for the activities of the State Adviser, the Assembly of the People of Kazakhstan, and advisory bodies under the President, and monitors the implementation of their decisions;

16) performs other functions established by the legislation of the Republic of Kazakhstan and (or) determined by the President.

4. The organization of the Administration's activities and the powers of its officials and employees

23. The Administration consists of the Head of the Presidential Administration of the Republic of Kazakhstan (hereinafter referred to as the Head of the Administration), the First Deputy and Deputy Heads of the Administration, the Secretary of the Security Council of the Republic of Kazakhstan, assistants to the President of the Republic of Kazakhstan, the Head of the Office of the President of the Republic of Kazakhstan, advisers to the President of the Republic of Kazakhstan, heads of structural divisions and other Administration staff.

24. The Administration is headed by the Head of the Administration, who is appointed and dismissed by the President and works under his direct supervision, is accountable and controlled by him.

Head of Administration:

1) submits the regulations on the Administration to the President for approval, makes proposals on the structure and staffing of the Administration, approves the staffing table of the Administration, and makes changes to it within the approved staffing;

2) coordinates the work of his first deputy and deputies, assistants and advisers to the President, organizes and directs the work of the structural divisions of the Administration, ensures interaction with government agencies;

3) in agreement with the President, approves the distribution of duties between his first deputy and deputies, the head of the Chancellery, assistants and advisers to the President (hereinafter referred to as the Distribution);

4) submits proposals for the President's consideration on the appointment and dismissal of his first deputy and deputies, assistants and advisers to the President, heads of structural divisions of the Administration, with the exception of the heads of individual Administration secretariats;

5) appoints and dismisses the heads of individual administrative secretariats, deputy heads of structural divisions of the Administration, state inspectors, heads of sectors and other administrative civil servants of the Administration;

6) approves the regulations on the structural divisions of the Administration;

7) coordinates the work on monitoring the execution and observance of acts of the President, the execution of his instructions, the passage of documents in the Administration for these purposes, as well as on the preparation of events with the participation of the President, the Head of the Administration, including holding meetings with senior officials of the Administration and inviting the heads of relevant state bodies of the Republic;

8) submits to the President for signature laws adopted by Parliament, draft decrees, orders and other documents and materials addressed to the President for consideration;

9) issues orders to the Administration;

10) establishes internal work regulations in the Administration;

11) approves the Administration's financing plan and manages financial resources within its limits;

12) signs official documentation;

13) encourages Administration staff and imposes disciplinary penalties on them;

14) sends Administration employees on business trips;

15) has the right to form interdepartmental working groups and involve government officials in the execution of presidential instructions.;

16) carries out personal reception of citizens;

17) controls the implementation of the legislation of the Republic of Kazakhstan on civil service in the Administration;

18) provides permanent communication between the Administration and the Parliament, its Chambers, working bodies and offices of the Chambers of Parliament; the Government and the Government Staff; ministries; the Constitutional Court; the Supreme Court; the Supreme Judicial Council; government agencies directly subordinate and accountable to the President; akims, maslikhats of regions, cities of republican significance and the capital; political parties and other public associations; mass media; individuals and legal entities;

19) has the right to attend open and closed sessions of the Parliament and its Chambers;

20) have the right to participate in meetings of the Government, boards of central executive bodies, government bodies directly subordinate and accountable to the President, and advisory bodies under the President, meetings of the Supreme Judicial Council, the Council of the Assembly of the People of Kazakhstan and sessions of the Assembly of the People of Kazakhstan;

21) organizes and ensures the implementation of the President's personnel policy;

22) submits proposals to the President on candidates appointed to senior positions by the President or on his proposal, and also ensures coordination with the President of candidates proposed for appointment to senior positions by the Government, other state bodies and state officials.;

23) has the right to delegate the performance of certain of its powers to other senior officials of the Administration;

24) exercise other powers provided for by these regulations, as well as those assigned to him by the President.

25. In the absence of the Head of the Administration, his duties are performed by the first deputy or one of the deputies, determined by the Head of the Administration.

26. The First Deputy and Deputy Heads of the Administration, assistants and advisers to the President, heads of structural divisions of the Administration, with the exception of heads of individual Administration secretariats, are appointed and dismissed by the President on the recommendation of the Head of the Administration.

27. First Deputy and Deputy Heads of the Administration, Head of the Presidential Office, assistants and advisers to the President:

1) organize the execution of acts and orders of the President, the Head of the Administration;

2) inform the President about the state of affairs in the country, provide him with information and analytical materials;

3) coordinate the activities of state bodies on issues within their competence according to the Distribution;

4) coordinate the activities of the structural divisions of the Administration according to their Distribution, ensure their interaction with government agencies and other organizations;

5) perform other functions established by the President and the Head of the Administration.

28. Presidential Advisers:

1) inform the President about the situation in the supervised area, provide him with information and analytical materials;

2) perform other functions established by the President and the Head of the Administration.

29. Depending on the priority and importance of the tasks, the President may assign other tasks and powers to the First Deputy and Deputy Heads of the Presidential Administration, his assistants and advisers, other than those provided for in these Regulations. The President determines the number and areas of activity of his assistants and advisers.

30. Heads of structural divisions of the Administration:

1) organize the fulfillment of tasks assigned to structural divisions, timely and exhaustive execution of acts and instructions of the President, instructions of the Head of Administration;

2) distribute duties among their deputies, approve job descriptions of administrative civil servants of the structural subdivision;

3) ensure the organization of work and proper labor discipline, and are responsible for record keeping in accordance with the rules established in the Administration.;

4) submit a submission on the appointment and dismissal, encouragement and imposition of disciplinary action on an employee of the structural unit of the Administration headed by him;

5) has the right, in accordance with the established procedure, to use information databases available to government agencies.;

6) has the right to participate in meetings of the Government, boards of state and advisory bodies.;

7) has the right to conduct official correspondence with government agencies, officials and organizations on issues related to the jurisdiction of the structural divisions of the Administration;

8) perform other functions established by the President and the Administration leadership.

31. The staff of the Administration are civil servants with the authority to solve the tasks facing the Administration.

32. In order to implement the functions provided for in this regulation, the Administration has the right:

1) give instructions:

to the Deputy Prime Ministers of the Republic of Kazakhstan;

Office of the Government of the Republic of Kazakhstan;

ministries and other central executive bodies;

akims of regions, cities of republican significance and the capital of the Republic;

The Supreme Court, the Prosecutor General's Office, and the National Security Committee – on matters unrelated to the administration of justice, the functions of criminal prosecution, inquiry, preliminary investigation, and operational investigative activities, respectively; the Judicial Administration of the Republic of Kazakhstan;

To the Supreme Judicial Council of the Republic of Kazakhstan on issues not related to the selection of candidates for judicial positions;

The National Bank, the Supreme Audit Chamber of the Republic of Kazakhstan, and other government agencies directly subordinate to and accountable to the President;

2) request and receive necessary information, documents and other materials from government agencies and officials.

Orders and requests from the Administration for the provision of necessary information, documents and other materials that are mandatory for government agencies and officials are answered within two weeks from the date of their receipt, unless the Administration sets other deadlines.;

3) coordinate and monitor the activities of relevant government agencies and officials, organize appropriate inspections of the execution of acts and instructions of the President and his Administration, including for compliance with acts of the Government, central and local government agencies, akims and other government officials with the Constitution, laws of the Republic of Kazakhstan and acts of the President of the Republic of Kazakhstan;

4) to demand the elimination of identified violations and deficiencies in the course of the implementation of the laws of the Republic, acts and instructions of the President;

5) develop recommendations for the elimination of identified violations, facts of non-compliance with the laws of the Republic of Kazakhstan, acts of the President of the Republic and non-fulfillment of his instructions;

6) to hear oral and request written explanations from the relevant officials;

7) systematically report to the President of the Republic on the results of the inspections conducted by the Administration.

The powers provided for in the sub-paragraphs 1), 2), 3), 4), 5), 6) and 7) of this paragraph, have the authority of the Head of Administration and his first deputy.

The powers provided for in the sub-paragraphs 1), 2), 3), 4), 5), 6) and 7) of this paragraph, with the exception of the second paragraph of subparagraph 1), have: the Secretary of the Security Council, the Head of the Presidential Office, presidential assistants, Presidential advisers. At the same time, these officials have the right to give instructions to an official who performs the functions of Deputy Prime Minister and Chief of Staff of the Government of the Republic of Kazakhstan concurrently.

The powers provided for in subitems 2) - 7) of this paragraph are vested in the heads of structural divisions of the Administration, state inspectors of the Administration.
