AGREEMENT between the Republic of Kazakhstan and Turkmenistan on the Delimitation of the Caspian Sea floor between the Republic of Kazakhstan and Turkmenistan

The Republic of Kazakhstan and Turkmenistan, hereinafter referred to as the Parties, striving to ensure favorable conditions for the exercise of their sovereign rights to develop and use the resources of the seabed and subsoil of the Caspian Sea, taking into account that the existing legal regime of the Caspian Sea does not meet modern needs and does not fully regulate the relations of the Caspian littoral States, calling on the Caspian littoral States to conclude as soon as possible on the basis of their common agreement, the Convention on the Legal Status of the Caspian Sea, Guided by the principles and norms of international law, convinced that this Agreement will contribute to the further strengthening of good-neighborliness and the development of mutually beneficial and equal cooperation between the Parties, have agreed as follows:
Article 1
The bottom and subsoil of the Caspian Sea are delimited between the Parties along a line that is based on the median line, taking into account the principles and norms of international law, as well as by agreement of the Parties (hereinafter referred to as the demarcation line).
Article 2
To build the demarcation line, the Parties proceeded from the long-term average level of the Caspian Sea, equal to minus 28 meters of the 1977 Baltic elevation system relative to the zero of the Kronstadt footstock. The coordinates of the turning points of the demarcation line are determined on the basis of cartographic materials agreed by the Parties in the 1942 coordinate system and are fixed in the Catalog of Geographical Coordinates of the Turning Points of the Demarcation Line (Appendix 1). The starting point No. 1 of the demarcation line is border point No. 13, indicated in Appendix 1 to the Agreement between the Republic of Kazakhstan and Turkmenistan on the Delimitation and Demarcation of the Kazakh-Turkmen State Border dated July 5, 2001. The demarcation line runs along geodetic lines connecting the turning points indicated in Appendix 1 to this Agreement. The end point of the demarcation line will be the junction point of the lines delimiting the sections of the Caspian Sea floor between the Republic of Kazakhstan, Turkmenistan and the Republic of Azerbaijan, which will be determined by a separate international treaty. The line of demarcation is plotted on the agreed-upon Scheme of the line of demarcation of the seabed and subsoil of the Caspian Sea between the Republic of Kazakhstan and Turkmenistan (Appendix 2). The annexes to this Agreement are an integral part of it.
Article 3
Within their seabed areas, the Parties, in accordance with international and national environmental norms, requirements and standards, exercise sovereign rights for the exploration, development and use of the resources of the bottom and subsoil of the Caspian Sea, laying underwater cables and pipelines along the bottom of the Caspian Sea, creating artificial islands, berms, dams, overpasses, platforms and other engineering structures., as well as other legitimate economic activities at the bottom. The issues of exploration and development of promising structures and deposits in the event that the demarcation line passes through them will be the subject of separate agreements between the Parties.
Article 4
Differences in the interpretation and application of the provisions of this Agreement shall be resolved through consultations and negotiations or other peaceful means at the option of the Parties.
Article 5
This Agreement does not prevent the Caspian littoral States from reaching a general agreement on the legal status of the Caspian Sea and may be considered by the Parties as part of their general agreements. The line of demarcation may be adopted to delimit the maritime belts between the Parties, which are subject to their sovereignty and jurisdiction, in accordance with the agreements of the Caspian Littoral States on the legal status of the Caspian Sea.
Article 6
By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized by separate protocols that are an integral part of this Agreement and enter into force in accordance with the procedure established by Article 7 of this Agreement.
Article 7
This Agreement is open-ended and shall enter into force on the date of receipt through diplomatic channels of the last written notification of its ratification.
Done in the city of Ashgabat on December 2, 2014, in two copies, each in the Kazakh, Turkmen and Russian languages, all texts being equally authentic. In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will use the text in Russian.
