Terrorist group

 

A terrorist group is an organized group of people that is created for the purpose of committing one or more terrorist crimes. Such groups can operate at the national or international level and usually have a strict internal structure and hierarchy. The purpose of a terrorist group is to carry out acts of violence, threats, or other actions aimed at undermining State security, destabilizing public order, or intimidating the population.

 

According to paragraph 31 of Article 3 of the Criminal Code of the Republic of Kazakhstan (CC RK), a terrorist group is an organized group whose purpose is to commit one or more terrorist crimes. Such groups operate on the basis of a coordinated plan and structured organization, with a clear goal of committing terrorist acts.

 

The main characteristics of the terrorist group:

1. An organized structure is a group consisting of several individuals who act together and in a coordinated manner to achieve their criminal goals.

2. The purpose of committing terrorist crimes – the main task of the group is to commit crimes related to terrorism, such as acts of violence, intimidation of the population, attacks on government agencies and government representatives.

3. The commission of one or more terrorist crimes – a group can plan and implement both single terrorist acts and a series of crimes aimed at destabilizing the state and public order.

1. Article 257 of the Criminal Code of the Republic of Kazakhstan – Creation, leadership of a terrorist group or participation in its activities. This article provides for responsibility for the creation of a terrorist group, the management of its activities, as well as participation in its criminal plans.

  - The creation of a terrorist group is punishable by imprisonment for a term of 12 to 15 years with confiscation of property.

  - Participation in a terrorist group is punishable by imprisonment for a term of 8 to 12 years with confiscation of property.

 

2. Article 255 of the Criminal Code of the Republic of Kazakhstan is an act of terrorism. It includes penalties for terrorist acts, including if they were organized by a terrorist group.

 

3. Article 258 of the Criminal Code of the Republic of Kazakhstan – Financing of terrorist or extremist activities and other aiding and abetting terrorism or extremism. Implies responsibility for assisting a terrorist group through financing, logistical support, and other types of assistance.

"On certain issues of judicial practice on the application of legislation on terrorist and extremist crimes" – clarifies the procedure for considering cases related to terrorist activities, including participation in terrorist groups. This resolution details the issues of proving the composition of the crime and the qualification of the actions of the participants.

 

A terrorist group is considered one of the most dangerous forms of organized crime, as its activities are aimed at destroying the foundations of State and public security. The legislation of the Republic of Kazakhstan strictly punishes the creation, management and participation in such groups, as well as any form of assistance to their activities (for example, financing or providing resources).
