An arbitration court is a court established by individuals and (or) legal entities in accordance with the legislation of the Republic of Kazakhstan, which is engaged in the consideration of disputes between legal entities (companies) and private entrepreneurs. Arbitration considers cases related to the violation of contractual obligations, discussion, participation and other issues that are regulated in the course of business activities.
Arbitration proceedings are initiated on the basis of an agreement - a written agreement of the parties to submit to arbitration a dispute that has arisen or may arise from civil law relations. Arbitration proceedings are governed by the Rules of Arbitration - this is a procedure for organizing the activities of a permanent arbitration and rules for arbitration;
Arbitrations in the Republic of Kazakhstan may not be established by state bodies, state enterprises, as well as natural monopolies and entities occupying a dominant position in the market of goods and services, legal entities, fifty or more percent of voting shares (interests in the authorized capital) of which are directly or indirectly owned by the state, their subsidiaries and affiliates, as well as second-tier banks, organizations engaged in certain types of banking operations.
An arbitration attorney represents the interests of his client in the arbitration process. An arbitration dispute arises when a party does not resolve its dispute voluntarily and applies to an arbitration court to resolve the dispute instead of a state court.
The role of an arbitration attorney is to draft and prepare documents for participation in the arbitration process, represent the client's interests in the arbitration court and protect his rights.
