The States Parties to this Convention, represented by Governments, hereinafter referred to as the Parties, based on the need for coordinated actions in the field of international road transport of passengers and baggage, have agreed as follows:
Chapter I General provisions
Article 1
1. This Convention applies to carriers of the Parties carrying passengers and baggage in international traffic by buses, regardless of the country of their registration, and is binding on them, as well as on the carriage of passengers and their baggage by buses, when the contract of carriage states that the carriage is carried out in the territories of at least two Parties and the point of departure. or the destination is located on the territory of one of the Parties.
2. The Convention regulates the conditions and rules of transportation, the liability of carriers, and the procedure for filing claims and lawsuits.
3. The terms used in the Convention have the following meanings:: a) "passenger" means an individual who, in pursuance of a contract of carriage concluded on his behalf or by himself, is transported for a fee or free of charge by the carrier;
b) "carrier" - a legal entity or individual engaged in international transportation of passengers and baggage and registered as a business entity in accordance with the legislation of the State of location;
c) "bus" - a vehicle designed to transport passengers and luggage, having at least 7 seats, not counting the driver's seat;
d) "ticket" - a document certifying the passenger's right to use a bus and confirming the conclusion of a contract of carriage between the carrier and the passenger;
e) "baggage" - cargo packed for departure by transport and transported separately from the passenger; f) "baggage receipt" - a document confirming the acceptance of baggage for transportation.
Chapter II Transportation conditions
Article 2
1. The general conditions of international automobile transportation of passengers and baggage, including the organization of transportation and obtaining the right to carry them out, the procedure for insurance, border, customs, sanitary and other types of control, are regulated by the following documents: multilateral conventions and agreements; bilateral intergovernmental agreements on international road transport; national legislation of the Parties.
2. The form of the ticket, baggage receipt and form is approved by the state competent authorities in the field of motor transport of the carrier and recognized by the state competent authorities in the field of transport of other States through whose territory transportation is carried out. The State competent authorities in the field of road transport will develop uniform forms of ticket, baggage receipt and form, approved by the state competent authorities in the field of transport of the States through whose territory transportation is carried out.
Article 3
Transportation of passengers and baggage in international traffic can be carried out by carriers that are subjects of private, collective, state or mixed forms of ownership, provided they have an appropriate license issued in the state of registration of the bus. The Parties instruct the competent authorities to prepare a draft document on the mutual recognition of licenses.
Article 4
When carrying out international transportation of passengers and baggage, the carrier is guided by the legislation in the field of traffic and nature protection of the State through whose territory the transportation is carried out.
Article 5
The order of organization and control of international transportation of passengers and baggage is determined by The Rules for the Carriage of Passengers and Baggage by Road in International Traffic of the member States of the Commonwealth of Independent States (hereinafter referred to as the Rules for the Carriage of Passengers), which are an integral part of this Convention, subject to the provisions of its Article 17.
Chapter III Responsibility of carriers
Article 6
The liability of carriers in international transportation, as well as the procedure for filing claims and lawsuits, are regulated by this Convention, bilateral agreements on international road transport, as well as the national legislation of the Parties.
Article 7
1. The carrier is responsible for damage caused to the passenger's health or damage to baggage during transportation in connection with: with death, bodily injury or any other harm caused to the passenger's health, regardless of the place and time of the incident (during transportation, boarding, disembarking or loading, unloading of baggage); with total or partial loss of baggage or its damage. The carrier is responsible for the baggage from the moment it is accepted for carriage until it is delivered or deposited in accordance with the procedure provided for The rules of passenger transportation. 2. The carrier is responsible both for his actions and for the actions of other persons, whose services he uses to fulfill the obligations imposed on him by virtue of the contract of carriage, when these persons act within their obligations.
Article 8
1. The carrier is released from liability for damage caused to a passenger or damage caused to baggage if the cause of the incident was circumstances, the consequences of which the carrier, despite the measures taken, could not have foreseen and avoided, as well as if the damage or damage resulted from a defect in baggage containing perishable or prohibited substances, means or objects.. 2. In order to relieve itself of responsibility, the carrier cannot refer either to the physical or mental disabilities of the driver, as well as to the malfunction of the bus.
Article 9
The total amount of compensation for harm or damage to be paid by the carrier in connection with the same event is determined by the courts of the Parties in accordance with their national legislation.
Article 10
1. The carrier is released from liability in whole or in part if the damage or damage is caused by the fault of the passenger. 2. If harm or damage is caused by the actions or omissions of a third party, the carrier is responsible for all harm or damage. At the same time, he retains the right to bring claims against this third party, except in the cases provided for in article 8 of this Convention.
Article 11
The carrier shall not be entitled to invoke the provisions of this Convention, which exclude his liability in whole or in part, if he has caused harm or damage to passengers, baggage or property as a result of his violation of the Traffic Rules of the State through whose territory the Carriage was carried out, or the Rules for the Carriage of Passengers. The same applies to the person for whose actions the carrier is responsible in accordance with article 7 of this Convention.
Article 12
The harm or damage referred to in this Convention shall be calculated in the national currency of the State in whose territory it was caused.
Chapter IV Claims and lawsuits
Article 13
1. The passenger has the right to make a claim to the carrier within seven days from the date of arrival of the passenger or baggage at the destination. 2. In case of illness of a passenger, when he is unable to file a claim for health reasons, this period may be extended until the passenger recovers.
Article 14
1. In all disputes arising in connection with the carriage of passengers and baggage in international traffic, the passenger has the right in accordance with Article 20 Convention on Legal Assistance and Legal Relations in Civil, Family and Criminal Matters of January 22, 1993 to apply to the courts of the State in whose territory the event that caused harm or damage occurred, or located at the legal address of the carrier or passenger, as well as at the points of departure or arrival of the passenger. 2. The court shall not have the right to require citizens of the Parties to deposit collateral to ensure payment of court costs related to the filing of a claim concerning transportation covered by this Convention.
Article 15
1. The right to file a claim in connection with the damage caused to the passenger's health remains for three years. The limitation period is calculated from the day when the person who was harmed found out or should have found out about it. 2. The right to file a claim in connection with the total or partial loss of baggage or its damage is maintained for one year. The limitation period is calculated from the date of arrival of the vehicle at the passenger's destination or, in case of non-arrival, from the day when it should have arrived there. 3. A written claim suspends the running of the limitation period until the carrier notifies in writing that the claim has not been satisfied, attaching the relevant documents to it. In case of partial recognition of the submitted claim, the limitation period is resumed only in respect of that part of the claim that remains the subject of dispute. The costs associated with proving the facts stated in the claim, or with responding to it, as well as returning relevant documents, are borne by the Party who refers to these facts. The filing of further claims on the same issue does not interrupt the limitation period if the carrier does not agree to consider them.
Article 16
1. A condition of the contract of carriage which directly or indirectly allows derogation from the provisions of this Convention shall be deemed null and void. The invalidity of such a condition does not entail the invalidity of other conditions of the contract of carriage. 2. Any condition according to which the carrier is granted the rights arising from the insurance contract is invalid.
Chapter V Final provisions
Article 17
This Convention does not affect the provisions of other international treaties to which the Parties are Parties.
Article 18
This Convention may be amended and supplemented with the general consent of the Parties.
Article 19
Disputes related to the application or interpretation of this Convention shall be resolved through consultations or negotiations between the Parties concerned.
Article 20
This Convention is open for accession by States that share its objectives and principles by submitting instruments of such accession to the depositary. The accession is considered to have entered into force from the date of receipt by the depositary of the notification of accession.
Article 21
This Convention is subject to ratification by the Signatories in accordance with their domestic procedures and will enter into force after the deposit of the third instrument of ratification with the depositary. For the Parties that have ratified it later, it shall enter into force on the date of their deposit of their instruments of ratification with the depositary.
Article 22
This Convention shall be in force for a period of five years from the date of its entry into force. After this period, the Convention is automatically extended each time for a period of five years, unless the Parties decide otherwise.
Article 23
Each Party may withdraw from this Convention by sending a written notification to the depositary no later than 6 months prior to withdrawal. Done in Bishkek on October 9, 1997, in one original copy in the Russian language. The original copy is kept at the Executive Secretariat of the Commonwealth of Independent States, which will send a certified copy to each signatory State of this Convention.
Appendix to Conventions on the International Carriage of Passengers and Baggage by Road
Rules for the carriage of passengers and baggage by road in international traffic of the Participating States The Commonwealth of Independent States
I. General provisions
1. The Rules for the Carriage of Passengers and Luggage by Road in International Traffic of the member States of the Commonwealth of Independent States (hereinafter referred to as the Rules for the Carriage of Passengers) have been developed in accordance with the Convention on the International Carriage of Passengers and Luggage by Road and regulate the process of transporting passengers and luggage by bus in regular and irregular international bus traffic.
2. These Rules of Passenger Transportation apply to passengers and carriers of the Parties and are binding on them.
3. These Rules of Passenger Transportation provide for a system of organization and control of the transportation process, as well as the rights and obligations of carriers and passengers.
4. The basis for the organization of transportation of passengers and baggage by buses in international regular traffic is the agreement on joint activities for the regular international transportation of passengers and baggage (hereinafter referred to as the Agreement on Joint Activities), which is concluded by carriers of the member States of the Commonwealth of Independent States, determines fares and timetables, previously agreed with the relevant competent transport authorities of the Commonwealth.
5. The terms contained in the Passenger Transportation Rules have the following meanings: "bus terminal" is a complex of facilities that provides passenger services in populated areas and includes: a building with a waiting room with a capacity of over 75 people and ticket offices; an apron for boarding and disembarking passengers; a parking area for buses, posts for cleaning and inspection of the bus;
"bus station" is a complex of facilities that provides passenger services in populated areas and includes: a building with a waiting room for up to 75 people and ticket offices; an apron for boarding and disembarking passengers; a parking area for buses;
"hand luggage" - passenger's belongings weighing no more than 20 kg and having dimensions of no more than 600 x 400 x 200 mm, transported free of charge by the passenger;
"driver" is an individual driving a motor vehicle, or who, on behalf of and on behalf of the carrier, is entrusted with the functions of driving and servicing consignees, shippers or passengers.;
"contract of carriage" is an agreement on the provision of transportation services concluded between the carrier and the passenger;
"route" is the established route of a vehicle between certain points.;
"pendulum transportation" is the transportation of a group of passengers carried out at a certain time from the territory of one state to the place of temporary stay in the territory of another state, followed by the return of this group by buses of the same carrier to the state of its initial departure.;
"irregular transportation" means transportation in which the conditions for its implementation are determined in each individual case by agreement between the customer and the carrier.;
"regular transportation" means the transportation of passengers and baggage under a contract of carriage, which defines the conditions of transportation, fares and timetable of buses along the route, indicating the stopping points for boarding and disembarking passengers.;
"timetable" - a schedule, a table containing information about the time, place and sequence of the flight;
"flight" - the route of the bus from the start to the end of the route;
"permissive system" is a set of regulatory and technological documents that ensure the implementation of interstate bus transportation;
"route diagram (routes)" - graphical representation of routes (route) with symbols;
"fare" is a fixed amount of payment for the transportation of passengers and baggage per unit of distance or time.;
stencil - a pointer with information for passengers about the route and the mode of operation of buses;
"form (travel list)" is a document that defines the type of transportation and contains a description of the route and a list of passengers.;
"competent transport authority" is the state transport authority that issues a permit to the carrier for the right to carry out international automobile passenger transportation along an agreed route.;
"license" is a document issued by an authorized state body of the Party certifying the right to carry out passenger automobile transportation in international traffic within a specified period.
II. Organization of passenger transportation
6. Licenses for international passenger transportation by road are issued, extended and cancelled in accordance with the current legislation of the State where buses are registered.
7. Explosive, toxic, flammable, caustic, radioactive, chemical, toxic, ozone-depleting substances and products containing them, narcotic, psychotropic and fetid substances are not allowed to be transported in baggage and hand luggage.;
baggage that pollutes rolling stock, passengers' clothes, storage rooms and things located there;
baggage exceeding the norms in size and weight established by these Rules of Passenger Transportation, as well as items prohibited by the legislation of the State in whose territory it is carried out.
8. In order to open a route for regular passenger transportation in international traffic, the carrier must: coordinate with a partner from another country to which the route runs, the intentions to open the route; send an application to the competent transport authority of your state with the following documents attached: a joint operation agreement, a copy of the license for the right to carry out passenger transportation in international traffic, as well as a certificate of registration of the enterprise with its details, a timetable for the route, a route diagram indicating border crossings, transportation tariffs, work and rest conditions for drivers on the route. The competent transport authority of the State to which the application has been submitted shall send to the competent transport authority of the State through whose territory the route is laid a request for permission, applications for the opening of the route, accompanied by the documents indicated above. The competent transport authority of the State to which the application has been submitted, after receiving permits from all States through whose territory the route is laid, issues these permits to the carrier. The carrier draws up a route diagram and submits it for approval to the competent transport authorities of the States through whose territory the route runs. The route, stops, timetable, and route closure are changed after prior agreement with the relevant competent transport authorities of the States through whose territory the route runs.
9. The competent transport authorities shall coordinate with the competent authorities of the Commonwealth States the time of crossing the border by regular buses and issue a pass for an extraordinary border crossing.
10. Buses for international passenger transportation in regular traffic are equipped with front and side stencils with the names of the starting and ending points of the route.
11. Departure and arrival of international buses is carried out from the bus station (bus station). Bus terminals (bus stations) provide information about the rules of transportation, bus schedules, the cost and conditions of travel for passengers and baggage transportation, bus station services, and the operation of other modes of transport.
12. Transportation tariffs are agreed upon by the carriers.
13. The ticket must contain the following basic data: the name of the bus station (bus station) of departure and destination; ticket number (indicated by printing); fare; date of issue of the ticket; date and time of departure; seat number; place of issue of the ticket; flight number. Ticket sales are recorded in the ticket register.
14. Pre-sale of tickets for travel and baggage transportation is carried out at separate ticket offices of bus terminals (bus stations) and separately located ticket pre-sale offices. On the day of departure of the buses, tickets must be sold at the ticket offices of the bus stations (bus stations) at the starting points of the routes, and at the intermediate points - upon receiving information about the availability of seats on the bus. The ticket is valid only for the departure day and the bus flight indicated on it. The right to purchase tickets on an extraordinary basis is granted to citizens in accordance with the current legislation of the State in which the ticket is being sold.
15. The number of passengers transported by bus on international routes corresponds to the number set by the manufacturer for this bus model.
16. The driver and passengers of an international bus must have properly executed documents for the right to cross the border.
17. When crossing the border, passengers' documents, baggage, hand luggage, currency and valuables must be issued in accordance with the requirements of the applicable border and customs legislation of the State through which the transportation is carried out.
18. Baggage is considered issued to a passenger if the carrier has handed it over to the person who presented the baggage receipt.
19. If there is no baggage receipt, the carrier has the right to transfer the baggage to the person who has proved that the baggage belongs to him. If a person claiming to receive baggage without a receipt provides insufficient evidence of the baggage belonging to him, the carrier has the right to require him to pay an appropriate deposit, which is refunded after one year from the date of its deposit.
20. Baggage that is not claimed upon arrival of the bus at the final destination, regardless of whether a baggage receipt has been issued for it or not, is deposited for safekeeping, for which a fee is charged to the passenger upon baggage collection. The carrier may assign baggage storage to a third party who is entitled to receive remuneration for its storage. The order of baggage storage is regulated by the legislation in force in the State in which the storage is carried out.
21. Baggage that has not been delivered to the passenger within fourteen days from the date of receipt of his request for extradition is considered lost.
22. If the baggage, which was considered lost, is found within one year from the date when the passenger requested its delivery, the carrier notifies the passenger about it. Within thirty days from the date of receipt of the notification, the passenger may request to deliver the baggage either to their point of departure or to their destination.
III. Passenger's duties and rights
23. When carrying out international bus transportation, the passenger is obliged to: purchase a ticket and pay for baggage transportation in accordance with the cost of the trip set by the carrier, occupy the seat indicated on the ticket, save the ticket until the end of the trip and present it to the controlling persons; arrive at the place of boarding the bus in accordance with the rules in force on the territory of this state; comply with the established rules for crossing the border of the state through which the international transportation; have a baggage receipt and be present during the inspection of baggage and other property belonging to him, as well as during the sampling of substances and materials belonging to him for rapid analysis by the relevant regulatory authorities.
24. A passenger on an international route has the right to: to carry one child under the age of 5 with you on the bus for free - without providing a separate seat, between the ages of 5 and 10 - with a 50% discount from the cost of a full ticket - with a separate seat and when transporting two or more children under the age of 10, one of them is transported for free the rest - with a 50% discount from the cost of the full ticket, with the provision of a separate seat;
carry hand luggage, small animals and birds in cages, animals (dogs, cats) free of charge for a fee set by the carrier, with the provision of documents issued by the veterinary service of the state from which the animal is being exported upon boarding the transported animals; receive timely and accurate information about the list of services provided and the conditions for their provision and the route of movement; to demand compensation for damage to the passenger's health or damage to his baggage caused during international transportation; to require the carriers to fulfill the contract of carriage; to declare the value of baggage when it is checked in for transportation.
The amount of the declared baggage value must be determined by the passenger in the national currency of the sending State and indicated on the baggage receipt. The receipt must be kept for the entire time of transportation and inspection of baggage and other property that belongs to it.
25. A passenger may be refused transportation: in case of lack of available seats; in case of baggage that has not been processed by customs; in case of an attempt to carry baggage that is prohibited for transportation or does not comply with established standards in terms of nomenclature, weight or size.
26. The passenger is not entitled to: while driving, interfere with the driver or distract his attention from driving the bus; open the bus doors until it stops completely; make corrections to tickets and other travel documents and transfer them to other passengers; carry luggage on the seats; use emergency equipment unnecessarily, except in prescribed cases.
27. The passenger is responsible for the damage caused by his fault, including for damage or contamination of the bus or equipment belonging to the carrier, as well as for violation of these Rules of Passenger Transportation. The amount of compensation is determined by the amount of damage caused.
IV. Obligations and rights of the carrier
28. The carrier is obliged to: to ensure the pre-sale of tickets in international traffic; to familiarize the driver with the route layout and give him the timetable before the trip; to deliver the bus in good time in proper technical and sanitary condition; to provide the passenger with a safe, comfortable bus ride in accordance with the contract of carriage and the approved schedule; to ensure that passengers travel to the final destination of the route without additional costs for them in case of termination of the trip due to a technical malfunction of the bus; to provide the passenger with additional services stipulated in the contract of carriage.
29. The carrier has the right to: cancel a bus flight under circumstances that he could not have foreseen and prevented, despite all the measures taken. In this case, the carrier returns to the passenger the cost of the ticket after its presentation, as well as the cost of additional services paid by the passenger. In addition, expenses, confirmed by the relevant documents, incurred by the passenger and related to his possible return to the starting point of the trip indicated in the ticket and departure from it by the cheapest means of transport, are subject to refund. The conditions for the refund of the ticket price and the additional services paid to the passenger are determined by the Agreement on Joint Activities; to limit or terminate international transportation on the territory of their state in the event of an epidemic, natural disaster or force majeure circumstances (force majeure); to note in the baggage receipt the condition of the baggage or its packaging with the passenger's consent. If the passenger does not confirm the check, the carrier may refuse to accept the baggage for carriage. If the baggage is accepted by the carrier without a mark, it is considered that the baggage was accepted in proper condition and in proper packaging.
V. Duties and rights of the driver
30. The bus driver performing international passenger transportation is obliged to: follow the Rules of the road, the rules of technical operation of the bus, the job description and follow the operational instructions of the dispatch service; comply with the rules of border, customs, sanitary quarantine and other types of control of the states through which international transportation is carried out; have registration documents for the vehicle and driver's license that meet the requirements of the Convention on Road Traffic of November 8 In 1968; organize, notify and prepare passengers in a timely manner for border crossing control; present for verification at border crossing:
a) for regular transportation: driver's license, travel (waybill), ticket and accounting documentation, original permit, bus timetable, license, documents for the right to cross the state border;
b) in case of irregular transportation: driver's license, travel document, license, travel document, permit for irregular transportation (if such is provided for by the agreement on international road transportation), documents for the right to cross the state border; confirm, in accordance with the agreement concerning the work of crews of vehicles engaged in international road transportation, the driver's mode of operation; follow the set route and follow the bus schedule; check the availability and compliance of tickets for travel and baggage transportation during passenger boarding; receive and place baggage intended for transportation, give passengers luggage at scheduled stops; announce the names of stops and parking times there; stop the bus at the signal of persons authorized to monitor international transportation, follow their instructions and provide assistance in monitoring; to carry out boarding (disembarkation) after stopping the vehicle only from the landing platform, and in the absence of such a platform - from the sidewalk or curb. If this is not possible, then from the side of the carriageway, provided that it is safe and does not create obstacles for other road users; in the event of a traffic accident, if possible, provide assistance to the victims and notify the relevant authorities of the incident; take measures to provide first aid to the passenger in need of it, as well as to deliver Take him to the nearest emergency room. If the passenger terminates the trip due to illness, his baggage is deposited in accordance with the procedure provided for in paragraph 20 of these Rules; start driving after the doors in the bus are fully closed and they are opened only at stops.
31. The driver has the right: to prevent a passenger from traveling or dropping him off at the nearest stop who has violated the contract of carriage, or because of his behavior, illness, or other reasons that pose a danger to surrounding passengers; to require passengers to perform their duties; not to give out luggage unless a baggage receipt is presented; to be present during the inspection of the bus and baggage.
VI. Refund of payments
32. If the ticket is returned to the ticket office of the bus station (bus station) no later than 2 hours before the departure of the international bus, the passenger will be refunded the ticket price minus the provided fee for the pre-sale of the ticket. If the ticket is returned later than this period, but not less than 15 minutes before the departure of the bus, according to the timetable, the passenger will be refunded the ticket price in the amount determined by the carrier. In case of loss of the ticket, the passenger is not allowed to board the bus, the ticket price is not refunded, a duplicate is not issued, and claims are not accepted.
33. If a bus of a carrier of one State cannot continue to move while traveling through the territory of another State for any reason, the Association of International Automobile Carriers of that State, at the request of the driver of the specified bus, provides the necessary assistance at the expense of the carrier in organizing the transportation of passengers of this bus to the nearest point, from where it is possible to send in the required direction. In case of an emergency stop and if it is impossible to deliver the passenger to the place of arrival, as well as if the passenger terminates the trip due to illness or accident, the cost of travel and baggage (with the exception of the commission fee) will be refunded based on the distance from the place of breakdown or forced stop to the final destination, which is regulated by the Agreement on Joint Activities.
34. The passenger has the right to return the tickets to the ticket office before the departure of the bus and receive the full fare, including pre-sale fees, in the following cases: if the bus is more than an hour late for the flight, compared to the time stipulated in the timetable.;
when providing a passenger with a seat on a bus of a lower class than the one provided for in the ticket. If the passenger agrees to travel in a lower class bus, the difference in the ticket price will be refunded. If instead of the bus provided by the schedule, a bus is served, which is more expensive to travel on, then passengers who purchased tickets before the announcement have the right to travel on these tickets at no extra charge. From the moment of the announcement of the replacement of the bus type, tickets are sold at a fixed higher fare with a corresponding warning to passengers.
In case of delay, the passenger has the right, within three hours from the moment of departure of the bus for which the ticket was purchased, and due to illness or accident - for three days, to restore the travel documents with an additional payment of 25% of the ticket price or to receive the fare with a deduction of 25% of the ticket price. Money refund is carried out: ticket pre-sale offices that sold or delivered the ticket, within a calendar day (up to 18 hours) before the departure of the bus; the ticket offices of the current ticket sale of the bus station (bus station) of the starting point of the route - on the day of departure of the bus.
VII. Passenger and baggage transportation control
35. The control of the transportation of passengers and baggage during international transportation by road is carried out on the basis of bilateral intergovernmental agreements on international road transport and the national legislation of the States through whose territory the transportation is carried out.
36. Responsibility of carriers and passengers for violation of these Rules of Passenger Transportation is provided for The Convention on the International Carriage of Passengers and Baggage by Road of October 9, 1997, multilateral and bilateral intergovernmental agreements on international road transport, as well as the national legislation of the State in whose territory the violation was committed.
