Chapter 64 Footwear, gaiters and similar articles; parts thereof
Notes: 1.- This group does not include: (a) disposable foot covers or shoes made of non-durable material (e.g. paper, plastic films) without attached soles. These goods are classified according to their constituent material; (b) shoes made of textile material, without an outer sole, glued, sewn or otherwise attached to the top of the shoe (section XI); (c) used shoes, heading 63.09; (d) products made of asbestos (heading 68.12); (e) orthopedic shoes or other orthopedic devices, or parts thereof (heading 90.21); or (f) toy shoes or boots with ice or roller skates attached to them; shin guards or similar sports protective accessories (Chapter 95). 2.- For the purposes of heading 64.06, the term "parts" does not include nagels, protectors, hinges, hooks, buckles, ornaments, braid, laces, pompoms or other finishing parts (which are included in the corresponding headings) or buttons or other goods of heading 96.06. 3.- In this chapter: (a) the terms "rubber" and "plastic" also mean fabrics or other textile materials with an outer layer of rubber or plastic visible to the naked eye, without taking into account any subsequent change in color; and (b) the term "leather" refers to products of headings 41.07, 41.12-41.14. 4.- Subject to the provisions of note 3 to this chapter: (a) the material for the upper of shoes is considered to be the material having the largest external surface area, without taking into account accessories or reinforcing parts such as staples, edging, decorative details, buckles, hinges, blocks or similar devices; (b) the main material from which the sole of a shoe is made is considered to be the material having the largest surface area in contact with the ground, without taking into account accessories or reinforcing parts such as spikes, rims, nails, protectors or similar elements.
Note to subheadings: 1.- For the purposes of subheadings 6402.12, 6402.19, 6403.12, 6403.19 and 6404.11, the term "athletic footwear" means only: (a) footwear designed for sports and having spikes, pins, stoppers, clips, rims and similar devices, or having devices for fastening spikes, pins, stoppers, clips, rims or similar devices; (b) skating boots, ski boots and cross-country ski shoes, snowboard boots, wrestling, boxing and cycling shoes.
