Resolution of the Government of the Republic of Kazakhstan dated August 29, 2026 No. 785

 

THE Government of the Republic of Kazakhstan DECIDES:

     1. To approve the attached draft Protocol on Amendments and Additions to the Agreement on Cooperation between the Governments of the Shanghai Cooperation Organization Member States in Combating Crime dated June 11, 2010.

     2. To authorize Ambassador Extraordinary and Plenipotentiary of the Republic of Kazakhstan to the Kyrgyz Republic Abylkair Baktybaevich Skakov to sign on behalf of the Government of the Republic of Kazakhstan the Protocol on Amendments and Additions to the Agreement on Cooperation between the Governments of the Shanghai Cooperation Organization Member States in Combating Crime dated June 11, 2010, authorizing amendments and additions that are not fundamental.

     3. This resolution shall enter into force from the date of its signing.

Protocol on Amendments and Additions to the Agreement on Cooperation between the Governments of the Member States of the Shanghai Cooperation Organization in Combating Crime dated June 11, 2010

     The Governments of the member States of the Shanghai Cooperation Organization, hereinafter referred to as the Parties,

     Expressing concern about the scale of the use of modern information and communication technologies for criminal purposes;

     Recognizing the need to improve cross-border cooperation mechanisms to preserve electronic evidence and combat money laundering through virtual assets;

     in order to increase the effectiveness of countering transnational organized crime, including in the field of illicit arms production and trafficking;

     Guided by article 12 of the Agreement on Cooperation between the Governments of the Member States of the Shanghai Cooperation Organization in Combating Crime dated June 11, 2010 (hereinafter referred to as the Agreement),

     have agreed on the following:

Article 1

     To make the following changes and additions to the Agreement:

     1. In the sixth paragraph of paragraph 1 of article 1, delete the words "and financing of terrorism".

     2. The fourteenth paragraph of paragraph 1 of Article 1 shall be worded as follows:

     "crimes in the field of or using information and communication technologies, including the use of artificial intelligence;".

     3. Paragraph 1 of Article 1 should be supplemented with the following paragraph:

     "financing of terrorism, separatism and extremism;".

     4. Paragraph 1 of Article 3 should be supplemented with sub–paragraphs 9) - 11) as follows:

     "9) execution of urgent requests for temporary preservation of digital data and freezing of virtual assets in order to avoid their loss or modification;

     10) establishment of joint investigative and operational or investigative coordination groups to investigate cross-border crimes in accordance with the national legislation of the States of the Parties and the procedure determined by the Parties.;

     11) exchange of information on transactions with virtual assets, including assistance in obtaining such information, in order to counteract the legalization (laundering) of proceeds from criminal activities and the financing of terrorism, separatism, and extremism in accordance with the national legislation of the States of the Parties and international treaties within the framework of the Shanghai Cooperation Organization.".

     5. Paragraph 2 of Article 5 shall be worded as follows:

     "2. The request or information is sent in writing or electronically, taking into account the national legislation of the States of the Parties.

     In urgent cases, the request or information may be transmitted using technical means (including through secure communication channels) or orally.

     In the case of transmission of a request or information using technical means or orally, the original request or information in writing must be sent through official channels no later than 72 hours.

     The Parties shall take measures to use cryptographic protection tools for the transmitted information in accordance with the laws of their states and international treaties within the framework of the Shanghai Cooperation Organization.".

     6. Add paragraph 4 to Article 7 as follows:

     "4. The Parties shall ensure the level of protection of the transmitted data not lower than the level provided for by the national legislation of their States and applicable international obligations.".

Article 2

     This Protocol shall enter into force in accordance with the procedure provided for in Article 12 of the Agreement.

Article 3

     After its entry into force, this Protocol is open for accession by any member State of the Shanghai Cooperation Organization by submitting an instrument of accession to the depositary.

     For the acceding State, this Protocol shall enter into force 30 days after the date of receipt by the depositary of the instrument of accession.
