On the establishment of requirements and specific features for conducting conformity assessment, as well as for putting into circulation vehicles imported from third countries by representatives of foreign manufacturers, provided that no more than 3 years have passed since the date of manufacture.

In accordance with the third paragraph of subparagraph 3.2.7 of paragraph 3 of Decision No. 877 of the Customs Union Commission dated December 9, 2011, “On the adoption of the Technical Regulation of the Customs Union ‘On the Safety of Wheeled Vehicles’”, the Government of the Republic of Kazakhstan DECIDES:

     1. 1. Establish the requirements and specific features for conducting conformity assessment, as well as for placing into circulation vehicles imported from third countries by representatives of foreign manufacturers, provided that no more than 3 years have passed since their manufacture, in accordance with the appendix to this resolution.

2. The Ministry of Internal Affairs of the Republic of Kazakhstan shall ensure the primary state registration of vehicles that have undergone conformity assessment in accordance with this resolution.

3. This resolution shall enter into force ten calendar days after the date of its first official publication and shall remain in effect until December 31, 2028.

Appendix to the Resolution of the Government of the Republic of Kazakhstan dated April 30, 2026, No. 351

 

Requirements and features of conducting conformity assessment, as well as putting into circulation vehicles imported from third countries by representatives of foreign manufacturers, the date of manufacture of which is no more than 3 years ago

Chapter 1. General Provisions

1. These requirements and features for conducting conformity assessment, as well as for putting into circulation vehicles imported from third countries by representatives of foreign manufacturers, provided that no more than 3 years have passed since their manufacture (hereinafter referred to as the requirements), have been developed in accordance with the third paragraph of subparagraph 3.2.7 of paragraph 3 of Decision No. 877 of the Customs Union Commission dated December 9, 2011, “On the adoption of the Technical Regulation of the Customs Union ‘On the Safety of Wheeled Vehicles’” (hereinafter referred to as the Commission’s Decision).

 These requirements apply to certain wheeled vehicles of category M1, model “Cadillac”, imported into the Republic of Kazakhstan by official representatives of foreign manufacturers, provided that no more than 3 years have passed since their manufacture (hereinafter referred to as “vehicles”).

     2. The following terms are used in these requirements:

     1) release into circulation – permission for interested parties to use and dispose of a vehicle (chassis) or a batch of components on the single customs territory of the Customs Union without restrictions;

2) State registration of a vehicle is the procedure for allowing a vehicle to participate in road traffic, carried out by the authorized body responsible for ensuring road safety after verifying that the documents comply with the legislation of the Republic of Kazakhstan, checking the vehicle’s identification numbers, issuing a vehicle registration certificate, and assigning a state registration plate number.

3) A vehicle state registration certificate is a document confirming that a vehicle is allowed to participate in road traffic.

4) approval of a vehicle type – a document certifying that vehicles put into circulation and classified as belonging to the same type comply with the requirements of the technical regulation of the Customs Union “On the Safety of Wheeled Vehicles” (TR CU 018/2011), approved by a Commission Decision (hereinafter referred to as the technical regulation);

5) conformity assessment body – a legal entity accredited in accordance with the established procedure to carry out conformity assessment activities;

6) a testing laboratory (center) is a legal entity or a structural unit of a legal entity acting on its behalf, which carries out tests (research);

7) a technical secretariat is an organization designated by the authorized body in the field of technical regulation to carry out activities related to verifying the correctness and validity of the issuance of vehicle type approval, chassis type approval, collecting information about issued certificates of vehicle design safety, and assigning international identification codes to vehicle manufacturers;

8) type approval – a form of assessing the compliance of a vehicle (chassis) with the requirements of the technical regulation established for the type of vehicle (chassis).

Chapter 2. Requirements and features of conducting a compliance assessment of vehicles imported from third countries by representatives of foreign manufacturers, the date of manufacture of which is no more than 3 years ago.

     3. The compliance assessment of vehicles is carried out in the form of type approval.

     4. With regard to the requirements stipulated in Appendices No. 2 and 3 to the technical regulation, declarations of conformity under declaration schemes 1d, 3d, 4d, 6d, or 7d may be accepted as evidence.

 The declarations of conformity specified in part one of this clause are drawn up on the basis of foreign documents. 

The conformity declarations specified in the first part of this clause are drawn up on the basis of foreign conformity assessment documents or test reports confirming compliance with FMVSS (Federal Motor Vehicle Safety Standards) and EPA (Environmental Protection Agency) standards.

     5. Compliance with the requirements for vehicle types is verified by conformity assessment bodies.

     The necessary tests are carried out by testing laboratories (centers) accredited in accordance with the Law of the Republic of Kazakhstan “On Accreditation in the Field of Conformity Assessment” (hereinafter referred to as accredited testing laboratories).

6. When conducting type approval, the applicant may be a person authorized by the manufacturer, registered on the territory of the Republic of Kazakhstan, acting on its behalf and having the manufacturer’s authority to carry out conformity assessment of its products.

7. Type approval is carried out in accordance with the following requirements:

1) submitting an application to the conformity assessment body, which includes the applicant’s name and details, the type of vehicle, and information about previously issued vehicle type approvals (hereinafter referred to as the application).

 Regarding the type of vehicle, one application is submitted to one conformity assessment body.

The application is accompanied by documents according to the list in Appendix No. 12 to the technical regulation;

     2) the conformity assessment body makes a decision on the application within 15 calendar days and concludes an agreement (contract) with the applicant for the performance of work. The decision shall reflect:

     the possibility of recognition and the sufficiency of the documents;

     the need to conduct tests in order to obtain the missing evidentiary materials;

the necessity and timing of conducting a review of production conditions;

     3) conducting the identification of the submitted vehicle samples by an accredited testing laboratory, their certification tests, and the preparation of protocols, each of which is accompanied by a technical description prepared by the manufacturer and certified by the accredited testing laboratory;

     4) conducting an analysis of the manufacturer’s production process.

5) registration by the conformity assessment body of conformity declarations and (or) issuance of certificates of conformity for the vehicle, in accordance with the individual requirements specified in Appendices No. 2 and 3 to the technical regulation, and their issuance to the applicant;

6) preparation by the conformity assessment body of a conclusion on the possibility of issuing a vehicle type approval based on the implementation of subparagraphs 3), 4) and 5) of this clause, provided that the vehicle complies with the requirements of the technical regulation in force at the time of issuance of the document certifying conformity;

7) processing by the conformity assessment body of the vehicle type approval;8) verification by the technical secretariat of the correctness and validity of the vehicle type approval;9) approval and registration of the vehicle type approval by the authorized body in the field of technical regulation of the Republic of Kazakhstan;10) monitoring by the conformity assessment body of the compliance of vehicles with the requirements of the technical regulation during the validity period of the vehicle type approval.

8. Based on the decision of the conformity assessment body, the accredited testing laboratory conducts an examination of the technical descriptions submitted by the applicant, identifies vehicle samples and conducts their testing, prepares test reports, and organizes their registration and accounting.

Based on the results of the tests and the technical examination of the submitted documents, the accredited testing laboratory prepares a protocol for the identification and testing results of the complete vehicle and submits it to the conformity assessment body.

9. The vehicle type approval is valid until December 31, 2028.

     10. The conformity assessment body shall submit the following documents to the technical secretariat:

     1) the vehicle type approval, signed with an electronic digital signature of the head of the conformity assessment body or an authorized person;

     2) the application for carrying out conformity assessment work;

     3) the decision of the conformity assessment body regarding the application.

4) the conclusion of the conformity assessment body (in accordance with paragraphs 40, 60 and 65 of the technical regulation, depending on the procedure used in preparing the submitted document);

5) a general technical description of the vehicles, prepared in accordance with the provisions of Appendix No. 12 to the technical regulation;

6) the act of the conformity assessment body regarding the results of the inspection of the manufacturer’s production conditions (in the case of an inspection prior to issuing vehicle type approvals) or the analysis material of the inspection of the manufacturer’s production conditions (if such an inspection was carried out), drawn up in accordance with Appendix No. 13 to the technical regulation;

7) the protocols of identification and test results for the complete vehicle, drawn up by an accredited testing laboratory, as provided for in clause

8) protocols for the identification and test results of the complete vehicle when issuing vehicle type approvals;

     9) evidence materials (notification of official type approval, certificate of conformity, declaration of conformity, test report, technical expertise report) confirming that the product complies with the requirements of the technical regulation, which served as the basis for issuing vehicle type approvals.

10) an agreement between the manufacturer and the applicant regarding the manufacturer’s granting of authority to the applicant to conduct conformity assessment and joint liability with the manufacturer for ensuring the safety of vehicles (chassis) in accordance with the requirements of the technical regulation.

11) an identification card for the approval of a vehicle type, approval of a chassis type, in the form specified in Appendix 1 to the Rules for verifying the correctness and validity of the issuance of vehicle type approvals and chassis type approvals, approved by Order No. 397‑NҚ of the Minister of Trade and Integration of the Republic of Kazakhstan dated June 8, 2021 (registered in the Register of State Registration of Regulatory Legal Acts under No. 23034) (hereinafter referred to as the Rules).

     11. The Technical Secretariat verifies the correctness and validity of the vehicle type approval documentation in accordance with the Rules, taking into account the requirements and specific features provided for in paragraphs 4 and 10 of these requirements.

The Technical Secretariat reviews the documents within 30 (thirty) working days, calculated from the date they are received by the Technical Secretariat.

12. The technical secretariat, upon a positive result of the verification of the correctness and validity of the vehicle type approval documentation, draws up a conclusion verifying the correctness and validity of the vehicle type approval documentation and forwards it for approval to the authorized body in the field of technical regulation in accordance with paragraph 8 of the Rules.

     13. In cases of incompleteness of the submitted documents and (or) their non-compliance with the requirements and features set out in paragraphs 4 and 10 of these requirements, the technical secretariat returns the submitted documents with a written reasoned refusal to the conformity assessment body within 15 (fifteen) calendar days in compliance with the requirements established by Article 73 of the Administrative Procedural Code of the Republic of Kazakhstan.

Chapter 3. The release into circulation of vehicles imported from third countries by representatives of foreign manufacturers, from the date of manufacture of which no more than 3 years have passed

14. Vehicles are permitted for release into circulation on the market:

     1) if they comply with the technical regulations, taking into account the requirements and features provided for in paragraph 4 of these requirements;

     2) exclusively within the territory of the Republic of Kazakhstan.

     15. In the vehicle type approval, the following entry is made in the “Additional Information” line: “This vehicle type approval is valid only within the territory of the Republic of Kazakhstan.”

 In the certificate of state registration of the vehicle, the following entry is made in the “Special notes” column: “Exercise of the rights of ownership, use, and disposal of the vehicle is permitted only on the territory of the Republic of Kazakhstan, on the basis of paragraph four of subclause 3.2.7 of clause 3 of the Commission’s Decision.”

     16. In the electronic vehicle passport, the following entry is made in the “Other information” column: “Exercise of the rights of ownership, use, and disposal of the vehicle is permitted only on the territory of the Republic of Kazakhstan, on the basis of paragraph four of subclause 3.2.7 of clause 3 of the Commission’s Decision.”
