In accordance with subparagraph 65-29) of Article 7 of the Law of the Republic of Kazakhstan "On Physical Culture and Sports", I ORDER:

1. To approve the attached Rules for the Formation and maintenance of the digital platform of physical culture and Sports (hereinafter referred to as the Rules).

2. The Department of Digital Transformation and Development of Public Services, in accordance with the procedure established by law, shall ensure:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within three working days after the entry into force of this order, its posting on the Internet resource of the Ministry of Tourism and Sports of the Republic of Kazakhstan;

3) within three working days after the execution of subitems 1) and 2) of this paragraph, provide the Department of Legal Service of the Ministry of Tourism and Sports of the Republic of Kazakhstan with information on their execution.

3. Control over the execution of this order is entrusted to the supervising Deputy Minister of Tourism and Sports of the Republic of Kazakhstan.

4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules for the formation and maintenance of a digital platform for physical culture and sports

Chapter 1. General provisions

1. These Rules for the Formation and Maintenance of a digital platform for physical culture and sports (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 65-29) of Article 7 of the Law of the Republic of Kazakhstan "On Physical Culture and Sports" (hereinafter referred to as the Law) and define the procedure for the formation and maintenance of a Digital Platform for Physical Culture and Sports (hereinafter referred to as the Platform).

2. The following concepts are used in these Rules:

1) the authorized body in the field of physical culture and sports is the central executive body responsible for the management and intersectoral coordination in the field of physical culture and sports;

2) the digital platform of physical culture and sports is a digitalization object designed to collect, process and analyze administrative and other data in the field of physical culture and sports, as well as to ensure information interaction with other objects of digitalization;

3) personal data – information or a set of information about the subject of personal data supplemented by one or more personal data identifiers;

4) digital system – a functionally connected complex of digital resources that uses digital infrastructure facilities to ensure the creation, collection, processing, storage and distribution of digital data, as well as automating the interaction of subjects of the digital environment and (or) providing services in the digital environment; 5) a digital object is a separate element of the digital environment created, used or transmitted through digital technologies, possessing unique digital characteristics and allowing subjects of the digital environment to exercise ownership, use or disposal powers to the extent established by the legislation of the Republic of Kazakhstan.;

6) integration of digital objects – measures to organize and ensure interaction between digital objects through integration services using standard data transmission protocols;

7) users of digital objects – individuals or legal entities who legally use digital objects in accordance with paragraph 2 of Article 39 of the Digital Code of the Republic of Kazakhstan;

8) electronic digital signature – a digital record (a set of digital data) created using the private key of an electronic digital signature and electronic digital signature tools, confirming the authenticity of an electronic document, its affiliation and the immutability of the content.

3. The platform is designed to collect, process and analyze administrative and other data in the field of physical culture and sports, as well as to ensure information interaction with other objects of digitalization.

4. The formation and maintenance of the Platform is carried out by the authorized body in the field of physical culture and sports (hereinafter referred to as the Authorized Body).

Chapter 2. The order of formation of the Platform

5. The Platform is formed by entering information by subjects of physical culture and sports specified in subitems 1), 2), 4) and 5) of paragraph 1 of Article 10 of the Law who are not private business entities (hereinafter referred to as Subjects of Physical Culture and Sports).

6. The information on the Platform is entered and updated by the subjects of physical culture and sports specified in paragraph 5 of these Rules, in the prescribed amount, time and form, in the following modules:

1) "Passport of an athlete, coach, judge and methodologist" – information is entered within two working days from the date of its occurrence, taking into account the requirements established by the legislation of the Republic of Kazakhstan on personal data and their protection in accordance with Appendix 1 to these Rules.;

2) "Unified Calendar of mass sports events" - information is entered in accordance with the Rules for the formation of a unified calendar of mass sports events, approved by Order No. 294 of the Chairman of the Agency of the Republic of Kazakhstan for Sports and Physical Culture dated July 28, 2014 (registered in the Register of State Registration of Regulatory Legal Acts under No. 9674);

3) "Competition protocols" – information is entered no later than two working days from the date of the sporting event, taking into account the requirements established by the legislation of the Republic of Kazakhstan on personal data and their protection in accordance with Appendix 2 to these Rules.;

4) "Sports infrastructure management" – information is entered on an ongoing basis, upon the occurrence of changes, but no later than two working days from the date of their occurrence in accordance with Annex 3 to these Rules.;

5) "Statistics and Analytics" – information is entered in accordance with the Order of the Minister of Culture and Sports of the Republic of Kazakhstan dated October 11, 2022 No. 297 "On approval of the statistical form for conducting departmental statistical observations and instructions for completing it" (registered in the Register of State Registration of Regulatory Legal Acts under No. 30119);

6) "Public services" – information is entered by service providers on an ongoing basis, upon the occurrence of changes, but no later than two working days from the date of their occurrence in accordance with the Order of the Acting Minister of Digital Development, Innovation and Aerospace Industry of the Republic of Kazakhstan dated January 31, 2020 No. 39/NK "On Approval of the Register of Public Services" (registered in the Register of State Registration of Regulatory Legal Acts under No. 19982).

7. The heads of the subjects of physical culture and sports specified in paragraph 5 of these Rules shall monitor the timely updating of data and confirm the accuracy of the data being filled in on the Platform with an electronic digital signature.

8. When entering and updating data on the Platform, archived data is secured.

Archived data is information that was previously entered into the Platform and saved after it was changed or updated.

9. The authorized body creates and activates user accounts on the Platform.

10. The authorized body coordinates the entry and updating of data on the Platform entered by subjects of physical culture and sports specified in paragraph 5 of these Rules.

11. The collection, processing and protection of personal data on the Platform is carried out in accordance with the legislation of the Republic of Kazakhstan on personal data and their protection.

Chapter 3. The procedure for maintaining the Platform

12. Within the framework of the management of the Platform, the Authorized Body:

1) Provides adding and changing metrics on the Platform;

2) ensures the creation and updating of the methodology of format-logical control;

3) provides identification of statistical and logical deviations in the data;

4) ensures compliance with uniform requirements in the areas of digitalization and cybersecurity;

5) provides preparation of instructional materials and instructional videos on working with the Platform;

6) provides the formation and modification of data forms;

7) provides consulting assistance to users on working with the Platform;

8) organizes user training on working with the Platform;

9) posts instructions on the Platform in text and video formats, frequently asked questions and answers to them;

10) posts information about upcoming technical or preventive work on the Platform at least one (1) business day in advance.

13. The authorized body accepts requests on technical issues related to the search and placement of information on the Platform through feedback.

14. The integration of the Platform with other digital objects of the digital government is carried out in accordance with the procedure established by the Rules for the Integration of Electronic Government Informatization Objects, approved by Order No. 123 of the Acting Minister of Information and Communications of the Republic of Kazakhstan dated March 29, 2018 (registered in the Register of State Registration of Regulatory Legal Acts under No. 16777).
