On approval of the Rules of Operation of the unified subsoil use platform, as well as the list of its information resources, services and functions

 In accordance with paragraph 3 of Article 68-1 of the Code of the Republic of Kazakhstan "On Subsoil and Subsoil Use", I ORDER:

     1. Approve:

     1) Rules of operation of the unified subsurface use platform in accordance with Appendix 1 to this order;

     2) The list of information resources, services and functions of the unified subsurface use platform in accordance with Appendix 2 to this order.

     2. The Committee of Geology of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure :

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

     4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules of operation of the unified subsurface use platform

Chapter 1. General provisions

     1. These Rules for the Functioning of the unified Subsoil use platform (hereinafter referred to as the Rules) have been developed in accordance with paragraph 3 of Article 68-1 of the Code of the Republic of Kazakhstan "On Subsoil and Subsoil Use" (hereinafter referred to as the Code) and determine the procedure for the functioning of the unified subsoil use platform."

     2. The functioning of the unified subsurface use platform is carried out in accordance with the legislation of the Republic of Kazakhstan in the field of subsurface use and informatization.

     3. The following basic concepts are used in these Rules:

     1) geological information – information about the material composition, geological structure and history, geological, geochemical, geophysical, hydrogeological, geomorphological and tectonic features of the subsurface and their areas, deposits and manifestations of minerals, recorded on any medium and having the requisites to identify such information;

     2) the unified Subsurface Use Platform (hereinafter referred to as the Platform) is a state information system that provides public services and information interaction between government agencies, subsurface users and other stakeholders in the field of subsurface use, including through integration with other informatization facilities;

     3) personal account - a section of the Platform, which is accessed by the user through authentication using an electronic digital signature (EDS), designed to submit applications, receive notifications, submit reports and participate in auctions;

     4) the map of subsurface use is a component of the platform that displays spatial data on subsurface areas, restricted areas and geological survey in real time.;

     5) spatial data – information containing information about the location of terrain objects, presented in a certain form and coordinate reference system, displayed on a map of subsurface use;

     6) Internet resource - information (in text, graphic, audiovisual or other form) hosted on a hardware and software complex with a unique network address and (or) domain name and operating on the Internet;

     7) competent authority – authorized bodies in the field of solid minerals or in the field of hydrocarbons, as well as local executive bodies for widespread minerals that grant subsurface use rights through the Platform;

     8) platform operator - the national operator in the field of geology, ensuring the functioning of the Platform;

     9) user – an individual or legal entity registered on the Platform, as well as government officials involved in information interaction through the Platform;

     10) information resources of the platform – databases, geographical coordinates and information, electronic arrays of information used in the field of subsoil use;

     11) technical and preventive maintenance – a set of measures to maintain computer equipment and telecommunication equipment in working condition, including prevention in order to prevent failure of machinery and (or) equipment and their premature wear, troubleshooting, replacement of individual parts and units, installation and configuration of equipment, software, additional devices and boards to increase the power of the equipment and provide assistance to users;

     12) technical failure is an unplanned temporary failure of a software and hardware complex or a separate component of an information system that has resulted in the inability of one or more users to use the information system.

     13) electronic document – a document in which information is presented in electronic and digital form and certified by means of an electronic digital signature;

     14) an electronic digital signature (hereinafter referred to as EDS) is a digital record (set of digital data) created using the private key of an electronic digital signature and electronic digital signature tools, confirming the authenticity of an electronic document, its affiliation and the immutability of its content.

Chapter 2. The procedure for the functioning of the unified subsoil use platform

Paragraph 1. Access to the Platform and user registration

     4. The platform consists of open and closed parts. The open part provides access to the Information Resources of the Platform, including the Map of subsurface use, registers of licenses and the Program of management of the state fund of subsurface resources, to all interested persons without the need for registration.

     5. Access to the closed part of the Platform is carried out through a Personal Account. A personal account is provided to the User after completing the registration and authentication procedure using an EDS.

     6. When registering Users, the Platform automatically verifies the data through integration with the State database "Legal Entities". When registering individuals, verification is carried out through the State database "Individuals".

     7. Users are required to keep their data up-to-date in their Personal Account to ensure that they receive notifications correctly, submit applications, submit reports, and participate in auctions.

Paragraph 2. The operating procedure of the Platform and the interaction of participants

     8. As part of the electronic application service, it is formed in the form of an application and submitted electronically exclusively through the personal account of the Platform.

     In case of detection of incompleteness of the submitted information, the electronic document must be returned for revision with an indication of the reason for the return, and in case of detection of inaccuracy of the submitted information on the electronic document, a reasoned refusal is formed.

     The electronic application service provides automatic routing of received electronic documents to the relevant competent authorities and/or Platform modules.

     After receiving the electronic application for processing, the user receives an electronic notification with the application number and the time of its receipt.

     An electronic document is considered delivered (delivered) to the user from the moment it is received into the user's personal account on the Platform, unless otherwise established by law.

     All operations of the Electronic Application Service are recorded in the event log from the moment they are received, indicating the time, initiator and result of each operation. The logs are kept and provided for auditing in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

     9. The monitoring service provides automated accounting of subsurface use rights, issued licenses and concluded contracts, including related conditions and deadlines for fulfilling obligations.

     Based on the results of the reconciliation, an automatic notification is generated about inconsistencies, deviations or violations and sends them to the user's personal account and for consideration by the competent authorities.

     The monitoring service provides the generation of summary analytical information and reports for competent authorities in the volume and format necessary for monitoring and making managerial decisions.

     The Platform operator ensures that the history of changes to records of rights and obligations is maintained, while maintaining the basis of the changes and data about the person who made the change.

     10. The service for visualization of subsurface areas and spatial data is carried out using a subsurface use map, which provides a display of layers containing information about all subsurface areas. Information posted on the subsurface use map is subject to updating based on information provided by authorized government agencies.

     11. Electronic documents are stored in relation to electronic documents generated, signed and submitted through the Platform using EDS.

     Access to documents is limited and provided in accordance with established access levels and requirements for the protection of confidential and proprietary information.

12. The Platform Operator ensures the operability of these services, data security, their integrity and accessibility, as well as technical and organizational information security measures in accordance with Resolution of the Government of the Republic of Kazakhstan dated December 20, 2016 No. 832 "On approval of uniform requirements in the field of information and communication technologies and information security".

     The platform provides the implementation of public services and services in the field of subsurface use through automated procedures, including licensing, registration of subsurface use rights, registration of contractual and other legal relations, transition to a licensing regime, issuance of permits and approvals, as well as other types of administrative procedures provided for by the current Code of the Republic of Kazakhstan "On Subsurface and Subsurface Use".

     13. Integration with e-government informatization facilities, state databases and (or) information systems is carried out in accordance with the Rules for the Integration of e-government Informatization Facilities, approved by Order No. 123 of the Acting Minister of Information and Communications of the Republic of Kazakhstan dated March 29, 2018 (registered with the Ministry of Justice of the Republic of Kazakhstan No. 16777).
