On approval of the Rules and deadlines for advanced training of employees of the regional authorized body for the protection of children's rights of the Republic of Kazakhstan

In accordance with paragraph 2 of Article 7-14 of the Law of the Republic of Kazakhstan "On the Rights of the Child in the Republic of Kazakhstan", I ORDER:
1. To approve the attached Rules and deadlines for advanced training of employees of the regional authorized body for the protection of children's rights of the Republic of Kazakhstan.
2. The Committee for the Protection of Children's Rights of the Ministry of Education of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Education of the Republic of Kazakhstan after its official publication;
3) within ten working days after the state registration of this order, submit to the Legal Department of the Ministry of Education of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.
3. Control over the execution of this order is entrusted to the supervising Vice Minister of Education of the Republic of Kazakhstan.
4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules and deadlines for advanced training of employees of the regional authorized body for the protection of children's rights of the Republic of Kazakhstan
Chapter 1. General provisions
1. These Rules and terms of advanced training for employees of the regional authorized body for the protection of children's rights of the Republic of Kazakhstan (hereinafter referred to as the Rules) have been developed in accordance with paragraph 2 of Article 7-14 of the Law of the Republic of Kazakhstan "On the Rights of the Child in the Republic of Kazakhstan" and determine the procedure and terms of advanced training for employees of the regional authorized body for the protection of children's Rights of the Republic of Kazakhstan. 2. The following basic concepts are used in these Rules:
1) professional development is a form of professional training that allows you to maintain, expand, deepen and improve previously acquired professional knowledge, skills and abilities;
2) the regional authorized body for the protection of children's rights of the Republic of Kazakhstan (hereinafter referred to as the regional authorized body) is a local executive body that coordinates activities to protect the fundamental rights and legitimate interests of children, prevent and early detect violations of their rights, take measures to restore and protect them, and perform state functions of guardianship or guardianship in relation to minors;
3) an employee of the regional authorized body for the protection of children's rights of the Republic of Kazakhstan (hereinafter referred to as an employee) is a person who has a professional education and carries out activities to protect children's rights.;
4) the authorized body in the field of protection of children's rights of the Republic of Kazakhstan (hereinafter referred to as the authorized body) is the central executive body designated by the Government of the Republic of Kazakhstan, which provides leadership and intersectoral coordination in the field of protection of children's rights;
5) certificate – a document issued by the organization to employees who have passed the final assessment in accordance with the professional development program.
3. Professional development is carried out at the expense of the funds of the regional authorized body.
Chapter 2. The procedure for advanced training of employees
4. Professional development of employees is organized:
1) full-time (on-the-job and with salary retention);
2) remotely, in cases of a state of emergency, restrictive measures, including quarantine, in the relevant administrative-territorial units (at individual facilities), declaring emergency situations.
5. Professional development of employees is carried out by organizations engaged in professional development of employees of organizations performing functions for the protection of children's rights and bodies for the protection of children's rights (hereinafter referred to as the organization).
6. The duration of professional development is at least 40 academic hours. At the same time, the academic hour of advanced training is 45 minutes.
Professional development of employees is carried out at least once every two years, regardless of their length of service.
7. The regional authorized body of the district (city of regional significance) annually, by November 1, forms a list of employees subject to advanced training for the upcoming calendar year and sends it to the regional authorized body of the region, the city of republican significance and the capital.
8. The regional authorized body of the region, the city of republican significance and the capital annually, by December 1, forms and approves a consolidated list of employees subject to advanced training for the upcoming calendar year.
9. Employees are sent for advanced training on the basis of an order from the head of the regional authorized body, indicating the duration of training and the name of the organization.
10. The educational process is regulated by the organization's class schedule.
11. The employee signs a professional development agreement with the organization specifying the following conditions for advanced training:
1) study according to the established schedule of classes;
2) observe academic discipline and standards of conduct, including showing respect to the teaching staff and other students, and not infringing on their honor and dignity;
3) pass the final test.
If an employee violates the terms of the agreement, the organization notifies the regional authorized body.
12. Upon completion of the educational program, the organization issues a certificate to employees in accordance with Appendix 1 to these Rules.
13. For employees who have not passed the final test, the organization issues a certificate of admission to a professional development program in any form.
Employees who have not received a certificate have the opportunity to:
1) for repeated testing, no more than once a year;
2) transfer for a valid reason (illness, emergencies, natural disasters) from one academic stream to another during the current year.
14. The Organization maintains a certificate registration log in accordance with Appendix 2 to these Rules.
