In accordance with subparagraph 13-2) of Article 9 of the Law of the Republic of Kazakhstan "On State and Socially Responsible Services", I ORDER:
1. To approve the attached Rules for classifying Public Services in electronic form to determine the method of service recipient authentication.
2. To invalidate certain orders in accordance with the annex to this order.
3. The Public Services Committee of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan.
4. Control over the execution of this order is entrusted to the supervising Vice Minister of Artificial Intelligence and Digital Development of the Republic of Kazakhstan.
5. This order will enter into force on July 12, 2026 and is subject to official publication.

Rules for classifying public services in electronic form to determine the method of service recipient authentication
Chapter 1. General provisions
1. These Rules for classifying public services in electronic form to determine the method of service recipient authentication (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 13-2) of Article 9 of the Law of the Republic of Kazakhstan "On Public and Socially Responsible Services" and define the procedure for classifying public services in electronic form to determine the method of service recipient authentication.
2. The following concepts are used in these Rules:
1) one–time password is a password valid only for one session of digital authentication of subjects receiving services in electronic form.;
2) database containing personal data (hereinafter referred to as the database) – a set of ordered personal data;
3) service recipient – individuals and legal entities, branches and representative offices of legal entities who have the right and (or) intention to apply for a state or socially responsible service, or who receive a state or socially responsible service, or who receive the result of providing a state or socially responsible service to realize their rights, freedoms and legitimate interests by providing them with related tangible or intangible benefits;
4) service provider – central government agencies, foreign institutions of the Republic of Kazakhstan, local executive bodies of regions, cities of republican significance, the capital, districts, cities of regional significance, akims of districts in the city, cities of regional significance, towns, villages, rural districts, as well as individuals and legal entities providing public or socially responsible services in accordance with the legislation of the Republic of Kazakhstan. with the legislation of the Republic of Kazakhstan;
5) login – the name (identifier) of the user account on the portal;
6) a public service is one of the forms of implementation of certain state functions carried out individually at the request of service recipients and aimed at realizing their rights, freedoms and legitimate interests, providing them with appropriate tangible or intangible benefits.;
7) digital authentication (hereinafter referred to as authentication) is a procedure for confirming the identity of an individual or the legal capacity of a legal entity when accessing services in a digital environment and facilities in cases provided for by the legislation of the Republic of Kazakhstan or by agreement of the parties.;
8) the authorized body in the field of digitalization (hereinafter referred to as the authorized body) is the central executive body responsible for the management and intersectoral coordination in the field of digitalization;
9) the digital government web portal (hereinafter referred to as the portal) is a digital object that provides a "single window" of access to consolidated information posted by government agencies and other entities involved in the provision of public services, including the regulatory legal framework, as well as to government and other services provided in electronic form.;
10) the digital Government mobile application (hereinafter referred to as the mobile application) is a software product installed and launched on a cellular subscriber device and providing access to government services and other services provided in electronic form via cellular communications and the Internet;
11) an electronic digital signature (hereinafter referred to as EDS) is a digital record (set of digital data) created using the private key of an electronic digital signature and electronic digital signature tools, confirming the authenticity of an electronic document, its affiliation and the immutability of its content.
Chapter 2. The procedure for classifying public services in electronic form to determine the method of service recipient authentication
3. The classification of public services is carried out by the state body responsible for the development of rules for the provision of public services.
4. Classification of public services in electronic form includes the following stages::
1) distribution of public services in electronic form according to the criteria established by paragraph 5 of these Rules;
2) evaluation of each criterion in accordance with paragraph 6 of these Rules;
3) calculation of the final score;
4) determining the authentication method of the service recipient.
5. For the classification of public services in electronic form, it is distributed according to the following criteria:
1) the risk of harm;
2) the presence of data changes in the database;
3) the deadline for the provision of public services in electronic form;
4) payment for public services in electronic form.
6. The criteria are evaluated in the following order:
1) the risk of harm is assessed by the following factors:
the possibility for third parties to obtain access to the result of the provision of public services in electronic form;
availability of personal data in electronic form as a result of the provision of the service;
potential legal, property or other consequences for the service recipient;
the possibility of changing the legal status, rights and obligations of the service recipient based on the results of the provision of public services in electronic form.
At the same time:
If there is at least one factor indicating a significant risk of harm, 2 points are awarded.;
in the absence of these factors, 1 point is awarded.
2) the presence of data changes in the database:
if there are changes, 2 points.;
in case of absence – 0 points;
3) the deadline for the provision of public services in electronic form:
more than 30 minutes – 1 point;
up to and including 30 minutes – 0 points;
4) payment for public services in electronic form:
paid – 1 point;
free – 0 points.
7. The final score of the classification of public services in electronic form is determined solely by adding the points assigned for each of the criteria, without using additional coefficients, adjustments or ways to change the values according to the following formula:
S = R + D + T + P,
where:
S — final score;
R — score based on the risk of harm;
D — score based on the criterion of making changes to information systems data;
T — score based on the criterion of the duration of public service provision;
P — score according to the criterion of payment for public services.
8. Depending on the final score of the classification of public services in electronic form, the method of service recipient authentication is determined.:
0-1 points – login/ password;
2-3 points – login / password + one-time password;
4-6 points – login / password + EDS.
9. Based on the results of the classification of the public service and the determination of the method of authentication of the service recipient, the service provider draws up an opinion in accordance with the annex to these Rules.
10. Government agencies, within 10 (ten) business days from the date of determining the authentication method for each public service, send an opinion to the authorized body for technical implementation on the digital government portal and mobile application.
