In accordance with subparagraph 48) of Article 24 of the Building Code of the Republic of Kazakhstan, I ORDER:

1. Approve:

1) The rules for issuing expert opinions on the comprehensive non–departmental expertise of construction projects, as well as the comprehensive urban planning expertise of urban development projects (hereinafter referred to as the Rules), in accordance with Appendix 1 to this order;

2) A list of certain orders that have become invalid, in accordance with Appendix 2 to this order.

2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.

3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

4. This order will enter into force on July 1, 2026 and is subject to official publication.

5. To establish that from July 1, 2028:

subparagraph 2) of paragraph 6 of the Rules is valid in the following wording:

"2) on the evaluation of the adopted design decisions, containing: the name of the section, surname, first name, patronymic (if any) of a member of the expert commission (expert groups), indicating the certificate number (if any), information on the compliance (non-compliance) of the section with the conditions of the source materials and permits for design provided for by the legislation of the Republic of Kazakhstan, as well as compliance in design decisions and calculations with the requirements of urban planning and technical regulations, norms and regulations of state and interstate regulatory documents;";

subparagraph 4) of paragraph 7 of the Rules is valid in the following wording:

"4) members of the expert commission (expert groups) in accordance with their specialization in each of the sections (parts) of the considered construction project.

Expert opinions on construction projects marked with secrecy or marked "for official use" are issued on paper, signed in accordance with the procedure specified in subparagraphs 1) – 4) of this paragraph of the Rules and certified by members of the expert commission (expert groups) with seals indicating the surname, first name, patronymic (if any), position, certificate numbers and date of issue.";

subparagraph 2) of paragraph 12 of the Rules is valid in the following wording:

"2) the name of the section, surname, first name, patronymic (if any) of a member of the expert commission (expert group), indicating the certificate number (if any) and information on the compliance (non-compliance) of the section with the conditions of the initial materials for design provided for by the legislation of the Republic of Kazakhstan, as well as compliance in design decisions and calculations with the requirements of urban planning regulations, norms and regulations of state and interstate regulatory documents;";

Paragraph 14 of the Rules is valid as follows:

"14. Expert opinions on urban planning projects marked with secrecy or marked "for official use" are issued on paper, signed in accordance with the procedure provided for in paragraph 13 of these Rules and certified by members of the expert commission (expert groups) with seals indicating the surname, first name, patronymic (if any), position, certificate number and the date of its issuance.".

Rules for issuing expert opinions on complex non-departmental expertise of construction projects, as well as comprehensive urban planning expertise of urban development projects

Chapter 1. General provisions

1. These Rules for issuing expert opinions on comprehensive non–departmental expertise of construction projects, as well as comprehensive urban planning expertise of urban development projects (hereinafter referred to as the Rules), have been developed in accordance with subparagraph 48) of Article 24 of the Construction Code of the Republic of Kazakhstan (hereinafter referred to as the Code).

2. These Rules define the procedure for issuing expert opinions on project documentation, according to which a comprehensive non-departmental expert examination of a construction project or a comprehensive urban planning expert examination of an urban development project has been conducted.

3. Preparation and issuance of expert opinions on project documentation is carried out through the portal for organizing the development and examination of projects on the "one–stop shop" principle (hereinafter referred to as the Portal), with the exception of project documentation classified as classified or marked "for official use".

4. In these Rules, the following basic concepts are used in the examination of projects:

1) state expert organization is a legal entity established by decision of the Government of the Republic of Kazakhstan in the organizational and legal form of a republican state enterprise on the right of economic management and carrying out project expertise activities attributed to the state monopoly, as well as carrying out other activities provided for by the laws of the Republic of Kazakhstan;

2) an expert organization is a legal entity accredited in accordance with the procedure established by the Code, which carries out a comprehensive non–departmental expert examination of construction projects that are not classified by the legislation of the Republic of Kazakhstan as a state monopoly.;

3) expert opinion is a document of a state expert organization or an expert organization that is the result of a comprehensive urban planning examination of urban development projects and a comprehensive non–departmental examination of a construction project.;

4) source materials – materials necessary for the development of project documentation;

5) urban planning projects – projects containing solutions for integrated urban planning of the organization, development and development of territories and settlements or their parts (general scheme of organization of the territory of the Republic of Kazakhstan, interregional schemes of territorial development, integrated schemes of urban planning of territories, general plans of settlements (schemes of development and development of settlements), detailed planning projects);

6) construction project – design and estimate documentation containing the relevant requirements of this Code, as well as estimates for the organization and management of construction, engineering preparation of the territory, landscaping. Construction projects also include projects for the conservation and postutilization of construction sites.

Chapter 2. The procedure for issuing expert opinions on the comprehensive non-departmental expertise of construction projects, as well as the comprehensive urban planning expertise of urban projects

Paragraph 1. Procedure for issuing expert opinions on complex non-departmental expertise of construction projects

5. The state expert organization and expert organizations, within the limits of their competence, taking into account the functional purpose of the projected facility, draw up expert opinions on a comprehensive non-departmental examination of construction projects.

6. Expert opinions on complex non-departmental expertise of construction projects contain the following minimum data:

1) basic data on the construction project, containing: the name of the project, information about the customer, contractor (general contractor), subcontractors, source materials and permits attached to the construction project, submitted by the customer for a comprehensive non-departmental examination of construction projects;

2) on the evaluation of the adopted design decisions, containing: the name of the section, surname, first name, patronymic (if any) of a member of the expert commission (expert groups), indicating the number of the certificate (certificate) (if any), information on the compliance (non-compliance) of the section with the conditions of the source materials and permits for design provided for by the legislation of the Republic Kazakhstan, as well as compliance in design decisions and calculations with the requirements of urban planning and technical regulations, norms and regulations of state and interstate regulatory documents;

3) the results of a comprehensive non-departmental examination of the construction project, indicating: conclusions and main technical and economic indicators (TEP), including the specified level of responsibility and parameters (distance, hazard class) of the preliminary (calculated) sanitary protection zone (SPZ).

If a positive expert opinion is issued, a QR code is provided with a link to the final version of the construction project.

7. Expert opinions on complex non-departmental expertise of construction projects by a state expert organization are issued in electronic form or on paper.

The electronic form of expert opinions on complex non-departmental expertise of construction projects is certified by electronic digital signatures (hereinafter – EDS):

1) the first head of a state expert organization or his deputy, whose official functions include organizing a comprehensive non-departmental examination of a construction project, or a person replacing him, with the exception of the cases provided for in subparagraph 2) this paragraph of the Rules;

2) for construction projects, the comprehensive non-departmental expertise of which has been carried out by a territorial subdivision of a state expert organization, expert opinions are certified by the head of the territorial subdivision or a person replacing him;

3) heads of structural divisions, specialists performing managerial functions on the considered construction project;

4) members of the expert commission (expert groups) in accordance with their specialization in each of the sections (parts) of the considered construction project.

8. Expert opinion of expert organizations on comprehensive non-departmental expertise of construction projects, issued in electronic form and certified by EDS:

the head of this expert organization or the person replacing him;

specialists who perform management functions for this construction project, depending on the functional purpose of the projected facility or the corresponding sections (parts) of the project;

members of the expert commission (expert groups) in accordance with their specialization in each of the sections (parts) of the considered construction project.

9. Expert opinions on construction projects, the examination of which is carried out in order to develop and coordinate individual plans for the phased development and coordination of construction projects for individual facilities requiring special regulation and (or) urban planning regulations, are drawn up in the form:

1) expert opinions on each of the stages, with a recommendation for approval of this part of the project upon its positive assessment;

2) an expert opinion on the final stage of a comprehensive non-departmental expert examination of the entire construction project.

10. Negative expert opinions on construction projects are drawn up and issued on the Portal, with the exception of construction projects classified as classified or marked "for official use."

The negative expert opinion indicates the identified violations with references to the relevant regulatory legal acts of the Republic of Kazakhstan, the requirements of urban planning and technical regulations, norms and provisions of state and interstate regulatory documents.

Paragraph 2. Procedure for issuing expert opinions on integrated urban planning expertise of urban development projects

11. The state expert organization, taking into account the level of the urban development project, draws up expert opinions on the comprehensive urban planning expertise of urban development projects.

12. The expert opinion on the integrated urban planning expertise of urban development projects provides:

1) an indication of the basic data on the urban development project, namely: the name of the urban development project, the customer, the developer, as well as information on the level of the urban development project, indicating the source materials attached to the project, submitted for examination by the Customer;

2) the name of the section, surname, first name, patronymic (if any) of a member of the expert commission (expert group), indicating the number of the certificate (if any) and information on the compliance (non-compliance) of the section with the conditions of the initial materials for design provided for by the legislation of the Republic of Kazakhstan, as well as compliance with design decisions and calculations requirements urban planning regulations, norms and regulations of state and interstate regulatory documents;

3) the results of the comprehensive urban planning examination of the urban development project with an assessment of the quality of the urban development project and (or) other conclusions obtained during the comprehensive urban planning examination.

If a positive expert opinion is issued, a QR code is provided with a link to the final version of the urban development project, with the exception of expert opinions on urban development projects marked with secrecy or marked "for official use."

13. Expert opinions on comprehensive urban planning expertise of urban development projects are issued in electronic form or on paper.

The electronic form of expert opinions on the integrated urban planning expertise of an urban development project is certified by the EDS:

the first head of a state expert organization or his deputy, or a person replacing him, whose official functions include organizing a comprehensive urban planning examination of an urban development project in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan in the field of architecture, urban planning and construction.;

heads of structural divisions of the state expert organization that carried out comprehensive urban planning expertise.

members of the expert group in accordance with their specialization in each of the sections (parts) of the considered urban development project.

14. Expert opinions on urban planning projects marked with secrecy or marked "for official use" are issued on paper, signed in accordance with the procedure provided for in paragraph 13 of these Rules and certified by members of the expert commission (expert groups) with seals indicating the surname, first name, patronymic (if any), position, certificate number (certificate) and the date of its issue.

15. Negative expert opinions on urban development projects are drawn up and issued on the Portal, with the exception of urban development projects classified as classified or marked "for official use."
