On approval of the Rules for determining the technical complexity of construction projects

In accordance with subparagraph 38) of Article 24 of the Building Code of the Republic of Kazakhstan, I ORDER:
1. Approve:
1) Rules for determining the technical complexity of construction projects in accordance with Appendix 1 to this order;
2) A list of certain orders that have become invalid, in accordance with Appendix 2 to this order.
2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.
3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.
4. This order will enter into force on July 1, 2026 and is subject to official publication.

Rules for determining the technical complexity of construction projects
Chapter 1. General provisions
1. These Rules for Determining the technical complexity of Construction facilities (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 38) of Article 24 of the Construction Code of the Republic of Kazakhstan.
2. The technical complexity of a construction site is determined depending on its level of responsibility for the construction site according to the degree of technical requirements for the reliability and strength of foundations and structures established by state and (or) interstate (international) regulatory documents, depending on the functional purpose of the construction site, the characteristics of its load-bearing and enclosing structures, the number of floors (structural tiers), seismic hazards or other special geological, hydrogeological, geotechnical conditions of the construction site (area), which are divided into:
The first level of responsibility is increased;
The second level of responsibility is normal;
The third level of responsibility is reduced.
Chapter 2. The procedure for determining the technical complexity of construction projects
3. The level of responsibility of the construction site planned for construction is determined by the customer and confirmed by the design organization during the design process, taking into account the technical complexity of the construction sites.
The list of construction projects, including linear structures of transport and engineering infrastructure, classified as the first (elevated), second (normal) and third (reduced) levels of responsibility is given in Chapter 2 of these Rules.
The established level of responsibility is indicated in the initial materials of the construction project (the general explanatory note and the relevant sections of the construction project) as a technical characteristic of the facility.
When developing construction projects involving the construction of a complex of new buildings and structures or modification of an existing building or structure (expansion, modernization, technical re-equipment, reconstruction, major repairs), the level of responsibility is established for the building (structure) with the highest level of responsibility. For engineering networks and communications, the level of responsibility is determined by the building (structure) for which they are intended.
Paragraph 1. Determination of the technical complexity of construction facilities (complexes) of the first (increased) level of responsibility
4. The first (increased) level of responsibility is determined at the design stage, taking into account the functional purpose of the construction site, design features and the potential scale of the consequences of accidents, emergencies involving severe economic, social or environmental consequences, as well as the uniqueness of buildings and structures that lack standard design standards, which necessitates the development of special technical conditions..
5. Construction projects of the first (increased) level of responsibility include:
1) industrial facilities, industrial buildings and structures:
hazardous production facilities not specified in these Rules, having the characteristics established by Articles 70 and 71 of the Law of the Republic of Kazakhstan "On Civil Protection", and identified as such in accordance with the Rules for the Identification of Hazardous Production Facilities approved by Order of the Minister of Investment and Development of the Republic of Kazakhstan dated December 30, 2014 No. 353 (registered in the Register state registration of regulatory legal acts No. 10310);
facilities for the use of atomic energy (including nuclear installations, storage facilities for nuclear materials and radioactive substances, waste);
buildings and structures of thermal power engineering with a capacity of 150 Mega Watts and above;
central nodes of blast furnaces, chimneys with a height of 100 meters or more;
industrial buildings and structures with a span of 100 meters or more and a height of 50 meters or more, and (or) cranes with a lifting capacity of 32 tons or more.
2) housing and civil facilities:
buildings of the administrative bodies of the republican administration, buildings of museums of republican significance, state archives, repositories of national and cultural values, and life-support facilities of cities and towns that require special devices for artificial microclimate and (or) require special security or anti-terrorist measures.;
residential and multifunctional buildings with a height of 25 floors and above (excluding the upper technical floor) for areas with normal geological conditions;
administrative buildings and structures with a height of 25 floors and above (excluding the upper technical floor) for areas with normal geological conditions;
residential and multifunctional buildings with a height above 12 floors (excluding the upper technical floor) in areas with increased seismic activity (7 or more points) or other special geological (hydrogeological and geotechnical) conditions requiring special design solutions and measures during construction;
administrative buildings and structures with a height above 12 floors (excluding the upper technical floor) in areas with increased seismic activity (7 or more points) or other special geological (hydrogeological and geotechnical) conditions requiring special design solutions and measures during construction;
healthcare facilities without hospitals with over 480 visits per shift;
buildings of hospitals with traumatology and surgical departments, as well as hospitals with more than 50 beds;
sports and entertainment, cultural and entertainment and religious indoor buildings or outdoor structures with a simultaneous stay in them (with a capacity of) more than 500 people;
shopping and entertainment facilities with simultaneous occupancy (capacity) of more than 1,200 people;
buildings of consumer service enterprises with 200 or more workplaces;
fire station complexes in areas with increased seismic activity (7 or more points);
buildings of secondary schools (gymnasiums, lyceums) with a capacity of more than 1,500 students;
unique construction sites with structural solutions and (or) structures, the construction project of which provides one of the following characteristics:
the height is more than 50 meters, except for residential and multifunctional facilities;
spans of more than 50 meters except for production facilities;
the presence of a console more than 15 meters;
the depth of the underground part below the planned ground level is more than 10 meters or the number of underground floors is more than two;
the presence of structures and structural systems for which non-standard calculation methods are used, taking into account physical or geometric nonlinear properties, or the development of special technical conditions for design and construction is required.;
facilities of institutions of the penal system, including pre-trial detention centers, correctional colonies, prisons, with infrastructure facilities (medical facilities, industrial complexes, and other facilities).
3) other structures:
reservoirs of oil, petroleum products, and liquefied gas with a capacity of 10,000 cubic meters or more;
hydraulic structures of classes I and II;
underground oil, petroleum products and gas storage facilities of categories I, II and III, established in accordance with state regulatory documents in the field of design;
facilities of gas distribution systems with a pressure over 1.2 Mega Pascal;
main oil pipelines and oil product pipelines of I and II class;
main water supply networks, including group water pipes, drainage systems and sewage collectors with a nominal (internal) diameter of 500 millimeters or more and structures on them, water supply and sewage treatment plants (VOS and KOS), pumping stations and water intakes with a capacity of 10,000 cubic meters per day or more;
main and distribution (intra-block) heat supply networks with a diameter of 500 millimeters and above and structures on them;
television towers and antenna-mast communication structures with a height of 100 meters or more;
power transmission lines and other electric grid facilities with a voltage exceeding 220 kilovolts;
category I motorways and structures on them;
locations of border guard service units (offices, outposts, commandant's offices);
high-speed trunk roads within localities, main streets of citywide significance with continuous traffic and structures on them;
mainline railways under construction as a single complex;
bridge structures with a length of 100 meters or more on roads of all categories;
tunnels of railways and highways;
subways;
airports, runways, and other aviation infrastructure facilities;
river and sea ports, with the exception of specialized ports intended for servicing sports and pleasure craft;
space infrastructure facilities, including facilities for ensuring their safety and engineering and technical fortification;
civil defense facilities;
landfills of solid household waste, with a volume of 100 thousand tons per year or more;
landfills for the neutralization and disposal of toxic industrial waste of hazard classes I, II and III;
standard projects developed by the authorized body in the field of architectural, urban planning and construction activities (design).
Paragraph 2. Determination of the technical complexity of construction facilities (complexes) of the second (normal) level of responsibility
6. The second (normal) level of responsibility is determined at the design stage, taking into account the functional purpose, design features and potential scale of the consequences of accidents, emergencies involving moderate economic, social or environmental consequences, and is also assigned to mass construction facilities, including residential, public, industrial and agricultural buildings and structures.
7. Construction projects of the second (normal) level of responsibility include:
1) industrial facilities, industrial buildings and structures:
buildings and structures of thermal power engineering with a capacity of up to 150 Mega Watts;
central nodes of metallurgical mine furnaces, exhaust pipes up to 100 meters high;
industrial facilities, including production facilities (warehouses with a height of more than 2 floors and an area of more than 2,000 square meters and storage facilities requiring special conditions for storing goods and materials, as well as other special design solutions and measures) that are not dangerous due to fire, explosion, gas, chemical aggressive, toxic and toxic substances with a common with a span from 12 meters (inclusive) to 100 meters and (or) a height from 12 meters (inclusive) to 50 meters and (or) with cranes with a lifting capacity from 5 tons (inclusive) to 32 tons;
multifunctional silo-type complex for receiving, cleaning, drying and long-term storage of large volumes of grain crops (elevator);
grain warehouses with a storage capacity of more than 500 tons (inclusive);
livestock complexes and farms for the production of milk, meat products, breeding farms, feedlots with over 1,500 livestock (inclusive), as well as pig farms with over 10,000 livestock (inclusive);
poultry farms and complexes with over 6 million head/year (millions of heads per year) (inclusive);
greenhouse complexes with an area of over 10,000 square meters (inclusive);
feed mills and workshops with a volume of more than 5 tons per hour (inclusive);
facilities of the enterprise for the slaughter of livestock and the primary processing of products of slaughter of more than 10 tons per shift (inclusive);
animal burial grounds (biothermal pits), as well as burials of corpses of animals killed by anthrax;
milk receiving and harvesting stations, depending on their production capacity of more than 10 tons per shift (inclusive);
facilities for the use of renewable energy sources, with the exception of solar power plants with a capacity of less than 100 Megawatts (inclusive) with electrical networks with a voltage of up to 35 kilovolts (inclusive).
2) housing and civil facilities:
residential and multifunctional buildings from 6 to 25 floors (excluding the upper technical floor) for areas with normal geological conditions;
administrative buildings and structures with heights from 3 to 25 floors (excluding the upper technical floor) for areas with normal geological conditions;
residential and multifunctional buildings from 6 to 12 floors (inclusive) (excluding the upper technical floor) in areas with increased seismic activity (7 or more points) or other special geological (hydrogeological and geotechnical) conditions requiring special design solutions and measures during construction;
administrative buildings and structures with a height of up to 12 floors (inclusive) (excluding the upper technical floor) in areas with increased seismic activity (7 or more points) or other special geological (hydrogeological and geotechnical) conditions requiring special design solutions and measures during construction;
healthcare facilities without hospitals from 50 to 480 visits per shift (inclusive);
hotel complexes (motels, tourist bases) with a capacity of more than 50 places;
buildings of preschool institutions;
buildings of hospitals with traumatology and surgical departments, as well as hospitals with 50 or fewer beds;
sports and entertainment, cultural and entertainment and religious indoor buildings or outdoor structures with simultaneous stay in them (capacity) from 150 to 500 people (inclusive);
shopping and entertainment facilities with simultaneous stay in them (capacity) from 800 to 1200 people (inclusive);
buildings of consumer service enterprises from 50 to 200 workplaces;
fire station complexes for areas with normal geological conditions;
dormitory buildings of boarding schools and children's recreation camps with a capacity of more than 50 children;
buildings of secondary schools (gymnasiums, lyceums) with a capacity from 600 (inclusive) to 1,500 students (inclusive);
buildings of higher and secondary specialized educational institutions with a capacity of more than 600 students (inclusive), as well as specified buildings with educational laboratories and workshops;
car service points (workshops) with simultaneous maintenance of more than 10 units of vehicles, as well as above-ground or underground parking garages with a height of more than 5 ground floors and more than 2 underground floors;
residential buildings and social and cultural facilities in shift settlements above 3 ground floors (inclusive).
3) other structures:
car refueling station;
automobile gas filling station;
reservoirs of oil, petroleum products, and liquefied gas with a capacity of up to 10,000 cubic meters;
hydraulic structures of III and IV classes;
underground storage facilities for oil, petroleum products and gas of category IIIb and IIIb, established in accordance with state regulatory documents in the field of design;
industrial gas distribution systems with a pressure of up to 1.2 Mega Pascal (inclusive);
objects of gas distribution systems for residential and civil purposes with a pressure from 0.3 Mega Pascal to 1.2 Mega Pascal (inclusive);
main oil pipelines and oil product pipelines of class III and IV;
main water supply networks, including group water pipes, drainage and sewage collectors with a nominal (internal) diameter of up to 500 millimeters and structures on them, water supply and sewage treatment plants (VOS and KOS), pumping stations and water intakes with a capacity of 500 to 10,000 cubic meters per day;
group water pipes and sewers with a nominal (internal) diameter of 500 millimeters and higher when performed trenchless;
trunk and distribution (intra-block) heat supply networks with a nominal (internal) diameter from 350 inclusive to 500 millimeters and structures on them;
outdoor water supply networks with a working pressure of 1 Mega Pascal or more, with a nominal (internal) diameter of over 300 millimeters and structures on them, including distribution (indoor, street), on-site water supply networks, indoor drainage networks, indoor water supply and sanitation networks, sewage treatment plants for individual residential complexes with a number of residents over 500 people (inclusive);
linear cable structures of main communication lines, television towers up to 100 meters high;
antenna-mast communication structures from 45 meters to 100 meters high;
power transmission lines and other electric grid facilities with a voltage of more than 35 to 220 kilovolts (inclusive);
Category II and III motorways and structures on them;
automobile checkpoints;
bridge structures less than 100 meters long on roads of all categories;
streets and roads of cities and rural settlements not specified in paragraph 4 of these Rules, internal and external highways of industrial enterprises and structures on them (except for bridge structures);
mainline railway network facilities implemented under separate projects, as well as access and station tracks;
landfills of solid household waste, with a volume of up to 100 thousand tons per year;
landfills for the neutralization and burial of toxic industrial waste of hazard class IV;
the territory of a recreational land plot (a square, a park, a coastal zone) when developing a separate landscaping project with constructive solutions (used in the construction of "walls in the ground" foundations).
Paragraph 3. Determination of the technical complexity of construction facilities (complexes) of the third (reduced) level of responsibility
8. The third (reduced) level of responsibility is determined at the design stage, taking into account the functional purpose, lack of structural features, and is assigned to buildings and structures with low floors, as well as seasonal or auxiliary purposes.
9. Construction projects of the third (reduced) level of responsibility include:
1) industrial facilities, industrial buildings and structures:
industrial facilities, including production facilities (warehouses with a height of less than 2 floors (inclusive) and an area of less than 2000 square meters (inclusive) requiring special conditions for storing goods and materials, as well as other special design solutions and measures) that are not dangerous due to fire, explosion, gas, chemical aggressive, toxic and toxic substances with a total span of less than 12 meters and (or) a height of less than 12 meters and (or) with cranes with a lifting capacity of less than 5 tons;
grain warehouses with a storage capacity of less than 500 tons;
livestock complexes for the production of milk, meat products, livestock farms, breeding farms, feedlots with up to 1,500 livestock, as well as pig farms with up to 10,000 livestock;
poultry farms and complexes with up to 6 million head of livestock per year;
greenhouse complexes with an area of up to 10,000 square meters;
feed mills and workshops with a capacity of up to 5 tons per hour;
facilities of the enterprise for slaughtering livestock and primary processing of slaughter products up to 10 tons per shift;
milk receiving and harvesting stations, depending on their production capacity, up to 10 tons per shift;
fishery technological reservoirs (fish pond, fish breeding pool) for fish farming (aquaculture);
pasture irrigation systems;
solar energy facilities with a capacity of less than 100 Mega Watts (inclusive) with electrical networks with a voltage of up to 35 kilo Volts (inclusive).
2) housing and civil facilities:
residential buildings with a height of no more than 5 ground floors (inclusive) (excluding the upper technical floor) regardless of geological (hydrogeological and geotechnical) and seismic conditions;
administrative buildings and structures with a height of no more than 2 ground floors (excluding the upper technical floor) for areas with normal geological conditions;
healthcare facilities without hospitals for up to 50 visits per shift (inclusive);
hotel complexes (motels, tourist bases) with a capacity of up to 50 places inclusive;
buildings of higher and secondary specialized educational institutions with a capacity of less than 600 students, without educational laboratories and workshops;
sports and entertainment, cultural and entertainment and religious indoor buildings or outdoor structures with simultaneous stay in them (capacity) up to 150 people (inclusive);
shopping and entertainment facilities with simultaneous stay in them (capacity) up to 800 people (inclusive);
buildings of consumer service enterprises with up to 50 workplaces (inclusive);
dormitory buildings of boarding schools and children's recreation camps with a capacity of up to 50 children (inclusive);
buildings of secondary schools (gymnasiums, lyceums) with a capacity of less than 600 students;
car service points (workshops) with simultaneous maintenance of no more than 10 units (inclusive) of vehicles, as well as above-ground or underground parking garages with a height of no more than 5 (inclusive) ground floors, no more than 2 (inclusive) underground floors;
residential buildings and social and cultural facilities in shift settlements are no higher than 3 ground floors.;
detached single-storey buildings (structures) for housing individual business facilities with a total area of over 20 square meters.
3) other structures:
objects of gas distribution systems for residential and civil purposes with a pressure of up to 0.3 Mega Pascal (inclusive);
pumping stations and water intakes with a capacity of up to 500 cubic meters per day (inclusive);
group water pipes and sewers with a nominal (internal) diameter of up to 500 millimeters when performed trenchless;
arrangement of water intake wells and structures on them for domestic and technical water supply;
external heat supply networks with a nominal (internal) diameter of up to 350 millimeters and structures on them;
outdoor water supply networks with an operating pressure of less than 1 Mega Pascal with a nominal (internal) diameter of up to 300 millimeters (inclusive) and structures on them, including distribution (indoor, street), on-site water supply networks, indoor drainage networks, indoor water supply and sanitation networks, sewage treatment plants for individual residential complexes with a number of There are no more than 500 residents;
antenna-mast communication facilities up to 45 meters high (inclusive);
power transmission lines and other electric grid facilities with a voltage of up to 35 kilo volts (inclusive);

road surfaces of driveways and footpaths;
children's playgrounds and attractions;
park buildings and water facilities;
individual residential buildings are not higher than two floors;
household buildings on the territory of individual household plots, as well as on the plots of gardening and horticultural associations (societies);
on-site communication lines;
the territory of household and suburban areas, without changing the existing engineering networks;
mobile complexes of container, block and modular design, as well as single-storey buildings (structures) for retail, catering and consumer services enterprises, built from collapsible structures;
buildings or structures for temporary, seasonal, or auxiliary purposes (warehouses and storages (with a span of up to 6 meters, a height of up to 7 meters, and an area of up to 2,000 square meters inclusive) that require special conditions for storing goods and materials) that are not dangerous due to fire, explosion, gas, chemically aggressive, toxic, or toxic substances, greenhouses, greenhouses, pavilions, communication facilities, lighting, fencing and similar structures;
temporary buildings of residential and (or) household premises for seasonal work and animal husbandry;
open-type parking lots for no more than fifty vehicles, as well as garages with boxes for no more than two vehicles.;

detached single-storey buildings (structures) for housing individual business facilities with a total area of up to 20 square meters;
separate residential and non-residential premises in residential buildings (residential buildings), during their reconstruction (redevelopment, re-equipment, redevelopment), which does not require the allocation of additional land (pruning of the territory), is not associated with any changes in load-bearing structures, engineering systems and communications, does not impair architectural and aesthetic, fire, explosion and sanitary of high quality, which does not have a harmful effect on the environment during operation;
separate non-industrial premises during redevelopment (re-equipment) carried out in existing buildings and not requiring (not requiring) changes in load-bearing structures;
electricity supply networks with an installed capacity of up to 200 kW (Kilowatts) for business entities;
water supply and sanitation networks for residential buildings of the manor type;
on-site networks and installation of domestic gas supply systems for individual residential buildings;
an on-site territory (a land plot on the territory of a specific object) when developing a separate landscaping project without constructive solutions.
