On approval of the Rules for carrying out engineering and geological surveys

Order of the Acting Minister of Industry and Construction of the Republic of Kazakhstan dated April 21, 2026 No. 192. Registered with the Ministry of Justice of the Republic of Kazakhstan on April 22, 2026 No. 38517

 In accordance with subparagraph 17) of Article 24 of the Building Code of the Republic of Kazakhstan, I ORDER:

     1. To approve the attached Rules for carrying out engineering and geological surveys.

     2. Invalidate it:

     1) Order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated September 30, 2020 No. 509 "On Approval of the Rules for Conducting Engineering and Geological Surveys" (registered in the Register of State Registration of Regulatory Legal Acts No. 21338);

     2) Order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated February 10, 2023 No. 87 "On Amendments to the Order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated September 30, 2020 No. 509 "On Approval of the Rules for Carrying out Engineering and Geological Surveys" (registered in the Register of State Registration of Regulatory Legal Acts No. 31900).

     3. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the official Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.

     4. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

     5. This order will enter into force on July 1, 2026 and is subject to official publication.

Rules for carrying out engineering and geological surveys

Chapter 1. General provisions

     1. These Rules for carrying out Engineering and Geological Surveys (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 17) of Article 24 of the Construction Code of the Republic of Kazakhstan and determine the procedure for carrying out engineering and geological surveys.

     2. The rules must be observed for all subjects of architectural, urban planning and construction activities carried out on the territory of the Republic of Kazakhstan.

     3. The following concepts are used in these Rules:

     1) contractor - an individual or legal entity licensed for the relevant type of activity, performing engineering and geological surveys for construction under a contract or a public procurement contract concluded with the customer;

     2) the customer is an individual or a legal entity operating in accordance with the legislation of the Republic of Kazakhstan. Depending on the objectives of the activity, the customer may be the investor of the project (program), the customer (owner) or their authorized persons.

     4. Engineering and geological surveys are carried out in accordance with the Environmental Code of the Republic of Kazakhstan and the Building Code of the Republic of Kazakhstan, as well as state regulatory documents in the field of architectural, urban planning and construction activities.

     5. Engineering and geological surveys for construction are carried out by legal entities and individuals who have appropriate licenses issued in accordance with the procedure established by the Law of the Republic of Kazakhstan "On Permits and Notifications".

     6. Engineering and geological surveys provide a comprehensive study of the engineering and geological conditions of the territory (area, site, site, highway) the projected construction and forecasting of possible changes in the sphere of interaction of the projected objects with the geological environment in order to obtain sufficient materials for justifying the planning of urban development activities and the development of design solutions.

     7. Customer:

     1) independently or with the involvement of third-party specialists, draw up a technical specification for performing engineering and geological surveys for construction, approve it by the head or the person replacing him and certify it with a seal (if any).

     The technical specification for performing engineering and geological surveys for construction is an integral part of the contract and becomes binding on the parties from the moment it is approved by the customer.

     If complex natural and man-made conditions are identified in the course of engineering and geological surveys (due to insufficient knowledge of the territory of the construction site at previous stages of work and design stages), which have an adverse effect on the construction and operation of structures and habitat, the contractor of engineering and geological surveys is obliged to notify the customer of additional study and changes and additions to the terms of reference for performing engineering and geological surveys for construction. If the amendments made at the initiative of the customer to the terms of reference for the performance of engineering and geological surveys for construction require further work, an additional agreement to the contract is concluded, taking into account the amount of work performed.

     2) in accordance with the Law of the Republic of Kazakhstan "On Public Procurement", selects organizations to perform engineering and geological surveys for construction, except in cases where the customer is funded by non-governmental organizations and enters into contracts with them.;

     3) provides the contractor with the initial materials for engineering and geological surveys for the construction and wiring diagrams of external engineering networks;

     4) accepts a technical report (conclusion) from the contractor in the amount of at least two copies on paper and in two copies on electronic media.

     8. After the conclusion of the contract, the contractor draws up a program of engineering and geological surveys based on the customer's technical specifications in accordance with the requirements of state regulatory documents in the field of architectural, urban planning and construction activities and with the maximum use of materials from previously performed engineering and geological surveys and other information about the natural conditions of the area, site, site, highway, as well as with taking into account the results of the field survey of the area, if it was conducted.

     9. The program contains the composition and scope, methodology, technology and sequence of work, ensuring the completeness and reliability of the reporting materials, and also provides for the rational organization of work and completion of engineering and geological surveys on time.

     10. The program of engineering and geological surveys for construction is accompanied by a copy of the terms of reference and other documentation required for the production of survey work.

     11. In the absence of a customer's requirement for the preparation of a program of engineering and geological surveys, instead of the program, an order for the production of engineering and geological surveys is drawn up.

     12. Based on the results of the completed engineering and geological surveys, a technical report (conclusion) is prepared for transmission to the customer. The technical report (conclusion) contains the data provided by the terms of reference and the program for engineering and geological surveys, as well as justifications for the changes made.

     13. For improper performance of engineering and geological surveys and provision of a technical report (conclusion) in violation of the requirements of the legislation of the Republic of Kazakhstan and state regulatory documents in the field of architectural, urban planning and construction activities, as well as intentional provision of false information or information that does not correspond to reality, the performers bear administrative responsibility in accordance with Article 312 of the Code of the Republic of Kazakhstan on Administrative offenses.

     14. The validity period of the technical report (conclusion) of the engineering and geological surveys from the moment of their approval until the start of the development of the project documentation is:

     for unique construction projects - 6 (six) months;

     for non-unique construction projects - 36 (thirty-six) months.

Chapter 2. The procedure for carrying out engineering and geological surveys

Paragraph 1. Engineering and geological surveys for the development of pre-design documentation and urban planning projects

     15. Engineering and geological surveys for the development of pre-project documentation ensure the study of the engineering and geological conditions of the territory (area, site, highway) planned construction and forecasting changes in these conditions during the construction and operation of enterprises, buildings and structures.

     16. Engineering and geological surveys for the development of urban planning projects (master plan and detailed planning project) are carried out on the scale of an engineering and geological survey corresponding to the scale of the urban development project.

Paragraph 2. Engineering and geological surveys for project development

     17. Engineering and geological surveys for the development of a construction project for enterprises, buildings and structures provide a comprehensive study of the engineering and geological conditions of the selected site (site, highway) and a forecast of their changes during construction and operation with sufficient detail to develop design solutions.

18. Engineering and geological surveys provide materials and data for substantiating the layout of buildings and structures, structural and spatial planning solutions, drawing up a master plan for the projected facility, developing measures and structures for engineering protection, protecting the geological environment and creating safe living conditions for the population, and a construction project.

     19. During a comprehensive study of the engineering and geological conditions of the territory of the selected site (highway) The composition and volume of engineering and geological survey work are determined taking into account the allocation of engineering and geological elements in terms of plan and depth, with the determination of strength and deformation characteristics of soils, their normative and calculated values, as well as the establishment of hydrogeological parameters, quantitative indicators of the intensity of development of geological and engineering-geological processes by laboratory and (or) field methods. taking into account the requirements, the aggressiveness of groundwater to concrete and corrosion activity to metals in the sphere of interaction of the projected object with the geological environment.

     20. To develop a working draft for the construction of industrial and civil housing facilities, for which there are materials from engineering and geological surveys for pre-project documentation, engineering and geological survey work is carried out in accordance with paragraphs 21, 22 and 23 of these Rules.

Paragraph 3. Engineering and geological surveys for the development of working documentation

     21. Engineering and geological surveys for the development of working documentation provide details and clarification of the engineering and geological conditions of specific construction sites of projected buildings and structures and a forecast of their changes during construction and operation with sufficient detail to justify final design decisions.

     22. Engineering and geological surveys are carried out at specific sites of buildings and structures in accordance with the project, including at sites of individual design and crossings over natural and artificial obstacles of linear structures.

     23. The composition and scope of engineering and geological survey work are established in the program of engineering and geological surveys, taking into account the type (purpose) of buildings and structures (routes), the level of their responsibility, the complexity of engineering and geological conditions, the availability of data from previously performed engineering and geological surveys and ensuring the final allocation of engineering and geological elements, the establishment of regulatory and calculated indicators based on laboratory and (or) field definitions and methods of physical, strength, deformation, filtration and other characteristics of soil properties, clarification of hydrogeological parameters of aquifers, quantitative characteristics of the dynamics of geological processes and obtaining other data to calculate the foundations, foundations and structures of buildings and structures, substantiate their engineering protection, as well as to resolve individual issues that arose during the development, coordination and approval of the project.

Paragraph 4. Engineering and geological surveys during the construction, operation and postutilization of buildings and structures

     24. Engineering and geological surveys during the construction, operation and postutilization of enterprises, buildings and structures provide materials and data on the state and changes of individual components of the geological environment on the site.

     25. During the construction period, geological documentation of construction excavations and foundations of structures is carried out, as well as geotechnical control over the production of earthworks. Other types of work, including the author's supervision of the survey organization, are performed in accordance with the terms of reference of the design organization that carries out the author's supervision of construction.

     26. The terms of reference for engineering and geological surveys during the construction period contain data on the stages and timing of construction work, on the technical means used, tasks and required sequence of control at each stage of construction, the procedure for submitting survey products and promptly resolving issues related to linking the data obtained with the production of construction works, the procedure for coordination, expertise and approval of acts acceptance of works, as well as participation in their compilation.

     27. During the engineering and geological surveys during the construction period, the compliance of the engineering and geological conditions accepted in the design documentation with the actual ones is established based on the survey and engineering and geological documentation of excavation pits, tunnels, slits and other excavations based on the results of studying the nature of stratification, soil composition, groundwater seepage, condition and soil properties in these excavations.

     28. Engineering and geological surveys during the operation of buildings and structures are carried out in the following cases::

     preparation of project documentation for reconstruction (major repairs) associated with increased loads on the foundations and (or) expansion of the capital construction facility;

     the occurrence of a pre-emergency situation and to strengthen the foundation and (or) strengthen the foundations; design of engineering protection measures;

     investigation of the causes of the accident and (or) minimization of its consequences.

     29. During engineering and geological surveys during the operation of facilities (during construction in accordance with the customer's instructions), the soils of the foundations of existing buildings and structures are examined in order to solve the following tasks:

     the possibilities of superstructure, reconstruction of buildings and structures with an increase in temporary and permanent loads on the foundations;

     to establish the causes of deformations and develop measures to prevent their further development, as well as to restore the conditions of normal operation of buildings and structures.;

     determination of the soil condition of the base, the possibility and conditions of completion of buildings and structures after prolonged conservation of their construction;

     determining the condition of the adjacent buildings-extensions to existing buildings and developing measures to ensure their sustainability;

     finding out the causes of flooding and flooding of basements and other underground structures.

     30. When examining the soils of the foundations of buildings and structures, pits and wells are drilled, soil samples and groundwater samples are taken for laboratory determinations, sounding, geophysical surveys and other engineering and geological work are performed, and stationary observations of the deformations of the soils of the foundations of buildings and structures and the groundwater regime are carried out.

     31. The technical report on the results of the soil survey of the foundations additionally provides information on changes in the geological environment during the construction and operation of buildings (structures) and their compliance with the forecast, including changes in hydrogeological conditions, strength and deformation characteristics of soils, and provides normative and calculated indicators of soils of selected engineering and geological elements separately under the foundations and outside their area. influences, as well as their values before the construction and operation of these buildings and structures based on the materials of engineering and geological surveys of previous years.

     32. During engineering and geological surveys during the period of postutilization of an object (enterprises, buildings or structures), materials and data are obtained to substantiate design decisions on sanitation (rehabilitation) and reclamation (restoration of soils, lands) of territories.

     33. When conducting a comprehensive non-departmental examination of design estimates intended for the construction of new buildings, as well as changes (reconstruction, expansion, technical re-equipment, modernization and major repairs) of existing buildings and structures, their complexes, engineering and transport communications, regardless of the sources of financing, an assessment of the technical report (conclusion) of engineering and geological surveys of the construction site is carried out. in accordance with the Rules for conducting a comprehensive non-departmental examination of construction projects, intended for the construction of new buildings, as well as changes (reconstruction, expansion, technical re-equipment, modernization and capital repairs) of existing buildings and structures, their complexes, engineering and transport communications, approved by the authorized body for architecture, urban Planning and construction in accordance with subparagraph 10) of Article 24 of the Building Code of the Republic of Kazakhstan.
