Order of the Acting Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs dated July 8, 2026 No. 121. Registered with the Ministry of Justice of the Republic of Kazakhstan on July 9, 2026 No. 39270

In accordance with paragraph 7 of Article 14 of the Law of the Republic of Kazakhstan "On the Civil Service of the Republic of Kazakhstan", I ORDER:

     1. To approve the attached Rules for the transfer of property of civil servants, persons temporarily performing duties provided for by public office, to the trust management.

     2. Invalidate:

     1) Order of the Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs dated May 18, 2023 No. 116 "On Approval of the Rules for Transferring Property of Civil Servants to Trust Management" (registered in the Register of State Registration of Regulatory Legal Acts No. 32549);

     2) Paragraph 2 of the Order of the Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs dated March 13, 2026 No. 49 "On Amendments to the Orders of the Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs dated September 10, 2021 No. 158 "On Certain issues of civil Service" and dated May 18, 2023 No. 116 "On Approval of Transfer Rules the property of civil servants in trust management" (registered in the Register of State Registration of Regulatory Legal Acts No. 38166).

     3. The Department of Anti-Corruption Policy of the Agency of the Republic of Kazakhstan for Civil Service Affairs, in accordance with the procedure established by law, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Agency of the Republic of Kazakhstan for Civil Service Affairs after its official publication.

     4. Control over the implementation of this order is entrusted to the Deputy Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs, who oversees anti-corruption policy issues.

     5. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules for the transfer of property of civil servants, persons temporarily performing duties provided for by public office, to trust management

Chapter 1. General provisions

     1. These Rules for the transfer of property of civil servants, persons temporarily performing duties provided for by a public position, to trust management (hereinafter referred to as the Rules) have been developed in accordance with paragraph 7 of Article 14 of the Law of the Republic of Kazakhstan "On Civil Service of the Republic of Kazakhstan" and determine the procedure for the transfer of property of civil servants, persons temporarily performing duties provided for by public office, in trust management.

     2. Concepts used in these Rules:

     1) trust management – the activity of a trustee to manage on his own behalf the property of a civil servant, a person temporarily performing duties provided for by a public position, transferred to his possession, use and disposal, carried out in the interests of a civil servant, a person temporarily performing duties provided for by a public position, or another person (beneficiary) indicated by him within the limits of the powers established by the trust management agreement;

     2) trustee – any person, at the choice of a civil servant, a person temporarily performing duties provided for by a public position, who performs trust management of the property of a civil servant, a person temporarily performing duties provided for by a public position, on the basis of a relevant contract.

     3. A civil servant, a person temporarily performing duties stipulated by a public position, at their discretion, taking into account the requirements of the Civil Code of the Republic of Kazakhstan, determine the scope of powers delegated to the trustee.

Chapter 2. The procedure for the transfer of property of civil servants, persons temporarily performing duties provided for by public office, in trust management

     4. A civil servant or a person temporarily performing duties stipulated by a public position, within thirty calendar days from the date of taking office, for the duration of their public service, transfer to trust management the property belonging to them by right of ownership or other property right, the use of which entails income, with the exception of money, bonds, shares of open and interval mutual investment funds. funds, shares of commercial organizations (ordinary shares in the amount of, not exceeding five percent of the total number of voting shares of organizations), digital assets legally owned by them, as well as property transferred to property lease (lease), and submit a notarized copy of the property trust management agreement to the Personnel Management Service (HR department) at the place of work within the specified period.

     5. The Chairman of the National Bank of the Republic of Kazakhstan and his deputies, the Chairman of the authorized body for regulation, control and supervision of the financial market and financial organizations and his deputies, within thirty calendar days from the date of appointment to these government positions, shall transfer to the trust management and submit to the Personnel Management Service (HR service) at the place of work a notarized copy of the trust agreement. management of investment fund units, bonds and shares of commercial organizations owned by them.

     6. In case of ownership or other proprietary right to property, the use of which entails income, with the exception of shares of open and interval mutual funds, bonds, shares of commercial organizations (common shares in the amount not exceeding five percent of the total number of voting shares of organizations), digital assets acquired in accordance with the legislation of the Republic of Kazakhstan civil servant, a person temporarily performing duties stipulated by a public position, They transfer it to the trust management within thirty calendar days from the date of the ownership right or other property right in accordance with the procedure established by the legislation of the Republic of Kazakhstan, and submit a notarized copy of the trust management agreement to the Personnel Management Service (HR department) at the place of work within the specified period.

     7. The Chairman of the National Bank of the Republic of Kazakhstan and his deputies, the Chairman of the authorized body for regulation, control and supervision of the financial market and financial organizations and his deputies, transfer their shares of investment funds, bonds, shares of commercial organizations received as a result of inheritance or on the basis of court decisions or in other cases beyond the control of the will of these persons transferred to the trust management within thirty calendar days from the date of the occurrence of ownership rights or other property rights in accordance with the procedure established by the Government of the Russian Federation., in accordance with the procedure established by the legislation of the Republic of Kazakhstan, and submit a notarized copy of the property trust management agreement to the Personnel Management Service (HR department) at the place of work within the specified period.

     8. In the event of termination of the contract of trust management of the property of one of the parties, a civil servant or a person temporarily performing duties stipulated by a public position, within thirty calendar days after termination of the contract, shall transfer the property to be transferred to trust management again and submit it to the personnel management service (HR service) at the place of residence within the specified period. a notarized copy of the contract of trust management of the property.

     9. The contract of trust management of property, along with the general grounds for termination of obligations, is terminated.:

     1) the death of a citizen – trustee, declaring him deceased, recognizing him as incompetent or with limited legal capacity, missing; liquidation of a legal entity – trustee;

     2) the refusal of the trustee, a civil servant, or a person temporarily performing duties stipulated by a public position, due to the inability of the trustee to personally manage the entrusted property.;

     3) the refusal of a civil servant, a person temporarily performing duties provided for by a public position, from the performance of the contract, provided that losses and remuneration are paid to the trustee, if it was provided for by the contract.;

     4) refusal of the trustee in case of failure to inform him about the transfer of the pledged property to management with payment of remuneration to him, if it was stipulated by the contract.

10. Any subsequent information on the termination of the trust management agreement or its renegotiation shall be submitted by a civil servant, a person temporarily performing duties provided for by a public position, to the personnel management service (HR service) of the state body at the place of work within thirty calendar days after the occurrence of these events.

     When renegotiating a trust management agreement, a notarized copy of it is provided to the Personnel Management Service (HR department) of the state body at the place of work in accordance with the procedure established by these Rules.
