On approval of the Rules for state certification in relation to organizations implementing educational programs of technical and vocational, post-secondary education in the field of healthcare

    In accordance with subparagraph 3) Paragraph 3 of Article 55-1 of the Law of the Republic of Kazakhstan "On Education" I ORDER:

     1. To approve the attached Rules for conducting state certification in relation to organizations implementing educational programs of technical and vocational, post-secondary education in the field of healthcare.

     2. The Department of Science and Human Resources of the Ministry of Health of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Health of the Republic of Kazakhstan after its official publication;

     3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Legal Department of the Ministry of Health of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Health of the Republic of Kazakhstan.

     4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules for conducting state certification in relation to organizations implementing educational programs of technical and vocational, post-secondary education in the field of healthcare

Chapter 1. General provisions

     1. These Rules of state certification in relation to organizations implementing educational programs of technical and vocational, post–secondary education in the field of healthcare (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 3) paragraph 3 of Article 55-1 of the Law of the Republic of Kazakhstan "On Education" and establish the procedure for state certification in relation to organizations implementing educational programs of technical and vocational, post-secondary education in the field of healthcare (hereinafter – TiPPO organizations in the field of healthcare) regardless of their forms of ownership.

     2. The following concepts and definitions are used in these Rules:

     1) the attestation commission is a collegial body authorized to carry out the attestation procedure;

     2) the state certification of TiPPO organizations in the field of healthcare is a procedure for a comprehensive assessment of the quality and accessibility of education, aimed at determining the compliance of educational activities with the requirements of the state mandatory standard of the appropriate level of education;

     3) anonymous survey is a method of collecting information that allows respondents to express opinions without providing personal data, ensuring confidentiality and contributing to the openness of responses.

     3. The state certification of TiPPO organizations in the field of healthcare is carried out by the authorized body in the field of healthcare (hereinafter referred to as the authorized body) once every five years.

     4. The first state certification is carried out in newly created TiPPO organizations in the field of healthcare no later than one year after the first graduation of specialists.

Chapter 2. The procedure for organizing state certification

     5. The authorized body annually, by November 1, approves the list of TiPPO organizations in the field of healthcare subject to state certification in the current year, indicating the planned dates for the state certification for each TiPPO organization in the field of healthcare (hereinafter referred to as the List). The state certification is carried out in accordance with the specified list.

     The list is posted within 5 (five) business days from the date of approval on the official Internet resources of the authorized body.

     Amendments to the approved List are allowed in the following cases::

     1) statements by the TiPPO organization in the field of healthcare on exclusion from the List;

     2) notification of a TiPPO organization in the field of healthcare on reorganization, liquidation or suspension of activities in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

     6. Within 5 (five) business days from the date of approval of the changes to the List, the authorized body shall post the updated List on the official Internet resource and notify the TiPPO organization in the field of healthcare of the changes.

     7. The TiPPO organization in the field of healthcare is notified of the state certification no later than 30 (thirty) calendar days prior to its start.

     8. The Attestation Commission (hereinafter referred to as the Commission) is established by order of the authorized body. The number of members of the Commission must be odd and consist of at least five (5) members.

     The Commission consists of representatives of:

     1) the authorized body;

     2) government agencies responsible for the organization of TiPPO in the field of healthcare;

     3) educational organizations and their associations (associations) that are qualified specialists in the field of TiPPO organizations in the field of healthcare, subject to state certification;

     4) medical organizations and institutions in specialized areas.

     The Chairman of the Commission (hereinafter referred to as the Chairman) is determined by the decision of the deputy first head of the authorized body in charge of medical science, education and human resources of the healthcare industry, an employee of the authorized body.

     9. The organization of the TiPPO in the field of healthcare provides the necessary conditions for the work of the Commission, including unhindered access to premises, documentation, information systems, educational resources, as well as the provision of all requested materials necessary for state certification.

Chapter 3. The procedure for state certification

     10. The state attestation is carried out with a visit to the TiPPO organization in the field of healthcare by the Commission within a period not exceeding 7 (seven) working days from the date of the state attestation.

     The activities of the TiPPO organization in the field of healthcare for the two previous academic years and the current academic year preceding the start date of the state certification are subject to evaluation.

     11. During the state certification, the following areas of activity of the TiPPO organization in the field of healthcare are studied and evaluated:

     1) organizational and legal activity (charter, availability of a license for educational activities (in specialties), information on the latest state certification, accreditation (certificate), the structure of the TIPPO organization in the field of healthcare;

     2) staffing of the educational process in the specialties, including the availability of teachers and mentors, masters of industrial training with appropriate qualifications;

     3) the number of students in the field of specialties (admission/graduation);

     4) organization of the educational process (compliance with standard curricula, curricula, schedules), pedagogical and educational workload in accordance with the requirements of orders of the Minister of Health of the Republic of Kazakhstan dated July 4, 2022 No. KR DSM-63 "On approval of state mandatory standards for levels of education in the field of healthcare" (registered in the Register of State Registration of regulatory legal acts No. 28716) (hereinafter – State Educational Standard) and No. 4 dated January 9, 2023 "On Approval of standard training programs in medical and Pharmaceutical specialties" (registered in the Register of State Registration of Regulatory Legal Acts No. 31672);

     5) organization of educational work, including planning, organization and implementation of educational activities in accordance with the Order of the Minister of Health of the Republic of Kazakhstan dated July 4, 2022 No. KR DSM-63 "On approval of state mandatory standards for levels of education in the field of healthcare" (registered in the Register of State Registration of Regulatory Legal Acts No. 28716);

     6) material and technical support (provision of classrooms, laboratories, training and production workshops, availability of a simulation center/office) by specialty;

     7) information and digital resources (official website, education management information system with up-to-date databases on the contingent, provision of Internet connection, computers, organizational equipment), library fund;

     8) assessment of graduates' knowledge and skills, provided for by the Order of the Minister of Health of the Republic of Kazakhstan dated December 11, 2020 No. KR DSM-249/2020 "On approval of the rules for assessing students' knowledge and skills, assessing the professional readiness of graduates of educational programs in the field of healthcare and specialists in the field of healthcare" (registered in the Register of State Registration of Regulatory Legal Acts No. 21763), by analyzing the work of the internal system for evaluating students' academic achievements (current, intermediate and final attestations), verification of practical and professional competencies, including the performance of practical tasks, situational tasks, or other evaluative actions reflecting the specifics of the profile;

     9) anonymous survey of participants in the educational process;

10) organization of industrial and professional practice, including the availability of contracts with practice bases, as well as interaction with employers in the form of joint practice, internships, participation in final certification and employment of graduates.

     12. The study of the implementation of educational programs is carried out taking into account the level of education and is aimed at determining the compliance of the content and conditions of the educational process with the requirements of the State Educational Standard, standard curricula and curricula, as well as studying compliance with the requirements of educational programs, organization of practices, final certification and interaction with employers.

     13. The assessment of the level of satisfaction with the conditions of the educational process is carried out by the Commission through an anonymous survey during the certification using paper media or online format.

     Students, parents (legal representatives), teachers and employers participate as respondents to ensure the objectivity and reliability of the results.

     The Commission uses the results of the anonymous survey in a generalized form and as an indicator for evaluating the activities of the TiPPO organization in the field of healthcare.

     14. Based on the results of studying materials, observation results, assessment of students' practical skills, surveys, analysis of documentation and other materials related to the activities of the TiPPO organization in the field of healthcare, the Commission performs analytical processing and evaluation of information.

     15. The members of the Commission prepare analytical materials on the assigned areas of assessment, including established facts, conclusions and recommendations. The analytical materials are submitted to the Chairman for generalization and systematization.

     16. Based on the results of a comprehensive analysis of the submitted materials, the Commission collectively reviews the assessment results in all areas specified in paragraph 11 of these Rules and decides on the degree of compliance of the educational activities of the TiPPO organization in the field of healthcare.

     17. The Commission's decisions are taken collectively by a majority vote of the Commission members present. If the votes are equal, the vote of the Chairman of the Commission is decisive.

     18. Based on the established degree of compliance, the Commission forms a state certification opinion (hereinafter referred to as the Opinion) containing a reasoned proposal to recognize a TiPPO organization in the field of healthcare that has passed or has not passed state certification in accordance with the annex to these Rules. The conclusion is drawn up in two copies and signed by the Chairman and all members of the Commission.

     19. One copy of the Report is sent to the TiPPO organization in the field of healthcare under the signature of the head, the second copy, together with the materials of the state attestation, is stored in the authorized body. If the head of the TiPPO organization in the field of healthcare refuses to sign, an appropriate act is drawn up, which is attached to the materials of the state attestation.

     20. The materials of the state attestation and the Conclusion are kept for at least 5 (five) years from the date of issue of the order on recognition of the TiPPO organization in the field of healthcare, which has passed or has not passed the state attestation to the authorized body.

     21. Based on the Conclusion of the Commission, the authorized body issues an order recognizing a TiPPO organization in the field of healthcare as having passed or failed state certification. The Order is issued no later than 3 (three) business days from the date of receipt of the Commission's Conclusion.

     In case of failure to pass the state certification, these TiPPO organizations in the field of healthcare are sent to the state body performing control functions at the levels of technical and vocational, post—secondary education - the Committee for Quality Assurance in Education of the Ministry of Education of the Republic of Kazakhstan for preventive control with a visit to the subject (object) of control in accordance with the Business Code of the Republic of Kazakhstan, the Law The Law of the Republic of Kazakhstan "On Education".

     22. The results of the state certification are brought to the attention of the TiPPO organization in the field of healthcare within 5 (five) working days from the date the order was issued.

     23. Information on the results of the state attestation is posted on the official Internet resources of the authorized body that conducted the state attestation, no later than 5 (five) working days from the date of issue of the order.

     24. The results of the state certification are used by the authorized body and local public administration bodies of healthcare and education of regions, cities of republican significance and the capital to analyze the state of quality of educational activities, as well as to develop and implement measures of methodological, organizational and consulting support for TIPPO organizations in the field of healthcare. The organization of TiPPO in the field of healthcare ensures that the results of state certification are reviewed at a meeting of the pedagogical council (or other collegial body provided for by the charter of the educational organization) in order to plan measures to improve the educational process and improve the internal quality assurance system of education.

Chapter 4. The procedure for appealing the results of the state attestation

     25. In case of disagreement with the Conclusion of the Commission, the TiPPO organization in the field of healthcare has the right to file a written complaint with the body that conducted the state certification — the authorized body within 3 (three) working days from the date of receipt of the Conclusion.

     26. A complaint against the Conclusion of the Commission and (or) the decision to recognize a TiPPO organization in the field of healthcare as having passed or failed state certification is submitted to the first head of the authorized body in accordance with the legislation of the Republic of Kazakhstan and is considered within 20 (twenty) business days from the date of its registration.

     Appealing against the Commission's conclusion does not suspend its validity.

     27. Unless otherwise provided by the laws of the Republic of Kazakhstan, judicial appeal of the results of state attestation is allowed after their appeal in an administrative (pre-trial) manner in accordance with paragraph 5 of Article 91 of the Administrative Procedural Code of the Republic of Kazakhstan.
