On approval of the Rules for certification of specialists (experts) in the field of architectural, urban planning and construction activities

   In accordance with subparagraph 43) of Article 24 and paragraph 1 of Article 57 of the Building Code of the Republic of Kazakhstan, I ORDER:

     1. To approve the attached Rules for certification of specialists (experts) in the field of architecture, urban planning and construction.

     2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

     4. This order will enter into force on July 1, 2028 and is subject to official publication.

Rules for certification of specialists (experts) in the field of architectural, urban planning and construction activities

Chapter 1. General provisions

     1. These Rules for certification of specialists (experts) in the field of architectural, urban planning and construction activities have been developed in accordance with subparagraph 43) of Article 24 of the Building Code of the Republic of Kazakhstan (hereinafter referred to as the Rules) and define the procedure for certification of specialists (experts) in the field of architectural, urban planning and construction activities.

     2. These Rules apply to individuals applying for professional activity in the following fields in accordance with the list of professions of specialists (experts) in accordance with Appendix 1 to these Rules.

     3. Certification is carried out at the following levels::

     1) specialist in the field of architectural, urban planning and construction activities;

     2) expert in the field of architectural, urban planning and construction activities.

     4. The following basic concepts are used in these Rules:

     1) a candidate applying for certification as a specialist (expert) in the field of architectural, urban planning and construction activities (hereinafter referred to as the candidate) is an individual who meets the qualification requirements established by these Rules and has applied to the certification center for recognition of his professional qualifications.;

     2) certification of specialists (experts) is a procedure conducted by a certification body in order to assess the compliance of a candidate applying for certification with the requirements of professional standards in accordance with the procedure defined by these Rules.

     3) certification center is a legal entity in the form of an association of individuals and (or) legal entities for the certification of specialists (experts) in the field of architectural, urban planning and construction activities.

Chapter 2. Procedure for certification of specialists (experts) in the field of architectural, urban planning and construction activities

     5. Certification includes the following steps::

     1) acceptance and review of candidate's documents;

     2) the interview;

     3) making a decision on issuing a certificate.

     6. Candidates who meet the qualification requirements set out in Chapter 3 of these Rules are eligible for certification.

Paragraph 1. Acceptance and review of candidate's documents

     7. Candidates submit the following documents in electronic form to the certification center conducting certification in their chosen field of professional activity:

     1) an application for certification in accordance with Annex 2 to these Rules;

     2) a copy of the identity card of a citizen of the Republic of Kazakhstan;

     3) notarized documents confirming compliance with the qualification requirements provided for in Chapter 3 of these Rules.

     Notarization is not required if the applicant submits the original document for verification to an employee of the certification authority.

     8. Grounds for refusal of admission to the interview:

     1) provision of an incomplete package of documents provided for in paragraph 7 of these Rules;

     2) non-compliance with the qualification requirements established by Chapter 3 to these Rules;

     3) submission of false information.

     Refusal of admission is not a reason for accepting for consideration the re-submitted documents. Repeated submission of documents is allowed after thirty calendar days from the date of the decision on refusal.

     9. The certification center reviews the submitted documents within ten working days from the date of receipt of the documents for completeness and compliance with the qualification requirements specified in paragraph 7 of these Rules, following which it decides on the candidate's compliance with the established qualification requirements and admits him to an interview or to refuse admission to an interview on the grounds specified in paragraph 8. these Rules.

     The decision is made in the form of a protocol.

     10. Candidates admitted to the interview will be notified of the date of the interview within two working days from the date of the decision. Notification can be made by phone, by sending information to the e-mail addresses and mobile phones of the participants.

     11. Candidates who have not received admission will be notified within two working days after the decision is made.

Paragraph 2. The interview

     12. The purpose of the interview is to determine the candidates' compliance with the requirements of professional standards.

     The interview is conducted by a commission established by the certification authority.

     13. Candidates admitted to the interview will be interviewed by certification authorities within one month from the date of notification of candidates about their admission to the interview.

     14. The course of the interview with each candidate is drawn up in the form of a separate protocol and recorded using technical recording tools.

     15. The minutes of the interview with the candidate are signed by all members of the commission and approved on the day of the interview.

     16. The certification center notifies the candidates who have passed the interview within five working days from the date of approval of the protocol with the entry of data into the register of certified specialists (experts) in the field of architectural, urban planning and construction activities.

     17. The certificate of a specialist (expert) in the field of architectural, urban planning and construction activities in the form provided for in Appendix 3 of these Rules is issued within five working days after notification.

     18. The certification center provides information about certified specialists (experts) in the field of architectural, urban planning and construction activities to the authorized body for architecture, urban planning and construction on a monthly basis.

     1. Designing:

     1. Chief Engineer of the project,

     2. Chief architect of the project

     3. Chief Designer:

     1) On load-bearing and enclosing structures: hydraulic engineer; construction.

     2) For transport construction: engineer of highways and airfields; engineer of bridges and tunnels; engineer of railways.

     4. Chief Specialist:

     1) Engineering networks and facilities: heat and gas supply and ventilation; water supply and sewerage/water supply and sanitation; communications engineer; electrical engineer; oil and gas engineer.

     2) On technological equipment.

     5. Lead Design Engineer:

     1) Architecture.

     2) For load-bearing and enclosing structures: hydraulic engineer;

     construction.

     3) Engineering networks and facilities: heat and gas supply and ventilation; water supply and sewerage/water supply and sanitation; communications engineer; electrical engineer; oil and gas engineer.

     4) For transport construction: engineer of highways and airfields; engineer of bridges and tunnels; engineer of railways.

     5) On technological equipment.

     2. Technical supervision:

     1. on load-bearing and enclosing structures;

     2. on engineering networks;

     3. on technological equipment.

     3. Author's supervision:

     1. Architecture;

     2. Load-bearing and enclosing structures.

     4. Exploration activities:

     1. the surveyor;

     2. The topographer;

     3. hydrogeologist;

     4. Geophysicist.

     5. Technical inspection of the reliability and stability of buildings and structures.

     6. Examination of construction projects:

     1) urban planning;

     2) Pre-project documentation;

     3) Architecture;

     4) the constructive part;

     5) engineering networks and systems (by type of engineering networks and systems);

     6) technological part (depending on the purpose of the facility);

     7) estimated part;

     8) Fire safety;

     9) Environmental part;

     10) sanitary and epidemiological profile.

     7. Construction and installation works:

     1. Chief Engineer;

     2. Head of the Production and Technical Department;

     3. The head of the site:

     1) For load-bearing and enclosing structures: hydraulic engineer; construction;

     2) Engineering networks and facilities: heat and gas supply and ventilation; water supply and sewerage/water supply and sanitation; communications engineer; electrical engineer; oil and gas engineer;

     3) Transport construction: engineer of highways and airfields; engineer of bridges and tunnels;
