On approval of the Rules for coordinating the holding of spectacular cultural events with the participation of foreign creative groups and performers in the territory of the Republic of Kazakhstan

   In accordance with paragraphs 5 and 7 of Article 9-1 of the Law of the Republic of Kazakhstan "On Culture", I ORDER:

     1. To approve the attached Rules for coordinating the holding of spectacular cultural events with the participation of foreign creative groups and performers in the territory of the Republic of Kazakhstan.

     2. The Committee of Culture of the Ministry of Culture and Information of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Culture and Information of the Republic of Kazakhstan, after its official publication.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Culture and Information of the Republic of Kazakhstan.

     4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules for coordinating the holding of spectacular cultural events with the participation of foreign creative groups and performers in the territory of the Republic of Kazakhstan

Chapter 1. General provisions

     1. These Rules for Coordinating the holding of spectacular cultural events with the participation of foreign creative groups and performers in the territory of the Republic of Kazakhstan (hereinafter referred to as the Rules) have been developed in accordance with paragraphs 5 and 7 of Article 9-1 of the Law of the Republic of Kazakhstan "On Culture" (hereinafter referred to as the Law) and determine the procedure for coordinating the holding of spectacular cultural events with with the participation of foreign creative teams and performers in the territory of the Republic of Kazakhstan.

     2. The following basic concepts are used in these Rules:

     1) advertising – information distributed and (or) posted in any form by any means, intended for an indefinite circle of people and designed to generate or maintain interest in an individual or legal entity, goods, trademarks, works, services and promote their sale;

     2) the local executive body (akimat) (hereinafter referred to as the MIO) is a collegial executive body headed by the akim of a region, a city of republican significance and the capital, a district (city of regional significance), which carries out, within its competence, local government and self–government in the relevant territory;

     3) conflict of interests – a conflict between the personal interests of persons holding a responsible public position, persons authorized to perform public functions, persons equated to them, officials and their official powers, in which the personal interests of these persons may lead to non-performance and (or) improper performance of their official duties.;

     4) a spectacular cultural event (hereinafter referred to as an event) is a cultural event held in venues for events and involving the simultaneous presence of two hundred or more spectators at this event.;

     5) the organizer of a spectacular cultural and mass event (hereinafter referred to as the Organizer) is an individual or legal entity engaged in organizing and holding the event.;

     6) The Commission on the issue of holding spectacular cultural events with the participation of foreign creative groups and performers in the territory of the Republic of Kazakhstan (hereinafter referred to as the Commission) – a permanent collegial body established and approved by the decision of the Ministry of Economic Development of the capital, regions, and cities of republican significance to review documents and issue advisory opinions on holding events with the participation of foreign creative teams and performers in the territory of the Republic of Kazakhstan for the presence or absence of the requirements specified in subparagraph 5) of paragraph 5 of Article 9-1 of the Law.

Chapter 2. The procedure for approving the holding of spectacular cultural events with the participation of foreign creative groups and performers in the territory of the Republic of Kazakhstan

     3. For the event, the Organizer sends an application in accordance with the appendix to these Rules and documents to the e-mail address or on paper to the office of the MIO.

     To carry out socially significant cultural events implemented as part of the payment of subsidies to state theaters, concert organizations, circuses, cultural and leisure organizations, as well as within the framework of a state assignment in accordance with Article 16 of the Budget Code of the Republic of Kazakhstan, the Organizer, no later than 3 (three) calendar days before the date of the event, sends to The MIO in whose territory the event is planned to be held, a written notification.

     The MIO will send a response to the written notification to the Organizer within two (2) business days, but no later than the date of the event. If the M&E does not provide a response within the specified period, the written notification is considered agreed by default.

     4. The received application with the attached documents is accepted and registered by the office of the MIO within 1 (one) business day after receipt.

     The following documents are attached to the application:

     1) a copy of the certificate of state registration as an individual entrepreneur or a legal entity in relation to the Organizer;

     2) the program (scenario, rules of procedure) of the event;

     3) a portfolio, a reference containing information about the participants (creative teams and performers), links to Internet resources, a summary (synopsis), a libretto, dramatic material (play or staging), a concert program indicating the author of the songs, lyrics, a script for a humorous monologue.

     5. The submitted application and documents are subject to review by the relevant M&E department within no more than 15 (fifteen) business days from the date of their registration.

     If an incomplete set of documents is submitted, no later than 3 (three) business days from the date of registration of the application, the MIO sends a notification of the need to finalize them, indicating specific violations and elimination requirements within 2 (two) business days.

     If the application and documents are not brought into compliance with the requirements specified in the second part of paragraph 4, within the time period specified in the notification, the MIO returns the application to the Organizer within 3 (three) business days.

     6. If the requirements specified in the second part of paragraph 4 of these Rules are met, the MIO will send the application and the package of documents to the members of the Commission on the next business day in order to receive recommendations.

     7. The Commission consists of an odd number of members, numbering at least five (5) persons, including the Chairman and deputy chairman, elected from among representatives of state bodies.

     In order to avoid conflicts of interest, the Commission may not include persons who have a personal interest in reviewing applications, as well as persons whose family ties or other circumstances may affect the objectivity of the Commission's decision.

     A member of the Commission who has a conflict of interest shall immediately notify the Chairman in writing.

     The decision on recusal is made at a meeting of the Commission if there is information about a conflict of interest or the possibility of its occurrence.

     The decision on recusal is formalized by a protocol, which is signed by the Chairman of the Commission, the Deputy Chairman, and the members of the Commission.

     If one of the members resigns from the Commission, the new member will be included in the Commission no later than 5 (five) business days after the official notification of his departure.

     8. The Chairman of the Commission directs its activities and holds meetings of the Commission. During the absence of the Chairman, his functions are performed by the Vice-Chairman.

     9. The Secretary of the Commission is appointed by the Chairman from among the staff of the MIO.

     10. The Secretary of the Commission notifies the members of the Commission of the date, time and place of the Commission meeting, coordinates the work to ensure the activities of the Commission, collects and prepares the materials specified in the second part of paragraph 4 of these Rules for the meeting, draws up the minutes of the Commission meeting (hereinafter referred to as the minutes). The Secretary is not a member of the Commission and does not participate in the voting.

     11. Meetings of the Commission are held as necessary, but not more than 2 (two) once a month. Meetings of the Commission are considered competent if they are attended by at least two thirds of the total number of members of the Commission. If the votes of the Commission members are equal, the chairman's vote is decisive.

     Notification of the date of the Commission meeting is sent by the Secretary to the members of the Commission via SMS notification, telephone communication or by e-mail no later than 1 (one) business day before the meeting.

12. When reviewing the documents specified in paragraph 4 of the Rules, the Commission verifies and issues a recommendation opinion in accordance with subparagraph 5) of paragraph 5 of Article 9-1 of the Law on the presence or absence of use of content aimed at propaganda or agitation of a violent change in the constitutional order, violation of the integrity of the Republic of Kazakhstan, undermining state security, war, social, racial, national, religious, class and clan superiority, cult of cruelty and violence, suicide, pornography, narcotic drugs, non-traditional sexual orientation and pedophilia, which also contradicts generally accepted norms of morality and morality when holding events with the participation of foreign creative groups and performers in the territory of the Republic of Kazakhstan, which is formalized by the protocol within 5 (five) calendar days after the meeting. The Secretary shall send a copy of the protocol to the MIO's email address within one (1) business day.

     13. After receiving a copy of the protocol, the MIO makes one of the following decisions within 3 (three) business days from the date of its receipt, which is issued in the form of an opinion:

     1) coordinate;

     2) refuse.

     The reason for refusing to hold the event is the use of content aimed at propaganda or agitation of a violent change in the constitutional order, violation of the integrity of the Republic of Kazakhstan, undermining the security of the state, war, social, racial, national, religious, class and tribal superiority, the cult of cruelty and violence, suicide, pornography, narcotic drugs, non-traditional sexual orientation and pedophilia, which also contradicts generally accepted norms of morality and morality.

     14. The MIO shall notify the Organizer of the decision within two (2) business days from the date of the decision.

     15. Decision, action (inaction) M&E may be appealed by the Organizer in an administrative (pre-trial) manner in accordance with Article 91 of the Administrative Procedural Procedure Code of the Republic of Kazakhstan (hereinafter referred to as the APPC).

     The MIO considers the complaint in the manner and within the time limits stipulated by the APPC.

     The complaint is considered within the time limits established by Article 99 of the CPC.

     16. The organizer who submitted the application conducts the events and concludes an agreement on the organization of events with an indication of the venue, as well as organizes advertising and ticket sales only after agreement with the MIO for the events, but no later than 30 (thirty) business days before the start of the event.

     17. In case of a change in the date of the events, re-approval with the MIO is not required.

     When changing the venue of events, replacing the team or performer, re-approval with the MIO is required, the review period is 7 (seven) business days.
