On approval of the Rules for the Creation, Operation, Accounting and Termination of digital Condominiums

In accordance with paragraph 6 of Article 35 of the Digital Code of the Republic of Kazakhstan, I ORDER:
1. Approve the attached Rules for the Creation, Operation, Accounting and Termination of digital Condominiums.
2. The Committee of Digital Assets and Breakthrough Technologies of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan after its official publication;
3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Legal Department of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.
3. Control over the execution of this order is entrusted to the supervising Vice Minister of Artificial Intelligence and Digital Development of the Republic of Kazakhstan.
4. This order will enter into force on July 12, 2026 and is subject to official publication.

Rules for the creation, operation, accounting and termination of digital condominiums
Chapter 1. General provisions
1. These Rules for the Creation, Operation, Accounting and Termination of digital Condominiums (hereinafter referred to as the Rules) have been developed in accordance with paragraph 6 of Article 35 of the Digital Code of the Republic of Kazakhstan and define the procedure for the creation, operation, accounting and termination of a digital condominium.
2. The following concepts are used in these Rules:
1) a smart contract is a contract that provides for the automatic fulfillment of conditions agreed upon in advance by the parties upon the occurrence of certain circumstances using digital technologies.;
2) the authorized body in the field of digitalization (hereinafter referred to as the authorized body) is the central executive body responsible for the management and intersectoral coordination in the field of digitalization;
3) the authorized person for the management of a digital condominium (hereinafter referred to as the authorized person) is an individual or legal entity designated by the participants and managing the digital condominium;
4) digital condominium is a form of ownership in which the rights of joint ownership, use and disposal of distributed digital objects created and used by participants are exercised on the basis of general rules of interaction.;
5) a participant in a digital condominium (hereinafter referred to as a participant) is an individual or legal entity that has concluded an agreement on the creation of a digital condominium or a smart contract for the joint ownership, use and disposal of distributed digital objects.;
6) a digital object is a separate element of the digital environment created, used or transmitted through digital technologies, possessing unique digital characteristics and allowing subjects of the digital environment to exercise the rights of ownership, use or disposal to the extent established by the current legislation of the Republic of Kazakhstan.
Chapter 2. The procedure for the creation and operation of a digital condominium
3. A digital condominium is created on the basis of an agreement between the participants (hereinafter referred to as the agreement) or a smart contract.
4. The agreement or smart contract contains the following information:
1) identification information about the participants:
for individuals – last name, first name, patronymic (if any), individual identification number;
for legal entities – name, business identification number;
2) the composition of distributed digital objects;
3) the procedure for joint ownership, use and disposal of distributed digital objects;
4) the procedure for managing a digital condominium;
5) rights and obligations of participants;
6) other information that does not contradict the legislation of the Republic of Kazakhstan.
5. Changes in the composition of participants, distributed digital facilities and operating conditions of a digital condominium are carried out on the basis of an agreement or a smart contract and are subject to mandatory fixation in the digital environment.
6. An operation with a distributed digital object is initiated by a participant by forming a request in a digital system or smart contract.
7. Upon receipt of the request, the operation is executed upon its confirmation by the participants or upon the occurrence of the conditions stipulated in the smart contract.
8. After the operation is completed, a record is generated in the digital system or smart contract indicating the participants, the distributed digital object, the content of the operation, the date and time of its completion.
9. The management of a digital condominium is carried out directly by its participants or through an authorized person acting on the basis of an agreement with the participants in accordance with the procedure established by the agreement or smart contract.
Chapter 3. Procedure for registration and termination of a digital condominium
10. The accounting of digital condominiums is carried out by an authorized body.
11. Accounting for a digital condominium includes:
1) fixing the composition of the participants;
2) accounting for distributed digital objects;
3) consideration of the rights and obligations of participants;
4) recording of transactions carried out within the digital condominium.
12. The authorized person shall send to the authorized body information on the creation, modification of information and termination of the digital condominium within 5 (five) business days from the date of occurrence of these circumstances.
13. The digital condominium is being discontinued:
1) by decision of the participants;
2) upon the occurrence of circumstances stipulated by the agreement or smart contract;
3) on the basis of a court decision that has entered into legal force;
4) in other cases stipulated by the legislation of the Republic of Kazakhstan.
14. Upon termination of the digital condominium, the participants determine the procedure for the distribution of rights to distributed digital objects.
