On approval of the Rules for maintaining an automated registry in the field of architectural, urban planning and construction activities

In accordance with paragraph 2 of Article 52 of the Building Code of the Republic of Kazakhstan, I ORDER:
1. To approve the attached Rules for maintaining an automated registry in the field of architectural, urban planning and construction activities.
2. Invalidate them:
1) Order of the Minister of Industry and Construction of the Republic of Kazakhstan dated July 31, 2024 No. 283 "On Approval of the Rules for Maintaining, Suspending, Terminating (Revoking) Permits in the Automated Register of Construction Permits" (registered in the Register of State Registration of Regulatory Legal Acts No. 34852);
2) Item 7 to the Order of the Minister of Industry and Construction of the Republic of Kazakhstan dated September 15, 2025 No. 367 "On Amendments and Additions to certain Orders" (registered in the Register of State Registration of Regulatory Legal Acts No. 36866).
3. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Defense of the Republic of Kazakhstan after the day of its first official publication.
4. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.
5. This order will enter into force on July 1, 2026 and is subject to official publication.

Rules for conducting an automated registry in the field of architectural, urban planning and construction activities
Chapter 1. General provisions
1. These Rules for Maintaining an automated registry in the field of architectural, urban planning and construction activities (hereinafter referred to as the Rules) have been developed in accordance with paragraph 2 of Article 52 of the Building Code of the Republic of Kazakhstan and define the procedure for maintaining an automated registry in the field of architectural, urban planning and construction activities.
2. The maintenance of an automated registry in the field of architectural, urban planning and construction activities is carried out in order to:
1) systematization of information on permits of the first and second categories subject to automation through the state digital system;
2) informing individuals and legal entities of the Republic of Kazakhstan about the information contained in the automated register in the field of architectural, urban planning and construction activities.
3. The basic concepts used in these Rules:
1) the holder of a second category permit is a natural or legal person who has a valid second category permit.;
2) personal account is a section of the digital system that contains personal information about the user collected from digital objects of government agencies and other organizations.;
3) licensee – a natural or legal person, as well as a branch of a foreign legal entity, the subject of which is the provision of financial services, licensed;
4) the applicant is an individual or legal entity, a branch or representative office of a legal entity, a licensee, a holder of a second–category permit who has applied to the relevant licensing authority for licensing or a permit procedure, or who has sent a notification;
5) licensing authorities – licensors and bodies authorized to issue permits of the second category;
6) Authorization information – complete authorization information, including all document data and the history of changing the authorization status;
7) permit status – a characteristic of the current status of the permit, which changes as the permitting procedures are carried out.;
8) the automated registry in the field of architectural, urban planning and construction activities (hereinafter referred to as the Registry) is a component of a digital system in the field of architecture, urban planning and construction, integrated with digital objects of government agencies and other organizations, containing information about subjects of architectural, urban planning and construction activities. ;
9) the authorized body for architecture, urban planning and construction (hereinafter referred to as the Authorized Body) is the central executive body responsible for the management, as well as, within its competence, intersectoral coordination in the field of public administration of architectural, urban planning and construction activities.
4. The Registry is divided into the following sections:
1) register of licenses issued for project activities (design), survey activities and construction and installation work;
2) register of accredited legal entities in the field of architectural, urban planning and construction activities.
5. Information is entered into the Register through a digital system in the field of construction, architecture and urban planning.
6. The applicant registers and creates a personal account in the digital system in the field of construction, architecture and urban planning and consents to the collection and (or) processing of personal data contained in digital objects of state bodies and (or) state legal entities.
Chapter 2. The procedure for maintaining an automated registry in the field of architectural, urban planning and construction activities
7. The registry contains the following information:
1) Permission category (first category permission (license), second category permission);
2) Permit class (1 – permits issued for activities);
3) name of the permit;
4) individual identification number/business identification number of the licensee/ permit holder of the second category;
5) surname, first name, patronymic (if any) of the individual / the name of the legal entity – licensee;
6) the address of the individual's place of residence or the location of the legal entity;
7) about engineering and technical workers, if they are included in the licensing (qualification) requirements;
8) about experts, if they are included in the licensing (qualification) requirements;
9) about the production base;
10) about the realized objects (if they are included in the licensing (qualification) requirements;
11) about the material and technical equipment;
12) the date of issue of the permit;
13) Permission status;
14) licensing authority;
15) type of activity, actions (for permits issued for the type of activity, actions);
16) subspecies of activity (for permits for the type of activity that have subspecies of activity);
17) special conditions;
18) the permit identification number (assigned by the System to permits in electronic form);
19) the period of suspension of the permit (for permits for which suspension has been carried out);
20) the basis for revocation (cancellation) of the permit (for permits revoked/cancelled by the licensing authority on the basis of a court decision or in other cases provided for by the laws of the Republic of Kazakhstan).
8. Information specified in the sub-items 1), 2), 3), 4), 5), 6), 7), 8), 9), 10), 11) and 12) of paragraph 7 of these Rules are to be completed for all permits. Information given in the sub-paragraphs 13), 14), 15), 16), 17), 18), 19) and 20) of paragraph 7 of these Rules, are to be filled in if any.
9. The full list of permission information, taking into account specific fields that are not included in the Registry information, can be viewed in the detailed permission information.
10. The State architectural and construction control is carried out by the Registry in the form of checking for compliance with the qualification or licensing requirements for permits issued, the requirements for notifications sent in accordance with the Law of the Republic of Kazakhstan "On Permits and Notifications".
Verification is carried out on an ongoing basis by monitoring information about the subject (object) of control and supervision, including information obtained through integration with digital systems of government agencies and other organizations.
11. In case of detection of violations of the requirements of the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities, based on the results of verification of compliance with the qualification or licensing requirements for permits issued, the requirements for notifications sent, the Registry forms and sends to the subject of control and supervision a notification on the elimination of violations in accordance with Appendix 1 to these Rules to the user's personal accounts on the websitethe portal of the "digital government" and the digital system in the field of construction, architecture and urban planning.
12. In case of non-elimination of violations specified in the notification of elimination of identified violations, prompt response measures are applied in the form of suspension of the permit and (or) the annex to the permit in accordance with Article 50 of the Building Code of the Republic of Kazakhstan, by issuing a resolution on the application of rapid response measures in accordance with Annex 2 to these Rules and sent to user's personal accounts on the web portal of the digital government and the digital system in the field of construction, architecture and urban planning.
13. The suspension, termination (revocation) of permits in the Register is carried out by a digital system in the field of construction, architecture and urban planning in automatic mode or by licensing authorities, based on a court decision or in other cases provided for by the laws of the Republic of Kazakhstan by entering information on the suspension, termination (revocation) of permits.
14. The period of suspension of permits in the Registry is not more than six months.
15. Inclusion and exclusion from the Register is carried out on the grounds provided for by the Building Code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan "On Permits and Notifications".
