On approval of the Rules for logging the actions of users of the Internet portal of open Data

In accordance with paragraph 4 of Article 17 of the Digital Code of the Republic of Kazakhstan, I ORDER:
1. Approve the attached Rules for logging the actions of users of the Open Data Internet portal.
2. The Public Services Committee of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan;
3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Legal Department of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.
3. Control over the execution of this order is entrusted to the supervising Vice Minister of Artificial Intelligence and Digital Development of the Republic of Kazakhstan.
4. This order will enter into force on July 12, 2026 and is subject to official publication.

Rules for logging the actions of users of the Open Data Internet portal
Chapter 1. General provisions
1. These Rules for Logging the actions of Users of the Open Data Internet portal (hereinafter referred to as the Rules) have been developed in accordance with paragraph 4 of Article 17 of the Digital Code of the Republic of Kazakhstan and define the procedure for logging the actions of users of the open Data Internet portal.
2. The following basic concepts are used in these Rules:
1) open data – digital data presented in machine-readable form and intended for free use, processing, republication and dissemination, placed in the public domain;
2) the Internet portal of open data is a government digital resource designed for the centralized placement, description, storage, search, access and reuse of open digital data, as well as the provision of software interfaces for machine access to such data.;
3) components of the Internet portal of open data - operating systems, database management systems, content management systems, application software, telecommunication equipment, anti–virus protection and cybersecurity systems;
4) logging of user actions on the Internet portal of open data (hereinafter referred to as logging) is the process of recording the actions of users of the Internet portal of open data in the event log in the form of digital events;
5) the user of the Internet portal of open data (hereinafter referred to as the user) is an individual or legal entity that provides access to the Internet portal of open data.;
6) software is a digital object, which is a set of codes prepared for use, implementing algorithms that ensure the performance of certain functions, processing, storage, reproduction and (or) transmission of digital data.;
7) the infrastructure of the exact time source is a hierarchically linked server equipment using a network time synchronization protocol that performs the task of synchronizing the internal clocks of servers, workstations, and telecommunications equipment.;
8) event log – a file containing information about digital events of the open data Internet portal, used to monitor its operation and identify the causes of failures in case of their occurrence;
9) digital event – a digitally recorded circumstance that arose as a result of the actions of a subject of the digital environment or the functioning of a digital object and reflects the parameters of their interaction in the digital environment;
10) the digital government operator (hereinafter referred to as the operator) is a legal entity designated by the Government of the Republic of Kazakhstan that ensures the functioning of digital government facilities.
Chapter 2. The procedure for logging the actions of users of the Internet portal of open data
3. The operator provides technical support, cybersecurity, uninterrupted availability, relevance of the posted open data, as well as logging.
4. Logging is performed in an automated mode using software (hereinafter referred to as logging software).
5. To ensure logging, the Operator performs:
setting up the logging software for the list and types of digital events to be logged, defined in the rules for monitoring the cybersecurity of digital government digital facilities and critical digital facilities, approved by the authorized body in the field of cybersecurity in accordance with subparagraph 7) of Article 7-1 of the Law "On Cybersecurity" (hereinafter referred to as the Monitoring Rules) and types of access access to the event logs of the operator's employees, protecting them from deletion, modification and unauthorized viewing;
time synchronization of event logs by connecting the servers of the Internet portal of open data to the infrastructure of the exact time source.
6. The sequence of logging actions:
creation of a digital event at the time of the user's action in the component of the Internet portal of open data;
transformation of a digital event into its structured form according to the Monitoring Rules;
checking the compliance of a digital event with the list and type of events to be logged;
determining the component of an open data Internet portal in whose event log it is necessary to record a digital event;
writing to the event log.
7. According to the results of logging, the operator:
Performs weekly event logs review and analysis in order to filter and search for failure events and/or cybersecurity violations.;
performs weekly backup and archiving of event logs;
ensures the physical safety and storage of event logs for at least three years in archived form and in online access for at least two months.
