On approval of the Standard of medical care in the field of traditional medicine in the Republic of Kazakhstan

In accordance with subparagraph 32) of Article 7 of the Code of the Republic of Kazakhstan "On the Health of the people and the healthcare system", I ORDER:

     1. To approve the attached Standard of Medical Care in the field of traditional medicine in the Republic of Kazakhstan (hereinafter referred to as the Standard).

     2. The Department of Medical Care Organization of the Ministry of Health of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Health of the Republic of Kazakhstan after its official publication;

     3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, provision to the Legal Department of the Ministry of Health of the Republic of Kazakhstan of information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Health of the Republic of Kazakhstan.

     4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

     To establish that from July 12, 2026, subparagraph 14) of paragraph 2, paragraph 16, subparagraph 3) of paragraph 18 of the Standard is valid as follows:

     "14) the medical digital system (hereinafter referred to as the MTSS) is a digital system that ensures the management of processes of healthcare entities in a digital format;";

     "16. Information on the provision of medical services using traditional medicine methods is documented in the MCC. Healthcare entities ensure the maintenance of medical records and the submission of reports in accordance with the order of the Minister of Health of the Republic of Kazakhstan dated December 10, 2020 No. KR DSM-244/2020 "On Approval of the rules for maintaining primary medical records and Reporting" (registered in the Register of State Registration of Regulatory Legal Acts under No. 21761) in accordance with the forms approved by the order of the Acting Minister of Health Of the Republic of Kazakhstan dated October 30, 2020 No. KR-DSM -175/2020 "On approval of forms of accounting documentation in the field of healthcare, as well as instructions for completing them" (registered in the Register of State Registration of Regulatory Legal Acts under No. 21579) (hereinafter referred to as Order No. KR–DSM 175/2020) and Order of the Minister of Health of the Republic of Kazakhstan dated December 22, 2020 No. KR DSM-313/2020 "On approval of forms of accounting documentation in the field of healthcare" (registered in the Register of State Registration of Regulatory Legal Acts under No. 21879) (hereinafter referred to as Order No. KR DSM-313/2020).";

     "3) entering information into the MCC and maintaining medical records in accordance with Orders No. KR DSM-175/2020 and No. KR DSM-313/2020;".

The standard of medical care in the field of traditional medicine in the Republic of Kazakhstan

Chapter 1. General provisions

     1. This standard of medical care in the field of traditional medicine in the Republic of Kazakhstan (hereinafter referred to as the Standard) has been developed in accordance with Article 132 of the Code of the Republic of Kazakhstan "On Public Health and the Healthcare System" (hereinafter referred to as the Code) and establishes general requirements for the organization of medical services using traditional medicine methods in the Republic of Kazakhstan.

     2. Terms and definitions used in this Standard:

     1) antiseptics – a set of methods for destroying or suppressing the vital activity of potentially dangerous microorganisms on the skin, mucous membranes, wounds and cavities of the patient in order to provide treatment and prevent the development of the infectious process;

     2) asepsis is a set of methods aimed at preventing pathogens from entering the patient's skin, wound and cavities during operations, medical and diagnostic procedures.;

     3) specialized specialist – a medical professional with higher medical education, who has a certificate in the field of healthcare;

     4) hirudotherapy is a method of treating traditional medicine with medical leeches and medicinal preparations from leeches;

     5) homeopathy is a method of treating traditional medicine with small doses of homeopathic medicines;

     6) traditional medicine is a set of codified methods of prevention, diagnosis, treatment and rehabilitation based on the centuries–old traditions of traditional medicine and approved for medical use.;

     7) the certificate of a specialist in the field of healthcare is a standard document confirming the level of qualification of an individual and his readiness for professional activity in the field of healthcare, including readiness for clinical or pharmaceutical practice, or activities in the field of sanitary and epidemiological welfare of the population.;

     8) healthcare entities – healthcare organizations, as well as individuals engaged in private medical practice and pharmaceutical activities;

     9) invasive methods – diagnostic and treatment methods carried out by penetrating into the internal environment of the human body;

     10) clinical protocol (hereinafter referred to as KP) – scientifically proven recommendations for prevention, diagnosis, treatment, medical rehabilitation and palliative care for a particular disease or condition of the patient;

     11) license – a first-category permit issued by the licensor to an individual or legal entity, as well as to a branch of a foreign legal entity whose business is the provision of financial services, to carry out a licensed type of activity or a subspecies of a licensed type of activity associated with a high level of danger;

     12) manual therapy is a method of treating traditional medicine using manual intervention aimed at correcting pathobiomechanical changes in the musculoskeletal system and pathogenetically related visceral, cerebrospinal and cerebral disorders;

     13) medical worker – an individual who has a professional medical education and carries out medical activities;

     14) medical information system (hereinafter referred to as MIS) is an information system that ensures the management of processes of healthcare entities in electronic format;

     15) quality of medical care – the level of compliance of the provided medical care with the standards of medical care;

     16) patient – an individual who is (has been) a consumer of medical services, regardless of the presence or absence of a disease or condition requiring medical care.;

     17) prevention is a complex of medical and non–medical measures aimed at preventing the occurrence of diseases, the progression of diseases in the early stages and the control of complications that have already developed, damage to organs and tissues.;

     18) reflexotherapy is a group of traditional medicine treatment methods based on mechanical, thermal and other irritation of biologically active points on the body surface, the effect on which causes reflex reactions of various organs and body systems;

     19) phytotherapy is a branch of traditional medicine that develops and applies methods of treatment with natural herbal medicines;

     20) informed consent is a procedure for a person to voluntarily confirm in writing their consent to receive medical care and/or participate in a specific study after receiving information about all aspects of medical care and/or research that are relevant to their decision—making.

     3. Medical services using traditional medicine methods are provided by healthcare entities, regardless of their form of ownership and departmental affiliation, if they have a license to carry out medical activities under the subspecies of "Traditional Medicine" in accordance with the Law of the Republic of Kazakhstan "On Permits and Notifications".

     4. The activities of facilities providing medical services using traditional medicine methods are carried out in accordance with the Order of the Minister of Health of the Republic of Kazakhstan dated August 11, 2020 No. KR DSM-96/2020 "On Approval of Sanitary Rules "Sanitary and Epidemiological requirements for Healthcare facilities" (registered in the Register of State Registration of Regulatory Legal Acts under No. 21080) (hereinafter – Order No. KR DSM-96/2020) and with the requirements of state standards in the field of architecture, urban planning and construction.

5. Medical services using traditional medicine methods are provided to the population by a specialist with higher medical education and/or with a multidisciplinary specialization in "Traditional medicine (reflexology)", "Traditional medicine (Manual therapy)", "Traditional medicine (Su-jok therapy)", "Traditional medicine (Homeopathy)", "Traditional medicine (Hirudotherapy)", "Traditional medicine (Phytotherapy)" in accordance with the Order of the Minister of Health of the Republic of Kazakhstan dated November 30, 2020 No. KR DSM-218/2020 "On approval of the list of specialties and specializations, healthcare professionals subject to certification" (registered in the Register of State Registration of Regulatory Legal Acts under No. 21699) and a specialist's certificate in the specialty "Traditional therapy (reflexology, manual therapy, su-jok therapy, homeopathy, hirudotherapy, phytotherapy) and "Traditional Medicine".

     6. Medical personnel practicing traditional medicine methods undergo mandatory and periodic medical examinations, in accordance with the order of the Acting Minister of Health of the Republic of Kazakhstan dated October 15, 2020 No. KR DSM-131/2020 "On approval of target groups of persons subject to mandatory medical examinations, as well as the rules and frequency of their conduct, the volume of laboratory and functional research, medical contraindications, a list of harmful and (or) dangerous production factors, professions and jobs, in the course of which preliminary mandatory medical examinations are carried out upon admission to work and periodic mandatory medical examinations and rules for the provision of public services "Passing preliminary mandatory medical examinations" (registered in the Register of State Registration of Regulatory Legal Acts under No. 21443).

     7. Medical services using traditional medicine methods are provided to the population: in outpatient clinics, inpatient replacement and inpatient conditions of healthcare organizations and sanatorium-resort organizations on a paid basis in accordance with the Order of the Minister of Health of the Republic of Kazakhstan dated October 29, 2020 No. KR DSM-170/2020 "On approval of the rules for the provision of paid services by healthcare entities and the standard form of the contract for the provision of paid medical services (assistance)" (registered in the Register of State Registration of Regulatory Legal Acts under No. 21559).

Chapter 2. The structure of organizations, the main tasks and areas of activity of organizations providing medical care in the field of traditional medicine

     8. Healthcare entities, regardless of the form of ownership, licensed for medical activities, organize traditional medicine rooms for the provision of medical services using traditional medicine methods, depending on the profile of traditional medicine (rooms for reflexology, manual therapy, hirudotherapy, homeopathy, phytotherapy and natural remedies).

     9. Medical services using traditional medicine methods are provided in outpatient, inpatient and inpatient replacement healthcare organizations at the primary, secondary and tertiary levels of medical care and sanatorium-resort organizations, regardless of the form of ownership and departmental affiliation.

     10. The main tasks of healthcare entities providing medical services using traditional medicine methods are:

     1) providing safe and high-quality medical care using traditional medicine methods;

     2) providing medical care to the population using traditional medicine methods in accordance with approved clinical protocols;

     3) disease prevention, health promotion and improvement of the adaptive capabilities of the patient's body using traditional medicine methods;

     4) the use of traditional methods in the complex treatment of diseases and rehabilitation;

     5) respect for patients' rights, information about traditional medicine methods, contraindications and possible treatment results;

     6) training and professional development of specialists;

     7) carrying out information and educational work among the population;

     8) compliance with sanitary and epidemiological requirements and standards of medical activity.

Chapter 3. The procedure for providing medical care in the field of traditional medicine

     11. Medical services using traditional medicine methods in outpatient settings are provided in accordance with the order of the Minister of Health of the Republic of Kazakhstan dated April 27, 2022 No. KR DSM-37 "On approval of the rules for the provision of specialized medical care in outpatient settings" (registered in the Register of State Registration of Regulatory Legal Acts under No. 27833) (hereinafter – Order No. KR DSM-37).

     The following medical services may be provided on an outpatient basis using traditional medicine methods:

     Reflexology;

     manual therapy;

     hirudotherapy;

     Homeopathy;

     phytotherapy and natural remedies.

     In order to receive medical services using traditional medicine methods, a specialized specialist, in accordance with clinical protocols, if there are indications and no contraindications, directs the patient to a specialist in traditional medicine in accordance with the procedure provided for by Order No. KR DSM-37.

     When performing procedures, a specialist in traditional medicine, in accordance with the profile of traditional medicine, ensures compliance with sanitary and epidemiological requirements, including the use of sterile consumables, the procedure for collecting, neutralizing, storing medical waste, compliance with safety standards, prevention of complications and maintenance of medical records.

     12. Medical services in the field of traditional medicine in hospital-substituting conditions are provided in accordance with the Order of the Minister of Health of the Republic of Kazakhstan dated June 7, 2023 No. 106 "On approval of the standard of medical care in hospital-substituting conditions in the Republic of Kazakhstan" (registered in the Register of State Registration of Regulatory Legal Acts under No. 32740) (hereinafter – Order No. 106).

     In hospital-substituting conditions, it is allowed to provide the following medical services using traditional medicine methods:

     Reflexology;

     manual therapy;

     hirudotherapy;

     Homeopathy;

     phytotherapy and natural remedies.

     In order to receive medical services using traditional medicine methods, a specialized specialist, in accordance with clinical protocols, if there are indications and no contraindications, directs the patient to a specialist in traditional medicine in accordance with the procedure provided for by Order No. 106.

     13. Medical services in the field of traditional medicine in inpatient settings are provided in accordance with the Standard for the Organization of Medical Care in Inpatient Settings in the Republic of Kazakhstan, approved by Order of the Minister of Health of the Republic of Kazakhstan dated March 24, 2022 No. KR DSM-27 (registered in the Register of State Registration of Regulatory Legal Acts under No. 27218) (hereinafter - Order No. KR DSM-27).

     In inpatient settings, the following medical services can be provided using traditional medicine methods:

     Reflexology;

     manual therapy;

     hirudotherapy;

     Homeopathy;

     phytotherapy and natural remedies.

     In order to receive medical services using traditional medicine methods, a specialized specialist, in accordance with clinical protocols, if there are indications and no contraindications, directs the patient to a specialist in traditional medicine in accordance with the procedure provided for by Order No. KR DSM-27.

     14. Medical services in the field of traditional medicine in sanatorium-resort organizations are provided in accordance with Order No. KR DSM-27.

     The following medical services may be provided by traditional medicine methods in sanatorium-resort organizations:

     Reflexology;

     manual therapy;

     hirudotherapy;

     Homeopathy;

     phytotherapy and natural remedies.

     In order to receive medical services using traditional medicine methods, a specialized specialist, in accordance with clinical protocols, if there are indications and no contraindications, directs the patient to a specialist in traditional medicine in accordance with the procedure provided for by Order No. KR DSM-27.

     15. Medical services using traditional medicine methods are provided in accordance with clinical protocols approved by the Joint Commission on Quality of Medical Services of the Ministry of Health of the Republic of Kazakhstan.

     16. Information on the provision of medical services using traditional medicine methods is documented in the IIA. Healthcare entities ensure the maintenance of medical records and the submission of reports in accordance with the order of the Minister of Health of the Republic of Kazakhstan dated December 10, 2020 No. KR DSM-244/2020 "On Approval of the rules for maintaining primary medical records and Reporting" (registered in the Register of State Registration of Regulatory Legal Acts under No. 21761) in accordance with the forms approved by the order of the Acting Minister of Health Of the Republic of Kazakhstan dated October 30, 2020 No. KR-DSM -175/2020 "On approval of forms of accounting documentation in the field of healthcare, as well as instructions for completing them" (registered in the Register of State Registration of Regulatory Legal Acts under No. 21579) (hereinafter referred to as Order No. KR–DSM 175/2020) and Order of the Minister of Health of the Republic of Kazakhstan dated December 22, 2020 No. KR DSM-313/2020 "On approval of forms of accounting documentation in the field of healthcare" (registered in the Register of State Registration of Regulatory Legal Acts under No. 21879) (hereinafter referred to as Order No. KR DSM-313/2020).

17. The provision of medical services using traditional medicine methods is carried out after receiving the informed consent of the patient in accordance with the form approved by Order No. KR-DSM -175/2020.

     18. A doctor of traditional medicine, in accordance with the profile of the traditional medicine method, performs:

     1) conducting a medical examination, determining indications and contraindications for procedures in the field of traditional medicine;

     2) carrying out procedures in accordance with the profile of traditional medicine in compliance with sanitary requirements, rules of asepsis and antisepsis;

     3) entering information into the IIA and maintaining medical records in accordance with Orders No. KR DSM-175/2020 and No. KR DSM-313/2020;

     4) informing the patient about possible risks, contraindications and alternative treatment methods;

     5) obtaining the informed consent of the patient or his legal representative to receive the procedures.

     19. Medical services using traditional medicine methods are provided according to the profile of traditional medicine in compliance with safety standards, including conducting and monitoring the safety of invasive traditional medicine methods during hirudotherapy and reflexology in order to protect the life and health of patients, prevent infectious and other adverse effects.

     20. Sanitary and epidemiological requirements for the maintenance of premises and procedures:

     1) methods of traditional medicine involving violation of the integrity of the skin, multiple punctures of the skin for medicinal purposes, and contact with the patient's biological fluids (hirudotherapy, acupuncture, acupuncture) are carried out in rooms that comply with the requirements of Order No. KR DSM-96/2020;

     2) medical personnel are required to comply with the rules of asepsis and antisepsis in accordance with the requirements of the Order of the Minister of Health of the Republic of Kazakhstan dated December 2, 2022 No. KR DSM- 151 "On approval of Sanitary Rules "Sanitary and epidemiological requirements for the organization and conduct of sanitary and anti-epidemic, sanitary and preventive measures to prevent infections related to the provision of medical care" (registered in the Register of State Registration of Regulatory Legal Acts under No. 30928) (hereinafter – Order No. KR DSM-151), use personal protective equipment, keep records of the use of biomaterials and needles, and be responsible for compliance with infection safety requirements.

     21. Requirements for ensuring infectious and biological safety during reflexotherapy:

     1) for carrying out procedures, it is allowed to use only sterile disposable needles of industrial manufacture with a registration certificate and a quality document.;

     2) Reuse of needles is not allowed;

     3) before starting the procedure, the specialist must: treat the hands in accordance with current sanitary requirements; ensure antiseptic treatment of the patient's skin in the needle insertion area; check the integrity of the packaging and sterility of the instruments;

     4) after completion of the procedure, all used needles must be collected in containers for safe collection and disposal of medical waste, exported and further disposed of by specialized organizations.;

     5) all medical procedures related to the violation of the integrity of the skin and mucous membranes are carried out in sterile disposable gloves. The repeated use of the same pair of disposable gloves in contact with more than one patient or after their treatment is unacceptable.;

     6) the use of single-use medical gloves is carried out in accordance with the requirements of Order no. KR DSM-151;

     7) hand hygiene of medical personnel performing medical manipulations is carried out taking into account the algorithm of hand treatment of employees of healthcare entities in accordance with the requirements of Order No. KR DSM-151.

     22. Requirements for ensuring infectious and biological safety during hirudotherapy:

     1) the use of medical leeches is allowed for hirudotherapy.;

     2) the storage conditions of leeches should ensure their viability and safety, including: maintenance in a separate room or a dedicated area; use of containers with running or regularly updated water; keeping a log of receipt, storage and use;

     3) medical leeches are living biological objects used in the provision of medical services by the method of hirudotherapy and are not subject to reuse;

     4) leeches after application are disposed of in accordance with the accepted scheme for the treatment of medical waste of class "B" in accordance with order No. KR DSM-96/2020;

     5) the specialist is obliged to ensure that used leeches do not come into contact with the environment and personnel.;

     6) all medical procedures related to the violation of the integrity of the skin and mucous membranes are carried out in sterile disposable gloves. The repeated use of the same pair of disposable gloves in contact with more than one patient or after their treatment is unacceptable.;

     7) the use of single-use medical gloves is carried out in accordance with the requirements of Order no. KR DSM-151;

     8) hand hygiene of medical personnel performing medical manipulations is carried out taking into account the algorithm of hand treatment of employees of healthcare entities in accordance with the requirements of Order No. KR DSM-151.

     23. The use of traditional medicine methods is prohibited as the only method of treatment (monotherapy) for conditions requiring urgent care, oncology, infections, acute mental illnesses. If the patient refuses evidence-based medicine methods, introduce a mandatory consultation and informed written refusal of the patient.

     24. If the patient refuses the proposed treatment using traditional medicine methods, the specialist issues an informed written refusal of the patient, which is filed in the medical documentation and registered in accordance with the established procedure.

Chapter 4. Recommended staff and equipment of medical devices in the field of traditional medicine

     25. The recommended staff of healthcare organizations providing medical services using traditional medicine methods in the field of traditional medicine is carried out in accordance with the appendix to this Standard.

     26. The recommended equipment of medical devices for healthcare organizations providing medical services using traditional medicine methods in the field of traditional medicine is carried out in accordance with the appendix to this Standard.
