On the approval of the Standard Rules for the improvement of the territories of cities and settlements

 In accordance with subparagraph 62) of Article 24 of the Building Code of the Republic of Kazakhstan, I ORDER:

     1. To approve the Standard Rules for the improvement of the territories of cities and settlements in accordance with Appendix 1 to this order.

     2. To invalidate the orders in accordance with Appendix 2 to this order.

     3. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after the day of its first official publication.

     4. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

     5. This order will enter into force on July 1, 2026 and is subject to official publication.

Standard rules and regulations for the territories of cities and towns

Chapter 1. General provisions

     1. These Model Rules for Landscaping the Territories of Cities and Settlements (hereinafter referred to as the Model Rules) have been developed in accordance with subparagraph 62) of Article 24 of the Building Code of the Republic of Kazakhstan and define the procedure for landscaping the territory of settlements for all legal entities, regardless of their legal status and forms of economic activity, individuals, as well as officials responsible for for the improvement of courtyards and public areas.

     2. These Model Rules aim to create a safe, comfortable, convenient, environmentally friendly and attractive urban environment conducive to the integrated and sustainable development of territories in human settlements.

     3. Basic concepts used in the Standard Rules:

     1) landscaping - a set of measures aimed at improving the comfort of citizens' living through proper maintenance of the sanitary, ecological and aesthetic condition of the adjacent territory and common areas of cities and towns, providing for a set of works on engineering training and ensuring the safety of the territory, road construction, development of communication networks and water supply facilities, sewerage, energy supply, coating, lighting, placement small architectural forms and objects of monumental art, reducing noise levels, improving the microclimate, protection from pollution of the air basin, open reservoirs and soil, clearing, cleaning, sanitary cleaning and landscaping of the territory;

     2) objects of landscaping - territories of a locality where landscaping activities are carried out:

     playgrounds, courtyards, blocks, functional planning formations, territories of city districts, as well as territories allocated according to the principle of unified urban planning regulations (security zones) or visual and spatial perception (an area with buildings, a street with adjacent territory and buildings), other territories of the settlement;

     3) participants in the improvement of territories - a natural or legal person who, on the basis of a contract, carries out activities in the field of landscaping on the territory of a locality;

     4) landscaping elements - decorative, technical, planning, structural devices, landscaping elements, various types of equipment and decoration, including facades of buildings, structures, structures, small architectural forms, non-capital non-stationary structures and structures, information boards and signs used as integral parts of landscaping;

     5) maintenance of the landscaping object - maintenance of the landscaping objects and their individual elements in proper technical, physical, and aesthetic condition;

     6) flower garden - an area of geometric or free-form with planted one-, two- or perennial plants.;

     7) earthworks - a complex of construction works, including excavation (development) of soil, its movement, laying with leveling and compaction of soil, as well as preparatory work related to the clearing of the territory, related work (including the layout of areas, slopes, webs of excavation and embankments, finishing of the canvas, installation of ledges along the slopes (at the base) of embankments, drilling holes with crane machines, filling the sinuses of pits);

     8) individual residential building – a detached building intended for personal (family) living, with a height of no more than three floors, taking into account the attic and ground floor, owned by an individual along with household and other buildings and green spaces;

     9) storage bin is a standard container for collecting bulky waste and other waste from production and consumption in accordance with the regulations.;

     10) road - the entire strip of land or the surface of an artificial structure, equipped or adapted and used for the movement of vehicles and pedestrians. A road includes one or more carriageways, as well as tram tracks, sidewalks, roadsides, and dividing lanes, if any.;

     11) container - a multi-purpose universal transport equipment designed for the transportation of goods;

     12) container sites – special sites for the accumulation of waste, on which containers for the collection of solid household waste are placed, with access roads for specialized vehicles transporting solid household waste.;

     13) lawn - an element of landscaping (a piece of land), including a grassy cover and other plants, fenced off from the sidewalk, parking pockets, parking lots and other road elements with a curb stone and (or) decorative fencing;

     14) landscaping – parks, squares, boulevards, linear plantings, house plantings, lawns, flower beds located within the boundaries of settlements on public lands;

     15) the adjacent land plot of an apartment building (hereinafter referred to as the adjacent land plot) is a land plot adjacent to an apartment building and intended for landscaping, landscaping, sports, playgrounds, access roads, parking lots, sidewalks, small architectural forms;

     16) street - an area intended for the movement of vehicles and pedestrians, including a roadway, roadsides, ditches and reinforcing berms;

     17) facade - the exterior (front) side of buildings (structures);

     18) common areas are territories, facilities that are accessible or open to the public;

     19) passage – an element of the road that provides access for vehicles to residential and public buildings, institutions, enterprises, and development facilities within neighborhoods, neighborhoods, and settlements;

     20) sidewalk - an element of the road intended for the movement of pedestrians, adjacent to the carriageway or separated from it by a lawn or ditch system;

     21) temporary structures - residential, cultural, household and other buildings and structures for servicing builders, access roads, roads, warehouses, pumping stations, substations, concrete-mortar units, engineering networks and industrial facilities necessary for construction and installation work, usually eliminated upon completion of construction;

     22) low–mobility groups of the population - elderly people, people with disabilities, people who have difficulty moving independently, receiving services, information or navigating in space, including those using baby strollers and (or) wheelchairs;

     23) small architectural forms – objects of a decorative nature and practical use (sculptures, with the exception of monumental art structures, installed to perpetuate the memory of outstanding personalities, significant historical events, fountains, flower vases, pavilions, gazebos, benches, urns, equipment and structures for children's games and adult recreation);

     24) adjacent territory – an area (within 5 meters along the perimeter) directly adjacent to the boundaries of a building, structure, fence, construction site, retail, advertising and other facilities owned, owned, leased, on the balance sheet of legal entities or individuals.

Chapter 2. The standard procedure of improvement of territories of cities and settlements

Paragraph 1. Elements of complex and organizational work on improvement of territories of cities and settlements

     4. The elements of landscaping include:

     1) small architectural forms;

     2) elements of landscaping;

     3) types of coatings;

     4) fences;

     5) utility equipment - devices for street lighting, bins and trash containers, bicycle parking;

     6) works of monumental and decorative art – sculptures, steles, with the exception of buildings of monumental art, installed to perpetuate the memory of outstanding personalities, significant historical events, decorative compositions, obelisks, works of monumental painting;

     7) information signs - full houses (signs of names of streets, squares, embankments, bridges), license plates of houses, information stands, billboards with schemes of addressing building blocks, neighborhoods;

8) commemorative and information boards (signs);

     9) signs of protection of historical and cultural monuments, zones of specially protected territories;

     10) holiday decoration elements.

     5. The presence of elements of landscaping, which are integral components of landscaping facilities, is developed and provided for in the design documentation for the creation, modification (reconstruction) of landscaping facilities in the urban environment. The person who prepares the project documentation organizes and coordinates the work on the preparation of the project documentation, ensures the quality of the project documentation and its compliance with the requirements of technical regulations and standards of urban planning design.

     6. The main requirements for small architectural forms are:

     1) compliance with the nature of the architectural and landscape environment of the landscaping elements of the territory;

     2) high decorative and operational qualities of materials, their preservation over a long period of time, taking into account the effects of the external environment;

     3) durability, reliability, and safety of the structure.

     7. Basic requirements for benches:

     1) availability of backs for benches in recreational areas;

     2) the presence of backs and handrails for benches in courtyard areas;

     3) the absence of backs and handrails for benches in transit areas.

     The installation of benches must be provided for on solid types of pavement or foundation. Benches may be installed on soft surfaces in recreation areas, forest parks, and playgrounds. If there is a foundation, its parts are not protruding above the ground surface. The surfaces of the bench for relaxation are made of wood, with various types of waterproof treatment.

     8. Basic requirements for flower pots (flowerpots), including mounted ones:

     1) planters are displayed only at existing facilities;

     2) flower pots have sufficient height to prevent accidental car collisions and debris;

     3) flower pots and planters should be stored indoors in winter or replaced with coniferous plants or other plant decorations.

     9. Basic requirements for fences:

     1) Sufficient strength to protect pedestrians from being hit by cars;

     2) modularity, the ability to create structures of any shape;

     3) Reflective elements where accidental car impact is possible.

     10. The organization of landscaping includes the development of project documentation for landscaping, the implementation of landscaping activities and the maintenance of landscaping facilities.

     11. Participants in landscaping activities are, among others:

     1) local executive bodies that form the terms of reference, select the contractor (general contractor) in accordance with the legislation of the Republic of Kazakhstan on public procurement and provide financing;

     2) individuals and legal entities operating in the territory of a locality who participate in the formation of a request for landscaping, as well as in financing landscaping activities;

     3) contractors (general contractors), including construction and installation organizations (enterprises/companies), manufacturers of small architectural forms and other subjects of architectural, urban planning and construction activities.

     12. The infrastructure and landscaping of the territories of the settlement is being developed taking into account the priority of pedestrians, public and bicycle transport, and irrigation ditch systems.

     13. The design, construction and operation of landscaping facilities for various functional purposes ensure compliance with the requirements for protecting and maintaining the health of every person, protecting the historical and natural environment, creating technical opportunities for the unhindered movement of low-mobility groups of the population, ensuring fire safety, and the operation of the irrigation system.

     14. Landscaping, maintenance and cleaning of the territories of a settlement is carried out by the owners of land plots or participants in landscaping on the basis of contracts, unless otherwise provided by civil legislation or an agreement.

     15. Participants in the improvement of territories carry out works on the improvement, maintenance and cleaning of the settlement, as well as organizes the cleaning of adjacent territories, with the exception of land plots owned by individuals and legal entities by right of ownership.

     16. Improvement of the settlement is provided:

     1) participants in landscaping;

     2) individuals and legal entities engaged in the improvement, maintenance and operation of territories belonging to them by right of ownership or other right, courtyard, house territories and participating in the improvement of adjacent territories, unless otherwise provided by civil legislation or contract.

     17. The local executive body decides on the issues of landscaping and exterior design of public places.

     18. Special territories marked with signs are defined for walking pets in a locality.

     19. Pet owners clean up the excrement of pets.

     20. Individuals and legal entities engaged in economic activities on the territory of a locality related to the organization of markets (warehouses), funeral services (in cemeteries), and construction (on construction sites for the construction period); related to public events, public visits to stationary shopping facilities, stationary catering facilities and seasonal cafes, social and communal facilities, gas stations, parking lots, car washes, car service stations, temporary attractions, mobile zoos, parks of culture and recreation, recreation areas and beaches, itineraries transportation at the end points of regular urban transportation routes, as well as garage cooperatives, objects of religious significance ensure the availability and functioning of stationary toilets, in the absence of sewerage, portable toilets for both employees and visitors. The construction and use of cesspools at these facilities is not allowed.

     21. Public stationary toilets and bio toilets are kept in good condition in accordance with sanitary and epidemiological requirements.

     Sanitary and technical condition of toilets is provided by the owners, owners, tenants or specialized organizations that maintain them.

     22. Bins are installed in all squares and streets, squares and parks, stadiums, train stations, markets, bus stops, enterprises, shopping facilities, cinemas, kiosks and other facilities in accordance with regulatory legal acts in the field of sanitary and epidemiological welfare of the population.

     23. Bins are cleaned as they are filled, and in places of mass movement and large concentrations of citizens - at least once a day. Urn repairs are carried out as needed, but at least once a year. The urns are kept in good condition and in a painted form. Overflow of bins is not allowed.

     24. The organizers of mass events ensure the cleaning of the venue, the territories adjacent to it and the restoration of landscaping that they have disrupted.

     25. Individuals and legal entities who own buildings (premises in them), buildings, structures, including temporary structures, as well as those who own a land plot by right of ownership, other right, or lease right, maintain (beautify) the adjacent territory independently or through the involvement of organizations at their own expense.

Paragraph 2. Contents on improvement of territories of cities and settlements

Section 1. Organization of events for the maintenance of territories

     26. The content of the territories includes:

     1) daily cleaning of debris, foliage, snow and ice (ice);

     2) treatment of roadways, bridges, streets, sidewalks, driveways, and pedestrian areas with anti-icing materials;

     3) Raking and sweeping snow;

     4) removal of snow and ice (snow and ice formations);

     5) maintenance and cleaning of roads and other objects of the road network;

     6) installation and maintenance of clean and technically sound container sites, storage bunkers, containers for all types of waste, trash cans, benches, small architectural forms, etc.;

     7) cleaning, washing and disinfection of waste collection chambers, containers, storage bins and container sites;

     8) installation and maintenance of stationary toilets and bio toilets in a clean and technically sound condition and their functioning as intended;

     9) drainage of rain and meltwater;

     10) collection and removal of garbage, waste and MSW;

     11) removal of animal corpses from transport infrastructure facilities;

     12) watering the territory to reduce dust formation and humidify the air, including driveways, roads, sidewalks;

     13) ensuring the safety of green spaces and their care;

     14) restoration of territories after construction, repair, excavation and other works;

     15) restoration of damaged landscaping elements after the construction, reconstruction and repair of communal facilities, communications (structures), roads, railways, bridges, pedestrian crossings, restoration and archaeological work and other excavation work;

     16) cleaning of drainage ditches (ditch system) in the adjacent territories of private households, public areas;

1) participants in landscaping;

     2) individuals and legal entities engaged in the improvement, maintenance and operation of territories belonging to them by right of ownership or other right, courtyard, house territories and participating in the improvement of adjacent territories, unless otherwise provided by civil legislation or contract.

     17. The local executive body decides on the issues of landscaping and exterior design of public places.

     18. Special territories marked with signs are defined for walking pets in a locality.

     15) restoration of damaged landscaping elements after the construction, reconstruction and repair of public utilities, communications (structures), roads, railways, bridges, pedestrian crossings, restoration and archaeological work and other excavation work;

     16) cleaning of drainage ditches (ditch system) in the adjacent territories of private households, public areas;

     17) maintenance of unfinished construction sites and fences surrounding construction sites in good condition. Construction-in-progress facilities that are not being worked on are covered with construction nets or decorative banners or advertising banners.

Section 2. Organization of events for the maintenance of streets and roads

     27. Maintenance of streets and roads, driveways, access roads to courtyards, sidewalks (pedestrian areas), bridges and overpasses includes a range of seasonal activities that ensure the cleanliness of the carriageway of streets and roads, sidewalks and other road structures, as well as safe conditions for traffic and pedestrians. Road maintenance includes a complex of works that result in maintaining the transport and operational condition of the road, road structures, right-of-way, elements of road construction, organization and safety of traffic that meet the requirements of Traffic Regulations, Basic provisions for the admission of vehicles to operation, a list of operational and special services, the transport of which is subject to special equipment using light and sound signals and coloring according to special color schemes, approved by the Order of the Minister of Internal Affairs of the Republic of Kazakhstan dated June 30, 2023 No. 534 (registered in the Register of State Registration of Regulatory Legal Acts No. 33003).

     28. The maintenance of road territories includes:

     1) routine repairs of roads, sidewalks, and artificial structures;

     2) daily cleaning of dirt, debris, snow and ice from sidewalks (pedestrian areas) and carriageways of roads, streets and bridges;

     3) washing and watering of road surfaces;

     4) lawn and green space maintenance;

     5) maintenance of street lighting poles and contact network;

     6) repair and painting of small architectural forms;

     7) repair and cleaning of inspection wells, ditches, rain wells, storm sewers, upland ditches and open trays that are part of artificial structures.

     29. Observation and rain-receiving wells, wells of underground utilities, hatches (grilles), and the irrigation system are kept in a closed and serviceable condition, ensuring safe movement of vehicles and pedestrians.

     The maintenance, cleaning and maintenance in good technical condition of reception, dead-end, inspection and other wells and chambers are provided by their owners.

     30. Destroyed covers and gratings of wells, open wells within one hour, unless otherwise established by applicable law, are protected by the owners of engineering networks, as well as organizations (enterprises) carrying out construction and installation work, with appropriate warning signs and are replaced within no more than five hours. The presence of open hatches, as well as potholes, subsidences and sinkholes along the outer edge of the well within a radius of one meter from the outer edge of the well cover (grate) is not allowed.

Section 3. Organization of events for the maintenance of individual residential buildings

     31. Owners of individual residential buildings:

     1) ensure the proper condition of building facades, fences and fences, as well as other structures within land use. Timely maintenance and painting are carried out.;

     2) have a license plate on the apartment building and maintain it in good condition;

     3) keep the land plot in order within the established boundaries and ensure proper sanitary condition of the adjacent territory, clean it of debris, mowing of weeds and quarantine vegetation;

     4) keep the green spaces located on them in a healthy state and ensure their safety, protection and maintenance at their own expense within the land use, do not allow tree planting in the protected area of gas pipelines, cable and overhead power transmission lines and other engineering networks;

     5) do not allow cluttering of the adjacent territory with production and consumption waste.

     32. Owners of individual residential buildings are not allowed to store construction materials, fuel, fertilizers, manure and slurry storage and other movable items such as motor vehicles, trailers, carts in the adjacent territory.

Section 4. Organization of measures for the maintenance of facades of buildings, structures and fences

33. The owners of buildings and structures ensure their proper maintenance and operation, including the timely repair and painting of buildings, structures, and their facades, as well as the maintenance of commemorative plaques, street signs (including alleys, squares), license plates, and signage located on the facades. and information signs.

     34. Buildings and structures whose facades define the architectural appearance of the existing urban development include all those located on the territory of a locality (operated, under construction, reconstructed, or under major repair).:

     1) administrative and socio-cultural buildings;

     2) apartment buildings and residential buildings;

     3) industrial buildings and structures;

     4) light-weight buildings (shopping malls, kiosks, garages and other similar facilities);

     5) fences and other stationary architectural forms located on land plots adjacent to buildings.

     35. The elements of the facades of buildings to be maintained include:

     1) pits, entrances to basements and garbage storage rooms;

     2) entrance nodes, groups (including steps, platforms, railings, canopies over the entrance, fences, walls, doors);

     3) plinth and blind area;

     4) Wall planes;

     5) protruding facade elements (including balconies, loggias, bay windows, cornices);

     6) roofs, including ventilation and chimneys, including fencing grilles, exits to the roof;

     7) Architectural details and cladding;

     8) downpipes, funnels;

     9) fencing of balconies, loggias;

     10) parapet and window fences, grilles;

     11) metal finishing of windows, balconies, belts, plinth projections, overhangs;

     12) hinged metal structures (including flag holders, anchors, fire escapes, ventilation equipment);

     13) horizontal and vertical seams between panels and blocks (facades of large-panel and large-block buildings);

     14) glass, frames, balcony doors;

     15) stationary fences adjacent to buildings.

     36. Violations detected during the operation of facades of buildings and structures are eliminated in accordance with the established standards of the Technical Regulations "On the Safety of Buildings and Structures, Building Materials and Products", approved by Order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated June 9, 2023 No. 435 (registered in the Register of State Registration of Regulatory Legal Acts No. 32783) and state regulations in the field of architecture, urban planning and construction.

     37. Owners of residential, administrative, industrial and public buildings post signs and house numbers of the established samples, which are kept clean and in good condition.

     38. The owners of information signs, signage, advertising structures, decorative panels, and entrance groups that are not part of the common property of the condominium facility take the necessary measures to preserve the above structures when cleaning the roof of the house in winter.

     39. The owners of monuments and objects of monumental art, buildings that are monuments of architecture, history and culture, keep them in proper condition.

     40. It is not allowed on the territory of the settlement.:

     1) to break and damage elements of the arrangement of buildings and structures, monuments, memorial plaques, trees, shrubs, small architectural forms and other elements of external landscaping in public areas, as well as to make their unauthorized alterations, alterations and rearrangements;

     2) apply inscriptions, drawings, paste up and hang any announcements and other information messages on bus stops, walls, poles, fences (fences) and other objects not provided for these purposes. The owners of these facilities ensure the organization of work on the removal of inscriptions, drawings, advertisements and other information messages.;

     3) to store and store movable property outside the boundaries and fences of their owned land plots;

     4) place and store containers, industrial goods and other trade items or objects on sidewalks, lawns, roads, container sites and adjacent territories, place garbage not classified as municipal waste (construction debris and debris of natural origin) on container sites and adjacent territories;

     5) construction, including temporary, economic, domestic buildings and structures, modification of building facades, reconstruction, as well as the construction of extensions in violation of the requirements of the Building Code of the Republic of Kazakhstan and state standards in the field of architecture, urban planning and construction.

     41. The owners of buildings and structures notify the owners of non-residential and residential premises twenty-four hours before the start of snow removal and ice from roofs by informing them through mass media, social networks or mobile communications.

     42. The current maintenance of sidewalk lawns in adjacent territories is carried out by legal entities or individuals to whom these territories are assigned.

     43. The pasting of newspapers, posters, posters, various kinds of advertisements, advertisements, and election campaign materials is allowed only on specially installed billboards and advertising stands.

     Printed campaign materials are posted in specially designated places, as well as on buildings, structures and other facilities with the consent of the owners or owners of these facilities.

     The placement of posters, advertisements, and propaganda printed materials on walls, plinths, and doors of buildings, poles, trees, outdoor lighting poles, and contact network, and other objects not intended for this purpose, is coordinated by the customer of the specified products.

     44. For the safety of the inhabitants of the settlement, during the design and construction of buildings and structures, fencing of construction sites is provided in accordance with state standards in the field of architecture, urban planning and construction.

Section 5. Organization of events for the maintenance of outdoor lighting facilities

     45. All street, house, and other outdoor lighting devices are kept in good condition.

     46. The maintenance and repair of street and house lighting connected to a single street lighting system is carried out by the owner (balance holder) of lighting devices. The maintenance of the house lighting connected to the introductory distribution devices of residential buildings is carried out by organizations providing services and (or) performing maintenance and repair work on the common property of the condominium facility or management organizations.

     47. Outdoor lighting is divided into street and house lighting.

     48. The elements of outdoor lighting include: fixtures, brackets, supports, wires, cables, power sources (including assemblies, feeding stations, control boxes).

     49. Streets, roads, squares, pedestrian alleys (parks, squares), residential areas, courtyards, territories of enterprises, institutions, organizations, as well as license plates of public and residential buildings, road signs and signs, elements of urban information and storefronts are illuminated at night.

     50. The placement of street lamps, floor lamps, and other sources of outdoor lighting in combination with the construction and landscaping of the city contribute to creating a safe environment, without interfering with road users, and the residence of citizens.

     51. Organizations responsible for outdoor lighting devices ensure their technically sound condition, in which quantitative and qualitative indicators correspond to the specified parameters for the illumination of such places, timely switching on and off and uninterrupted operation of outdoor lighting devices at night.

     52. Owners of outdoor lighting facilities or facilities equipped with outdoor lighting facilities, as well as organizations servicing outdoor lighting facilities:

     1) monitor the proper lighting of streets, roads, the quality of supports and fixtures, lighting installations; in case of violation or damage, carry out timely repairs and painting;

     2) ensure that the lighting is switched on and off in accordance with the established procedure for the given locality.;

     3) replace the outdoor lights in a timely manner;

     4) provide devices for automatic switching on and/or off based on the need for lighting in common areas.

     53. The number of non-working lamps on the streets in public areas should not exceed ten percent of their total number, while it is not allowed to place non-working lamps in a row, one after the other.

     54. Outdoor lighting devices for residential building entrances, architectural and artistic lighting systems, and advertising are switched on and off in the outdoor street lighting mode.

     55. Disruptions in the operation of outdoor lighting devices associated with broken electrical wires or damaged supports should be eliminated immediately after detection within twenty-four hours. In case of damage to the supports as a result of intentional and / or accidental violations, the restoration is carried out at the expense of the guilty party who committed a violation in the operation of street lighting.

     56. In case of damage or malfunction of street lighting as a result of an emergency (stormy wind, snowfall, other natural emergencies), restoration is carried out at the expense of the organization (enterprise) responsible for the maintenance and/or operation of street lighting.

57. The removal of downed lighting poles is carried out by the person operating linear structures, at the expense of the organization (enterprise) responsible for the maintenance and/ or operation of street lighting within three days from the moment of detection (dismantling).

Section 6. Maintenance of storm sewer networks, inspection and storm wells, drainage structures

     58. It is not allowed within the protected area of storm sewers without written approval from the operating organization and other authorities.:

     1) to carry out excavation work;

     2) damage storm sewer networks, crack or destroy manholes;

     3) to carry out construction, install commercial, household and household facilities;

     4) dump industrial, municipal, liquid waste, garbage and other materials.

     59. The operation of main and intra-block storm sewer networks in the city is carried out on the basis of contracts concluded with specialized organizations.

     60. The departmental storm sewer networks are operated at the expense of the relevant organizations.

     61. Flooding of streets, buildings, structures, formation of ice from water leakage due to malfunction of water supply, sewerage, storm water devices, systems, networks and structures, as well as discharge, pumping or draining of water on lawns, sidewalks, streets and courtyards is not allowed.

     62. The grilles of the rain wells are constantly in a cleaned state. Clogging and flooding of grates and wells, limiting their capacity, are not allowed. Preventive inspection of inspection and rain-receiving wells of storm sewers and their cleaning are carried out at least once a year.

     63. Utility wells where covers or grilles have been destroyed are fenced off within an hour by the owners of the networks, marked with appropriate warning signs and replaced within the time limits specified in state regulations in the field of architecture, urban planning and construction.

     64. During planned work on utility networks, sewage is discharged into the nearest wells of the fecal sewer, tap water and water from heating networks into the storm sewer (if available). Water discharge onto the road is not allowed.

     65. The elimination of the consequences of leaks is carried out by the forces and at the expense of the owners of damaged utility networks.

     66. The operating organization ensures the proper technical condition of storm sewer networks (including the timely closure of manholes and grilles).

Section 7. Maintenance of garden furniture, garden equipment and small architectural forms

     67. Objects of gardening furniture, gardening equipment and small architectural forms, including fountains, park pavilions, gazebos, bridges, fences, gates, canopies, flowerpots are in a clean and serviceable condition and must function in accordance with their intended purpose.

     68. In the spring period, a scheduled inspection of small architectural forms is carried out, their cleaning from old paint, rust, washing, painting, as well as replacing broken elements.

     69. It is provided for the maintenance of flower vases and urns in proper condition.:

     1) repair of damaged items;

     2) removing smudges and dirt;

     3) removal of debris, faded inflorescences and flowers, withered leaves.

     70. Fences (metal grilles) are kept in proper technical condition, cleaned of old coatings and painted at least once a year.

     71. In winter, elements of garden furniture, gardening equipment, and small architectural forms, as well as approaches to them, are cleared of snow and ice.

     72. During the operation of the fountains, the water surface is cleaned of debris on a daily basis.

     73. Swimming in fountains is not allowed.

     74. In the autumn-winter period, the operation of fountains is suspended and conservation is carried out by covering its surface, revising shut-off valves, dismantling pumping equipment and other work in order to reduce the time when starting the fountain for its stable operation in the spring and summer period.

Section 8. Maintenance of temporary buildings

     75. The installation and operation of temporary buildings is carried out in accordance with state standards in the field of architecture, urban planning and construction.

     76. After cleaning the temporary building, its owner restores and beautifies the land plot previously occupied by the temporary building. If necessary, it clears debris and recultivates the previously occupied area.

     77. Legal entities and individuals who own temporary buildings:

     1) they are repaired and painted. Repairs are carried out taking into account the preservation of the appearance and color scheme defined by the project documentation.;

     2) ensure the safety of green spaces, lawns, and curbstones in the surrounding area;

     3) install bins near temporary buildings, clean the bins of waste during the day as needed, but at least once a day.

     78. Legal entities and individuals who own temporary buildings are not allowed:

     1) to erect canopies, canopies and other structures not provided for by the projects to temporary buildings.;

     2) to store containers, goods, parts, and other household and industrial items at non-residential facilities and on their roofs, as well as to use non-residential facilities where trade is carried out, household and catering services are provided, for storage purposes;

     3) clutter up fire-fighting gaps between temporary buildings, equipment, and waste;

     4) during construction and installation work, provide access points with warning signs.

Section 9. Maintenance of construction sites

     79. The maintenance of construction sites in terms of compliance with the norms and requirements in the field of landscaping of the territory of the settlement, restoration of landscaping after completion of construction work is provided by the customer, unless otherwise provided by the construction contract.

     80. When maintaining construction sites in terms of compliance with the norms and requirements in the field of landscaping, it is necessary:

     1) to keep the fencing of the construction site in a clean and serviceable condition, to ensure the absence of information and printed products, drawings, inscriptions, dents, dents, chips;

     2) equip paved access roads from the construction site to the paved road;

     3) in the case of the use of a public area adjacent to the construction site, ensure the safety of the road surface, sidewalks, existing outdoor lighting networks, green spaces and small architectural forms located on this territory.

     81. Upon completion of construction work, road surfaces, sidewalks, and landscaping elements that were disrupted as a result of construction work and are located on public land are subject to restoration by the customer, unless otherwise provided for in the construction contract.

     82. It is not allowed to transport soil, debris, loose building materials, light containers, foliage, hay, cut trees without covering with tarpaulin or other material that eliminates road pollution, as well as transportation of building mixes and mortars (including cement-sand mortar, lime, concrete mixtures) without taking measures that exclude the possibility of spilling onto the road, sidewalk, curb, or lawn strip adjacent to the road.

Section 10. Maintenance of children's and sports grounds

     83. Children's and sports grounds:

     1) have a surface layout with sand filling in the irregularities in the summer;

     2) Regularly swept;

     3) they are cleared of snow in winter;

     4) they are kept in proper technical condition and painted.

     84. Fences and buildings on playgrounds and sports grounds should be painted at least once a year.

     85. The owners of the playgrounds ensure the maintenance and safety of children's and sports grounds.

     86. Playgrounds must be isolated from transit pedestrian traffic, driveways, turn-around areas, guest parking lots, garbage collection sites, permanent and temporary storage areas for vehicles. It is not allowed to organize approaches to playgrounds from driveways and streets.

     87. During the reconstruction of playgrounds, in order to avoid injury, it is necessary to prevent the presence of protruding roots or overhanging low branches on the site, remnants of old, cut-off equipment (racks, foundations) located above the ground, metal bridges not buried in the ground (as a rule, horizontal bars and swings). During the reconstruction of the adjacent territories, playgrounds are isolated from the places of work and storage of building materials.

Section 11. Maintenance of container sites

     88. Container sites are special sites for waste accumulation, where containers for collecting solid household waste are placed, with access roads for specialized vehicles transporting solid household waste. They are planned and installed in such a way as to prevent debris from spreading across the territory.

     89. Container sites are aesthetically designed and have information about waste disposal dates, the name of the organization performing this work, and contacts of the person responsible for high–quality and timely maintenance of the site and timely disposal of solid household waste.

90. Legal entities and officials (individual entrepreneurs) serving the housing stock have container sites on the territory of households in accordance with the requirements of the Sanitary Rules "Sanitary and epidemiological requirements for communal facilities", approved by Order of the Minister of Health of the Republic of Kazakhstan dated July 26, 2022 No. KR DSM-67 (registered in the Register of State Registration of Regulatory legal Acts of July 27, 2022 No. 28925) and Sanitary Rules "Sanitary and epidemiological requirements for collection, use, application, neutralization, transportation, storage and burial of industrial and consumer waste", approved by the order of the Acting Minister of Health of the Republic of Kazakhstan dated December 25, 2020 No. KR DSM-331/2020 (registered in the Register of State Registration of Regulatory Legal Acts No. 21934).

     91. The placement, maintenance and sanitary condition of sites for dumpsters and containers for collecting solid household waste is provided by the owner, taking into account the adjacent territory.

Section 12. Maintenance of pet walking areas

     92. Pet-walking areas are located on the territories of common areas of the microdistrict and residential area, free of green spaces.

     93. The list of landscaping elements on the territory of a pet-walking area, if necessary, includes: various types of coverings, fencing, a bench, an urn, lighting and information equipment.

     94. An information stand with Standard Rules for keeping and walking pets is provided on the territory of the site, approved by the Order of the Minister of Ecology, Geology and Natural Resources of the Republic of Kazakhstan dated May 20, 2022 No. 168 "On Approval of standard rules for keeping and walking pets" (registered in the Register of State Registration of Regulatory Legal Acts No. 28138).

Section 13. Maintenance of parking areas

     95. The following types of parking lots are provided on the territory of the settlement: short-term and long-term storage of cars, street (in the form of parking lots on the carriageway marked with markings), off-street (in the form of "pockets" and indentations from the carriageway).

     96. When planning common areas and courtyards, it is necessary to provide for physical barriers that make it impossible for vehicles to park on lawns.

     98. It is not allowed on house territories.:

     1) stopping and parking of vehicles in places not provided for these purposes, as well as on sidewalks, playgrounds, landscaping areas and areas with greenery, on container sites and territories adjacent to them;

     2) parking of dismantled vehicles.

Paragraph 3. Carrying out works on improvement of engineering communications

     99. All damages to structural elements and coatings of highways, elements and facilities of highway construction, technical means of traffic management, landscaping and landscaping elements carried out due to the fault of the contractor (general contractor), are eliminated in full by him.

     100. The contractor (general contractor) protects the place of work, installs information boards that indicate information about the construction site (reconstruction, repair, capital repairs), the name of the customer and contractor, the surname of the official responsible for the work, his office phone number, and the timing of the work.

     101. After the completion of works on the reconstruction and repair of engineering communications or works related to the opening of soils and hard surfaces, as well as emergency work, all elements of landscaping that were violated during their implementation are subject to restoration by the contractor (general contractor).

     102. The road surface of highways is restored in accordance with the requirements of the Classification of types of work performed during maintenance, current, medium and capital repairs of highways and management of road assets, approved by Order of the Minister of Transport and Communications of the Republic of Kazakhstan dated January 24, 2014 No. 56 (registered in the Register of State Registration of Regulatory Legal Acts No. 9176).

     103. In case of damage to the structural elements of landscaping, restoration is carried out at the expense of the party that damaged the structure, including small architectural forms, the ditch system, and engineering communications. The elimination period is not more than seventy-two hours, with the exception of engineering communications, the restoration period of which is twelve hours.

Paragraph 4. Measures to improve the territories of cities and towns

Section 1. Organization of measures for cleaning the territory of settlements

     104. Throughout the calendar year, the direction of maintenance and cleaning of the territories of the settlement is seasonal, depending on the climatic conditions of the region.

     105. Individuals and legal entities that own buildings (premises in them), structures, including temporary structures, as well as own land plots, clean the house and adjacent territory independently or by involving participants in landscaping at their own expense.

     106. It is not allowed to accumulate and dispose of production and consumption waste in unauthorized places on the territory of the settlement.

     107. Persons who have placed production and consumption waste in unauthorized places, at their own expense, clean and purify this territory, and, if necessary, reclaim the land.

     108. If it is impossible to identify the persons who placed production and consumption waste in unauthorized landfills, the disposal of production and consumption waste and the reclamation of landfill territories is carried out at the expense of persons providing cleaning of these territories.

     109. The collection and removal of consumer waste is carried out in accordance with the Rules approved by the Order of the Acting Minister of Ecology, Geology and Natural Resources of the Republic of Kazakhstan dated December 28, 2021 No. 508 (registered in the Register of State Registration of Regulatory Legal Acts No. 6341).

     110. Incineration of production and consumption waste is not allowed on the territory of the common areas of the settlement.

     111. The removal of municipal waste from multi-apartment residential buildings, individual residential buildings, trade and catering organizations, cultural institutions, children's and medical institutions is carried out by the owners, the specified organizations or under an agreement with an organization that carries out waste removal in accordance with the environmental legislation of the Republic of Kazakhstan.

     112. The removal of waste generated during repairs is carried out to places specially designated for this purpose by the persons who carried out this repair themselves.

     113. It is not allowed to store waste generated during repairs in temporary waste storage facilities and on container sites.

     114. If a waste producer who carries out his household and economic activities on a land plot, in a residential or non-residential building on the basis of a lease agreement or other agreement with the owner has not organized the collection, removal and disposal of waste independently, the collection, removal and disposal of waste from this waste producer is carried out by the owner of the above-mentioned real estate.

     115. To prevent clogging of streets, squares, squares and other public places with industrial and consumer waste, small containers (urns, tanks) specially designed for temporary storage of waste are installed.

     116. The installation of containers for temporary storage of production and consumption waste, their maintenance and cleaning are carried out by persons cleaning the relevant territories.

     117. Urns (tanks) are kept in good condition, cleaned as garbage accumulates, but washed and disinfected at least once a month.

     118. The disposal of industrial and consumer waste from the container site and the territory adjacent to it, spilled out during unloading from containers into garbage trucks, is carried out by employees of the organization that collects and exports waste.

     119. Cleaning and cleaning of trolleybus and bus stops is carried out by organizations cleaning the territories of streets and roads where these stops are located.

     120. Cleaning and cleaning of the final trolleybus and bus stops, territories of control points is provided by the organizations operating these facilities.

     121. Cleaning and cleaning of stops where commercial facilities are located is carried out by the owners of commercial facilities within the boundaries of adjacent territories, unless otherwise stipulated by the contract.

     122. The operation and maintenance of water collection columns in proper sanitary condition, including their cleaning from debris, ice and snow, as well as ensuring safe approaches to them, is carried out by the organization in whose ownership the columns are located.

     123. The organization of work on cleaning and cleaning the territory of markets and adjacent territories is carried out in accordance with the Sanitary Rules "Sanitary and epidemiological requirements for wholesale and retail food trade facilities", approved by Order of the Minister of Health of the Republic of Kazakhstan dated August 4, 2021 No. KR DSM - 73 (registered in the Register of State Registration of Regulatory Legal Acts No. 23856).

124. The cleaning of bridges, overpasses, pedestrian crossings, viaducts, and adjacent territories, as well as the maintenance of sewers, storm sewer pipes, and rain wells, is carried out by organizations serving these facilities.

     125. It is not allowed to install filling dumps, spill slops and sewage outside the territory of houses and streets, and carry industrial and consumer waste into street passages.

     126. Liquid household waste must be exported by contract to organizations that have special transport.

     127. Cleaning and cleaning of gutters, trays, pipes, drains intended for the discharge of surface and groundwater from yards is carried out by participants in landscaping responsible for cleaning the relevant territories.

     128. Water discharge onto sidewalks, lawns, and the carriageway is not allowed, and during emergency operations, water discharge is allowed only through special branches or hoses into nearby wells of fecal or storm sewers in agreement with the owners of communications and with reimbursement of the costs of wastewater disposal.

     129. Railway tracks passing within the boundaries of a populated area within the exclusion zone (slopes of depressions and embankments, crossings, crossings over tracks) are removed and maintained by the forces and facilities of railway organizations operating these facilities.

     130. Cleaning and cleaning of territories designated for the placement and operation of power lines, gas, water and heating networks is carried out by the forces and means of organizations operating these networks and power lines.

     131. When cleaning inspection wells and underground utilities, soil, garbage, and sewage are stored in special containers with immediate removal by organizations involved in cleaning operations.

     132. The collection of objects thrown on the streets that interfere with traffic is carried out by participants in the improvement of territories responsible for cleaning the relevant territories.

Section 2. Organization of street cleaning events

     133. The cleaning of the city territory is carried out daily with the maintenance of cleanliness and order during the day based on technical and sanitary requirements.

     134. Cleaning of house territories is carried out mainly in the early morning and late evening hours, when the number of pedestrians is insignificant.

     135. During cleaning, it is not allowed to move garbage cleaned from house territories, sidewalks and driveways onto the road.

     136. Residential buildings, sheds and other structures that have fallen into disrepair due to fire or expiration of their service life are fenced off, dismantled and cleared of debris by their owners in accordance with the Rules for issuing a decision to carry out a complex of works on the post-modernization of facilities (demolition), approved by the order of the Minister of Industry and Infrastructural Development of the Republic of Kazakhstan dated April 29, 2021 No. 202 (registered in the Register of State Registration of Regulatory Legal Acts No. 22672).

     137. Cleaning of such structures is carried out by the owners within six months from the moment they are determined unsuitable by a special commission.

Section 3. Organization of events for cleaning the territory of cities and towns in winter

     138. Winter cleaning of roads and driveways is carried out in accordance with the requirements of these Standard Rules.

     139. The removed snow is taken to places specially designated for this purpose, determined by the local executive body.

     140. The technology and modes of harvesting operations on streets and adjacent territories ensure unhindered movement of vehicles and pedestrians, regardless of weather conditions.

     141. The primary measures for winter cleaning of the territory of the settlement include:

     1) Raking and sweeping snow;

     2) treatment of the carriageway of roads and public areas with anti-icing materials;

     3) formation of a snow bank for subsequent removal;

     4) making breaks in the snowfall at intersections, at public passenger transport stops, entrances to administrative and public buildings, exits from the inner-city territories.

     142. The events of the second stage include:

     1) snow removal (removal);

     2) cleaning of the floodplain part of the road after snow removal from the carriageway;

     3) ice chipping and cleaning of snow and ice formations.

     143. Snow removal work on the roadway must begin immediately with the start of snowfall. During prolonged snowfalls and blizzards, the cycles of snow removal and treatment with deicing materials are repeated, ensuring the safety of pedestrians and vehicles.

     144. Streets, roads, and sidewalks are completely cleared of snow and rolling snow within forty-eight hours after the end of the snowfall.

     145. Snow removal from roads, streets and driveways is carried out primarily from bus stops, surface pedestrian crossings, bridges and overpasses, places of mass attendance (including large shops, markets, hotels, train stations, theaters), entrances to medical institutions and other social facilities within a day after the end of the snowfall.

     146. On roads, streets and passageways with one-way traffic, the floodplain part of the road is constantly cleared of snow and ice to the side stone throughout the winter period.

     147. Places of temporary storage of snow after snowmelt are cleared of debris.

     148. During the period of snowfall and ice, public areas, sidewalks and other pedestrian areas on the territory of the settlement are cleared of snow and treated with anti-icing materials.      Small architectural forms, as well as the space around them and the approaches to them, are being cleared of snow and ice.

     149. Snow removal operations (mechanized sweeping and manual mopping) on sidewalks, footpaths and bus stops begin immediately after the end of the snowfall. In case of prolonged snowfall, the cycles of snow removal and anti-icing treatment are repeated, ensuring safety for pedestrians.

     150. Sidewalks and staircases of bridge structures are cleaned to their full width before covering from freshly fallen or compacted snow (snow and ice formations).

     151. During snowfall, sidewalks and staircases of bridge structures are treated with anti-icing materials and passageways are cleared for pedestrian traffic.

     152. Manhole covers, water and sewer wells are completely cleared of snow and ice and are kept in a condition that allows rapid use of fire hydrants.

     153. Bridges, overpasses, descents, ascents, intersections, pedestrian crossings, entrance pockets of public transport stops, exit roads are sprinkled with a sand-and-salt mixture.

     154. When using chemical reagents, it is necessary to adhere to the established standards of their distribution.

     155. Roofs and canopies of residential buildings, buildings, structures, and structures are cleaned of snow and ice as needed, but at least once a month by dumping on the ground.      158. The organization of cleaning roofs from snow and ice, removal of snow and ice growths are carried out by the owners of individual residential buildings, buildings, structures, structures independently or through the involvement of specialized organizations at their own expense.

     Before carrying out work on cleaning roofs from snow and ice, it is necessary to carry out security measures (fencing, guards) to ensure the safety of citizens, persons carrying out these works, and vehicles, as well as the safety of trees, shrubs, overhead street lighting lines, information placement facilities, traffic lights, road signs, communication lines, and others. objects, if these objects are installed in accordance with the current legislation.

     159. When cleaning public areas, it is allowed to temporarily store snow that does not contain chemical reagents on sites prepared in advance for these purposes, provided that the green spaces and the outflow of meltwater are preserved.

     160. Not allowed:

     1) to push or move onto the carriageway of roads, streets and driveways snow that is being cleared from residential, house territories, territories of organizations, enterprises, institutions, construction sites;

     2) carry out the transfer and movement of contaminated snow, as well as ice chips to lawns, flower beds, shrubs and other areas with greenery;

     3) store snow against the walls of buildings and on the routes of heating networks.

161. When cleaning inner-city driveways and adjacent territories, first of all, pedestrian paths, driveways to courtyards and entrances to places where containers for collecting industrial and consumer waste are located are cleared.

     162. Snow collected from courtyards and driveways is stored on the adjacent and inner-block territories in such a way that there are free spaces for vehicles and citizens to pass through, while preventing damage to green spaces. Snow storage sites are prepared in advance. Meltwater is diverted from these sites to the storm sewer network. If it is not possible to organize such sites, snow is removed.

     163. After the snow melts, sidewalks, inner-city, house and adjacent territories, and public areas are cleaned of pollutants formed during the winter period.

Section 4. Organization of events for cleaning the territory of cities and towns in the summer

     164. The frequency of the main cleaning activities is regulated taking into account the weather conditions and the importance (categories) of streets.

     165. The following types of work are carried out during the summer cleaning period:

     1) sweeping, washing and watering of the carriageway, sidewalks, house territories;

     2) cleaning of dirt, washing, painting of fences and curb stone;

     3) cleaning of the floodplain part of the road;

     4) cleaning of lawns, flower beds and flower beds from debris, twigs, leaves, dry grass, faded inflorescences and sand;

     5) garbage collection to places of authorized storage, neutralization and disposal;

     6) garbage collection from house territories, including territories adjacent to houses of private development;

     7) mowing the grass.

     166. During the fall of leaves, fallen leaves are raked and removed from the carriageway of roads, public areas, adjacent territories. Raking of foliage to the clump of trees and shrubs is not allowed.

     167. Urban areas are being swept:

     1) sidewalks - daily throughout the day as pollution accumulates;

     2) adjacent territories - daily during the day as needed;

     3) other territories, including territories of common areas and adjacent territories, as pollution accumulates, taking into account the need to ensure cleanliness.

     168. Watering of the carriageway, sidewalks, access roads, and adjacent territory is carried out:

     1) to improve the microclimate in hot weather when the air temperature is above 25 degrees Celsius;

     2) to reduce dustiness, as needed.

     169. The stops are completely cleaned of ground and sand deposits, various debris and washed. Cleaning is carried out during the hours of least pedestrian movement and minimum congestion of passengers.

     170. Dividing strips made of reinforced concrete blocks are cleaned of sand, dirt and small debris over the entire surface. Dividing strips made in the form of lawns are cleared of debris.

     171. Metal fences, road signs and signs are washed.

     172. To avoid stagnation of rainwater, manhole covers and rainwater pipes are constantly cleaned of estimates and other contaminants.

     173. The mowing of the grass is carried out with subsequent removal.

     174. During the fall season, the fallen leaves are removed in a timely manner and taken to specially designated areas or composting fields.

     175. During the production of summer cleaning is not allowed:

     1) to dump garbage on green spaces, in inspection wells of engineering networks, rivers and reservoirs, on the carriageway of roads and sidewalks;

     2) to knock out estimates and garbage on sidewalks and lawns with a jet of water when washing the roadway;

     3) make bonfires and burn garbage, foliage, containers, production and consumption waste, with the exception of cutting and organized burning of plant parts infected with quarantine pests and diseases;

     4) pump water onto the roadway during the elimination of accidents on water supply, sewerage and heating networks.

     176. Based on these Model Rules, depending on the natural, climatic, geological, hydrogeological and seismic factors of a locality, the Rules for improving the territories of cities and settlements developed by local executive bodies are supplemented by provisions that do not contradict the current legislation of the Republic of Kazakhstan.
