On Ratification of the Protocol on Amendments to the Agreement on the Status of Formations of Forces and Means of the Collective Security System of the Collective Security Treaty Organization dated December 10, 2010

To ratify the Protocol on Amendments to the Agreement on the Status of Formations of Forces and Means of the Collective Security System of the Collective Security Treaty Organization dated December 10, 2010, signed in Astana on November 28, 2024.

Protocol on Amendments to the Agreement on the Status of Formations of Forces and Means of the Collective Security System of the Collective Security Treaty Organization dated December 10, 2010
Member States of the Collective Security Treaty Organization,
in order to improve the legal framework for the temporary stay of formations of forces and means of the collective security system in the territories of the Parties,
Guided by article 18 of the Agreement on the Status of Formations of Forces and Means of the Collective Security System of the Collective Security Treaty Organization dated December 10, 2010 (hereinafter referred to as the Agreement),
have agreed on the following:
Article 1
Make the following changes to the Agreement:
1. In article 1:
"a") add the words "(national Guard, police forces)" to the second paragraph after the words "internal troops".;
b) after the second paragraph, add the following paragraph:
"Command of formations" - a management body created to lead formations;";
c) the third paragraph should be worded as follows:
"sending Party" - the Party to which formations and their movable property belong, temporarily sent to the territory of the receiving Party;";
d) the fourth paragraph should be worded as follows:
"receiving Party" - the Party on whose territory the Command of Formations and formations of the sending Party with their movable property are temporarily located in order to perform assigned tasks or participate in joint exercises and surprise inspections;";
e) the fifth paragraph should be worded as follows:
"transit Party" - the Party through whose territory the formations of the sending Party, their movable property, as well as personnel assigned to Command the formations are transited;";
f) delete paragraphs six and seven;
g) after the seventh paragraph, add the following paragraph:
"transit" means transportation through the territory of a Party and (or) through the territory of a state that is not a party to this Agreement of formations and their movable property belonging to other CSTO member states, as well as personnel assigned to Command formations, beginning and ending outside the territory of these states;";
"h)"add the words "(National Guard, police forces)" to the eighth paragraph after the words "internal troops".;
i) delete the ninth paragraph;
k) the eleventh paragraph should be worded as follows:
"movable property" - weapons and military equipment, military-technical equipment, special equipment and special facilities, transport and other logistical means, as well as other goods owned by the sending and receiving Parties and necessary for the functioning of formations and Command formations;";
k) add the words "and Command formations" to the twelfth paragraph;;
m) after the twelfth paragraph, add the following paragraphs:
"aerodrome technical (airfield) flight support" is a type of logistical support for flights of state (military) aviation, including a set of measures carried out for the purpose of direct support at airfields (landing sites) of flights of aviation units, divisions and individual aircraft.;
"aeronautical maintenance" is an activity that includes the organization and maintenance of air traffic, provision of aviation telecommunications, provision of navigation and surveillance systems, aeronautical and meteorological information, search and rescue.".
2. In article 2:
a) the first paragraph should be worded as follows:
"Formations of the sending Party may be sent to the territory of the receiving Party:
in accordance with the official request of the host Country to exercise the right to collective defense in the event of a threat and (or) commission of an armed attack (aggression) against one or more Parties, countering other challenges and threats to collective security, preventing (resolving) crisis situations, eliminating emergencies, and providing humanitarian assistance.;
to participate in joint exercises and surprise inspections.";
b) in the third paragraph, the words "forces and means of the collective security system" should be deleted;
c) the fourth paragraph should be worded as follows:
"The decision on the deployment, tasks, composition, number of formations, the order of their subordination, locations, as well as the time spent on the territory of the host Country to perform tasks for their intended purpose is made by the CSTO Collective Security Council (hereinafter referred to as the Council) based on the official request of the host Party.";
d) the fifth paragraph should be worded as follows:
"Formations become subordinate to the Command of formations after their commanders (chiefs) report to the Command of formations about crossing the border of the host Country.";
e) add the following sixth paragraph:
"The decision on the transportation of formations to the territory of the receiving Party by the Party carrying out air transportation in the interests of the sending Party is made by agreement between these Parties.".
3. In the first paragraph of article 4:
"a") replace the words "formations can be conducted" with the words "formations can be conducted";;
"b") replace the words "Formation command" with the words "Formation Command".
4. Article 5 should be worded as follows:
"Article 5
In the case of the use of formations, by decision of the Council, the receiving Party shall notify the other Parties in writing of the place, time, and procedure for the intended crossing of its state border and create the necessary conditions for the unhindered and gratuitous movement of military echelons, air and sea (river) vessels and ships, automobile convoys with personnel and movable property, provides free of charge the placement and use of real estate (real estate objects).".
5. In article 6:
a) the second paragraph should be worded as follows:
"Aviation flights are carried out along routes, as well as in zones (areas) that are agreed with the Parties concerned.";
b) after the second paragraph, add the following paragraph:
"During transportation (transit) of formations to solve tasks for their intended purpose in cases of threat and (or) commission of an armed attack (aggression), countering other challenges and threats to collective security, preventing (resolving) crisis situations, eliminating emergency situations and providing humanitarian assistance, receiving, sending, airfield technical (airfield) support, the provision of parking spots and protection of aircraft at airfields, regardless of their affiliation, is carried out by the receiving and (or) transit Parties free of charge. Air navigation services for flights of state (military) aviation aircraft of the Parties are carried out without charge (fees).".
6. After the third paragraph, add the following paragraph to Article 7:
"Refueling with fuel, lubricants, special liquids and gases of aircraft at state (military) and civilian airfields is carried out by the forces and means of the transit Party and (or) the receiving Party on the basis of relevant agreements and (or) arrangements.".
7. In the articles 3, 7, 8, 11, 12, 13, 16 The words ""Formation command"" in the appropriate cases should be replaced by the words "Formation command" in the appropriate cases.
8. Replace "Command" with "Command of formations" in paragraphs two and three of Article 8.
9. ""Command" in article 14 should be replaced by the words "Command of formations".
10. Delete the second paragraph of article 15.
11. ""In the final provision, the words "Collective Security Treaty Organization" should be replaced by the abbreviation "CSTO".
Article 2
This Protocol shall enter into force in accordance with the procedure provided for in Article 17 of the Agreement.
Done in Astana on November 28, 2024, in one original copy in Russian. The original copy of this Protocol shall be kept at the Secretariat of the Collective Security Treaty Organization, which will send a certified copy to each signatory State.
