To ratify the Memorandum of Understanding between the Government of the Republic of Kazakhstan and the Government of the Kingdom of Saudi Arabia on attracting a grant from the Government of the Kingdom of Saudi Arabia for the implementation of a project to establish a Cardiac Surgery Center at the Republican state-owned enterprise A. Based on the principles of cooperation between the Government of the Republic of Kazakhstan and the Government of the Kingdom of Saudi Arabia, based on the Highest agreement on the allocation of five million US dollars for the construction of a hospital in Kazakhstan, taking into account the results of the visit to Kazakhstan of the technical delegation of the Ministry of Finance and National Economy of the Kingdom, which took place on 9.02.2001, which corresponds to 11/15/1421. In order to negotiate with responsible persons of the Government of the Republic of Kazakhstan, get acquainted with the location of the project, study the needs and meet with interested parties.
Based on the desire to determine the scope of measures for the implementation of this project, the Government of the Kingdom of Saudi Arabia and the Government of the Republic of Kazakhstan have agreed on the following:
1.a. Project location (hospital) The cardiac surgery specialization will be located in Almaty in the A. Syzganov surgical Complex on a plot of land allocated for the construction of a building in accordance with the general plan attached to this Memorandum and which was visited by members of the delegation accompanied by representatives of the Center.
b. The grant amount is intended for two purposes: The first is the construction of a hospital consisting of several floors with a total area of 4,495 square meters with a preliminary cost of 3,200,000 (three million two hundred thousand) US dollars according to calculations prepared by the Kazakh side. The second is the purchase of medical devices and equipment for the remaining amount.
v. The Kazakh side (A.Syzganov Surgical Center) should provide the Saudi side with data on the needs, profile and content of the project, the general program of the hospital for detailed design and preparation of the project, layout and drawings of the project.
2. The project will be implemented within the framework of the grant on a plot of land allocated by the grant user. The Ministry of Finance and National Economy of the Kingdom of Saudi Arabia (hereinafter referred to as the Ministry) will undertake the following: - prepare the layout, parameters, sketches, final drawings and documents of the project, carry out technical supervision of the progress of the project through one of the Saudi engineering advisory companies according to the proposals submitted by the Kazakh side during the visit of the technical group to Kazakhstan, after the agreement from the Kazakh side to the preliminary drawings of the project;
- putting the project up for tender among specialized companies, including Saudi and Kazakh firms. The Ministry qualifies the bidders and determines the winner based on the best offers.;
- The financing of the project will be carried out by the Ministry in the course of work based on the contractor's reports approved by the consulting company.
3. Based on the desire of the Kingdom to implement the project at the proper level, it was agreed that the Government of the Republic of Kazakhstan will undertake the following: 3.1. Provide the land plot without any obstacles.
3.2. Will take all measures to exempt the necessary materials from transportation, storage, import duties and direct and indirect taxes on materials, equipment, appliances and machinery, as well as carry out customs clearance without delay. In case of difficulties in implementing these measures for any reason, the Government of Kazakhstan assumes all taxes, fees and charges, as well as customs clearance of materials immediately after their arrival.
3.3. Grant all benefits to the contractor of the project, a construction license and other necessary permits, exempt the contractor from all taxes and duties applicable to the activities of contractors in the country, as well as its employees, workers, and provide the same benefits to companies working with the contractor on the project. 3.4. He will assist employees of the consulting company that prepares sketches and working drawings and oversees the progress of the project, as well as provide the necessary permits for the company's activities and its employees, equipment and vehicles, and exempt them from all taxes and duties. 3.5. Authorizes the Chairman of the Health Committee to communicate with the Saudi side. 3.6. Install an appropriately sized commemorative plaque with an inscription in Arabic and Kazakh that this project was carried out at the expense of a grant from the Kingdom of Saudi Arabia.
The Memorandum comes into force from the date of signing. Signed in Riyadh _____ _______ 1422 Hijri, which corresponds to October 22, 2001, in 2 copies in Arabic, Kazakh, English and Russian, with all its texts having equal force. In case of disagreement, the English text will be used as the basis.

I have the honor to inform you that the Ministry of Foreign Affairs of the KSA has received the consent of the relevant party in the KSA to the request of the Kazakh side to make editorial changes to the text of the Memorandum on the implementation of the project to create a Cardiac Surgery Center at the Republican State-Owned Enterprise "Scientific Center of Surgery named after A.N.Syzganov" in the Kazakh language, provided that no changes are made that will affect to the provisions of the Memorandum in accordance with the English text, as mentioned in this document, and this note is considered an integral part of the Memorandum. The Ministry takes this opportunity to renew its assurances of the highest consideration.
