Article 1. To denounce the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on interstate military transportation of border troops and cargo for their provision in the interests of Protecting the External Borders of the member States of the Commonwealth of Independent States, concluded in Moscow on September 9, 1994.
Article 2. This Law shall enter into force on January 1, 2005.

Agreement between the Government of the Republic of Kazakhstan and the Government of of the Russian Federation on interstate military transportation of border troops and cargo for their support in the interests of protecting the external borders of the member States of the Commonwealth of Independent States
The Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the Parties, proceeding from mutual interests in ensuring the security of States at the external borders (borders with third countries that are not member States of the Commonwealth of Independent States), expressing interest in effective cooperation in solving practical issues of comprehensive protection of the external borders of the Commonwealth, agreed as follows:
Article 1
For the purposes of this Agreement, the following terms mean: 1. "Border Troops of the Russian Federation" - formations, units and subdivisions of the Border Troops of the Russian Federation located on the territory of the member states of the Commonwealth of Independent States. 2. "Persons who are part of the Border Troops of the Russian Federation": a) military personnel of the Border Troops of the Russian Federation; b) persons from among the citizens of the Russian Federation who are not military personnel, working in units, institutions, organizations and enterprises of the Border Troops of the Russian Federation. 3. "Family members of persons who are members of the Border Troops of the Russian Federation" - spouses, children, as well as cohabiting and dependent relatives. 4. "Property" means all types of weapons, ammunition, military equipment, including transport and other logistical means, as well as any other material necessary to support the activities of the Border Troops of the Russian Federation. 5. "Interstate military transportation" means transportation from the territory of the Russian Federation to the territory of the Republic of Kazakhstan and back of troops, property and persons belonging to the Border Troops of the Russian Federation and their family members.
Article 2
The Kazakh Side ensures free, gratuitous transit through its territory of interstate military transports of the Russian Federation in the interests of ensuring the protection of the external borders of the member States of the Commonwealth of Independent States without levying customs duties, transit and other fees established in relation to transit.
Article 3
When carrying out interstate military transportation, the Parties shall be guided by the legislative acts of their States on military transportation and this Agreement.
Article 4
Interstate military transportation is carried out by rail, air, sea, river and road transport. Transportation of dangerous goods is carried out in accordance with the Rules of transportation of such goods in force in the Republic of Kazakhstan. Persons who are members of the Border Troops of the Russian Federation and their family members travel through the territory of the Republic of Kazakhstan on a visa-free basis upon presentation of identity documents, and their minor children - according to the records in these documents. The Parties grant the right to persons who are members of the Border Troops of the Russian Federation and their family members to transport personal property through the territory of the Republic of Kazakhstan without restrictions and collection of customs duties, taxes and fees.
Article 5
Applications for planning interstate military transportation are sent to the military transport authorities of the Parties.
Article 6
Management of interstate military transportation is carried out: in the territory of the Republic of Kazakhstan - by the Department of Special and Military Transportation of the Ministry of Internal Affairs of the Republic of Kazakhstan, in the territory of the Russian Federation - by the Department of Special Transportation of the Ministry of Internal Affairs of Russia. As of 6.00 and 18.00 Moscow time on the reporting day, the Department of Special and Military Transportation of the Ministry of Internal Affairs of the Republic of Kazakhstan and the Department of Special Transportation of the Ministry of Internal Affairs of Russia are exchanging information on interstate military transportation.
Article 7
The transport authorities of the Republic of Kazakhstan ensure the fulfillment of schedules of movement and safety of interstate military transportation on the territory of the Republic of Kazakhstan.
Article 8
Interstate military transportations requiring escort are guarded by military guards in accordance with the regulations in force in the Border Troops of the Russian Federation. The personnel of the guards escorting interstate military transports en route interacts with representatives of military transport authorities on the communication routes along which the transports are carried out.
Article 9
The organization of interstate military air transportation is carried out in coordination with the authorities of the Parties responsible for air transport issues. The control of aircraft flights on international air lines is carried out by the territorial air transport authorities of the Republic of Kazakhstan. Flight safety of aircraft performing interstate military transportation is ensured in accordance with international law and the legislation of the Republic of Kazakhstan. The Kazakh Side does not interfere with flights (flights) in the airspace of the Republic of Kazakhstan of aircraft and helicopters of the Border Troops of the Russian Federation. Planes and helicopters of the Border Troops of the Russian Federation carry out flights in the airspace of the Republic of Kazakhstan according to pre-submitted applications in the order and along routes determined by agreement between the Parties. Aviation flights of the Border Troops of the Russian Federation on the territory of the Republic of Kazakhstan are provided free of charge, with the exception of refueling, which is carried out by wire transfer at current prices in the Republic of Kazakhstan.
Article 10
Interstate military transportation by sea and river transport is carried out in coordination with the authorities of the Parties responsible for maritime and river transport.
Article 11
Interstate military transportation by road is carried out both individually and as part of a convoy. The movement of convoys is carried out in accordance with the rules of the road of the Republic of Kazakhstan, unless otherwise agreed by the competent authorities of the Parties.
Article 12
The resolution of disputes related to the implementation of the provisions of this Agreement is carried out through consultations between the competent authorities of the Republic of Kazakhstan and the Russian Federation.
Article 13
This Agreement comes into force from the date of its signing and will be valid for five years, and then automatically renewed each time for a subsequent five-year period, unless either Party declares its desire to terminate the Agreement, which it must notify the other Party in writing no later than six months before the expiration of the next five-year period. period. Amendments and additions may be made to the Agreement by mutual agreement of the Parties.
Done in Moscow on September 9, 1994, in two copies, each in the Kazakh and Russian languages, both texts are equally authentic.
