Whereas the Government of the Republic of Kazakhstan (hereinafter referred to as the Government of the Republic of Kazakhstan) represented by the Ministry of Economy and Budget Planning of the Republic of Kazakhstan (hereinafter referred to as the MEBP) and the Government of the United States of America (hereinafter referred to as the US Government) represented by the United States Agency for International Development (hereinafter referred to as USAID), hereinafter collectively referred to as the Parties, have concluded Memorandum of Understanding between the Government of the Republic of Kazakhstan and the Government of the United States of America on the Kazakh-American Economic Development Program (hereinafter - Memorandum) for the development and implementation of the Kazakh-American Economic Development Program "Houston Initiative" (hereinafter referred to as the Program) dated May 5, 2006; taking into account that the Parties express a desire to strengthen the success of the Program and continue cooperation on the basis of this Supplementary Agreement to the Memorandum (hereinafter referred to as the Supplementary Agreement), they agreed on the following Amendments and additions: 1. Paragraph 3.3 should be worded as follows: «3.3. The Parties intend to jointly participate in the financing of the Program. The Parties agree on the following estimated funding shares for each program year and in accordance with the conditions specified in paragraph 3.2 above:

In paragraph 6.2, replace the words "April 1 and August 1" with the words "June 1 and December 1"; add paragraph 7.2 as follows: «7.2. Annual work plans may include reporting forms and deadlines for each project.". The third paragraph of clause 8.7. should be worded as follows: "8 Orynbor St., Astana, 010000 Kazakhstan, Ministry of Economy and Budget Planning of the Republic of Kazakhstan, fax: + 7 (7172) 74-30-78"; in paragraph 8.1, replace the words "December 31, 2009" with the words "December 31, 2012". 2. The Parties acknowledge that, in accordance with paragraph 8.2 of the Memorandum, no part of it is a financial obligation, nor is it a means for any of the Parties to incur financial obligations. 3. All provisions of the Memorandum that have not been revised by this Additional Agreement remain completely unchanged. 4. This Supplementary Agreement shall enter into force on the date of receipt, through diplomatic channels, of the last written notification that the Parties have completed the relevant domestic procedures necessary for its entry into force. 5. Done in Astana on February 22, 2010, in two original copies, each in Kazakh, English and Russian languages. In case of disputes or discrepancies in the texts, the English text shall prevail.
