On the ratification of the General Agreement on Economic, Technical and Trade Cooperation between the member Countries of the Organization of the Islamic Conference

The Law of the Republic of Kazakhstan dated June 1, 2017 No. 68-VI.

      To ratify the General Agreement on Economic, Technical and Trade Cooperation between the member Countries of the Organization of the Islamic Conference, adopted in Tripoli at the 8th Session of the Council of Foreign Ministers of the Organization of the Islamic Conference on May 16-22, 1977, with a declaration and reservations in accordance with Annexes 1 and 2 to this Law.

Appendix No. 1 to the Law of the Republic of Kazakhstan "On Ratification of the General Agreement on Economic, Technical and Trade Cooperation between the Member Countries of the Organization Islamic Conference" dated June 1, 2017 No. 68-VI SAM

Statement The Government of the Republic of Kazakhstan to the General Agreement on Economic, Technical and Trade Cooperation between the member Countries of the Organization of the Islamic Conference

      "The Government of the Republic of Kazakhstan declares that it will implement the provisions of the General Agreement on Economic, Technical and Trade Cooperation between the member Countries of the Organization of the Islamic Conference (hereinafter referred to as the General Agreement), which do not contradict the norms of the Constitution of the Republic of Kazakhstan.

 

Appendix No. 2 to the Law of the Republic of Kazakhstan "On Ratification of the General Agreement on Economic, Technical and Trade Cooperation between the Member Countries of the Organization Islamic Conference" dated June 1, 2017 No. 68-VI SAM

Reservations The Government of the Republic of Kazakhstan to the General Agreement on Economic, Technical and Trade Cooperation between the member Countries of the Organization of the Islamic Conference

      1. Reservation to article 6: "The Government of the Republic of Kazakhstan will apply article 6 of the General Agreement as an obligation to provide the parties to this Agreement with a regime no less favorable than for any other third State, without prejudice to obligations arising from other international treaties to which the Republic of Kazakhstan is a party."

      2. Reservation to article 8: "The Government of the Republic of Kazakhstan will apply the General Agreement without prejudice to its rights and obligations enshrined in the agreements on the free trade area and customs unions to which it is a party.

     The Government of the Republic of Kazakhstan reserves the right to conclude preferential trade agreements and/or establish preferential treatment in trade with the member States of the Organization of the Islamic Conference in accordance with its foreign trade policy within the framework of the Eurasian Economic Union.

General Agreement on Economic, Technical and Trade Cooperation between the member Countries of the Organization of the Islamic Conference Preamble

     The Governments of the member countries of the Organization of the Islamic Conference are signatories to this Agreement.:

     in accordance with the objectives set out in the Charter of the Organization of the Islamic Conference and pursuant to the resolution of the Second Islamic Summit held in Lahore;

     Striving to create the best possible circumstances and conditions for the economic progress and development of the Member countries and with a view to improving the living conditions of their populations;

     Desiring to strengthen ties between the Member countries in all areas in order to achieve their common interests;

     Convinced that economic, technical and trade cooperation between the Member countries is one of the main means of consolidating the socio-economic development of the Islamic States;

     Making efforts to make the most of the economic, human and technical abilities and capabilities available in the Islamic world, with a view to mobilizing and applying them in the best possible way, in the context of strong and systematic cooperation between Member countries, for the well-being and prosperity of peoples;

     They approved this agreement and agreed to make every effort in the context of their economic and technical cooperation to ensure its implementation and to achieve their goals through collective efforts or through bilateral and multilateral events.

CHAPTER I Economic cooperation

Article 1

     Member Countries, if necessary, provide the necessary conditions, guarantees and incentives to encourage the transfer of capital and investments among themselves in accordance with the applicable laws and regulations of each Member country, in order to promote the socio-economic development of all Islamic States and provide new opportunities for the optimal use of economic resources available in the Islamic world.

Article 2

     Member countries should encourage joint projects that will provide broad economic benefits and advantages, as well as deepen and promote economic complementarity and socio-economic structures of the member countries.

Article 3

     The member countries cooperate in developing various studies to explore and identify investment opportunities in joint projects.

Article 4

     The member countries will promote the maximum use of the potential of food production in Islamic countries and cooperate in meeting the food needs in the Islamic world.

CHAPTER II Technical cooperation

Article 5

     Member countries will strive to make the most of the experience and technical capabilities available to them through expert exchanges, research and study fellowships, training and advanced training, and various scientific and technical conferences and seminars.

Article 6

     In order to meet their labor needs and benefit from existing technical and administrative expertise, Islamic States should cooperate in the exchange of experience in these areas and, all other things being equal, provide an advantage to the labor force from member countries, taking into account previously concluded bilateral and multilateral agreements and in accordance with national legislation in this area.

Article 7

     The Member States agree to take all necessary measures to establish an Islamic Foundation for Advanced Science and Technology.

CHAPTER III Trade cooperation

Article 8

     Taking into account the obligations under other agreements concluded earlier between them, the member countries will:

     a) strive to apply equal and non-discriminatory trade approaches with each other in relation to foreign trade policy;

     (b) To seek to expand and develop trade exchanges among themselves, in particular through trade liberalization, by reducing or eliminating customs and other restrictions that apply to export/import activities between them on the basis of bilateral or multilateral trade agreements; and

     (c) Take into account the special circumstances and situations of least developed country members.

Article 9

     In principle, the member countries agree to establish a center for the development of trade between Islamic States, whose main task will be to promote and develop trade exchanges between the member countries.

Article 10

     The member countries will make efforts to organize exhibitions and fairs to present and market their products in the member countries. For the same purpose, they will also try to participate in international fairs and exhibitions held in other member countries in order to familiarize themselves with the products of the member countries and increase opportunities for the development of trade exchange among themselves. Each State will provide suitable conditions for other member States for these purposes within the framework of existing economic policies and systems.

CHAPTER IV Final provisions

Article 11

     The Islamic Commission on Economic, Cultural and Social Affairs, in cooperation with the General Secretariat of the Organization of the Islamic Conference, is responsible for the implementation of this agreement, as well as the review and evaluation of the results of such implementation.

Article 12

     This Agreement is open for signature and ratification by the member countries of the Organization of the Islamic Conference, the instruments of ratification should be kept in the General Secretariat of the Organization of the Islamic Conference.

Article 13

     This Agreement will enter into force as soon as the instruments of ratification are submitted by more than half of the member countries of the Organization of the Islamic Conference.

Article 14

     This Agreement is drawn up in three original versions in Arabic, English and French - all three are equally valid.
