The Memorandum On Mutual Understanding between the Government of the Republic of Kazakhstan and the Government of the United States of America

The Government of the Republic of Kazakhstan and the Government of the United States of America, hereinafter referred to as the Parties, Taking into account the strategic nature of relations between the Republic of Kazakhstan and the United States of America, expressing readiness for close cooperation within the framework of Operation Enduring Freedom to combat international terrorism, religious and political extremism at the bilateral level; Reaffirming the commitment to the provisions of the Charter on Democratic Partnership between the Republic of Kazakhstan and the United States of America of 1994, the Kazakh-American Joint Statement on Terrorism of November 3, 1998;
Referring to the previously reached agreements on military cooperation and expressing their intention to strengthen them; Reached an understanding on the following issues:
I. Taking into account the request of the American Side for the provision by the Government of the Republic of Kazakhstan of special air corridors to ensure the passage of US aircraft (not group, single flights) as part of Operation Enduring Freedom, the Kazakh Side is ready to provide air corridors limited by the parameters:
1. NORDA A355 TOLE BI B142 ARBOL A352 TURKESTAN A480 BORIS - further through the territory of Uzbekistan to the point of KUNAS B363 AKTAU A87/R227 AZABI/ITAKA
2. RIRAN A118 SHYMKENT B114 TOLE BI A355 NORDA
3. NORDA A355 TOLE BI A356 ATYRAU G487 OVATA
4. RIRAN A118 SHYMKENT R482 TURKESTAN A352 KYZYLORDA A356 ATYRAU G487 OVATA
If these air corridors are closed on any given day, for any reason, the Air Traffic Services Center of the Republic of Kazakhstan (the Main Air Traffic Planning Center) will reschedule the route of the US aircraft, rather than postponing their flight through the airspace of Kazakhstan.
II. The Kazakh Side, for the purposes specified in paragraph I of this Memorandum, is ready to determine the following single diplomatic authorization number N MFA 110/015 KZN01.
III. The Parties proceed from the understanding that notifications about the use of Kazakhstan's airspace by US aircraft as part of Operation Enduring Freedom must be submitted at least 4 hours before departure by transmitting the flight plan to the Main Air Traffic Planning Center, containing the following information to AFTN
- UAAKZDZK, UAAAZDZX; (in cases where the AFTN address is not available, send the flight plan to CITA - ALAOKYA or fax: 7 (3272) 574343):
- single number of the diplomatic permit;
- type, registration number and radio call sign of the aircraft; - point of departure and delivery of passengers / cargo; - general nature of transportation (people, cargo, dangerous cargo); - date, full route and timetable with mandatory indication of air routes on the flight route, points of entry / exit to / from the airspace of Kazakhstan. Flights of aircraft on the air routes of the Republic of Kazakhstan must be carried out in compliance with the international rules for flights of civil aircraft (single flights). Regarding combat aviation, aircraft should travel sequentially, not in groups, and maintain a flight speed of no more than 0.80 M. Approximate number of aircraft flights: 8-10 flights per day.
IV. The Republic of Kazakhstan will provide fee-free air navigation services to U.S. aircraft involved in Operation Enduring Freedom and complying with the requirements of Paragraph III while these aircraft are in the airspace of the Republic of Kazakhstan. Additionally, the Republic of Kazakhstan will provide free air navigation services to U.S. aircraft under Operation Enduring Freedom, which previously received the diplomatic authorization number of the Ministry of Foreign Affairs 110/001 KZN 01, valid from September 23, 2001, until the date of entry into force of this Memorandum.
V. In case of accidents, the Parties will consult in a spirit of partnership. Third-party lawsuits brought as a result of the actions or omissions of any U.S. personnel may, at the discretion of the U.S. Government, be reviewed and settled in accordance with U.S. law.
VI. In order to ensure the greatest efficiency of the cooperation carried out under this Memorandum, the Parties will operate flights in accordance with international flight safety standards, including environmental safety.
VII. This Memorandum is valid for the duration of Operation Enduring Freedom, conducted by the United States of America and its partners in the international coalition. This Memorandum comes into force from the date of signing.
