      To ratify the Protocol on Amendments and Additions to the Agreement on Mutual Recognition of Benefits and Guarantees for Participants and Invalids of the Great Patriotic War, Participants in Military Operations on the Territory of Other States, and Families of Deceased Servicemen dated April 15, 1994, signed in Dushanbe on October 30, 2015.

 PROTOCOL on Amendments and Additions to the Agreement on Mutual Recognition of Benefits and Guarantees for Participants and Persons with Disabilities of the Great The Great Patriotic War, participants in military operations on the territory of other states, the families of the deceased servicemen of April 15, 1994

     (Entered into force on March 30, 2017 - Bulletin of International Treaties of the Republic of Kazakhstan 2017, No. 2, Article 26)

     The Governments of the member States of the Commonwealth of Independent States, hereinafter referred to as the Parties,

     have agreed on the following:

Article 1

      To make the following amendments and additions to the Agreement on Mutual Recognition of Benefits and Guarantees for Participants and Invalids of the Great Patriotic War, Participants in Military Operations on the Territory of Other States, and Families of Deceased Servicemen dated April 15, 1994 (hereinafter referred to as the Agreement):

      1. Article 2 should be worded as follows:

"The categories of persons referred to in article 1 of this Agreement, regardless of their nationality, enjoy benefits and guarantees in accordance with the legislation of the State Party to this Agreement in whose territory they permanently reside.  

      u1055 At the same time, benefits and guarantees are provided in kind based on the List of Benefits and Guarantees provided for in Annex 2 to this Agreement, or in the form of cash payments in accordance with the legislation of the States Parties to the Agreement."

      2. Article 3 should be worded as follows:

"For the categories of persons referred to in Article 1 of this Agreement who are temporarily staying or temporarily residing in the territories of the States Parties to this Agreement, the following benefits and guarantees are provided::

     . Free access to emergency medical care in medical organizations (institutions) in accordance with the legislation of the host state for diseases, accidents, injuries, poisoning and other conditions that threaten the patient's life, without mutual compensation by the governments of the CIS member states.

     2. Extraordinary services provided by enterprises and organizations of household services, trade, catering, public transport, housing and communal services, communication institutions, cultural and educational institutions in accordance with the legislation of the state of temporary residence or temporary residence."

      3. In article 5, the words "their national" should be deleted and the words "States Parties to this Agreement" should be added.

      4. In the second part of Article 8, the words "national legislation of the Parties" should be replaced by the words "legislation of the States Parties to this Agreement", the words "the State of this Party" - by the words "this State Party to this Agreement".

      5. In the first sentence of article 10, the words "their national" should be deleted and the words "States Parties to this Agreement" should be added.

      6. The title of Annex 1 to the Agreement should be supplemented with the words ", and a list of states, cities, territories and periods of hostilities involving citizens of the former USSR."

      7. Paragraph 1 of Annex 1 to the Agreement should be supplemented with the following subparagraph:

     "1.6. Persons who took direct part in combat operations to eliminate illegal formations and groups (banditry) in the territories of the Ukrainian SSR, Byelorussian SSR, Lithuanian SSR, Latvian SSR, Estonian SSR in the period from January 1, 1944 to December 31, 1951."

      8. Subparagraph 2.2 of paragraph 2 of Annex 1 to the Agreement should be supplemented with the words ", according to the List specified in paragraph 7 of this annex", deleting the footnote.

      9. To supplement Annex 1 to the Agreement with paragraph 7 as follows:

"7. List of states, cities, territories and periods of military operations involving citizens of the former USSR

     7.1. The Civil War: from February 23, 1918 to October 1922.

     The Soviet-Polish War: March-October 1920.

     Fighting in Spain: 1936-1939.

     The war with Finland: from November 30, 1939 to March 13, 1940.

      The Great Patriotic War: from June 22, 1941 to May 9 (11)  

     In 1945.

     The War with Japan: from August 9, 1945 to September 3, 1945.

     Combat operations to eliminate Basmachi: from October 1922 to June 1931.

      Fighting in the area of Lake Hassan: from July 29 to August 11  

     In 1938.

     Fighting on the Khalkhin Gol River: from May 11 to September 16, 1939.

      Military operations during the reunification of the USSR, Western Ukraine and Western Belarus: from September 17 to September 28, 1939.  

      Fighting in China:  

      from August 1924 to July 1927;  

      October-November 1929;  

      from July 1937 to September 1944;  

      July - September 1945;  

      from March 1946 to April 1949;  

     March - May 1950 (for personnel of the Air Defense Forces group);

     from June 1950 to July 1953 (for the personnel of military units that took part in the fighting in North Korea from the territory of China).

     Fighting in Hungary: 1956.

     Fighting in the area of Damansky Island: March 1969.

     Fighting in the area of Lake Zhalanashkol: August 1969.

     7.2. Defense of the city of Odessa: from August 10 to October 16, 1941.

      Defense of the city of Leningrad: from September 8, 1941 to January 27  

     In 1944.

     The defense of the city of Sevastopol: from November 5, 1941 to July 4, 1942.

     The defense of the city of Stalingrad: from July 12 to November 19, 1942.

     7.3. Fighting in Algeria: 1962 - 1964:

      Fighting in Egypt (United Arab Republic):  

      from October 1962 to March 1963;  

      June 1967;  

     The year 1968;

      from March 1969 to July 1972;  

      from October 1973 to March 1974;  

     from June 1974 to February 1975 (for personnel of the minesweepers of the Black Sea and Pacific Fleets involved in the mine clearance of the Suez Canal zone).

     Fighting in the Yemeni Arab Republic:

      from October 1962 to March 1963;  

     from November 1967 to December 1969.

     Combat operations in Vietnam: from January 1961 to December 1974, including for the personnel of the reconnaissance ships of the Pacific Fleet, which solved the tasks of combat service in the South China Sea.

     Fighting in Syria:

     June 1967;

     March - July 1970;

     September - November 1972;

     October 1973.

     Military operations in Angola: from November 1975 to December 31, 1991.

     Fighting in Mozambique:

     The years 1967-1969;

     from November 1975 to November 1979;

     from March 1984 to August 1988.

     Fighting in Ethiopia: from December 1977 to November 1990.

     Combat operations in Afghanistan: from April 1978 to February 15, 1989.

     Fighting in Cambodia: April-December 1970.

     Military operations in Bangladesh: 1972-1973 (for personnel of ships and auxiliary vessels of the USSR Navy).

     Fighting in Laos:

     from January 1960 to December 1963;

     from August 1964 to November 1968;

     from November 1969 to December 1970.

     Fighting in Syria and Lebanon: June 1982."

      10. The title of Annex 2 to the Agreement should read as follows: "The list of benefits and guarantees (with the exception of travel benefits) established by the legislation of the former USSR for the category of persons specified in Annex 1 to the Agreement on Mutual Recognition of Benefits and Guarantees for Participants and Invalids of the Great Patriotic War, participants in hostilities on the Territory of Other States, the families of the deceased servicemen."

Article 2

     This Protocol shall enter into force 30 days after the date of receipt by the depositary of the third notification that the signatory Parties have completed the internal procedures necessary for its entry into force.

     For the Parties that have completed the internal procedures later, this Protocol shall enter into force 30 days after the date of receipt by the depositary of the relevant documents.

Article 3

     After its entry into force, this Protocol is open for accession by a State party to the Agreement by submitting an instrument of accession to the depositary.

     For the acceding State, the Protocol shall enter into force 30 days after the date of receipt by the depositary of the instrument of accession.

     Done in Dushanbe on October 30, 2015, in one original copy in the Russian language. The original copy is kept in the Executive Committee of the Commonwealth of Independent States, which will send a certified copy to each signatory State of this Protocol.

     I hereby certify that the attached text is an authentic copy of the Protocol on Amendments and Additions to the Agreement on Mutual Recognition of Benefits and Guarantees for Participants and Invalids of the Great Patriotic War, Participants in Hostilities on the Territory of Other States, and Families of Deceased Servicemen dated April 15, 1994, adopted at a meeting of the Council of Heads of Government of the Commonwealth of Independent States, which was held October 30, 2015 in the city of Dushanbe. The original copy of the above-mentioned Protocol is kept in the Executive Committee of the Commonwealth of Independent States.
