The Governments of the States Parties to the Agreement on the Procedure for Customs Clearance and Customs Control of Goods Transported between the States Parties to the Agreement on the Establishment of a Free Trade Zone dated October 8, 1999 (hereinafter referred to as the Agreement), hereinafter referred to as the Parties,
have agreed on the following:
Article 1
Make the following changes to the Agreement:
1. The second paragraph of the preamble should read as follows: "Taking into account the provisions of the Agreement on the Establishment of a Free Trade zone of April 15, 1994, the Protocol on Amendments and Additions thereto of April 2, 1999 and the Agreement on a Free Trade Zone of October 18, 2011."
2. The third paragraph of Article 2 should read as follows: "simplification of customs procedures for goods originating from the territories of States - members of the CIS (in accordance with the Rules for Determining the country of Origin of Goods, approved by the Decision of the Council of Heads of Government of the CIS on September 24, 1993, taking into account the wording of paragraph 9, introduced by the Decision of the Council of Heads of Government of the CIS on October 18, 1996, and the Rules for Determining the Country of Origin of Goods, which are an integral part of the Agreement on the Rules for Determining the Country of Origin of Goods in The Commonwealth of Independent States of November 20, 2009), without prejudice to the national interests of each of these States."
3. Paragraph 1 of Article 3 shall be worded as follows:
"1. This Agreement is applied by the States parties to the Agreement on the Establishment of a Free Trade zone of April 15, 1994, the Protocol on Amendments and Additions thereto of April 2, 1999, or the Agreement on a Free Trade Zone of October 18, 2011."
4. Article 6 should be worded as follows:
"Article 6
The Parties, if necessary, on the basis of bilateral international agreements, create conditions at checkpoints at the state (customs) borders for joint customs control and customs operations."
5. In articles 2, 5 and 9, the words "customs clearance" should be replaced by the words "customs operations".
6. In Articles 4, 5 and 7, the words "customs clearance of goods" should be replaced by the words "performing customs operations in respect of goods".
Article 2
This Protocol shall enter into force on the date of receipt by the depositary of the third notification on the completion by the Parties of the internal procedures necessary for its entry into force.
For the Parties that have completed the internal procedures later, this Protocol shall enter into force on the date of delivery of the relevant documents to the depositary.
Done in Ashgabat on May 31, 2019, in one original copy in Russian. The original copy is kept in the Executive Committee of the Commonwealth of Independent States, which will send a certified copy to each signatory State of this Protocol.

RESERVATION of the Republic of Azerbaijan to the Protocol dated May 31, 2019 on amendments to the Agreement on the Procedure for Customs Clearance and Customs Control of Goods Transported between the States parties to the Agreement on the Establishment of a Free Trade Zone, dated October 8, 1999
The Republic of Azerbaijan is not a party Free Trade Area Agreement dated October 18, 2011.
None of the rights, obligations and provisions set forth in the Agreement of October 8, 1999 on the procedure for customs clearance and customs control of goods transported between the States parties to the Agreement on the Establishment of a Free Trade Zone will be applied by the Republic of Azerbaijan to the Republic of Armenia, as well as to activities carried out in the occupied territories of the Republic of Azerbaijan, until their release by the Republic of Armenia and the complete elimination of the consequences of aggression.

In connection with the submission by the Republic of Azerbaijan of a reservation to the Protocol on Amendments to the Agreement on the Procedure for Customs Clearance and Customs Control of Goods Transported between States – by the parties to the Agreement on the Establishment of a Free Trade Zone of October 8, 1999, none of the rights, obligations and provisions of the said Agreement will be applied by the Republic of Armenia to the Republic of Azerbaijan until the settlement of the Nagorno-Karabakh conflict, which is the result of the application by the Republic of Azerbaijan of the policy of ethnic cleansing against the people of the Nagorno-Karabakh Republic (Republic of Artsakh) and the outbreak of military aggression against the Nagorno-Karabakh Republic.

The original copy of the above-mentioned Protocol is kept in the Executive Committee of the Commonwealth of Independent States.
