      To ratify the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Tajikistan on the provision of military and technical assistance in ensuring security in the Adjacent areas of the Tajik-Afghan border, signed in Nur-Sultan on July 12, 2021.

Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Tajikistan on the provision of military and technical assistance in ensuring security in the adjacent areas of the Tajik-Afghan border

     The Government of the Republic of Kazakhstan and the Government of the Republic of Tajikistan (hereinafter referred to as the Parties),

     Desiring to strengthen the existing friendly relations and cooperation in the military field,

     Considering the provisions of the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Tajikistan on Military Cooperation dated December 16, 1999,

     in order to strengthen the security of the Central Asian region,

     have agreed on the following:

Article 1

     In order to ensure security in the adjacent areas of the Tajik-Afghan border, the Kazakh Side provides military and technical assistance to the Tajik Side in the form of a gratuitous transfer of military equipment.

     The names and amounts of military equipment are agreed through diplomatic channels by the authorized bodies of the Parties within 2 months after the signing of this Agreement.

     The Tajik Side uses the military equipment received from the Kazakh Side solely for the purposes of this Agreement and does not transfer it to a third party.

Article 2

     The authorized bodies for the implementation of this Agreement are:

     from the Kazakh Side - the Ministry of Defense of the Republic of Kazakhstan;

     from the Tajik Side - the Ministry of Defense of the Republic of Tajikistan.

     In case of a change in the name or functions of the authorized bodies, the Parties shall immediately notify each other through diplomatic channels.

Article 3

     The Kazakh Side ensures the delivery of military equipment by rail from the territory of the Republic of Kazakhstan (Otar station, Zhambyl region) to the territory of the Republic of Tajikistan (Rohati station, Dushanbe city), where representatives appointed by the authorized bodies of the Parties will make its proper reception and transfer.

     The issues of transportation of military equipment are regulated in accordance with international treaties in the field of military transportation, to which the States of the Parties are parties.

     The costs associated with the delivery of military equipment to the Rohati station in Dushanbe are borne by the Kazakh Side.

     Customs clearance and declaration of transferred military assets in the Republic of Kazakhstan are carried out in accordance with the legislation of the Eurasian Economic Union.

     Transferred military property is exempt from all types of duties, taxes and fees.

     The Tajik Side assumes the costs and is responsible for customs clearance in the Republic of Tajikistan.

Article 4

     By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized by the relevant protocols, which are an integral part of this Agreement.

Article 5

     Disputes related to the application and interpretation of the provisions of this Agreement are resolved through mutual consultations and negotiations.

Article 6

     This Agreement is temporarily applied from the date of signing and enters into force from the date of receipt by the Tajik Side of a written notification through the diplomatic channels of the Kazakh Side on the completion of internal procedures necessary for its entry into force.

     This Agreement shall terminate upon the full transfer to the Tajik Side of military equipment provided in accordance with this Agreement, which is confirmed by the Parties through diplomatic channels.

     Done in the city of Nur-Sultan on July 12, 2021, in two copies, each in the Kazakh, Tajik and Russian languages, all texts being equally authentic.

     In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will refer to the text in Russian.
