Agreement between the Government of the Republic of Kazakhstan and the Government of the Syrian Arab Republic on cooperation in the construction of the historical and cultural center and the mausoleum of Al-Farabi, restoration of the mausoleum of Sultan Az-Zahir Baybars in Damascus (Entered into force on October 6, 2011 - Bulletin of International Treaties of the Republic of Kazakhstan 2011, No. 5, art. 85)
The Government of the Republic of Kazakhstan and the Government of the Syrian Arab Republic, hereinafter referred to as the "Parties", and separately as the "Kazakh Side" and the "Syrian Side", taking into account the importance of friendly relations existing between the two countries, wishing to develop mutual cooperation, realizing that cultural cooperation serves to develop friendly relations and deepen mutual understanding between peoples, agreed about the following:
Article 1
The Syrian side (the Damascus City Hall) defines a land plot with an area of 0.22 hectares in the northeastern part of the Al al-Bayt necropolis in the city of Damascus for the construction of the historical and cultural center and the Al-Farabi mausoleum. The Syrian side demolishes residential buildings located on this piece of land within two weeks and registers the land plot as the property of the Damascus City Hall after the Kazakh side compensates the cost of the land plot and residential buildings to their owners. The Syrian side uses its own funds to create the necessary conditions (electricity, water supply, sewerage, telephony) for the start of construction work within 30 days after the demolition of residential buildings located on the territory. The Kazakh side, in accordance with the legislation of the Republic of Kazakhstan, determines the Kazakh general contractor (hereinafter referred to as the general contractor) for the construction of the historical and cultural center and the mausoleum of Al-Farabi, the restoration of the mausoleum of Sultan Az-Zahir Baybars in the city of Damascus.
Article 2
The Kazakh side, in coordination with the Syrian side, is developing design estimates for the construction of the historical and cultural center and the Al-Farabi Mausoleum. The Syrian side, in coordination with the Kazakh side, is developing design estimates for the restoration of the mausoleum of Sultan Az-Zahir Baybars in the city of Damascus. The Kazakh side, within the limits of the funds provided for by the legislation of the Republic of Kazakhstan, finances construction and restoration work at these facilities in accordance with the design and estimate documentation.
Article 3
The Syrian side, in agreement with the Kazakh side, determines a construction company in accordance with the national legislation of the Syrian Arab Republic, which, on the basis of an agreement with a general contractor, carries out the construction of the historical and cultural center and the Al-Farabi Mausoleum. The Syrian side, in agreement with the Kazakh side, determines a specialized restoration organization in accordance with the national legislation of the Syrian Arab Republic, which, on the basis of an agreement with a general contractor, carries out the restoration of the mausoleum of Sultan Az-Zahir Baybars. The General contractor may, if necessary, conclude separate agreements with the Damascus City Mayor's Office and the Arabic Language Association for the implementation of projects for the historical and cultural center and the mausoleum of Al-Farabi and the mausoleum of Sultan Az-Zahir Baybars, respectively.
Article 4
In order to control and coordinate the construction of the historical and cultural center and the mausoleum of Al-Farabi, the restoration of the mausoleum of Sultan Al-Zahir Baybars in the city of Damascus, the Parties are creating a joint commission consisting of three people from each Side. The Syrian side guarantees to provide the necessary conditions and assistance specified in Article 5 of this Agreement for the work of specialists from the Kazakh side until the completion of the construction of the historical and cultural center and the mausoleum of Al-Farabi, as well as the restoration of the mausoleum of Sultan Az-Zahir Baybars.
Article 5
The Syrian side: exempts the general contractor, consultants and staff involved in the implementation of projects that are not citizens of the Syrian Arab Republic from any taxes and payments to the budget established by the legislation of the Syrian Arab Republic regarding income received in connection with the performance of their works and services for the implementation of projects; exempts from payment of any tariffs, fees, customs duties, import taxes and other similar charges imposed on personal or household property imported into the territory of the Syrian Arab Republic or exported from the territory of the Syrian Arab Republic for personal use by specialists from the Kazakh side; ensures that the necessary licenses are obtained for construction and restoration work; Takes the necessary measures to speed up customs procedures for goods, property or other property imported into the territory of the Syrian Arab Republic for the implementation of projects.
Article 6
Upon completion of the construction and restoration work, the joint commission accepts the completed work in accordance with the act of acceptance and transfer and transfers the object to the Syrian side. Upon completion of the construction, the Parties conclude a separate Agreement on the functioning of the Al-Farabi Historical and Cultural Center.
Article 7
By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized in separate protocols, are its integral parts and enter into force in accordance with the procedure established by Article 10 of this Agreement. Changes in the provisions of this Agreement or termination of its validity will not affect the execution of projects under agreements (contracts) concluded during its validity period until their full completion.
Article 8
Disputes and disagreements on the interpretation of the provisions of this Agreement are resolved through negotiations and consultations between the executive bodies of the Parties.
Article 9
This Agreement does not affect the rights and obligations of the Parties arising from other international treaties to which they are parties.
Article 10
This Agreement shall enter into force on the date of receipt of the last written notification that the Parties have completed the internal procedures necessary for its entry into force. This Agreement is concluded for an indefinite period and is valid until the obligations assumed by the Parties are fully fulfilled.
Done in Damascus on October 21, 2007, in two original copies, each in Kazakh, Arabic, Russian and English, all texts being equally authentic. In case of disputes regarding the interpretation of the provisions of this Agreement, the Parties will refer to the English text.
