On the ratification of the Agreement between the Republic of Kazakhstan and the Holy See on Mutual Relations

AGREEMENT between the Republic of Kazakhstan and the Holy See on Mutual Relations

The Republic of Kazakhstan and the Holy See, hereinafter referred to as the Parties, and in unilateral commitments by the Republic of Kazakhstan and the Holy See, reaffirming their commitment to the norms of international law and desiring to develop equal relations between the Republic of Kazakhstan and the Holy See in accordance with the principles of respect and non-interference in internal affairs, have agreed as follows:
Article 1
The Parties recognize mutual freedom in the exercise of their rights and powers and undertake to respect this principle in their mutual relations and cooperation for the benefit of the peoples.
Article 2
The competent authorities of the Republic of Kazakhstan will grant residence permits to members of the Catholic Church from abroad who have been appointed to serve in individual churches or other institutions of the Catholic Church in Kazakhstan for the entire period of their appointment, in accordance with applicable law.
Article 3
The Republic of Kazakhstan recognizes the legal capacity of a legal entity for such entities of the Catholic Church, whose legal capacity is provided for by the codes of canon law, which may be archdioceses, dioceses (dioceses) or apostolic administrations, parishes, religious communities, missions, associations, seminaries, colleges, schools or educational institutions after their registration with the judicial authorities.
Article 4
The competent ecclesiastical authorities will transmit to the competent state authorities of the Republic of Kazakhstan authentic copies of the acts of creation of new or recognition of existing Catholic Church facilities for their inclusion in the state register of legal entities, in accordance with the legislation of the Republic of Kazakhstan.
Article 5
The competent authorities of the Catholic Church in the Republic of Kazakhstan will inform the competent State authorities about the appointment of church ministers.
Article 6
The Republic of Kazakhstan, in accordance with its national legislation, will provide the Catholic Church with the opportunity to acquire ownership or use buildings and plots of land appropriate to the needs of the Church for the construction of structures necessary for the pastoral service of the Church, such as churches, parish houses, houses or premises for religious, socio-cultural, catechetical, educational and charitable activities.. The protection of the property rights of the Catholic Church is carried out in accordance with the legislation of the Republic of Kazakhstan.
Article 7
The Republic of Kazakhstan recognizes as Catholic schools schools established and operated by subjects of canonical legal capacity, or subject to the norms of canon law and recognized as such by the competent ecclesiastical authorities in accordance with Article 3 of this Agreement.
Article 8
The Republic of Kazakhstan recognizes the right of the Catholic Church to establish its own schools of various levels and purposes and to manage them in accordance with the legislation of the Republic of Kazakhstan and the norms of Canon Law. Citizens of the Republic of Kazakhstan studying in theological educational institutions of the Catholic Church enjoy the benefits provided for by the legislation of the Republic of Kazakhstan.
Article 9
The Republic of Kazakhstan recognizes the right of the Catholic Church to organize and support the activities of its own medical and social institutions necessary for the fulfillment of its charitable and spiritual mission; such activities must be carried out in accordance with the legislation of the Republic of Kazakhstan.
Article 10
The Republic of Kazakhstan will facilitate the provision of spiritual assistance by the Catholic Church to believers in state health care, guardianship and detention facilities.
Article 11
The Republic of Kazakhstan recognizes the right of the Catholic Church to freely express its views and principles, including its right to use mass media, in accordance with the current legislation of the Republic of Kazakhstan.
Article 12
The Parties, confirming their mutual interest in developing cultural relations, will encourage the expansion of ties between institutions in the Republic of Kazakhstan and Catholic institutions around the world and will facilitate the exchange of students from theological educational institutions and research centers in accordance with the domestic legislation of the Parties.
Article 13
In case of disputes concerning the interpretation or application of the provisions of this Agreement, the Parties will resolve them through negotiations and consultations.
Article 14
This Agreement may be amended and supplemented by mutual agreement of the Parties.
Article 15
This Agreement shall enter into force upon mutual notification that the Parties have completed the procedures necessary for its entry into force. This Agreement will be valid for 10 years and its validity will be automatically extended each time for the next five years, unless either Party notifies the other Party in writing within six months of its desire to terminate it. Done at the Vatican on September 24, 1998, in two copies, each in the Kazakh, English and Russian languages, all texts being equally authentic. In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will be guided by the English text.
