On the ratification of the Agreement on Cooperation in the Field of Cinematography

       To ratify the Agreement on Cooperation in the field of Cinematography, signed in Almaty on February 10, 1995.

 It shall apply from the date of its signature and shall enter into force from the date of deposit with the depositary of the third notification on the implementation by States of the internal procedures necessary for its entry into force.

The Agreement entered into force on May 5, 1995.

       The Governments of the States Parties to this Agreement, hereinafter referred to as the Parties, guided by the concluded bilateral and multilateral agreements on cooperation in the field of culture, bearing in mind that cinematographic works are called upon to play an extremely important role in the dialogue of the nation, recognizing that every nation has the right to cinematographic works that reflect its social and cultural characteristics, agreed about the following:  

                               Article 1  

       The Parties confirm their commitment to cooperation in the field of cinematography based on the principles of sovereignty, equality of the member States of the Commonwealth, taking into account the national legislation in force in each of the member States of this Agreement.         The Parties recognize that the State policy of the States Parties to this Agreement in the field of cinematography is based on the following principles:         the responsibility of the State for the preservation, support and development of national cinematography;         recognition of cinematography as a specific field of culture, the prerequisite for which is the existence of a developed production, scientific, technical and information base;         creating conditions that make the works of national cinematography accessible to the general public; freedom of creativity, promotion of entrepreneurship, social protection of participants in the production, rental and screening of films; compliance with international treaties.         The Parties will make the necessary efforts to support and develop cinematography, including by providing tax and other benefits to enterprises and organizations that create, distribute and publicly display films.  

                               Article 2  

       The Parties will be guided in matters of protection of copyright and related rights on the territory of their States by the principles enshrined in the Berne Copyright Convention of 1886 and the World Copyright Convention of 1952, as well as agreements on the protection of copyright and related rights concluded within the framework of the Commonwealth of Independent States.         The Parties, interacting with each other, will make efforts to create a reliable system for the protection of copyright and related rights in the territories of their States.  

                               Article 3  

     The Parties will promote broad commercial and non-commercial exchanges of national films of various genres and their distribution throughout their countries.         The national legislation of the States Parties to this Agreement will encourage the display on their territories of national cinematographic works and cinematographic works created in the States that have joined the Agreement, ensure their free movement across the borders of the States Parties to the Agreement and exemption from customs duties.         The Parties will contribute to the maximum simplification and reduction of the administrative formalities necessary for such a demonstration.         Documents granting the right to rent and publicly display national films of the States parties to the Agreement are recognized in other States parties to the Agreement as proof of ownership and (or) disposition of films. At the same time, the relevant state bodies of each of the States parties to the Agreement have the right to determine the rental procedure and restrictions on the audience on their territory, taking into account the traditions, customs and national characteristics of the state.    

                                 Article 4  

       The parties will support cooperation between national cinematographic organizations in the production, distribution and public screening of films, as well as in the provision of mutual production and creative services.         The parties will encourage and develop various forms of creative cooperation in the field of cinematography, promote the development of modern cinematography, support experimental works enriching film culture, carry out information exchanges, and hold international festivals and competitions.  

                               Article 5  

       Goods necessary for the production and rental of films and videos are not subject to customs duties when moving across the borders of the States parties to the Agreement, provided there is a confirmation of their destination issued by the authorized state cinematography management body for presentation when crossing customs borders.  

                               Article 6  

       The parties will cooperate in the field of film education, including in the training and retraining of professional personnel for the needs of cinematography, and carry out exchanges of students and teachers of educational institutions in the film education system.  

                               Article 7  

       The parties will cooperate in the field of preservation and mutual use of cinematographic heritage, the formation of national film archives and film museums.  

                               Article 8  

     In order to deepen cooperation and develop national cinematographies, the Parties will assist in the creation and operation of international cinematographic organizations.  

                               Article 9  

       During the implementation of this Agreement, joint commissions and working groups may be established to study and prepare projects for mutual cooperation, assist national cinematographic organizations in their joint activities, and discuss other issues.  

                               Article 10  

       This Agreement does not exclude the possibility of the Parties concluding bilateral and multilateral agreements in the field of cinematography.         The Agreement is open for accession by other interested States that share the principles and objectives of this Agreement.  

                               Article 11  

       This Agreement is concluded for three years and is automatically extended for the next three years, if none of the Parties has notified the depositary of its intention to withdraw from this Agreement six months before the expiration of the next term of its validity.  

                               Article 12  

     This Agreement shall apply from the date of its signature and shall enter into force from the date of deposit with the depositary of the third notification on the implementation by the States of the internal procedures necessary for its entry into force.         Done in Almaty on February 10, 1995, in one original copy in the Russian language. The original copy is kept in the Archives of the Government of the Republic of Belarus, which will send a certified copy to each signatory State of this Agreement.
