On the ratification of the Agreement on the Grounds, Conditions and Procedure for Changing the Terms of Payment of Customs Duties

The Agreement shall expire on the date of entry into force of the relevant decision of the Eurasian Economic Commission in accordance with Article 444 and paragraph 2 of Article 448 of the Customs Code of the Eurasian Economic Union, ratified by the Law of the Republic of Kazakhstan dated December 13, 2017 No. 115-VI (for the procedure of entry into force, see Article 2).
AGREEMENT on the Grounds, conditions and procedure for changing the terms of payment of Customs duties (Entered into force on February 17, 2011 - Bulletin of International Treaties 2012, No. 4, art. 43)
The Governments of the member States of the Customs Union within the framework of the Eurasian Economic Community, hereinafter referred to as the Parties,
based on the Agreement on the Customs Code of the Customs Union dated November 27, 2009,
Recognizing the expediency of conducting a coordinated policy in the field of calculation and payment of customs duties,
Desiring to assist each other in this regard,
have agreed on the following:
Article 1

Article 5

Article 6
1. Deferral or installment payment of customs duties shall be granted to the payer of customs duties if there is one of the following grounds::
1) became invalid from the date of entry into force of the Treaty on the Customs Code of the Eurasian Economic Union, ratified by the Law of the Republic of Kazakhstan dated December 13, 2017 No. 115-VI (for the procedure of entry into force, see art. 2); 2) became invalid from the date of entry into force of the Treaty on the Customs Code of the Eurasian Economic Union, ratified by the Law of the Republic of Kazakhstan dated December 13, 2017 No. 115-VI (for the procedure of implementation, see art. 2); 3) became invalid from the date of entry into force of the Treaty on the Customs Code of the Eurasian Economic Union, ratified by the Law of the Republic of Kazakhstan dated December 13, 2017 No. 115-VI (for the procedure of entry into force, see art. 2); 4) became invalid from the date of entry into force of the Treaty on the Customs Code of the Eurasian Economic Union, ratified by the Law of the Republic of Kazakhstan dated December 13, 2017 No. 115-VI (for the procedure of entry into force, see art. 2); 5) became invalid from the date of entry into force of the Treaty on the Customs Code of the Eurasian Economic Union, ratified by the Law of the Republic of Kazakhstan dated December 13, 2017 No. 115-VI (for the procedure of entry into force, see 2); 6) became invalid from the date of entry into force of the Treaty on the Customs Code of the Eurasian Economic Union, ratified by the Law of the Republic of Kazakhstan dated December 13, 2017 No. 115-VI (for the procedure of entry into force, see Article 2);
7) import of goods, including raw materials, technological equipment, components and spare parts for their use in industrial processing.
The legislation of a member State of the Customs Union may determine the list of goods specified in subparagraph 7) of the first part of this paragraph.
For the purposes of this Agreement, industrial processing means the use of goods in production to obtain new goods, the code of which, in accordance with the unified Commodity nomenclature of foreign economic activity of the Customs Union, differs from the code of goods imported for their industrial processing at the level of any of the first four characters.

Article 7

Article 11 Dispute resolution
1. Disputes between the Parties related to the interpretation and/or application of the provisions of this Agreement shall be resolved primarily through negotiations and consultations.
2. If the dispute is not settled by the parties to the dispute through negotiations and consultations within six months from the date of the official written request for their conduct sent by one of the parties to the dispute to the other party to the dispute, then, in the absence of any other agreement between the parties to the dispute regarding the method of its resolution, either party to the dispute may refer this dispute for consideration to the Court of the Eurasian Economic Community. the economic community.
3. The Customs Union Commission shall assist the Parties in resolving the dispute before it is referred to the Court of the Eurasian Economic Community for consideration.
Article 12 Introduction of amendments
This Agreement may be amended, which are formalized by separate protocols, which are integral parts of this Agreement.
Article 13 Final provisions
This Agreement is subject to ratification and is temporarily applied from the date of entry into force. The Agreement on the Customs Code of the Customs Union dated November 27, 2009.
This Agreement shall enter into force on the date of receipt by the depositary of the last written notification through diplomatic channels on the implementation by the States of the Parties of the internal procedures necessary for the entry into force of this Agreement.
Done in St. Petersburg on May 21, 2010, in one original copy in the Russian language.
The original copy of this Agreement is kept at the Customs Union Commission, which will send a certified copy to each Party.
