About the republican budget for 2009-2011

Law of the Republic of Kazakhstan dated December 4, 2008 No. 96-IV

Article 1. To approve the republican budget for 2009-2011 in accordance with appendices 1, 2 and 3, respectively, including for 2009 in the following amounts: 1) revenues - 2 768 742 908 thousands of tenge, including for: tax receipts - 1 381 278 646 thousands of tenge; non-tax receipts - 89,630,415 thousand tenge; proceeds from the sale of fixed assets - 5,458,048 thousand tenge; proceeds from transfers - 1 292 375 799 thousands of tenge; 2) costs - 3 178 048 422 thousands of tenge; 3) net budget lending - KZT 18,736,401 thousand, including: budget loans - 46,201,969 thousand tenge; repayment of budget loans - 27,465,568 thousand tenge; 4) balance of operations with financial assets - 145,583,080 thousand tenge, including: acquisition of financial assets - 147,083,080 thousand tenge; proceeds from the sale of financial assets of the state - 1,500,000 thousand tenge; 5) deficit - 573,624,995 thousand tenge or 3.5 percent of the gross domestic product of the country; 6) financing of the budget deficit - 573,624,995 thousand tenge. Article 2. To provide in the republican budget for 2009 for the receipt of lease payments for the use of the Baikonur complex by the Russian Federation in the amount of KZT 17,250,000 thousand and military training grounds in the amount of KZT 3,717,900 thousand. Article 3. To approve the volume of budget revenues for 2009, allocated to the National Fund of the Republic of Kazakhstan, according to Appendix 4.

Article 4. To establish that the following are credited to the income of the relevant budget: according to the code "Mineral Extraction Tax" of the revenue classification of the unified budget classification - the debt of subsurface users on royalties, as well as royalties on subsurface use contracts in which guarantees of stability of the tax regime are maintained.; according to the "Social Tax" code of the income classification of the unified budget classification, arrears of contributions previously transferred to the Pension Fund, the State Pension Payment Center, the Compulsory Medical Insurance Fund, the State Social Insurance Fund, the Employment Assistance Fund, as well as contributions from highway users previously received by the Road Fund. At the same time, taxpayers operating under subsurface use contracts, which maintain guarantees of stability of the tax regime, reduce the above-mentioned deductions or social tax by the amount of deductions to the State Social Insurance Fund, calculated in accordance with the Law of the Republic of Kazakhstan "On Compulsory Social Insurance"; according to the code "Gasoline (except aviation) of their own production, sold by manufacturers in bulk" - debt on gasoline collection, previously received by the Road Fund; according to the code "Diesel fuel of own production, sold by manufacturers in bulk" - the debt on collection from diesel fuel, previously received by the Road Fund.

Article 5. The negative balance formed as of December 31, 1998 as a result of the excess of the amounts of benefits accrued by employers for temporary disability, pregnancy and childbirth, at the birth of a child, and burial, paid from the State Social Insurance Fund, over the accrued amount of deductions to the specified fund, is monthly offset against the payment of social tax within 4 percent of the the salary fund.

Article 6. To provide in the republican budget for 2009 the volume of budget withdrawals from regional budgets, budgets of Astana and Almaty cities to the republican budget in the amount of 89,922,302 thousand tenge, including: Atyrau region - 20 192 716 thousand tenge; Mangystau region - 5,342,114 thousand tenge; Almaty city - 55,811,279 thousand tenge; Astana city - 8,576,193 thousand tenge.

Article 7. To provide in the republican budget for 2009 the amount of guaranteed transfer from the National Fund of the Republic of Kazakhstan in the amount of 843,100,000 thousand tenge.

Article 7-1. To provide in the republican budget for 2009 a target transfer in the amount of KZT 347,900,000 thousand, transferred from the National Fund of the Republic of Kazakhstan to ensure employment, prevent significant unemployment and create conditions for sustainable post-crisis development. Article 8. To establish from January 1, 2009: 1) the minimum wage is 13,470 tenge; 2) the amount of the state basic pension payment is 5,388 tenge; 3) the minimum pension amount is 9,875 tenge; 4) the monthly calculation index for calculating benefits and other social benefits, as well as for the application of penalties, taxes and other payments in accordance with the legislation of the Republic of Kazakhstan - 1,273 tenge; 5) the minimum subsistence level for calculating basic social benefits - 13,470 tenge. To establish from July 1, 2009: 1) the minimum wage - 13,717 tenge; 2) the amount of the state basic pension payment - 5,487 tenge; 3) the monthly calculation index for calculating benefits and other social benefits, as well as for the application of penalties, taxes and other payments in accordance with the legislation of the Republic of Kazakhstan - 1,296 tenge; 4) the amount of the subsistence minimum for calculating the amount of basic social benefits - 13,717 tenge. Article 9. The fulfillment of state guarantees to recipients of pension payments for the safety of mandatory pension contributions in accumulative pension funds in the amount of actually paid mandatory pension contributions, taking into account the inflation rate at the time of acquisition by the recipient of the right to pension payments is carried out under the republican budget program 002 "Pension Program" of the Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan in accordance with the procedure determined by the Government Of the Republic of Kazakhstan.

Article 10. Starting from January 1, 2009, establish a monthly amount of monetary compensation for military personnel (except for conscripts), employees of internal affairs bodies, as well as employees of operational search, investigative and combat units of fire service bodies, bodies and institutions of the penitentiary system of the Ministry of Justice of the Republic of Kazakhstan, financial police bodies to pay for housing maintenance and utilities in the amount of 3,739 tenge.

Article 11. To provide in the republican budget for 2009 the volume of subventions transferred from the republican budget to regional budgets in the amount of 526,926,835 thousand tenge, including: Akmola region - 35,399,399 thousand tenge; Aktobe region - 17,544,081 thousand tenge; Almaty region - 60,034,569 thousand tenge; East Kazakhstan region - 54,083,302 thousand tenge; Zhambyl region - 52,049,283 thousand tenge; West Kazakhstan Region - 21,712,022 thousand tenge; Karaganda region - 40,621,386 thousand tenge; Kostanay region - 37,721,866 thousand tenge; Kyzylorda region - 42,159,181 thousand tenge; Pavlodar region - 16,370,560 thousand tenge; North Kazakhstan - 34,097,487 thousand tenge; South Kazakhstan - 115,133,699 thousand tenge.

Article 12. It should be noted that the republican budget for 2009 provides targeted current transfers to regional budgets, budgets of Astana and Almaty in the following amounts: 2,097,744 thousand tenge - for the maintenance of newly commissioned healthcare facilities; 5,997,531 thousand tenge - for the maintenance of newly commissioned educational facilities; 212,012 thousand tenge - for the maintenance of newly commissioned social security facilities; 11,383,031 thousand tenge - for the purchase of medicines, vaccines and other immunobiological preparations; 936,694 thousand tenge - for the introduction of standards of social services; 151 100 thousand tenge - for the development of a network of day-care units in medical and social institutions; 165,120 thousand tenge - for placing a state social order in the non-governmental sector; 4,189,900 thousand tenge - for increasing nutrition standards in medical and social institutions; 3 280 631 thousand tenge - for the payment of state targeted social assistance and monthly state allowances for children under 18 years of age due to an increase in the subsistence level; 2,176,334 thousand tenge - to subsidize the cost of services for the supply of drinking water from particularly important group and local water supply systems, which are alternative sources of drinking water supply. The order of use (with the exception of paragraphs six, seven, eight, nine and ten) and the distribution of the indicated amounts of targeted current transfers to regional budgets, budgets of Astana and Almaty cities are determined on the basis of a decision of the Government of the Republic of Kazakhstan. Article 12-1. To take into account that the republican budget for 2009 provides funds for the implementation of the strategy of regional employment and staff retraining in the amount of 134,764,069 thousand tenge, including: 117,425,642 thousand tenge - to provide employment for the population; 7,600,440 thousand tenge - to expand the program of social jobs and youth practice; 9,737,987 thousand tenge - for training and retraining of personnel. The distribution and the procedure for the use of these amounts are determined on the basis of a decision of the Government of the Republic of Kazakhstan. The footnote. Article 13. It should be noted that the republican budget for 2009 provides targeted current transfers to regional budgets, the budget of Astana for capital and medium repairs of highways of regional and district significance and streets of Astana in the amount of 15,629,356 thousand tenge. The distribution of these amounts of targeted current transfers to regional budgets and the budget of Astana city is determined based on a decision of the Government of the Republic of Kazakhstan. Article 14. To provide in the republican budget for 2009 targeted current transfers to the regional budget of the Karaganda region in the amount of 542,944 thousand tenge for the maintenance of the infrastructure of the city of Priozersk in accordance with the Agreement between the Republic of Kazakhstan and the Russian Federation on the terms of use and lease of the Sary-Shagan test site and ensuring the vital activity of the city of Priozersk dated January 20, 1995.

Article 15. To provide funds in the republican budget for 2009 for the payment of one-time state monetary compensation to pensioners and recipients of state social benefits, as well as to the working and non-working population living and living in radiation risk zones and in areas with preferential socio-economic status from 1949 to 1990, affected by nuclear tests at the Semipalatinsk nuclear test site, in the amount of 781,147 thousand tenge. To establish that these funds are allocated in accordance with the procedure determined by the Government of the Republic of Kazakhstan. The footnote. Article 17. It should be noted that the republican budget for 2009 provides targeted current transfers to regional budgets, budgets of Astana and Almaty for the development of agriculture in the amount of 39,258,811 thousand tenge, including: 1,911,124 thousand tenge - to support seed production; P090099 2,497,397 thousand tenge - to support livestock breeding; P090167 KZT 16,262,831 thousand - to reduce the cost of fuels and lubricants and other inventory items necessary for spring field and harvesting operations for priority crops determined by the Government of the Republic of Kazakhstan; KZT 2,928,650 thousand - to support the increase in yield and quality of agricultural crops; P090164 1,358,101 thousand tenge - to subsidize the cost of water delivery services to agricultural producers; 2,480,424 thousand tenge - to ensure the laying and cultivation of perennial plantings of fruit and berry crops and grapes; P090098 11,666,580 thousand tenge - to subsidize the increase in productivity and quality of livestock products; P090168 153,704 thousand tenge - to assess the quality of Kazakhstani cotton fiber. Article 18. To take into account that the republican budget for 2009 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty for the implementation of the State Program for the development of education in the Republic of Kazakhstan for 2005-2010 in the amount of 9 284 399 thousand tenge, including: 2 320 129 thousand tenge - for equipping classrooms of physics, chemistry, biology in state institutions of basic secondary and general secondary education with educational equipment; 2,428,910 thousand tenge - for the creation of language and multimedia classrooms in state institutions of primary, basic secondary and general secondary education; 4,535,360 thousand tenge - for the introduction of new learning technologies in the state education system. The distribution and procedure for using these amounts of targeted current transfers to regional budgets, budgets of Astana and Almaty cities are determined based on a decision of the Government of the Republic of Kazakhstan. Article 19. It should be noted that the republican budget for 2009 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty to attract foreign English teachers for professional lyceums as part of the implementation of the State Program for the Development of Vocational and Technical Education in the Republic of Kazakhstan for 2008-2012 in the amount of 187,200 thousand tenge. The distribution and procedure for using these amounts of targeted current transfers to regional budgets, budgets of Astana and Almaty cities are determined based on a decision of the Government of the Republic of Kazakhstan.

Article 20. To take into account that the republican budget for 2009 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty for the implementation of the State Program for the reform and development of healthcare in the Republic of Kazakhstan for 2005-2010 in the amount of 24 782 937 thousand tenge, including: KZT 9,272,618 thousand - for the material and technical equipment of medical healthcare organizations at the local level; KZT 15,510,319 thousand - to ensure and expand the guaranteed volume of free medical care. The distribution and procedure for using these amounts of targeted current transfers to regional budgets, budgets of Astana and Almaty cities are determined based on a decision of the Government of the Republic of Kazakhstan. Article 21. To provide in the republican budget for 2009 for the development and strengthening of rural social infrastructure within the framework of the implementation of the State Program for the development of rural areas of the Republic of Kazakhstan for 2004-2010 the costs in the amount of 46,203,433 thousand tenge, including: for the development of mobile and telemedicine in healthcare in rural areas - 1,583,078 thousand tenge; targeted transfers for development: construction and reconstruction of drinking water supply facilities in rural settlements - 18,903,482 thousand tenge; construction and reconstruction of educational facilities in rural areas - 11,026,250 thousand tenge; construction and reconstruction of healthcare facilities in rural areas - 14,690,623 thousand tenge. Article 22. It should be noted that the republican budget for 2009 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty to increase the amount of scholarships for students in technical and vocational, post-secondary education organizations based on the state educational order of local executive bodies in the amount of 1,765,645 thousand tenge. The distribution of these amounts of targeted current transfers to regional budgets, budgets of Astana and Almaty cities is determined based on a decision of the Government of the Republic of Kazakhstan. Article 23. To provide in the republican budget for 2009 for the receipt of transfers from regional budgets, the budgets of Astana and Almaty in connection with the transfer of powers of local executive bodies: in the field of emergency situations - 713,410 thousand tenge; in the field of sanitary and epidemiological surveillance - 10,740,087 thousand tenge. Receipts to the republican budget of the indicated amounts of transfers from regional budgets, budgets of Astana and Almaty cities are determined on the basis of a decision of the Government of the Republic of Kazakhstan. Article 24. To provide in the republican budget for 2009 targeted current transfers to regional budgets, budgets of Astana and Almaty for the implementation of transferred functions in the field of environmental protection within the framework of the division of powers between levels of government in the amount of 25,195 thousand tenge. The distribution of these amounts of targeted current transfers to regional budgets, budgets of Astana and Almaty cities is determined based on a decision of the Government of the Republic of Kazakhstan.

Article 25. To provide for 2,340,000 thousand tenge as part of the expenses of the Ministry of Agriculture of the Republic of Kazakhstan for state support of the development of the agro-industrial complex, including for financing, in accordance with the procedure determined by the decisions of the Government of the Republic of Kazakhstan, activities related to subsidies: interest rates on loans issued by financial institutions to agricultural processing enterprises to replenish their fixed and working capital, equipment leasing - 2,300,000 thousand tenge; P090171 agricultural production management systems - 40,000 thousand tenge. Article 26. It should be noted that the republican budget for 2009 provides funds for the repayment of tax and other debts of the liquidated departments of the Ministry of Agriculture of the Republic of Kazakhstan in the amount of 66,165 thousand tenge according to the list of legal entities and the amounts of debt determined by the Government of the Republic of Kazakhstan. Article 27. To provide, as part of the expenses of the Ministry of Energy and Mineral Resources of the Republic of Kazakhstan, funds to increase the authorized capital of Dostyk Energy Joint Stock Company to ensure the payment of debts of legal entities of the Republic of Kazakhstan to business entities of Turkmenistan in the amount of 477,481 thousand tenge. Article 28. To provide in the republican budget for 2009 for the implementation of the State Housing Construction Program in the Republic of Kazakhstan for 2008-2010 targeted development transfers to regional budgets, budgets of Astana and Almaty: for the construction and (or) purchase of housing of the state communal housing stock in the amount of 9 600 000 thousand tenge; for the development, improvement and (or) purchase of engineering and communication infrastructure in the amount of 40,939,900 thousand tenge. The distribution of these amounts of targeted development transfers to regional budgets, the budgets of Astana and Almaty cities is determined based on a decision of the Government of the Republic of Kazakhstan. Article 29. To provide 16,100,000 tenge in the republican budget for 2009 for lending to regional budgets, budgets of Astana and Almaty at a zero interest rate for the construction and (or) purchase of housing within the framework of the implementation of the State Housing Construction Program in the Republic of Kazakhstan for 2008-2010 in accordance with the procedure determined by the Government of the Republic of Kazakhstan. Article 30. To approve the reserve of the Government of the Republic of Kazakhstan for 2009 in the amount of 63,697,126 thousand tenge. The footnote. Article 31. To provide funds in the national budget for 2009 in the amount of 1,010,157 thousand tenge for the payment of government premiums on deposits in housing construction savings. Article 32. To provide in the republican budget for 2009 12,017 thousand tenge for the payment of the exchange rate difference on the 2008 payments of borrowers of preferential housing loans received through the closed joint-stock company Zhilstroybank. Article 33. It should be noted that the expenses of the Ministry of Emergency Situations of the Republic of Kazakhstan for the formation and storage of the state material reserve include funds in the amount of 4,708,237 thousand tenge, including funds from the sale of tangible assets issued in the order of refreshment, in the amount of 2,706,666 thousand tenge, reflected in the revenues of the republican budget. Article 34. To establish that, on the basis of a decision of the Government of the Republic of Kazakhstan, the claims of the Government of the Republic of Kazakhstan to borrowers liquidated in accordance with the legislation of the Republic of Kazakhstan as of January 1, 2009, on loans previously transferred to the balance sheet of the joint-stock company Fund for Financial Support of Agriculture on the basis of a Decree of the President of the Republic of Kazakhstan and separate acts of the Government of the Republic of Kazakhstan are terminated.

Article 35. To establish that from January 1, 2009, the requirements of the Government of the Republic of Kazakhstan to legal entities liquidated as of January 1, 2009 in accordance with the legislation of the Republic of Kazakhstan, for loans and funds allocated to fulfill obligations under state guarantees, according to the list of legal entities and the amount of debt determined by the Government of the Republic of Kazakhstan, cease.

Article 38. To set the government debt limit as of December 31, 2009 in the amount of 1,577,000,000 thousand tenge.

Article 39. To set a limit on the provision of state guarantees in 2009 in the amount of 70,000,000 thousand tenge.

Article 40. To establish that the limit of concession obligations of the Government of the Republic of Kazakhstan is not applied in 2009.

Article 41. To approve the list of republican budget programs that are not subject to sequestration in the process of executing the republican budget for 2009, according to Appendix 5. To establish that in the process of executing local budgets for 2009, local budget programs are not subject to sequestration in accordance with Appendix 6.

Article 42. This Law shall enter into force on January 1, 2009.
