About the republican budget for 2010 - 2012

Article 1. To approve the republican budget for 2010 - 2012 according to appendices 1, 2 and 3, respectively, including for 2010 in the following amounts: 1) revenues - 3 413 771 966 thousands of tenge, including for: tax receipts - 1 886 864 566 thousand tenge; non-tax receipts - 59,711,418 thousand tenge; proceeds from the sale of fixed assets - 26,378,092 thousand tenge; proceeds from transfers - 1 440 817 890 thousands of tenge; 2) costs - 3 897 666 677 thousands of tenge; 3) net budget lending - 35 467 864 thousand tenge, including: budget loans - 138,985,636 thousand tenge; repayment of budget loans - 103,517,772 thousand tenge; 4) balance of operations with financial assets - 284,278,703 thousand tenge, including: acquisition of financial assets - 284,778,703 thousand tenge; proceeds from the sale of financial assets of the state - 500,000 thousand tenge; 5) deficit - 803,641,278 thousand tenge, or 4.2 percent of the gross domestic product of the country; 6) financing of the budget deficit - 803,641,278 thousand tenge. Article 2. To provide in the republican budget for 2010 for the receipt of lease payments for the use of the Baikonur complex by the Russian Federation in the amount of KZT 17,250,000 thousand and military training grounds in the amount of KZT 3,717,900 thousand.
Article 3. To approve the volume of budget revenues for 2010, allocated to the National Fund of the Republic of Kazakhstan, according to Appendix 4.
Article 4. To establish that the income of the relevant budget includes: according to the code "Mineral Extraction Tax" of the revenue classification of the unified budget classification, the debt of subsurface users on royalties, as well as royalties on subsurface use contracts in which guarantees of stability of the tax regime are maintained.; according to the "Social Tax" code of the income classification of the unified budget classification, arrears of contributions previously transferred to the Pension Fund, the State Pension Payment Center, the Compulsory Medical Insurance Fund, the State Social Insurance Fund, the Employment Assistance Fund, as well as contributions from highway users previously received by the Road Fund. At the same time, taxpayers operating under subsurface use contracts, which maintain guarantees of stability of the tax regime, reduce the above-mentioned deductions or social tax by the amount of deductions to the State Social Insurance Fund, calculated in accordance with the Law of the Republic of Kazakhstan "On Compulsory Social Insurance"; according to the code "Gasoline (except aviation) of their own production, sold by manufacturers in bulk" - debt on gasoline collection, previously received by the Road Fund; according to the code "Diesel fuel of own production, sold by manufacturers in bulk" - the debt on collection from diesel fuel, previously received by the Road Fund.
Article 5. The negative balance formed as of December 31, 1998 as a result of the excess of the amounts of benefits accrued by employers for temporary disability, pregnancy and childbirth, at the birth of a child, and burial, paid from the State Social Insurance Fund, over the accrued amount of deductions to the specified fund, is monthly offset against the payment of social tax within 4 percent of the the salary fund.
Article 6. To provide in the republican budget for 2010 the volume of budget withdrawals from regional budgets, budgets of Astana and Almaty cities to the republican budget in the amount of 77 663 111 thousand tenge, including: Atyrau region - 18,739,180 thousand tenge; Mangystau region - 2,431,287 thousand tenge; Almaty city - 54,999,926 thousand tenge; Astana city - 1,492,718 thousand tenge.
Article 7. To provide in the republican budget for 2010 for the receipt of transfers from regional budgets, the budgets of Astana and Almaty in connection with: changes in the wage fund in the budgetary sphere, taking into account changes in the taxable base of social tax and individual income tax provided for in the calculation of general transfers approved by the Law of the Republic of Kazakhstan "On the volume of general transfers between the republican and regional budgets, budgets of the city of republican significance, the capital for 2008 - 2010" in the total amount of 29,005,216 thousand tenge; transfer of powers of local executive bodies: in the field of sanitary and epidemiological supervision - 12 130 368 thousand tenge; for the provision of inpatient and inpatient replacement medical care, except for medical care for infectious, tuberculosis and mental diseases - 120 785,873 thousand tenge; in the field of emergency situations - 833 503 thousand tenge; for the provision of emergency medical care to victims in the area of natural and man-made emergencies in accordance with the Law of the Republic of Kazakhstan "On Natural and man-made emergencies" - 258,487 thousand tenge; for the organization of public notification in accordance with the Law of the Republic of Kazakhstan "On Civil Defense" - 141,332 thousand tenge. Receipts to the republican budget of the indicated amounts of transfers from regional budgets, budgets of Astana and Almaty cities are determined on the basis of a decision of the Government of the Republic of Kazakhstan. Article 8. To provide in the republican budget for 2010 the amount of guaranteed transfer from the National Fund of the Republic of Kazakhstan in the amount of 1,200,000,000 thousand tenge. Article 9. To establish from January 1, 2010: 1) the minimum wage is 14,952 tenge; 2) the amount of the state basic pension payment is 5,981 tenge; 3) the minimum pension amount is 12,344 tenge; 4) the monthly calculation index for calculating benefits and other social benefits, as well as for the application of penalties, taxes and other payments in accordance with the legislation of the Republic of Kazakhstan - 1,413 tenge; 5) the minimum subsistence level for calculating basic social benefits - 14,952 tenge.
Article 10. The fulfillment of state guarantees to recipients of pension payments for the safety of mandatory pension contributions in accumulative pension funds in the amount of actually paid mandatory pension contributions, taking into account the inflation rate at the time the recipient acquires the right to pension payments is carried out under the republican budget program 002 "Pension Program" of the Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan in accordance with the procedure determined by the Government of the Republic of Kazakhstan.
Article 11. Starting from January 1, 2010, establish a monthly amount of monetary compensation for military personnel (except conscripts), employees of internal affairs bodies, as well as employees of operational search, investigative and combat units of fire service bodies, bodies and institutions of the penitentiary system of the Ministry of Justice of the Republic of Kazakhstan, financial police bodies to pay for housing maintenance and utilities in the amount of 3,739 tenge.
Article 12. To provide in the republican budget for 2010 the volume of subventions transferred from the republican budget to regional budgets in the amount of 645,354,441 thousand tenge, including: Akmola region - 42 771 759 thousand tenge; Aktobe region - 23 691 835 thousand tenge; Almaty region - 73 799 997 thousand tenge; East Kazakhstan region - 64 659 125 thousand tenge; Zhambyl region - 62 677 573 thousand tenge; West Kazakhstan region - 26 545 434 thousand tenge; Karaganda region - 50 337 692 thousand tenge; Kostanay region - 45,264,059 thousand tenge; Kyzylorda region - 51,506,999 thousand tenge; Pavlodar region - 21,736,991 thousand tenge; North Kazakhstan region - 40,432,203 thousand tenge; South Kazakhstan region - 141,930,774 thousand tenge.
Article 13. It should be noted that the republican budget for 2010 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty in the following amounts: 2,590,269 thousand tenge - for the maintenance of newly commissioned healthcare facilities; 10,001,916 thousand tenge - for the maintenance of newly commissioned educational facilities; 14,518 thousand tenge - for the purchase of equipment for Self-knowledge classrooms; 1,519,609 thousand tenge - to provide educational materials to preschool educational organizations, organizations of secondary, technical and vocational, post-secondary education, institutes of advanced training in the subject of "Self-knowledge"; 337,973 thousand tenge - for the maintenance of newly commissioned social security facilities; 14,700,984 thousand tenge - for the purchase of medicines, vaccines and others immunobiological preparations; 2,026,145 thousand tenge - for the introduction of standards of special social services; 202,346 thousand tenge - for the development of a network of day-care units in medical and social institutions; 453,467 thousand tenge - for placing a state social order in the non-governmental sector; 2,789,272 thousand tenge - for increasing nutrition standards in medical and social institutions; 4,153,631 thousand tenge - for the payment of one-time financial assistance to participants and invalids of the Great Patriotic War, as well as persons equated to them; military personnel, including those discharged from the reserve, who served from June 22, 1941 to September 3, 1945 in military units, institutions, and military educational institutions that were not part of the active army, and who were awarded the medal "For Victory over Germany in the Great Patriotic War of 1941-1945." or the medal "For Victory over Japan", to persons who worked (served) for at least six months in the rear during the Great Patriotic War, on the 65th anniversary of Victory in the Great Patriotic War; 90,979 thousand tenge - to provide travel for participants and invalids of the Great Patriotic War in the countries of the Commonwealth of Independent States, on the territory of the Republic of Kazakhstan, as well as payment to them and their accompanying persons for food, accommodation, travel to participate in festive events in the cities of Moscow and Astana for the 65th anniversary of Victory in the Great Patriotic War; 56,049 thousand tenge - for carrying out the operation "Poppy"; 2,751,529 thousand tenge - for the maintenance of local executive bodies in the field of veterinary medicine; 5,504,538 thousand tenge - for anti-epizootic measures; 7,836,918 thousand tenge - for the maintenance of public service centers; 3,019,649 thousand tenge - for subsidizing the cost of services for the supply of drinking water from particularly important group and local water supply systems that are alternative sources of drinking water supply; 8,549,489 thousand tenge - for the sale of state educational order in pre-school educational organizations; 1,115,973 thousand tenge - for the payment of state targeted social assistance; 2,967,928 thousand tenge - for the payment of state benefits for children under 18 years of age. The order of use (with the exception of paragraphs eight, nine, ten, eleventh, nineteenth, twenty-first and twenty-second) and the distribution of the indicated amounts of targeted current transfers to regional budgets, budgets of Astana and Almaty cities are determined on the basis of a decision of the Government of the Republic of Kazakhstan. Article 13-1. To take into account that the republican budget for 2010 provides targeted development transfers to regional budgets, the budget of the city of Almaty for the construction of new educational facilities in the amount of 11 271 765 thousand tenge. The distribution and procedure for using the specified amount of targeted development transfers to regional budgets and the budget of the city of Almaty are determined based on a decision of the Government of the Republic of Kazakhstan. Article 14. To take into account that the republican budget for 2010 provides funds for the implementation of the strategy of regional employment and staff retraining in the amount of 101,638,965 thousand tenge. Article 15. It should be noted that the republican budget for 2010 provides targeted current transfers to regional budgets, budgets of Astana and Almaty for capital and medium repairs of highways of regional, district significance and streets of Astana and Almaty in the amount of 22,137,335 thousand tenge. The distribution of the specified amount of targeted current transfers to regional budgets, budgets of Astana and Almaty cities is determined based on a decision of the Government of the Republic of Kazakhstan. Article 16. To provide in the republican budget for 2010 targeted current transfers to the regional budget of the Karaganda region in the amount of 537,958 thousand tenge for the maintenance of the infrastructure of the city of Priozersk in accordance with the Agreement between the Republic of Kazakhstan and the Russian Federation on the terms of use and lease of the Sary-Shagan test site and ensuring the vital activity of the city of Priozersk dated January 20, 1995.
Article 17. To provide in the republican budget for 2010 targeted current transfers to the regional budget of the Kyzylorda region to support the activities of the special representative of the President of the Republic of Kazakhstan at the Baikonur complex in the amount of KZT 18,498 thousand. Article 18. To provide funds in the republican budget for 2010 for the payment of one-time state monetary compensation to pensioners and recipients of state social benefits, as well as to the working and non-working population who lived and resided in radiation risk zones and in areas with preferential socio-economic status from 1949 to 1990, affected by nuclear tests at the Semipalatinsk test site nuclear test site, in the amount of 268,291 thousand tenge. To establish that these funds are allocated in accordance with the procedure determined by the Government of the Republic of Kazakhstan. The footnote. Article 19. To take into account that the republican budget for 2010 provides targeted current transfers to regional budgets, budgets of Astana and Almaty for the development of agriculture in the amount of 40,828,570 thousand tenge, including: 2,087,532 thousand tenge - to support seed production; 3,429,554 thousand tenge - to support breeding livestock; 14,205,685 thousand tenge - to reduce the cost of fuels and lubricants and other inventory items necessary for spring field and harvesting operations for priority crops determined by the Government of the Republic of Kazakhstan; 3,214,995 thousand tenge - to support the increase in yield and quality of agricultural crops; 1,492,338 thousand tenge - to subsidize the cost of water delivery services to agricultural producers; KZT 1,513,025 thousand - to ensure the laying and cultivation of perennial plantations of fruit and berry crops and grapes; KZT 13,130,000 thousand - to subsidize the increase in productivity and quality of livestock products; KZT 153,704 thousand - to examine the quality of Kazakhstani cotton fiber; KZT 56,072 thousand - to create forest plantations along the highway "Astana - Shchuchinsk" at the Shortandy - Shchuchinsk sites; 1,545,665 thousand tenge - for updating with special equipment and marine equipment of the subject of the state monopoly in the field of fisheries. The distribution and procedure for using these amounts of targeted current transfers to regional budgets, budgets of Astana and Almaty cities are determined based on a decision of the Government of the Republic of Kazakhstan. Article 20. It should be noted that the republican budget for 2010 provides for: targeted current transfers to regional budgets, budgets of Astana and Almaty for the implementation of social support measures for specialists in the social sphere of rural settlements in the amount of 650,776 thousand tenge; budget loans to regional budgets, budgets of Astana and Almaty for the implementation of social support measures for specialists in the social sphere of rural settlements items in the amount of KZT 3,560,760 thousand in accordance with the conditions determined by the Government of the Republic of Kazakhstan. The distribution of these amounts to the regional budgets, the budgets of the cities of Astana and Almaty is determined on the basis of a decision of the Government of the Republic of Kazakhstan. Article 21. To take into account that the republican budget for 2010 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty for the implementation of the State Program for the Development of education in the Republic of Kazakhstan for 2005-2010 in the amount of 4,872,670 thousand tenge, including: 2,330,625 thousand tenge - for equipping classrooms of physics, chemistry, biology in state institutions of basic secondary and general secondary education with educational equipment; 2,542,045 thousand tenge - for the creation of language and multimedia classrooms in public institutions of primary, basic secondary and general secondary education. The distribution and procedure for using these amounts of targeted current transfers to regional budgets, budgets of Astana and Almaty cities are determined based on a decision of the Government of the Republic of Kazakhstan. Article 22. It should be noted that the republican budget for 2010 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty to attract foreign English teachers for professional lyceums as part of the implementation of the State Program for the Development of Vocational and Technical education in the Republic of Kazakhstan for 2008 - 2012 in the amount of 233 220 thousand tenge. The distribution and procedure for using the specified amount of targeted current transfers to regional budgets, budgets of Astana and Almaty cities are determined based on a decision of the Government of the Republic of Kazakhstan. Article 23. To take into account that the republican budget for 2010 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty for the implementation of the State Program for the reform and development of healthcare in the Republic of Kazakhstan for 2005-2010 in the amount of 28,755,239 thousand tenge, including: 14,873,103 thousand tenge - for the material and technical equipment of medical healthcare organizations at the local level; 13,882,136 thousand tenge - to ensure and expand the guaranteed volume of free medical care. The distribution and procedure for using these amounts of targeted current transfers to regional budgets, budgets of Astana and Almaty cities are determined based on a decision of the Government of the Republic of Kazakhstan. Article 24. It should be noted that the republican budget for 2010 provides for targeted current transfers to regional budgets, the budgets of Astana and Almaty to increase the amount of scholarships for students in technical and vocational, post-secondary education organizations on the basis of a state educational order of local executive bodies in the amount of 3 110,925 thousand tenge. The distribution of the specified amount of targeted current transfers to regional budgets, budgets of Astana and Almaty cities is determined based on a decision of the Government of the Republic of Kazakhstan. Article 25. To provide in the republican budget for 2010 targeted current transfers to regional budgets, the budgets of Astana and Almaty for the implementation of transferred functions in the field of environmental protection within the framework of the division of powers between levels of government in the amount of 29 707 thousand tenge. The distribution of the specified amount of targeted current transfers to regional budgets, budgets of Astana and Almaty cities is determined based on a decision of the Government of the Republic of Kazakhstan. Article 26. To provide in the republican budget for 2010 for the implementation of the Nurly Kosh Program for 2009-2011 targeted development transfers to regional budgets, budgets of Astana and Almaty for the development, improvement and (or) acquisition of engineering and communication infrastructure in the amount of 5,626,461 thousand tenge. The distribution of the specified amount of targeted development transfers to regional budgets, budgets of Astana and Almaty cities is determined based on a decision of the Government of the Republic of Kazakhstan. Article 27. To provide funds in the republican budget for 2010 for crediting regional budgets, budgets of Astana and Almaty cities as part of the implementation of Nurly Kosh programs for 2009 - 2011: for construction and (or) purchase of housing in the amount of 8,968,499 thousand tenge; for employment in the field of greenhouse development in the amount of 850,598 thousand tenge. The distribution and procedure for the use of these amounts of loans to regional budgets, budgets of Astana and Almaty cities are determined on the basis of a decision of the Government of the Republic of Kazakhstan. Article 28. To provide for 5,042,609 thousand tenge as part of the expenses of the Ministry of Agriculture of the Republic of Kazakhstan for state support of the development of the agro-industrial complex, including for financing, in accordance with the procedure determined by decisions of the Government of the Republic of Kazakhstan, activities related to subsidies: interest rates on loans issued by financial institutions to agricultural processing enterprises to replenish their fixed and working capital, equipment leasing - 5,000,000 thousand tenge; agricultural production management systems - 42,609 thousand tenge. Article 29. To provide in the republican budget for 2010 for the implementation of the State Housing Construction Program in the Republic of Kazakhstan for 2008-2010 targeted development transfers to regional budgets, budgets of Astana and Almaty: for the construction and (or) purchase of housing of the state communal housing stock in the amount of 10 766 883 thousand tenge; for the development, improvement and (or) acquisition of engineering and communication infrastructure in the amount of 38,632,757 thousand tenge. The distribution of these amounts of targeted development transfers to regional budgets, the budgets of Astana and Almaty cities is determined based on a decision of the Government of the Republic of Kazakhstan. Article 30. To provide in the republican budget for 2010 17 500 000 thousand tenge for crediting regional budgets, budgets of Astana and Almaty at a zero interest rate for the construction and (or) purchase of housing in the framework of the implementation of the State Housing Construction Program in the Republic of Kazakhstan for 2008-2010 in accordance with the conditions determined by the Government of the Republic of Kazakhstan.
Article 31. To approve the reserve of the Government of the Republic of Kazakhstan for 2010 in the amount of 44,379,364 thousand tenge. The footnote. Article 32. To provide in the republican budget for 2010 funds in the amount of 1,804,675 thousand tenge for the payment of government premiums on deposits in housing construction savings. Article 33. To provide in the republican budget for 2010 12,601 thousand tenge for the payment of the exchange rate difference on 2009 payments of borrowers of preferential housing loans received through the closed joint-stock company Zhilstroybank. Article 34. It should be noted that the expenses of the Ministry of Emergency Situations of the Republic of Kazakhstan for the formation and storage of the state material reserve include funds in the amount of 5,888,474 thousand tenge, including the reflection in the revenues of the republican budget of funds from the sale of tangible assets issued in the order of refreshment in the amount of 5,202,092 thousand tenge. Article 35. To establish that, on the basis of a decision of the Government of the Republic of Kazakhstan, the claims of the Government of the Republic of Kazakhstan to borrowers liquidated in accordance with the legislation of the Republic of Kazakhstan as of January 1, 2010, on loans previously transferred to the balance sheet of the joint-stock company Fund for Financial Support of Agriculture on the basis of a Decree of the President of the Republic of Kazakhstan and separate acts of the Government of the Republic of Kazakhstan are terminated.
Article 36. To establish that from January 1, 2010, the requirements of the Government of the Republic of Kazakhstan to legal entities liquidated as of January 1, 2010 in accordance with the legislation of the Republic of Kazakhstan, for loans and funds allocated to fulfill obligations under state guarantees, according to the list of legal entities and amounts of debt determined by the Government of the Republic of Kazakhstan, cease.
Article 37. To provide in the republican budget for 2010 1,887,592 thousand tenge for repayment and servicing of government-guaranteed loans.

Article 41. To establish that the limit of concession obligations of the Government of the Republic of Kazakhstan is not applied in 2010.
Article 42. To approve the list of republican budget programs that are not subject to sequestration in the process of executing the republican budget for 2010, according to Appendix 5. To establish that local budget programs are not subject to sequestration in the process of executing local budgets for 2010, according to Appendix 6.
Article 43. This Law shall enter into force on January 1, 2010.
