A criminal case is pending against the U.K.K., suspected of committing a crime under Articles 24, parts 1-120, Part 1 of the Criminal Code of the Republic of Kazakhstan, registered in the ERDR for No. 231962031002008.

According to Part 1 of Article 10 of the CPC of the Republic of Kazakhstan, the court, prosecutor, investigator, body of inquiry and inquirer in criminal proceedings are required to strictly comply with the requirements of the Constitution of the Republic of Kazakhstan, this Code, and other regulatory legal acts specified in Article 1 of this Code.

According to Part 1 of Article 15 of the Criminal Procedure Code of the Republic of Kazakhstan, the body conducting criminal proceedings is obliged to protect the rights and freedoms of citizens participating in criminal proceedings, create conditions for their implementation, and take timely measures to meet the legitimate demands of participants in criminal proceedings.

However, the staff of the Talgar district Police Department grossly violated the above requirements of the Criminal Procedure Code of the Republic of Kazakhstan.

According to the U.K.'s explanation, on the night of July 10, 2023, he was taken, accompanied by police officers, to a medical facility for examination. Due to his ignorance of Kazakh and Russian languages, he does not know the exact name of the institution. He was held in the same facility until 9:00 a.m. on July 10, 2023. The same police officers seized his passport of a citizen of the Republic of Uzbekistan.

At 9:00 a.m. on July 10, 2023, U.K.K. was taken to the Talgar district Police Department, accompanied by police officers, where he stayed with them during the day. Then the police officers took him back to the medical facility, where he had previously been examined and he spent the night there from July 10 to July 11, 2023.

On the morning of 07/11/2023, U.K.K. was taken to the Talgar district police Department and police officers were with him during the day. Police officers then took him to an institution, as he understood it, for people without a fixed place of residence, where he subsequently spent the night from July 11 to July 12, and then the night from July 12 to July 13, 2023. All this time, his freedom of movement was restricted by police officers.

However, there is no information in the materials of the criminal case that U.K.K. was detained.

According to the detention protocol, U.K.K. was detained only at 3:30 p.m. on July 13, 2023.

Thus, during the period from 09.00 hours on July 10, 2023 to 15.30 hours on July 13, 2023, U.K.K. was restricted in movement by police officers of the Talgar district police Department without appropriate legal grounds.

Thus, the actions of the staff of the Talgar district Police Department show signs of a criminal offense under Article 362 of the Criminal Code of the Republic of Kazakhstan.

Based on the above, please:

- to initiate a criminal case on the fact of abuse of power or official authority in relation to unidentified employees of the Talgar district Police Department.
