STATEMENT

regarding the commission of a criminal offense

I, SED, hereby request that a pre-trial investigation be conducted and that a legal assessment be given to the actions of Andrey Sergeyevich La, related to coercing me and my wife into writing acknowledgments stating that we had allegedly received money from him as loans, whereas in fact no independent loan relationships existed between us.

On 2 March 2026, Lym A.S., as the Customer, and IE “B. E.”, as the Agent, entered into Agreement No. 214 for the provision of services related to the search for and selection of a vehicle, as well as assistance in the purchase and registration process. I was directly involved in the conclusion and performance of the said agreement.

The subject matter of the agreement was the purchase and delivery from the Republic of Korea of a 2022 Porsche 911 Turbo S, with a purchase price of USD 210,000. The funds in the amount of USD 210,000 were handed over in cash to Lym A.S. specifically for the purpose of performing the said agreement and purchasing the vehicle. The agreement and its annex expressly provide for a Porsche 911 Turbo S with a value of USD 210,000.

The funds received were intended for the performance of the contractual obligations. Subsequently, I transferred the funds to persons located in the Republic of Korea for the purpose of purchasing the vehicle. However, due to circumstances beyond my control, those persons failed to perform their obligations in a timely manner, as a result of which the vehicle was not delivered to Lym A.S. within the agreed period.

Following the occurrence of this situation, Lym A.S. began exerting psychological pressure on me, repeatedly threatening to contact law-enforcement authorities with a complaint of fraud and to have me prosecuted. He stated that, if I failed to comply with his demands, he would ensure that I was prosecuted and would “have me put in prison” for fraud.

Under such pressure, Lym A.S., together with his representative, demanded that I write an acknowledgment in such a manner as to make it appear that a completely different legal relationship — namely, a loan agreement — existed between us.

In fact, on 27 July 2026, at the demand of Lym A.S., I was forced to write an acknowledgment in my own handwriting in which I was compelled to state a date that did not correspond to the actual circumstances, namely 1 March 2026, and to state that I had allegedly received KZT 55,000,000 from Lym A.S. as a loan and undertook to repay the amount by 17 July 2026.

In reality, on 1 March 2026, Lym A.S. did not provide me with KZT 55,000,000 as a loan, and no separate loan agreement was concluded between us. The said acknowledgment was connected with the obligations that had already arisen under Agreement No. 214 and was written later under the pressure exerted upon me.

The acknowledgment itself states that it was allegedly executed on 1 March 2026, that I allegedly received KZT 55,000,000 from Lym A.S. as a loan, and that I was required to repay the amount by 17 July 2026.

Similarly, under the pressure exerted upon her, my wife, K.A.Yu., was forced to write an acknowledgment stating that she had allegedly received KZT 50,000,000 from Lym A.S. as a loan, although in fact Lym A.S. did not transfer the said funds to her and no separate loan relationship existed between them. The acknowledgment executed by K.A.Yu. also bears the date 1 March 2026, although in fact it was prepared later, namely on 27 July 2026.

Thus, the two acknowledgments were prepared in such a manner as to create the appearance that Lym A.S., independently of Agreement No. 214, had separately provided me with KZT 55,000,000 and my wife with an additional KZT 50,000,000 as loans, which in fact never occurred.

Subsequently, Lym A.S. used the said acknowledgment to file a separate claim with the Taraz City Court of the Zhambyl Region against me for recovery of the alleged loan debt. In his statement of claim, he alleged that on 1 March 2026 a loan agreement had allegedly been concluded between us and that he had allegedly handed over KZT 55,000,000 in cash to me.

At the same time, the actual circumstances surrounding the origin of the acknowledgment, its connection with Agreement No. 214 dated 2 March 2026, and the fact that KZT 55,000,000 had not been separately transferred to me as a loan were not disclosed in the statement of claim.

Under the continuing pressure associated with threats to contact law-enforcement authorities and have me prosecuted for fraud, I subsequently also agreed to enter into a settlement agreement in the said civil case. By a ruling of the Taraz City Court dated 12 August 2026, the settlement agreement was approved, and I was ordered to pay KZT 31,600,000 to Lym A.S.

I particularly draw attention to the fact that Lym A.S. has now filed a new claim in which he himself states that the USD 210,000 initially transferred by him was provided exclusively in connection with the performance of Agreement No. 214 and was intended for the purchase of the vehicle, and also states that it was I who received those funds in connection with the performance of that agreement.

In my opinion, these circumstances confirm the need to investigate the circumstances under which the acknowledgments concerning the alleged independent loans came into existence, whether any separate transfer of funds under those acknowledgments actually took place, and for what reason the date 1 March 2026 was indicated in the acknowledgments.

I believe that the circumstances set out above require a full-scale pre-trial investigation, including verification of whether the actions of Lym A.S. contain elements of the criminal offense provided for by Article 248 of the Criminal Code of the Republic of Kazakhstan, as well as any other criminal offenses, the legal classification of which should be determined by the criminal prosecution authority based on the circumstances established during the investigation.

I have been warned of criminal liability for knowingly making a false report under Article 419 of the Criminal Code of the Republic of Kazakhstan.

Based on the foregoing and pursuant to Articles 71, 73, 167, 179 and 181 of the Criminal Procedure Code of the Republic of Kazakhstan,

I REQUEST THAT YOU:

  1. Register the criminal case in the Unified Register of Pre-Trial Investigations against Lym A.S. on the grounds of the criminal offense provided for by Article 248 of the Criminal Code of the Republic of Kazakhstan (coercion to enter into a transaction or to refuse to enter into a transaction).
  2. Recognize me, SED, and my wife, K.A.Yu., as victims in the criminal case.
  3. Recognize me, SED, and my wife, K.A.Yu., as civil claimants.
  4. Conduct a comprehensive, complete and objective pre-trial investigation and take all measures provided for by law.

Respectfully,

S. E.D.
