I DECREE:
1. To create the republican state institution "Presidential Center of the Republic of Kazakhstan" on the basis of the multifunctional scientific, analytical, humanitarian and educational state institution "Nazarbayev Center".

2. Approve the attached Library Charter.
3. Establish a staff strength of the Library in the amount of 110 units.

4. To the Government of the Republic of Kazakhstan in accordance with the procedure established by the legislation of the Republic of Kazakhstan:
1) to create the republican state institution "National Art Gallery "Astana" of the Ministry of Culture of the Republic of Kazakhstan (hereinafter - the gallery "Astana");
2) ensure the transfer to the Astana Gallery of the Nazarbayev Center's staff in the amount of 269 units and the property assigned to the Nazarbayev Center, ensuring the safety of funds and the functioning of the Astana Gallery;
3) to ensure the establishment of official salaries (rates) of specialists and employees of the Library;
4) ensure the state registration of the Library;
5) take other measures resulting from this Decree.
5. To approve amendments and additions to certain decrees of the President of the Republic of Kazakhstan and to invalidate certain decrees of the President of the Republic of Kazakhstan in accordance with the annex to this Decree.
6. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.
7. This Decree shall enter into force from the date of signing.

The Charter of the state Institution "Library of the First President of the Republic of Kazakhstan - Elbasy"

1. General provisions
1. The state Institution "Library of the First President of the Republic of Kazakhstan - Elbasy" (hereinafter referred to as the state institution) is a non-profit organization with the status of a legal entity established in the organizational and legal form of a state institution.
2. Type of state institution: republican.
3. The state institution was established by Decree of the President of the Republic of Kazakhstan dated March 13, 2014 No. 767 "On certain issues of the state institution Library of the First President of the Republic of Kazakhstan - Elbasy".
4. The founder of the state institution is the President of the Republic of Kazakhstan.
5. The authorized body for the management of the relevant branch (sphere) of public administration is the Office of the First President of the Republic of Kazakhstan – Elbasy (hereinafter referred to as the authorized body).

6. Full name of the state institution:
1) in the official language: "Kazakhstan Republikasyn Tumysh Presidenti - Elbasyn kitapkhanasy" memlekettik mekemesi;
2) in Russian: the state institution "Library of the First President of the Republic of Kazakhstan - Elbasy".
7. Location of the state institution: Building 1, Alikhan Bokeikhan Street, Nur-Sultan city, 010000, Republic of Kazakhstan.

2. Legal status of a public institution
8. A state institution is considered established and acquires the rights of a legal entity from the moment of its state registration.
9. A state institution has an independent balance sheet, bank accounts in accordance with the legislation of the Republic of Kazakhstan, seals, letterheads with the image of the State Emblem of the Republic of Kazakhstan and stamps of the established pattern with the name in the state and Russian languages.
10. A state institution may not create or act as a founder (participant) of another legal entity.
11. A State institution is liable for its obligations with the money at its disposal. If a state institution does not have enough money, the Republic of Kazakhstan bears subsidiary responsibility for its obligations.
12. Civil law transactions concluded by a state institution come into force after their mandatory registration in the territorial division of the Treasury of the Ministry of Finance of the Republic of Kazakhstan.
13. In its activities, the state institution is guided by the Constitution of the Republic of Kazakhstan, the Civil Code of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan, other regulatory legal acts, as well as this Charter.
3. The subject, objectives, and activities of a government agency
14. The main subject of the activity of the state institution is to ensure the functioning of the personal library, personal archive and museum of the First President of the Republic of Kazakhstan - Elbasy; scientific, methodological and cultural support for the process of accumulation and study of materials related to the life, state and public activities of the First President of the Republic of Kazakhstan - Elbasy, as well as scientific, analytical, information and image promotion at home and abroad, his creative ideas and strategic initiatives.
15. The objectives of the activity of the state institution are:
1) organization of the work of the personal library, personal archive and museum of the First President of the Republic of Kazakhstan - Elbasy;
2) studying the history of the formation and development of the Republic of Kazakhstan, the leading role of the First President of the Republic of Kazakhstan, Elbasy, in this process, the content of his creative ideas and strategic initiatives;
3) information and image promotion of creative ideas and strategic initiatives of the First President of the Republic of Kazakhstan - Elbasy;
4) cultural, scientific and methodological support for the process of accumulation and study of historical, cultural and socio-political information based on the comprehensive collection, systematization, storage, research and popularization of materials related to the life, state and public activities of the First President of the Republic of Kazakhstan - Elbasy.
16. In order to achieve these goals, the state institution carries out the following types of activities::
1) acquisition, accounting, systematization, replenishment, preservation and use of the personal library, personal archive and museum of the First President of the Republic of Kazakhstan - Elbasy;
2) study of archival and museum collections in order to gain new knowledge about the life and work of the First President of the Republic of Kazakhstan, Elbasy, about the main facts of his biography, the stages of public and state activities, the formation and achievements of the Institute of the presidency during the years of independence of Kazakhstan;
3) library and bibliographic, archival, scientific and analytical, information and reference support for the activities of the First President of the Republic of Kazakhstan - Elbasy;
4) ensuring public access to the materials of the personal library, personal archive and museum of the First President of the Republic of Kazakhstan - Elbasy;
5) holding exhibitions abroad on the basis of library, archival and museum funds, as well as hosting and organizing exhibitions in foreign countries;
6) scientific design and organization of museum expositions and exhibitions, scientific processing of funds, development of scientific concepts of the main directions of library, archival and museum activities;
7) conducting excursions, lectures, seminars, classes of clubs and other events with various categories of visitors;
8) acquisition of the museum collection, which includes the following forms: collection work, purchase of objects of museum significance, gratuitous transfer of objects for permanent storage;
9) carrying out scientific work to ensure state accounting of the museum fund and its inclusion in the museum fund of the Republic of Kazakhstan, ensuring the legal and physical protection of museum valuables;
10) participation in the logistical, technological, organizational, financial, scientific and methodological support of the process of collecting, storing, studying and using the national cultural heritage of the country;
11) methodological, scientific, methodological, information and technological support of the documentary base of research and propaganda activities of the state institution;
12) promotion and dissemination of the results of scientific research, methodological and restoration activities of the state institution;
13) creation of a rational storage system and conditions ensuring the complete safety of library, archival and museum materials, guaranteeing their protection from destruction, spoilage, theft;
14) restoration of library, archival and museum materials;
15) development and development of scientific reference equipment for library, archival and museum collections, as well as the creation of conditions for their public use;
1) organization of the work of the personal library, personal archive and museum of the First President of the Republic of Kazakhstan - Elbasy;
2) studying the history of the formation and development of the Republic of Kazakhstan, the leading role of the First President of the Republic of Kazakhstan, Elbasy, in this process, the content of his creative ideas and strategic initiatives;
3) information and image promotion of creative ideas and strategic initiatives of the First President of the Republic of Kazakhstan - Elbasy;
4) cultural, scientific and methodological support for the process of accumulation and study of historical, cultural and socio-political information based on the comprehensive collection, systematization, storage, research and popularization of materials related to the life, state and public activities of the First President of the Republic of Kazakhstan - Elbasy.
16. In order to achieve these goals, the state institution carries out the following activities::
1) acquisition, accounting, systematization, replenishment, preservation and use of the personal library, personal archive and museum of the First President of the Republic of Kazakhstan - Elbasy;

13) creation of a rational storage system and conditions ensuring the complete safety of library, archival and museum materials, guaranteeing their protection from destruction, spoilage, theft;
14) restoration of library, archival and museum materials;
15) development and development of scientific reference equipment for library, archival and museum collections, as well as the creation of conditions for their public use;
16) organization of research and expert-analytical work on the study of the history of the formation and development of the Republic of Kazakhstan, the contribution to the development of sovereign Kazakhstan of the First President of the Republic of Kazakhstan - Elbasy, current problems of domestic and foreign policy in the context of his creative ideas and strategic initiatives, including conducting opinion polls, compiling analytical reviews on the profile of the activity of the state institution;
17) organization of information and image work to highlight and popularize the life and work of the First President of the Republic of Kazakhstan, Elbasy, his creative ideas and initiatives, including the development, publication, dissemination, examination of relevant research, methodological, expert, analytical and journalistic literature, including: catalogs, guidebooks, reference books, albums, collections of scientific papers;
18) formation of a dialogue and expert platform for the promotion of creative ideas and strategic initiatives of the First President of the Republic of Kazakhstan, Elbasy, organization and participation in thematic scientific, theoretical, scientific and practical conferences, symposiums, congresses, seminars, trainings, round tables, meetings of expert clubs, socially significant events, exhibitions in In the Republic of Kazakhstan and abroad;
19) cooperation with foreign and international organizations in the field of public institution activities, including participation in the development and implementation of scientific and cultural programs of domestic and foreign organizations aimed at explaining and promoting global ideas and strategic initiatives of the First President of the Republic of Kazakhstan - Elbasy;
20) participation in the implementation of state scientific programs, projects, as well as in grant application activities in accordance with the legislation of the Republic of Kazakhstan;
21) participation in the organization of events with the participation of the First President of the Republic of Kazakhstan - Elbasy in the field of activity of a state institution;
22) participation in the formation and implementation of state policy in the field of culture, as well as educational, educational and humanitarian activities, including through the development of educational and educational programs for all levels of education, individual lectures and seminars in accordance with the profile of the state institution;
23) support, including through grants and scholarships, legal entities and individuals of the Republic of Kazakhstan, foreign and international organizations, and foreign citizens to achieve the goals and objectives of a public institution;
24) organization of measures to improve the professional qualifications of specialists in various fields in the field of activity of a public institution.
When carrying out the activities of a government agency:
1) cooperates with the media;
2) represents the interests of the Republic of Kazakhstan in international organizations on behalf of the First President of the Republic of Kazakhstan - Elbasy;
3) carries out foreign economic activity within the limits of its statutory activities;
4) carries out currency transactions within the scope of its statutory activities;
5) sends employees of a state institution on a contractual basis for internships, advanced training and training in domestic and foreign research and educational organizations;
6) purchases library, archival and museum items and documents on a contractual basis from any organizations and individuals;
7) carries out other types of activities and makes transactions that meet the requirements of the legislation of the Republic of Kazakhstan and do not contradict the Charter of the state institution.
17. A state institution may not engage in activities that do not correspond to the subject matter and objectives of its activities set out in the Charter.
18. A transaction made by a state institution in contradiction with the objectives of its activities, which are clearly limited by the laws of the Republic of Kazakhstan or the constituent documents, or in violation of the statutory competence of the head, may be declared invalid at the request of the authorized body or the authorized body for state property, or the prosecutor.
19. The actions of the head and the person acting in his absence aimed at carrying out non-statutory activities by a state institution are a violation of labor duties and entail the application of disciplinary, material and other liability measures.
4. Management of a public institution
20. The general management of a state institution is carried out by an authorized body.
21. The authorized body performs the following functions in accordance with the procedure established by the legislation of the Republic of Kazakhstan:
1) assigns property to a state institution;
2) approves the budget program and the individual financing plan of the state institution;
3) exercises control over the safety of property and approves in-kind standards for the provision of public institutions;
4) determines the structure, procedure for the formation and term of office of the governing bodies of a state institution, and the procedure for making decisions by a state institution;
5) defines the rights, duties and responsibilities of the director of a public institution (hereinafter referred to as the director);
6) approves the structure, the register of positions of civil servants and the staffing table of the state institution;
7) approves the annual financial statements;
8) performs an internal audit of a public institution;
9) gives consent to the authorized body for state property for the withdrawal or redistribution of property transferred to a state institution or acquired by it as a result of its own economic activities;
10) gives consent to the establishment of branches and representative offices by a state institution;
11) in coordination with the authorized body for state property, reorganizes and liquidates the republican state institution;
12) performs other functions established by the legislation of the Republic of Kazakhstan.
22. The Director is appointed and dismissed by the President of the Republic of Kazakhstan on the recommendation of the Head of the Office of the First President of the Republic of Kazakhstan – Elbasy and in coordination with the First President of the Republic of Kazakhstan – Elbasy.

23. The Director organizes and directs the work of the state institution, is directly subordinate to the Office of the First President of the Republic of Kazakhstan – Elbasy and is personally responsible for the exercise of his functions and the fulfillment of the tasks assigned to the state institution.

24. The Director acts on the principles of unity of command and independently decides on the activities of the state institution in accordance with its competence, determined by the legislation of the Republic of Kazakhstan and this Charter.
25. When carrying out the activities of a public institution, the director in accordance with the procedure established by law:
1) acts on behalf of a government agency without a power of attorney;
2) represents the interests of a government agency in government agencies and other organizations;
3) concludes contracts;
4) issues power of attorney;
5) approves the procedure and plans of the state institution for business trips, internships, training of employees in Kazakh and foreign training centers and other types of professional development of employees;
6) opens bank accounts;
7) issues orders and gives instructions that are mandatory for all employees of a public institution;
8) in coordination with the Office of the First President of the Republic of Kazakhstan, Elbasy appoints and dismisses his deputies and chief accountant.;
9) according to the staffing table, carries out the recruitment and dismissal of employees of a public institution;
10) applies incentive measures and imposes disciplinary penalties on employees of a public institution in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
11) determines the duties and terms of reference of his deputies and other senior staff of the state institution;
12) performs other functions assigned to him by the legislation of the Republic of Kazakhstan and this Charter.

5. The procedure for the formation of property and financing of the activities of a public institution
26. The property of a public institution consists of assets, the value of which is reflected on its balance sheet. The property of a state institution is formed at the expense of:
1) property transferred to him by the owner;
2) property (including monetary income) acquired as a result of own activities;
3) other sources not prohibited by the legislation of the Republic of Kazakhstan.
27. A state institution shall not have the right to independently alienate or otherwise dispose of the property assigned to it and property acquired at the expense of funds allocated to it under the financing plan.
28. According to the legislation of the Republic of Kazakhstan, a state institution is granted the right to carry out income-generating activities and manage money received for the sale of goods (works, services) produced in accordance with the laws of the Republic of Kazakhstan in the following areas of activity:
1) making copies from all types of media, formats, standards and their processing;
2) production of materials for citizens with disabilities;
3) organization and holding of exhibitions, seminars, conferences, meetings, symposiums, trainings, round tables, congresses;
4) examination of books, educational and methodical literature and other materials about the First President of the Republic of Kazakhstan - Elbasy;
5) publication and distribution of books, scientific research, scientific-methodical, expert-analytical and journalistic literature;
6) dissemination of the results of the development and research of a public institution;
7) conducting research and consulting services.
29. The activities of a state institution are financed from the republican budget by the authorized body, unless an additional source of financing is established by the laws of the Republic of Kazakhstan.
30. The state institution maintains accounting records and submits reports in accordance with the legislation of the Republic of Kazakhstan.
31. The audit and revision of the financial and economic activities of a state institution shall be carried out by the authorized body in accordance with the procedure established by law.
32. A State institution has the right to receive funds from legal entities and individuals in the form of grants, sponsorship and charitable assistance in accordance with legislative acts.
6. Working hours in a public institution
33. The mode of operation of a state institution is established by the rules of the internal labor regulations and should not contradict the norms of the labor legislation of the Republic of Kazakhstan.
7. The procedure for making amendments and addenda to the constituent documents
34. Amendments and additions to the Charter of a state institution are made by decision of the President of the Republic of Kazakhstan.
35. Amendments and additions to the Charter of a state institution are registered in accordance with the legislation of the Republic of Kazakhstan.
8. Conditions of reorganization and liquidation of a public institution
36. The reorganization and liquidation of a state institution are carried out in accordance with the decision of the President of the Republic of Kazakhstan.
9. Information about branches and representative offices of a government agency
37. A state institution has the right to have branches and representative offices in the territory of the Republic of Kazakhstan and in foreign countries.

AMENDMENTS AND ADDITIONS to certain acts of the President of the Republic of Kazakhstan, and the list of certain laws of the President of the Republic of Kazakhstan that have become invalid
1. To amend and supplement the following decrees of the President of the Republic of Kazakhstan:
1) abrogated by Decree of the President of the Republic of Kazakhstan dated 07/31/2023 No. 290.2) abrogated by Decree of the President of the Republic of Kazakhstan dated 05.05.2018 No. 681;
3) dated March 7, 2013 No. 523 "On approval of the Register of positions of civil servants" (SAPP of the Republic of Kazakhstan, 2013, No. 19, art. 320):
in the Register of positions of Civil Servants approved by the above-mentioned Decree:
in the section "Political government positions":
after the line "Special Representatives of the President of the Republic of Kazakhstan", add the following line:
"Director of the Library of the First President of the Republic of Kazakhstan - Elbasy, Executive Director, Deputy Directors."

2) dated March 5, 2012 No. 278 "On approval of the Charter of the multifunctional scientific-analytical and humanitarian-educational state institution "Nazarbayev Center" (SAPP of the Republic of Kazakhstan, 2012, No. 35, art. 457).
