About the formation of the Council for the Development of Artificial Intelligence

Decree of the President of the Republic of Kazakhstan dated May 19, 2025 No. 881.

I DECREE:

     1. To form a Council for the development of artificial Intelligence.

     2. To approve the attached Regulations on the Council for the Development of Artificial Intelligence.

     3. This Decree shall enter into force from the date of its signing.

Regulations on the Council for the Development of Artificial Intelligence

Chapter 1. General provisions

     1. The Council for the Development of Artificial Intelligence (hereinafter referred to as the Council) is an advisory body under the President of the Republic of Kazakhstan.

     2. In its activities, the Council is guided by the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan, as well as these Regulations.

     3. The Council consists of the Chairman, the Secretary and the members of the Council.

     4. The Council's decisions are advisory in nature.

     5. The activities of the Council are provided by the Administration of the President of the Republic of Kazakhstan and the working body of the Council.

     6. The working body of the Council is the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan (hereinafter referred to as the working body of the Council).

     7. By the decision of the Chairman of the Council, working groups of the Council (hereinafter referred to as working groups) may be established in order to implement the tasks assigned to him.

Chapter 2. The main tasks of the Council

     8. The Council was established for the purpose of effectively solving problems related to the development of artificial intelligence in the Republic of Kazakhstan, as well as monitoring their implementation.

     9. The main objectives of the Council are:

     1) development of proposals and recommendations for conceptual approaches in the development of public policy in the field of artificial intelligence;

     2) development of proposals and recommendations for improving the legislation of the Republic of Kazakhstan in the field of artificial intelligence;

     3) development of proposals and recommendations for industry planning documents for the development of artificial intelligence;

     4) providing consulting support and expertise of projects in the field of artificial intelligence;

     5) development of recommendations for the results of the assessment of the level of development of artificial intelligence in the sectors of the economy of the Republic of Kazakhstan;

     6) identification of priority industries for the creation of working groups for the effective implementation of industry initiatives in the field of artificial intelligence;

     7) participation in the review and formation of programs and projects in the field of artificial intelligence of international importance;

     8) assistance in establishing cooperation with similar councils of other countries and international organizations in the field of artificial intelligence.

Chapter 3. The procedure for forming the composition of the Council

     10. The Chairman of the Council is the President of the Republic of Kazakhstan.

     11. The Secretary of the Council is the Minister of Artificial Intelligence and Digital Development of the Republic of Kazakhstan.

     12. The members of the Council from the Kazakh side are ex officio: Prime Minister of the Republic of Kazakhstan, Head of the Presidential Administration of the Republic of Kazakhstan, Deputy Heads of the Presidential Administration of the Republic of Kazakhstan, Chairman of the National Security Committee of the Republic of Kazakhstan, Chairman of the Board of the National Welfare Fund Samruk-Kazyna Joint Stock Company (as agreed), Assistant to the President of the Republic of Kazakhstan in charge of Minister of Foreign Affairs of the Republic of Kazakhstan, Minister of Science and Higher Education of the Republic of Kazakhstan, Minister of Artificial Intelligence and Digital Development of the Republic of Kazakhstan and Advisor to the President of the Republic of Kazakhstan on International Issues.

     13. The members of the Council from the foreign side are representatives of international organizations in the field of artificial intelligence, the first heads of foreign companies or their deputies, determined in accordance with the procedure provided for in paragraphs 14-16 of these Regulations.

     14. For admission to the Council, representatives of international organizations and foreign companies (hereinafter referred to as applicants) who have expressed a desire to participate in the Council may apply to the Council's working body on their own initiative or in response to an invitation from the Council's working body, providing information about their activities.

     15. The main criteria for admission to the Council from a foreign party are:

     1) recognized expertise in the relevant field, confirmed by successful work experience, the introduction of innovative approaches and achievements that ensure a real impact on the industry;

     2) impeccable business reputation, confirmed by stable partnerships, successful implementation of international projects and commitment to ethical principles;

     3) willingness to actively participate in the activities of the Council.

     16. Applicants' applications are considered by the working body of the Council in the order of priority of their receipt for compliance with the criteria established by paragraph 15 of these Regulations.

     17. If, in accordance with the recommendation of the Council's working body, the applicant does not meet the criteria set out in paragraph 15 of these Regulations, but carries out activities in the priority sector of the economy and makes a significant contribution to the development of artificial intelligence, the applicant may be included in the Council's working groups.

     18. The Council may include other officials of the Republic of Kazakhstan, as determined by the President of the Republic of Kazakhstan.

     19. The personal composition of the Council is approved by the President of the Republic of Kazakhstan.

Chapter 4. Organization of the Council's activities

     20. The activities of the Council are managed by the Chairman of the Council, including:

     1) approves the agenda of the Council meeting;

     2) decides on holding a meeting of the Council;

     3) considers the petitions of the Council members on the issues of the Council's activities and the agenda of the Council meeting;

     4) signs the minutes of the Council meetings;

     5) makes decisions on other issues of the Council's activities.

     21. Members of the Council may:

     1) submit petitions on the Council's activities and the agenda of its meetings;

     2) participate in the preparation of materials for the meetings of the Council;

     3) to participate in the discussion of issues considered at the meetings of the Council.

     22. Members of the Council may not delegate their powers to other officials.

     23. Secretary of the Council:

     1) monitors the execution of the Chairman's instructions and decisions taken at Council meetings;

     2) may involve relevant experts and specialists in accordance with the established procedure for the implementation of certain types of work.;

     3) exercise other powers on the instructions of the Chairman.

     24. The working body of the Council:

     1) provides information and analytical support and support for the activities of the Council;

     2) submits the agenda of the meeting to the Chairman of the Council.;

     3) collects and systematizes materials for Council meetings, monitors the proper preparation of Council materials, as well as materials for interim meetings and thematic meetings.;

     4) provides preparation and support for Council meetings, interim meetings, and thematic meetings;

     5) keeps minutes of Council meetings, interim meetings and thematic meetings;

     6) notify the members of the Council of changes in the composition, position of the Council and other changes;

     7) monitors the progress of the implementation of the decisions taken in accordance with the consolidation of control;

     8) interacts with government agencies, organizations and other persons within the competence of the Council;

     9) ensures the provision of minutes of the Council, interim meetings and thematic meetings to interested bodies and persons.

     25. Meetings of the Council are held at least once a year. The Council's decisions are made by a majority vote. In the case of an equal distribution of votes, the vote of the Chairman of the Council is decisive.

     26. The Council meeting includes a discussion of the report on the execution of the protocol instructions of the previous meeting, consideration of the main topic of the meeting, a final report on the recommendations developed by the Council's working groups during the year, as well as discussion of other issues.

     27. Materials on the agenda of the Council meeting (references, presentations, draft minutes, lists of speakers and participants) are submitted by government agencies to the Council's working body at least two months before the meeting, unless otherwise provided in the decision to convene the meeting.

     28. Materials on the agenda of the Council meeting (references, presentations, draft minutes, lists of speakers and participants) are submitted by the working body of the Council to the Administration of the President of the Republic of Kazakhstan at least one month before the meeting, unless otherwise provided in the decision to convene the meeting.

     29. The decisions of the Council are formalized by the protocol.

     30. The working body of the Council, within one month from the date of the Council meeting, prepares a draft protocol with the attachment of securing control over the implementation of instructions and ensures its coordination with all interested government agencies and the Head of the Presidential Administration of the Republic of Kazakhstan.

31. In the period between the meetings of the Council, an interim meeting is held under the chairmanship of the Head of the Presidential Administration of the Republic of Kazakhstan.

     32. If necessary, the Head of the Presidential Administration of the Republic of Kazakhstan holds additional thematic meetings with the co-chairs of the Council's working groups.

     33. Interim meetings and thematic meetings may be attended by members of the Council, heads of government agencies of the Republic of Kazakhstan, co-chairs of the Council's working groups, as well as other invited persons.

     34. At the interim meetings, the preliminary results of the implementation of the protocol decisions of the last meeting, the preparations for the upcoming meetings, and recommendations developed by the Council's working groups are discussed.

     35. At the thematic meetings of the Council, proposals and recommendations on the topics of the meeting, developed by the Council's working groups, and other issues requiring preliminary discussion are discussed.

     36. Materials on the agenda of interim meetings and thematic meetings (references, presentations, draft minutes, lists of speakers and participants) are submitted to the working body of the Council at least fifteen working days before their holding, unless otherwise provided in the decision to convene interim meetings and thematic meetings.

     37. The decisions of the interim meetings and thematic meetings are formalized by the protocol.

     38. The working body of the Council, within two weeks from the date of the interim meetings and thematic meetings, prepares a draft protocol with the attachment of securing control over the execution of instructions and ensures its coordination with all interested government agencies.

Chapter 5. Working groups of the Council

     39. In order to develop recommendations and proposals to the Council on the implementation of the protocol instructions of the meetings, as well as within the framework of the tasks of the Council on priority sectors determined by the Council, working groups may be established.

     40. The co-chairman of the working group from the Kazakh side may be an official at the level of the first head of the ministry in charge of issues related to the activities of this working group.

     41. The co-chairman of the working group from the foreign side may be members of the Council from the foreign side.

     42. The Council's working groups may include representatives of government agencies of the Republic of Kazakhstan, international organizations, Kazakhstani and foreign companies.

     43. The regulations on the working groups, the composition of the working groups from the Kazakh and foreign sides are approved by the co-chairs of the working groups of the Kazakh side.

     44. The annual work plans and reports of the working groups are approved by the Co-Chairs of the working groups in consultation with the members of the working groups.

     45. The overall management of the Council's working groups is carried out by the co-chairs from the Kazakh and foreign sides.

     46. The working groups develop recommendations to the Council, which are discussed in advance at its interim meetings.

Chapter 6. The procedure for the exclusion or replacement of foreign members of the Council and the grounds for the withdrawal of a foreign member from the Council

     47. When considering the issue of expelling or replacing foreign members of the Council, consideration is given to:

     1) personal participation of foreign Council members in Council meetings;

     2) personal and active participation of foreign Council members in the activities of the Council's working groups;

     3) compliance by foreign members of the Council with the legislation of the Republic of Kazakhstan.

     48. The grounds for the withdrawal of a foreign member from the Council are:

     1) a written request from a foreign member of the Council to terminate his/her activities in the Council;

     2) termination of the activities of an international organization or a foreign company whose representative is a foreign member of the Council.

     49. The Council's recommendations may also serve as grounds for the withdrawal of a foreign member from the Council.
