About the Human Rights Commission under the President of the Republic of Kazakhstan

     In accordance with subparagraph 20) of Article 44 of the Constitution of the Republic of Kazakhstan, paragraph 1 of Article 33 of the Constitutional Law of the Republic of Kazakhstan dated December 26, 1995 "On the President of the Republic of Kazakhstan", I decree:

     1. Approve the attached documents:

     1) Regulations on the Human Rights Commission under the President of the Republic of Kazakhstan;

     2) the composition of the Human Rights Commission under the President of the Republic of Kazakhstan.

     2. To invalidate Decree of the President of the Republic of Kazakhstan dated April 22, 1997 No. 3470 "On the Human Rights Commission under the President of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 1997, No. 16, Article 128; 1998, No. 17, Article 147; 2000, No. 17, Article 167; 2001, No. 36-37, article 463).

     3. This Decree comes into force from the date of signing.

Regulations on the Human Rights Commission under the President of the Republic of Kazakhstan

     1. The Human Rights Commission under the President of the Republic of Kazakhstan (hereinafter referred to as the Commission) is an advisory body that facilitates the implementation by the Head of State of his constitutional powers as a guarantor of human and civil rights and freedoms recognized and guaranteed in accordance with the Constitution of the Republic of Kazakhstan.

     2. In its activities, the Commission is guided by the Constitution and laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan, as well as these Regulations.

     3. The main tasks of the Commission are:

     1) creating conditions for the President of the Republic of Kazakhstan to exercise his constitutional status as a guarantor of human and civil rights and freedoms in the Republic of Kazakhstan;

     2) assistance in improving the mechanism for ensuring and protecting human and civil rights and freedoms;

     3) assistance to the activities of central and local government agencies in the implementation of state policy in the field of ensuring and protecting human and civil rights and freedoms;

     4) participation in the development of concepts and programs of state policy in the field of ensuring and protecting human rights and freedoms;

     5) assistance in strengthening international cooperation in the field of ensuring and protecting human rights and freedoms.

     4. Competence of the Commission:

     1) considers appeals addressed to the Head of State and directly to the Commission from citizens of the Republic of Kazakhstan, foreign citizens, stateless persons, as well as organizations containing information on violations of human and civil rights and freedoms;

     2) prepares reports on the human and civil rights situation in the Republic of Kazakhstan addressed to the Head of State. These reports can be published in print.;

     3) considers proposals of state bodies, public associations, other organizations and citizens on issues within the competence of the Commission;

     4) develops proposals on improving the mechanism for ensuring and protecting human and civil rights and freedoms and submits them to the President of the Republic of Kazakhstan for consideration;

     5) analyzes the legislation of the Republic of Kazakhstan affecting the issues of ensuring and protecting human and civil rights and freedoms, participates in the preparation of draft laws regulating these issues;

     6) prepares analytical materials, expert advisory opinions and proposals on international human rights treaties;

     7) participates in the work of international human rights organizations and other non-governmental human rights organizations.

     5. The Commission, in exercising its powers, interacts in accordance with the established procedure with State authorities, non-governmental human rights organizations, as well as with the mass media.

     In order to protect human and civil rights and freedoms, the Commission cooperates with law enforcement agencies.

     6. In order to carry out the tasks assigned to it, the Commission has the right:

     1) to request and receive from government agencies, as well as organizations and officials the necessary information, documents and materials;

     2) to hear at their meetings information from relevant government officials on issues related to ensuring and protecting human and civil rights and freedoms;

     3) initiate verification by authorized state bodies of information on violations of human and civil rights;

     4) involve scientists and specialists in the prescribed manner to carry out certain works;

     5) cooperate with human rights commissions and other similar structures of the member States of the Commonwealth of Independent States, as well as other States, to discuss issues related to the observance of fundamental human and civil rights and freedoms.

     7. In matters within the competence of the Commission, its members, in accordance with the procedure established by law, have the right to visit public authorities, as well as government organizations.

     8. The decisions of the Commission are recommendations and conclusions adopted at its meetings and brought to the attention of the President of the Republic of Kazakhstan.

     The recommendations and conclusions of the Commission are adopted by a simple majority vote of the number of members present at the meeting. If the votes are equal, the decision voted for by the chairman of the meeting is considered adopted.

     9. The recommendations and conclusions of the Commission, adopted within the limits of its powers, are sent to the relevant State body, which is responsible for resolving the issue.

     The State body and its officials who have received the recommendations and conclusions of the Commission are obliged to review them within the prescribed period and notify it of the decision taken.

     10. The composition of the Commission is approved by the President of the Republic of Kazakhstan on the recommendation of the Assistant to the President for Internal Policy and Communications and consists of a chairman, two deputies, a secretary and members of the Commission.

     The Chairman, Vice-Chairmen and members of the Commission participate in its work on a voluntary basis.

     11. The Chairman of the Commission carries out the general management of the Commission's activities, gives instructions to the deputies, secretary and members of the Commission, determines the agenda of its meetings, signs official documents, recommendations and conclusions of the Commission, participates in meetings related to human rights and freedoms, in coordination with the Assistant to the President of the Republic of Kazakhstan on Internal Policy and Communications, makes proposals to the President of the Republic of Kazakhstan to improve the work of the Commission.

     In the absence of the Chairman of the Commission, official documents, recommendations and conclusions are signed by one of the Vice-Chairmen of the Commission.

     In the absence of the Chairman of the Commission and his deputies, the official documents, recommendations and conclusions of the Commission are signed by its Secretary.

     12. Meetings of the Commission are convened by its Chairman as necessary, but at least once a quarter. Meetings of the Commission are considered valid if they are attended by more than half of its members.

     In the absence of the Chairman of the Commission, one of the Vice-Chairmen of the Commission shall preside at its meetings.

     13. Information, analytical and organizational support of the Commission's activities is provided by the Department of Internal Policy of the Presidential Administration of the Republic of Kazakhstan.

     The Department of Internal Policy of the Presidential Administration also provides organizational, methodological, informational and other assistance to officials of the offices of akims of regions, cities of republican significance and the capital of the Republic, which are responsible for human rights issues and consideration of appeals from individuals and legal entities.

14. An expert council consisting of representatives of scientific institutions, educational organizations and non-governmental organizations, working on a voluntary basis, is established under the Commission to conduct expert and analytical research. The composition of the expert council is approved at a meeting of the Commission.
