The Law of the Republic of Kazakhstan dated December 31, 1996 N 59-1

Article 1. To approve the republican budget for 1997 for revenues in the amount of 186668929 thousand tenge, official transfers received - 922,000 thousand tenge, expenditures - 228877075 thousand tenge, net lending - 22387,852 thousand tenge, with the maximum size of the republican budget deficit - 63673998 thousand tenge, or 3.66% of gross domestic product, according to the appendix. The Government of the Republic of Kazakhstan should implement targeted allocation of expenditures of the republican budget in accordance with the departmental classification.

To establish the following sources of covering the republican budget deficit for 1997:

loans from the National Bank of the Republic of Kazakhstan in the amount of 2,500,000 thousand tenge;

proceeds from loans, including repayment of their principal amount in the amount of 61173998 thousand tenge.

Article 2. To establish that revenues to the republican budget for 1997 are generated by:

corporate income tax and personal income tax withheld at the source of payment, with the exception of amounts credited to local budgets;

tax on securities transactions;

value added tax;

excise taxes on crude oil and gasoline;

bonuses, royalties and tax on excess profits from subsurface users;

customs payments;

income from dividends on government-owned shares;

interest received for granting loans and credits from budgetary funds;

rent for the use of the Baikonur complex;

other non-tax revenues; proceeds from the sale of inventory items from the reserves of the state reserve, proceeds from the sale of grain; proceeds from privatization.

Article 3. Include the Republican Fund for Nature Protection, formed from payments for environmental pollution and penalties for violations of the environmental legislation of the Republic of Kazakhstan, in the amount of 30 percent of their revenues for the purposes of financing republican and interregional environmental protection measures, into the revenue of the republican budget. The Government of the Republic of Kazakhstan will finance the costs of implementing the functions of the Republican Fund for Nature Protection in the amount of 60 percent of their actual revenues.

Article 4. To provide for the receipt of funds from the privatization of state property in the amount of 30969,898 thousand tenge, as well as the receipt of dividends on state-owned blocks of shares in the amount of 2200,000 thousand tenge. Article 5. To establish for 1997 the distribution of the total amount of revenue from national taxes to the budgets of the regions and the city of Almaty in the following amounts: a) for corporate income tax: Akmola region - 45 percent, Aktobe - 50, Atyrau - 10, East Kazakhstan - 100, Karaganda - 65, Kostanay - 100, Mangystau - 10, Pavlodar - 5, Almaty, Zhambyl, West Kazakhstan, Kyzylorda, North Kazakhstan and South Kazakhstan - 100 percent each, Almaty city - fully to the republican budget; b) personal income tax withheld at the source of payment: Atyrau region - 22 percent, Almaty city - 35, Mangystau region - 58, and other regions - 100 percent each. Article 6. To establish that the revenues of local budgets include:

local taxes and fees;

income tax on individuals engaged in entrepreneurial activities;

corporate income tax, with the exception of amounts credited to the republican budget;

personal income tax withheld from the source of payment, with the exception of amounts credited to the republican budget;

excise taxes, with the exception of amounts credited to the republican budget;

payment for forest use;

payment for water;

income from the rental of communal property;

proceeds from administrative fines and sanctions;

State duties;

rent for the use of polygons;

proceeds from the sale of property rights and land use rights, including the lease of land;

receipts to local nature protection funds in the amount of 70 percent of payments for environmental pollution and penalties for violations of environmental legislation;

other non-tax revenues, with the exception of amounts credited to the republican budget.

Article 7. In 1997, to allocate transfers to regional budgets in the amount of 25743955 thousand tenge, including:

In 1997, provide for transfers to support the social infrastructure of the city of Priozersk, Karaganda region, in the amount of 140,000 thousand tenge. The Government of the Republic of Kazakhstan should develop a mechanism for providing transfers to regional budgets as they meet the targets set by the Government of the Republic of Kazakhstan and taking into account the special economic zones operating on their territory.

Article 8. To establish, starting from January 1, 1997, contributions to compulsory social insurance in the amount of 30 percent of the salary fund for legal entities (including legal entities with foreign participation) and for representative offices of foreign legal entities in terms of the salary fund of citizens of the Republic of Kazakhstan. For the Voluntary Society of the Disabled of the Republic of Kazakhstan, the Kazakh Society of the Blind, the Kazakh Society of the Deaf, as well as for production and educational organizations owned by these societies and created at their expense, in which disabled people make up at least 50 percent of the total number of employees, the Republican Association of Retired Enterprises "Veteran", as well as for production, educational and production organizations that are owned by this association and created at its expense, in which only pensioners work. The Republican Association of Enterprises of the Kazakh Republican Organization of Veterans of the War in Afghanistan (without production organizations), the Bar Association, for the Voluntary Society of War Invalids in Afghanistan (without production organizations), the SOS Children's Villages of Kazakhstan Children's Charity Foundation, the Red Crescent and Red Cross Societies, the amount of this contribution is 5 percent of the wage fund. Individuals engaged in entrepreneurial and other activities without forming a legal entity pay monthly contributions to compulsory social insurance in the amount of one monthly calculation index for each employee. Distribute the total amount of contributions to compulsory social insurance among state funds according to the following standards: to the Pension Fund of the Republic of Kazakhstan - 85 percent, to the Compulsory Medical Insurance Fund under the Government of the Republic of Kazakhstan - 10 percent and to the State Social Insurance Fund - 5 percent. To establish that the budgets of the regions and the city of Almaty include allocations for their transfer by insurance payments for the unemployed part of the population to the regional and Almaty city offices of the Compulsory Medical Insurance Fund under the Government of the Republic of Kazakhstan. Article 9. To establish that since January 1, 1997, the Employment Assistance Fund of the Republic of Kazakhstan is formed at the expense of mandatory insurance contributions from employers (including legal entities with foreign participation and representative offices of foreign legal entities in terms of the salary fund of citizens of the Republic of Kazakhstan) in the amount of 2 percent of the wage fund: for organizations maintained by the state budget, for The Voluntary Society of War Invalids in Afghanistan (without production organizations), the SOS Children's Villages of Kazakhstan Children's Charity Foundation, The Red Crescent and Red Cross Societies - in the amount of 1 percent of the wage fund. Exempt from insurance contributions to the Employment Assistance Fund of the Republic of Kazakhstan organizations of the Voluntary Society of the Disabled of the Republic of Kazakhstan, the Kazakh Society of the Deaf, the Kazakh Society of the Blind, as well as production, educational and production organizations owned by these societies and created at their expense, in which the disabled make up at least 50 percent of the total number of employees. To establish that the financing of expenses for resettlement activities under the annual immigration quota is carried out at the expense of local budgets.

Article 10. Set a minimum wage:

since January 1, 1997 - 2,030 tenge;

since April 1, 1997 - 2,060 tenge;

since July 1, 1997 - 2085 tenge;

since October 1, 1997 - 2,340 tenge.

Article 11. To establish a calculated indicator for calculating pensions, allowances and other social benefits, as well as for the application of penalties, tax and other payments in accordance with current legislation on a monthly basis in the following amounts:

since January 1, 1997 - 550 tenge;

since April 1, 1997 - 565 tenge;

since July 1, 1997 - 585 tenge:

since October 1, 1997 - 620 tenge.

Article 12. Starting from January 1, 1997, establish the amount of monthly stipends for postgraduate students studying on an on-the-job basis, based on government orders, at the level of the official salary of a junior researcher without an academic degree.

Article 13. To establish scholarships for students studying in higher education institutions within the framework of the government's order in the following amounts:

since January 1, 1997 - 1,180 tenge;

since April 1, 1997 - 1,250 tenge;

since September 1, 1997 - 1,350 tenge.

Establish scholarships for students of secondary specialized educational institutions studying under the government's order in the amount of 80 percent of the scholarship amount for students of state higher educational institutions. The Government of the Republic of Kazakhstan should develop a procedure for paying scholarships to students.

Article 14. In 1997, to preserve for nonresident students and full-time students studying under government orders in higher and secondary specialized educational institutions of the republic, preferential travel by rail, water and motor intercity transport during the holidays (twice a year round trip) in the amount of 50 percent of the fare at the expense of the relevant budgets..  

Article 15. Starting from January 1, 1997, establish the amount of monthly state benefits for families with children as a percentage of the calculated indicator, while maintaining the current procedure for their appointment and payment: uniform benefits for children under the age of 3 - 125 percent, from 3 to 18 years - 130 percent; benefits for children of conscripts - 130 percent; benefits for children infected with the acquired human immunodeficiency virus or AIDS patients - 130 percent; Benefits for unemployed mothers with many children with four or more children under the age of 7 are 100 percent. Take into account that the payment of allowances for disabled children who are raised and home-schooled is made quarterly in the amount of 3875 tenge in the first, 4070 tenge in the second, 4230 tenge in the third and 4445 tenge in the fourth quarters. The payment of a one-time allowance for the birth of a child in the amount of four times the calculated indicator is made at the expense of the State Social Insurance Fund. The funeral allowance is paid to family members or persons organizing the burial, for working citizens - in the amount of ten times the calculated indicator at the expense of the State Social Insurance Fund, for pensioners - in the amount of ten times the calculated indicator at the expense of the Pension Fund and for participants and invalids of the Great Patriotic War - in the amount of thirty-five times the calculated indicator at the expense of The Pension Fund.  

Article 16. To provide expenses for the payment of one-time monetary compensation to: persons who have become disabled, families who have lost a breadwinner due to an environmental disaster, for damage in accordance with subparagraph 5) of paragraph 2 of Article 13 of the Law of the Republic of Kazakhstan dated June 30, 1992 N 1468 Z922600_ "On social protection of citizens affected by an environmental disaster in the Aral Sea region" (Bulletin of the Supreme Council of the Republic of Kazakhstan, 1992, No. 13-14, art. 348, 1994, No. 8, Article 140) in the amount of 8000 thousand tenge, to pensioners - for damage caused by nuclear tests, in accordance with paragraphs one, two, three, four, five and six of the first part of Article 12, and who lived in the zones specified in Articles 5,6,7,8 and 9 of the Law of the Republic of Kazakhstan dated December 18, 1992, No. 1787 Z923600_ "On social protection of citizens affected by nuclear tests at the Semipalatinsk Nuclear Test Site" (Bulletin of the Supreme Council of the Republic of Kazakhstan, 1992, No. 23, Article 560; 1994, No. 8, Article 140), in the amount of 500,000 thousand tenge.  

Article 17. To provide appropriations for the payment of pensions to civil servants in accordance with the Decree of the President of the Republic of Kazakhstan dated June 17, 1996 No. 3037 "On approval of the Regulations on the procedure for pension provision of civil servants" in the amount of 42424 thousand tenge. To establish that the corresponding allocations are provided as part of the expenditures of the budgets of the regions and the city of Almaty for the same purposes.  

Article 18. Provide for financing of research expenses in the amount of 3937,824 thousand tenge, including through external grants for financing scientific projects in the amount of 922,000 thousand tenge, allocated as they are actually received.  

Article 19. To establish that since January 1, 1997, the maintenance of all functional and structural divisions of regional, city and district departments (departments) of internal affairs, as well as preschool institutions of other law enforcement agencies, is carried out at the expense of local budgets.  

Article 20. To establish that the funds received from the lease or sale of military property, minus the costs of providing rental services and selling property, are used for the needs of the Armed Forces in accordance with the procedure established by the Government of the Republic of Kazakhstan.

Article 21. To provide for allocations in the amount of 2909653 thousand tenge for the payment of communication services for the distribution of state television and radio broadcasting, of which 398,000 thousand tenge for the introduction of a national satellite broadcasting system.

Article 22. To provide allocations for state support of newspapers, magazines and the publication of socially significant literature in the amount of 735,000 thousand tenge.  

Article 23. To provide allocations in the amount of 143,000 thousand tenge for the celebration of the 100th anniversary of the birth of Mukhtar Auezov and 270,000 thousand tenge for preparations for the celebration of the 1500th anniversary of the city of Turkestan.  

Article 24. To provide allocations for the implementation of measures under Decree of the President of the Republic of Kazakhstan dated September 6, 1993 No. 1344 "On new housing policy" (SAPP of the Republic of Kazakhstan, 1993, No. 35, art.405) to second-tier banks in the amount of 2920000 thousand tenge, including funds from the privatization of state property in in the amount of 4 percent. Transfer of funds from the privatization of state property should be carried out as they are received by the budget. The footnote. Article 25. To provide for allocations: for carrying out measures for the rehabilitation and rehabilitation of organizations in the amount of 5090,690 thousand tenge; for monitoring and developing the infrastructure of small and medium-sized businesses in the amount of 50,000 thousand tenge; to the State Fund for Financial Support of Agriculture in the amount of 4889,000 thousand tenge; to finance priority facilities in the amount of 7406022 thousand tenge, including loans to the State Export-Import Bank of the Republic of Kazakhstan for financing highly effective investment projects, as well as co-financing projects on attracted foreign loans; for the implementation of the Defense Industry Development and Conversion Program in the amount of 600,000 thousand tenge.

Article 26. To finance the costs of the state geological survey and protection of the subsoil in the amount of 1,154,000 thousand tenge and exploration and evaluation work on special Government decisions, compensated by subsurface users - 172,000 thousand tenge. To establish that the incoming funds from the sale (exchange, sale) of geological information are credited to the republican budget.

Article 27. To provide allocations for servicing the public debt formed as a result of borrowing by the Government of the Republic of Kazakhstan in the total amount of 13147822 thousand tenge. Article 28. To provide credit resources in the amount of 800,000 thousand tenge for leasing operations. The Government of the Republic of Kazakhstan should determine the procedure for allocating funds for the organization of equipment supplies on these terms.

Article 29. To establish that the republican budget receives funds from repayment of: debts based on the results of the intra-republican offset and directive loans in the amount of 713,900 thousand tenge; debts on loans transferred to the State Fund for Financial Support of Agriculture in the amount of 3,200,000 thousand tenge; a loan issued to the State Rehabilitation Bank of the Republic of Kazakhstan in the amount of 2,700,000 thousand tenge.

Article 30. To provide allocations to the Joint-Stock National Savings Bank of Kazakhstan in the amount of 3,300,000 thousand tenge for the implementation of Decree of the President of the Republic of Kazakhstan dated May 20, 1996 No. 2988 "On compensation of deposits of citizens over the age of 60 as of January 1, 1996, in the Joint-Stock National Savings Bank of Kazakhstan" (SAPP of the Republic of Kazakhstan, 1996, No. 19, V.161).  

Article 31. To establish as of December 31, 1997 the limit of the state debt formed as a result of borrowing by the Government of the Republic of Kazakhstan in the amount of 228,000,000 thousand tenge. Article 32. To set the limit of the provided state guarantees of the Republic of Kazakhstan in 1997 for a total amount of 7740000 thousand tenge.

Article 33. The Government of the Republic of Kazakhstan should convert the state internal debt to the National Bank of the Republic of Kazakhstan on loans received in previous years into government securities with a maturity of ten years, starting from January 1, 1998.  

Article 34. Provide 9666128 thousand tenge for repayment and servicing of external loans previously received under state guarantees of the Republic of Kazakhstan. Article 35. To approve the reserve fund of the Government of the Republic of Kazakhstan in the amount of 3260700 thousand tenge, including for financing emergency situations and measures, including the elimination of natural and man-made emergencies, in the amount of 1860700 thousand tenge.  

Article 36. To approve the amount of the circulating cash reserve for the republican budget as of January 1, 1998 in the amount of 500,000 thousand tenge.

Article 37. To establish that in the process of executing the republican budget for 1997, expenses related to the payment of salaries, contributions to compulsory social insurance, scholarships, pensions for meals in organizations maintained at the expense of the republican budget, and official transfers aimed at paying off pension arrears are not subject to sequestration.

Article 38. To approve the amount of official transfers allocated to repay pension arrears in the amount of 36,000,000 thousand tenge in accordance with the procedure and deadlines established by the Government of the Republic of Kazakhstan.

Article 39. In case of shortfall in revenues to the republican budget, allow the Government of the Republic of Kazakhstan to increase the republican budget deficit and the national debt limit beyond the amounts established in Articles 1 and 31 of this Law.,

in addition, up to 0.5 percent of the gross domestic product, with the allocation of funds to pay off pension arrears.
