About the republican budget for 1999
The Law of the Republic of Kazakhstan dated December 16, 1998 No. 318
Article 1. To approve the republican budget for 1999 for revenues in the amount of 245,289,425 thousand tenge, official transfers received - 39,651,699 thousand tenge, repayment - 2,033,332 thousand tenge, expenditures - 325,687,514 thousand tenge, lending - 28,335,763 thousand tenge, with the maximum size of the republican budget deficit of 67 048,821 thousand tenge, or 3.7 percent of the gross domestic product, according to the appendix. The Government of the Republic of Kazakhstan should ensure that the national budget deficit is covered by borrowing on foreign and domestic capital markets, taking into account repayment of the principal amount of government debt. <*> The footnote. Article 2-1. The republican budget is formed in accordance with the Law of the Republic of Kazakhstan "On the Budget System".
Article 3-1. To establish that the revenues of the republican budget are formed in accordance with the Law of the Republic of Kazakhstan "On the Budgetary System", as well as at the expense of the following non-tax revenues: proceeds from the sale of confiscated, mismanaged property, property transferred by right of inheritance to the state, treasures and finds in the form of precious metals and foreign currency; (fourth paragraph) receipts from the sale of property by state institutions on the basis of decisions taken by central executive bodies; fees for issuing passports and identity cards of citizens of the Republic of Kazakhstan; proceeds from the voluntary surrender or recovery of illegally obtained property or the cost of illegally provided services to persons authorized to perform government functions or persons equivalent to them; fines for violations of environmental legislation (in the amount of 50%); proceeds from fines for the export of products without licenses; other fines and sanctions; and other non-tax revenues provided for by legislative acts. <*> The footnote. Article 4-1. To establish that the revenues of local budgets are formed in accordance with the Law of the Republic of Kazakhstan "On the Budgetary System", as well as at the expense of the following non-tax revenues: proceeds from the sale of property transferred by inheritance to an administrative-territorial unit, treasures and finds in national currency; proceeds from organizations for works and services performed by persons, those who have been subjected to administrative arrest; payment receipts from persons placed in medical detox centers; fines for violating environmental legislation (in the amount of 50%); income received from the activities of the penal enforcement inspectorate; fees for registering weapons; other payments and income from non-commercial and related sales; income received from the sale of products, works and services that do not meet the requirements of standards and certification rules; other sanctions and fines; other non-tax revenues provided for by legislative acts.
Article 5-1. To provide for the repayment of accounts payable of former budget organizations financed from the republican budget and the abolished Road Fund to suppliers of goods (works, services), as well as accounts payable of local budgets on loans to second-tier banks used to pay salaries and social benefits and approved by local representative bodies, formed as of December 31, 1998 year, in the amount of up to 10,000,000 thousand. tenge due to repayment of the debt of business entities on payments to the republican budget, which was formed at the time of the calculations, but not more than the amount of such debt formed as of December 31, 1998. The Government of the Republic of Kazakhstan should develop a procedure for the repayment of these accounts payable. <*> The footnote. Article 6-1. To establish that proceeds from the sale of goods and services provided by state institutions of secondary education, orphanages, orphanages, boarding schools for the elderly and the disabled, boarding schools for young people with disabilities and neuropsychiatric boarding schools, sanitary and epidemiological institutions, state nature reserves, state national nature parks are used by them in accordance with the procedure determined by the Ministry of Finance of the Republic of Kazakhstan.
Article 8. (Articles 8 and 9 are excluded by the Law of the Republic of Kazakhstan dated July 16, 1999 N 440)
Article 10. To establish that subsurface users who previously made payments to the Republican Fund for the Protection of Mineral Resources and the Reproduction of the Mineral Resource Base on the basis of Resolution No. 135 of the Government of the Republic of Kazakhstan dated February 24, 1998 "On measures to accelerate the transfer of subsurface users to a contractual basis", as well as enterprises that made fixed (rental) payments on the basis of a resolution of the Cabinet of Ministers Of the Republic of Kazakhstan dated June 1, 1995 No. 764 "On Fixed (rental) payments for oil, Gas and coal", prior to the conclusion of contracts for subsurface use, make the above-mentioned deductions to the revenue of the republican budget on account of royalties in the amounts and on the terms determined by the above-mentioned resolutions. In the case of obtaining for use or possession of deposits from which fixed (rental) payments were previously paid, legal entities and individuals, prior to the conclusion of a contract for subsurface use, continue to pay them in accordance with the procedure established in part one of this article.
Article 11. To establish that subsurface users must credit to the royalty account the arrears on the Fund for the Protection of the Subsoil and the Reproduction of the Mineral Resource Base, as well as the amounts of historical costs incurred by the state for the geological study of contract territories, which are reimbursed by subsurface users operating these deposits on the basis of subsurface use contracts.
Article 12. To establish that taxpayers must credit to the social tax account the arrears of contributions to the Pension Fund, the State Pension Payment Center, the Compulsory Medical Insurance Fund, the Social Insurance Fund, the Employment Assistance Fund, as well as contributions from road users (previously received by the Road Fund) for previous periods. The debt on the collection of gasoline and diesel fuel, previously received by the Road Fund, is credited as the receipt of excise taxes on gasoline and diesel fuel.
Article 12-1. To establish that the negative balance formed as of December 31, 1998, as a result of the excess of the amounts of benefits accrued by employers for temporary disability, pregnancy and childbirth, at the birth of a child, and burial, paid from the State Social Insurance Fund, over the accrued amount of deductions to the specified fund, is counted monthly against the payment of social tax in within 1.5% of the salary fund. <*> The footnote. Article 13. To provide for the receipt of the share of the Republic of Kazakhstan in the division of products received under the Production sharing contracts in the following amounts: for the West Kazakhstan region - 90% to the republican budget, 10% to the local budget; for the Mangystau region - 100% to the republican budget.
Article 14. Establish minimum amounts: 1) monthly salary: from January 1, 1999 - 2440 tenge, from April 1, 1999 - 2650 tenge, from October 1, 1999 - 2680 tenge; 2) pensions: from January 1, 1999 - 3000 tenge. <*> The footnote. Article 15. To establish a monthly calculation index for calculating pensions, allowances and other social benefits, as well as for the application of penalties, tax and other payments in accordance with current legislation in the following amounts: from January 1, 1999 - 660 tenge; from April 1, 1999 - 715 tenge; from October 1, 1999 -725 tenge.
Article 16. Starting from September 1, 1999, to establish additional payments to employees of state higher education organizations for academic degrees of Candidate of Sciences and Doctor of Sciences, if they have a corresponding diploma, in the amount of one monthly minimum wage for candidate of Sciences and two monthly minimum wages for doctors of sciences.
Article 17. Starting from January 1, 1999, set the monthly stipend for postgraduate students studying on an on-the-job basis on the basis of a government order at the level of the official salary of a junior researcher without an academic degree.
Article 18. To establish scholarships for students studying in higher education institutions on the basis of a state order in the following amounts: from January 1, 1999 - 1,420 tenge; from April 1, 1999 - 1,540 tenge; from September 1, 1999 - 1,555 tenge. Establish scholarships for students of secondary specialized educational institutions studying on the basis of a state order in the amount of 80 percent of the scholarship amount for students studying in higher education institutions on the basis of a state order.
Article 18-1. Starting from April 1, 1999, the republican budget should include expenditures on the provision of special state benefits to socially protected categories of citizens in accordance with the procedure and amounts established by the legislation of the Republic of Kazakhstan. <*> The footnote. Article 18-2. Starting from April 1, 1999, establish a monthly amount of monetary compensation for military personnel of the internal troops and military personnel (except for conscripts), regardless of seniority, as well as for employees of operational search, investigative, and combat units of internal affairs bodies according to the list determined by the Government of the Republic of Kazakhstan, for housing maintenance and utilities in the amount of 3430 tenge. The footnote. The Law is supplemented by Article 18-2 - the Law of the Republic of Kazakhstan dated April 1, 1999 N 359.
Article 18-3. One-time cash payments to specialists of state healthcare, education, social security, culture and sports organizations living and working in rural areas for the purchase of fuel in the amount of 1,000 tenge are made from local budgets. Article 19. Social assistance for the birth of a child, the burial of working citizens, assistance to families with children, housing assistance to low-income families (citizens) and financial assistance to the unemployed is provided at the expense of local budgets in accordance with the procedure and amounts established by law. Public works, vocational training and retraining of the unemployed, and assistance to the unemployed in finding employment are carried out at the expense of local budgets. <*> The footnote. Article 21. To provide in the republican budget allocations for the payment of one-time monetary compensation to pensioners who suffered as a result of nuclear tests at the Semipalatinsk nuclear test site, in accordance with paragraphs one, two, three, four, five and six of the first part of Article 12, and living in the zones specified in Articles 5, 6, 7, 8 and 9. The Law of the Republic of Kazakhstan dated December 18, 1992 "On Social protection of citizens affected by nuclear tests at the Semipalatinsk Nuclear Test Site" (Bulletin of the Supreme Council of the Republic of Kazakhstan, 1992, No. 23, Article 560; 1994, No. 8, Article 140, No. 20, Article 252 of the Law of the Republic of Kazakhstan dated June 19, 1997 "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan", published in the newspapers Egemen Kazakstan and Kazakhstanskaya Pravda on July 3, 1997) in the amount of 300,000 thousand tenge. Article 23. To allocate subventions to regional budgets in the amount of 25,471,786 thousand tenge in 1999: Akmola region - 3,266,134 thousand tenge; Almaty region - 6,047,347 thousand tenge; East Kazakhstan region - 282,452 thousand tenge; Zhambyl region - 2,346,787 thousand tenge; West Kazakhstan region - 344,089 thousand tenge; Kyzylorda region - 3,252,699 thousand tenge; North Kazakhstan - 3,815,267 thousand tenge; South Kazakhstan - 6,117,011 thousand tenge. Article 23-1. To establish the volume of budget withdrawals for 1999 in the amount of 37,904,949 thousand tenge, including: Aktobe region - 1,645,786 thousand tenge; Atyrau region - 6,765,916 thousand tenge; Karaganda region - 4,384,315 thousand tenge; Kostanay region - 362,519 thousand tenge; Mangystau region - 4,844,265 thousand tenge; Pavlodar - 3,740,322 thousand tenge; Almaty - 16,161,844 thousand tenge. Article 27. Article 28. Article 29. To approve the reserve of the Government of the Republic of Kazakhstan in the amount of 1,700,000 thousand tenge, including for crediting subordinate budgets in the amount of 600,000 thousand tenge. <*> The footnote. Article 30. To establish, as of December 31, 1999, the limit of government debt denominated in foreign currencies in the amount equivalent to 2,950,017 thousand US dollars and denominated in national currency in the amount of 110,907,437 thousand tenge. <*> The footnote. Article 31. To set a limit on the provision of government guarantees of the Republic of Kazakhstan in 1999 in the amount equivalent to 500,000 thousand US dollars. <*> The footnote. Article 32. To establish that in the process of executing the republican budget for 1999, republican budget programs are not subject to sequestration: those related to servicing government debt and guaranteed by the Government of the Republic of Kazakhstan; for the payment of pensions; for the payment of special state benefits; for the payment of state social benefits; "Diabetes"; "Tuberculosis", performed at the national level. <*> The footnote. Article 33. This Law shall enter into force on January 1, 1999.
