About the republican budget for 2006

The Law of the Republic of Kazakhstan dated November 22, 2005 No. 88

     Article 1. To approve the republican budget for 2006 in accordance with Appendix 1 in the following amounts: 1) revenues - 1 510 292 399 thousands of tenge, including for: tax receipts - 1 266 685 478 thousands of tenge; non-tax receipts - 39,313,436 thousand tenge; proceeds from the sale of fixed assets - 8,185,895 thousands of tenge; transfer receipts - 196,107,590 thousand tenge; 2) expenses - 1 518 760 614 thousand tenge; 3) operating balance - -8 468 215 thousand tenge;       4) net budget lending - KZT 16,250,026 thousand, including:       budget loans - 37,865,413 thousand tenge; repayment of budget loans - 21,615,387 thousand tenge; 5) balance of operations with financial assets - 101,526,018 thousand tenge, including:       acquisition of financial assets - 103,526,018 thousand tenge; proceeds from the sale of financial assets of the state - 2,000,000 thousand tenge; 6) deficit - 126,244,259 thousand tenge, or 1.4 percent of the gross domestic product of the country; 7) financing of the budget deficit - 126,244,259 thousand tenge. <*>       The footnote.      Article 2. To provide for receipts in the republican budget for 2006:       rent for the use of the Baikonur complex by the Russian Federation in the amount of KZT 14,605,000 thousand; rent for the use of military ranges by the Russian Federation, reflected in the revenues of the republican budget, in the amount of KZT 3,492,500 thousand, of which:       406,400 thousand tenge is received in cash;       KZT 3,086,100 thousand is carried out on the terms stipulated by agreements between the Republic of Kazakhstan and the Russian Federation on the lease of test sites, and is used by the Ministry of Defense of the Republic of Kazakhstan to reflect expenditures under republican budget programs 007 "Supply and repair of weapons and military equipment in accordance with interstate agreements on the lease of landfills" and 011 "Training of specialists with higher education and postgraduate professional education".  

     Article 3. To approve the volume of revenues for 2006 from organizations of the raw materials sector credited to the republican budget before July 1, 2006, according to Appendix 2. <*>       The footnote. Article 3-1. To approve the volume of budget receipts for 2006, allocated to the National Fund of the Republic of Kazakhstan from July 1, 2006, according to Appendix 2-1. <*>       The footnote. Article 3-2. To approve the list of oil sector enterprises engaged in the production and (or) sale of crude oil and gas condensate, for which direct taxes (with the exception of taxes credited to local budgets) are credited to the National Fund of the Republic of Kazakhstan from July 1, 2006, according to Appendix 2-2. <*>       The footnote.      Article 4. To approve the volume of revenues to the republican budget for 2006 from the privatization of property owned by the republic and related to the mining and manufacturing industries before July 1, 2006, according to Appendix 3. <*>       The footnote. Article 4 was amended by the Law of the Republic of Kazakhstan dated July 5, 2006 No. 159 (effective January 1, 2006).  

     Article 5. To establish that the income of the relevant budget includes:       according to the "Royalty" code of the revenue classification of the unified budget classification, the debt of subsurface users to the Republican Fund for the Protection of the Subsoil and Reproduction of the Mineral Resource Base, as well as the amount of historical costs incurred by the state for the geological study of contract territories, which are reimbursed by subsurface users operating these deposits on the basis of subsurface use contracts.;       according to the code "Social Tax" of the income classification of the unified budget classification - arrears on contributions previously transferred to the pension fund, the State Pension Payment Center, the Compulsory Medical Insurance Fund, the State Social Insurance Fund, the Employment Assistance Fund, as well as contributions from highway users previously received by the road fund; according to the code "Gasoline (with the exception of aviation) of its own production, sold by manufacturers in bulk" - arrears in the collection of gasoline previously received by the Road Fund;       according to the code "Diesel fuel of own production, sold by manufacturers in bulk" - the debt on collection from diesel fuel, previously received by the Road Fund.  

     Article 6. The negative balance formed as of December 31, 1998 as a result of the excess of the amounts of benefits accrued by employers for temporary disability, pregnancy and childbirth, at the birth of a child, and burial, paid from the State Social Insurance Fund, over the accrued amount of deductions to the specified fund, is counted monthly against the payment of social tax within the limits of 3 percent of the salary fund.

     Article 7. To provide in the republican budget for 2006 the volume of budget withdrawals from regional budgets, budgets of Astana and Almaty to the republican budget in the amount of 119,476,590 thousand tenge, including:       Aktobe region - 1,601,322 thousand tenge;       Atyrau region - 35,621,410 thousand tenge; Mangystau region - 19,439,802 thousand tenge; Almaty city - 56,507,741 thousand tenge; Astana city - 6,306,315 thousand tenge.          

Article 7-1. To provide in the republican budget for 2006 the amount of guaranteed transfer from the National Fund of the Republic of Kazakhstan in the amount of 76,631,000 thousand tenge from July 1, 2006. <*>       The footnote.      Article 8. To establish from January 1, 2006: 1) the minimum wage is 9,200 tenge; 2) the amount of the basic pension payment is 3,000 tenge; 3) the minimum pension amount is 6,700 tenge; 4) the monthly calculation index for calculating benefits and other social benefits, as well as for the application of penalties sanctions, taxes and other payments in accordance with the legislation of the Republic of Kazakhstan - 1,030 tenge; 5) the minimum subsistence level for calculating basic social benefits - 7,945 tenge.

     Article 9. To provide funds in the republican budget for 2006 in the amount of: 4,321,800 thousand tenge - for the payment of one-time state benefits in connection with the birth of a child in the amount of fifteen times the monthly calculation index; 6,339,665 thousand tenge - for the introduction of state benefits for child care from July 1, 2006 until he reaches one of the year.       To establish that these funds are allocated in accordance with the procedure determined by the Government of the Republic of Kazakhstan.  

     Article 10. Starting from January 1, 2006, establish a monthly amount of monetary compensation for military personnel (except for conscripts), employees of internal affairs bodies, as well as employees of operational search, investigative and combat units of the State Fire Service, bodies and institutions of the penitentiary system of the Ministry of Justice of the Republic of Kazakhstan, and financial police bodies to pay for housing costs. and utilities in the amount of 3,430 tenge.  

     Article 11. It should be noted that the republican budget for 2006 provides funds for the payment of bonus payments to military personnel for 1997-1998 in the amount of 388,986 thousand tenge, including:       To the Ministry of Defense of the Republic of Kazakhstan - 147,840 thousand tenge; to the Ministry of Internal Affairs of the Republic of Kazakhstan - 190,781 thousand tenge;       National Security Committee of the Republic of Kazakhstan - 10 907 thousand tenge; Republican Guard of the Republic of Kazakhstan - 36 344 thousand tenge; Prosecutor General's Office of the Republic of Kazakhstan - 3 114 thousand tenge.       To establish that payments of bonus payments to military personnel are made at their place of military service during the specified period in accordance with the procedure determined by the Government of the Republic of Kazakhstan.

     Article 12. To provide in the republican budget for 2006 targeted current transfers in the amount of 100,000 thousand tenge for the maintenance of the infrastructure of the city of Priozersk, Karaganda region, in accordance with the Agreement between the Republic of Kazakhstan and the Russian Federation on the terms of use and lease of the Sary-Shagan test site and ensuring the vital activity of the city of Priozersk dated January 20, 1995.

     Article 13. To provide in the republican budget for 2006 the volume of subventions transferred from the republican budget to regional budgets in the amount of 153,149,590 thousand tenge, including:       Akmola region - 15,958,655 thousand tenge; Almaty region - 17,707,954 thousand tenge;       East Kazakhstan region - 17,610,210 thousand tenge; Zhambyl region - 17,395,854 thousand tenge; West Kazakhstan region - 8,490,201 thousand tenge; Karaganda region - 5,908,832 thousand tenge; Kostanay region - 10,934,747 thousand tenge;       Kyzylorda region - 12,329,913 thousand tenge;       Pavlodar region - 1,617,733 thousand tenge;       North Kazakhstan - 13,367,240 thousand tenge; South Kazakhstan - 31,828,251 thousand tenge.

Article 14. To provide in the republican budget for 2006 funds in the amount of 11 151 820 thousand tenge for resettlement to the historical homeland and social protection of Oralmans who arrived under the quota of immigration of oralmans for 2006, approved by the decree of the President of the Republic of Kazakhstan.       To establish that funds are allocated to these Oralmans' families for housing based on a hundredfold monthly calculation index per family member, for transportation of property based on a fifty-fold monthly calculation index per family, for reimbursement of transportation costs based on a tenfold monthly calculation index per family member in accordance with the procedure determined by the Government of the Republic of Kazakhstan.  

     Article 15. To take into account that the republican budget for 2006 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty in the following amounts: 1,642,047 thousand tenge - to ensure the payment of scholarships to students studying at secondary vocational educational institutions on the basis of a state order from local executive bodies; 232,605 thousand tenge - for payment of travel compensation for students in secondary vocational educational institutions on the basis of a state order from local executive bodies;       283,776 thousand tenge - for the maintenance of newly commissioned healthcare facilities; 5,135,931 thousand tenge - for the purchase of medicines, vaccines and other immunobiological preparations; 200,000 thousand tenge - for the logistical equipment of blood centers at the local level; 3,600,000 thousand tenge - for the payment of state benefits for children under 18 years of age from low-income families according to Appendix 4;       KZT 499,921 thousand - to provide disabled people in need with mandatory hygiene products and the provision of services by sign language specialists, individual assistants in accordance with the individual rehabilitation program for the disabled; KZT 73,387 thousand - to compensate for the increase in telephone subscription fees to socially protected citizens who are subscribers of urban telecommunications networks;       1,048,816 thousand tenge - to subsidize the cost of services for the supply of drinking water from particularly important group water supply systems that are alternative sources of drinking water supply; 1,107,800 thousand tenge - to subsidize railway passenger transportation on socially significant inter-district (intercity) and internal communications; 240,162 thousand tenge - to increase the staffing of the migration police.       Take into account that in local budgets, at the expense of funds provided for the payment of state targeted social assistance, expenses for the payment of state benefits for children under 18 from low-income families in the amount of at least 2,919,000 thousand tenge should be provided in accordance with Appendix 4. Distribution of these amounts to regional budgets, budgets of Astana and Almaty cities and the procedure for Their use is determined on the basis of a decision of the Government of the Republic of Kazakhstan. <*>       The footnote.      Article 16. To provide in the republican budget for 2006 funds for the payment of one-time state monetary compensation to the working and non-working population living and living in areas of extreme and maximum radiation risks from 1949 to 1990, pensioners and recipients of state social benefits affected by nuclear tests at the Semipalatinsk nuclear test site, in the amount of 973,753 thousand tenge.       To establish that these funds are allocated in accordance with the procedure determined by the Government of the Republic of Kazakhstan.

     Article 17. To take into account that the republican budget for 2006 provides targeted current transfers to regional budgets, budgets of Astana and Almaty for subsidies aimed at agricultural development in the amount of 13,649,476 thousand tenge, including:       1,260,034 thousand tenge - to support the development of seed production; 1,891 109 thousand tenge - for the development of livestock breeding; 1,815,000 thousand tenge - to support the increase in yield and quality of agricultural crops;       7,000,000 thousand tenge - for subsidizing inventory items necessary for spring field and harvesting operations; 683,333 thousand tenge - for subsidizing the cost of water delivery services to agricultural producers; 1,000,000 thousand tenge - for subsidizing the increase in productivity and quality of livestock products.       The distribution of these amounts to the regional budgets, the budgets of Astana and Almaty cities and the procedure for their use are determined on the basis of a decision of the Government of the Republic of Kazakhstan.

     Article 18. Take into account that the republican budget for 2006 provides for a targeted current transfer to the city of Almaty in the amount of 96,685 thousand tenge for the functioning of cultural organizations transferred from the republican budget in 2006.

     Article 19. To provide in the republican budget for 2006 targeted current transfers to regional budgets, budgets of Astana and Almaty for the payment of salaries to civil servants, employees of government institutions who are not civil servants, and employees of state-owned enterprises in the amount of 39,036,632 thousand tenge, including:       Akmola region - 2,184,252 thousand tenge;       Aktobe region - 1,936,002 thousand tenge; Almaty region - 2,897,026 thousand tenge;       Atyrau region - 1,834,337 thousand tenge;       East Kazakhstan Region - 3,273,279 thousand tenge;       Zhambyl region - 2,752,117 thousand tenge; West Kazakhstan region - 1,901,808 thousand tenge; Karaganda region - 3,412,648 thousand tenge; Kostanay region - 2,407,284 thousand tenge;       Kyzylorda region - 1,901,141 thousand tenge; Mangystau region - 1,489,745 thousand tenge;       Pavlodar region - 2,066,967 thousand tenge;       North Kazakhstan - 2,215,166 thousand tenge; South Kazakhstan - 5,679,314 thousand tenge; Almaty city - 1,851,630 thousand tenge; Astana city - 1,233,916 thousand tenge.  

     Article 20. It should be noted that the republican budget for 2006 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty for the implementation of the State Program for the Development of Education of the Republic of Kazakhstan for 2005-2010 in the amount of 16,317,590 thousand tenge, including:       KZT 6,269,751 thousand - for the maintenance of standard staff of state institutions of general secondary education; KZT 3,532,939 thousand - for the maintenance of newly commissioned educational facilities;       102,102 thousand tenge - for catering, accommodation and transportation of children to testing points; 500,000 thousand tenge - for Internet connection and payment for traffic of state institutions of secondary general education; 895,513 thousand tenge - for the purchase and delivery of textbooks and teaching materials for updating library collections of state institutions of secondary general education; 1,576,970 thousand tenge - for the creation of language and multimedia classrooms in state institutions of secondary general education;       286,100 thousand tenge - to strengthen the material and technical base of state institutions of primary vocational education; 503,440 thousand tenge - for retraining and advanced training of teaching staff in regional (city) institutes of advanced training of teaching staff; 75,000 thousand tenge - to strengthen the material and technical base of regional (city) institutes of advanced training of teaching staff;       118,125 thousand tenge - to provide special (correctional) educational institutions with special technical and compensatory means.       2,457,650 thousand tenge - for equipping classrooms of physics, chemistry, biology in state institutions of secondary general education with educational equipment.       The distribution and the procedure for the use of these targeted current transfers are determined by the Government of the Republic of Kazakhstan. <*>       The footnote. Article 21. To take into account that the republican budget for 2006 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty for the implementation of the State Program for the reform and development of healthcare in the Republic of Kazakhstan for 2005-2010 in the amount of 24,896,568 thousand tenge, including:       77,178 thousand tenge - for reimbursement of expenses for increasing the cost of secondary vocational education within the framework of the state order;       190,763 thousand tenge - for advanced training and retraining of medical personnel, as well as managers in the field of healthcare; 1,076,249 thousand tenge - for providing medicines to children and adolescents registered at dispensaries for outpatient treatment of chronic diseases; 1,849,975 thousand tenge - for providing medicines on preferential terms for certain categories citizens at the outpatient level of treatment; 1,703,500 thousand tenge - to strengthen the material and technical base of regional centers of sanitary and epidemiological expertise;       2,279,971 thousand tenge - for staffing medical organizations of primary health care with medical personnel in accordance with staff standards and the development of the system of general practitioners; 107,919 thousand tenge - to ensure the activities of information and analytical centers being created; 10,890 thousand tenge - for the purchase of test systems for conducting sentinel epidemiological surveillance; 517 576 thousand tenge - for the provision of medicines for children under 5 years of age at the outpatient treatment level;       KZT 925,517 thousand - to provide pregnant women with iron and iodine-containing drugs; KZT 4,464,056 thousand - to carry out preventive medical examinations of certain categories of citizens; KZT 11,692,974 thousand - for the logistical equipment of medical healthcare organizations at the local level, including equipping with modern radiation therapy devices and X-ray diagnostic equipment of oncological organizations.       The distribution and the procedure for the use of these targeted current transfers are determined by the Government of the Republic of Kazakhstan.  

     Article 22. To provide in the republican budget for 2006 targeted development transfers to regional budgets for the development of small towns, including those with depressed economies, in the amount of 527,000 thousand tenge as part of the implementation of  Small town development programs for 2004-2006.       The distribution of the specified amount to the regional budgets is determined on the basis of a decision of the Government of the Republic of Kazakhstan.

     Article 23. To provide in the republican budget for 2006 targeted current transfers to regional budgets, budgets of Astana and Almaty in the amount of KZT 616,582 thousand to increase the staffing limit in connection with the transfer of certain functions and powers in the field of state regulation of architectural and urban planning, agriculture and land management to local executive bodies. resources, including:       Ministry of Agriculture of the Republic of Kazakhstan in the amount of 183,929 thousand tenge;       Ministry of Industry and Trade of the Republic of Kazakhstan in the amount of 84 029 thousand tenge;       The Land Resources Management Agency of the Republic of Kazakhstan in the amount of KZT 348,624 thousand. The distribution of these amounts to regional budgets, budgets of Astana and Almaty cities is determined based on a decision of the Government of the Republic of Kazakhstan.

     Article 24. To provide in the republican budget for 2006 targeted current transfers to the regional budget of the Kyzylorda region in the following amounts: 80,000 thousand tenge - to provide state targeted social assistance to the population of the Aral and Kazalinsky districts; 186,133 thousand tenge - to provide housing assistance to the population of the Aral, Kazalinsky and Karmakshinsky districts, the city of Baikonur.

     Article 25. To provide in the republican budget for 2006 targeted current transfers to the regional budget of the Aktobe region in the following amounts: 50,000 thousand tenge - to provide state targeted social assistance to the population of the Shalkar district; 47,981 thousand tenge - to provide housing assistance to the population of the Shalkar district.

     Article 26. To take into account that the republican budget for 2006 provides for expenditures in the amount of 2,274,216 thousand tenge to compensate for the cost of supplying fuel to an energy-producing organization in order to ensure stable electricity supply to consumers in the southern regions of Kazakhstan.

     Article 27. To provide in the republican budget for 2006 for the development and strengthening of the social infrastructure of the village as part of the implementation of  The State Program for Rural Development of the Republic of Kazakhstan for 2004-2010 costs in the amount of KZT 19,187,775 thousand, including:       for the development of mobile and telemedicine in healthcare in rural areas - 439,936 thousand tenge; targeted transfers for development:       construction and reconstruction of drinking water supply facilities in rural settlements - 5,187,775 thousand tenge;       construction and reconstruction of educational facilities in rural areas - 7,500,000 thousand tenge; construction and reconstruction of healthcare facilities in rural areas - 6,060,064 thousand tenge.       The list of educational, healthcare and drinking water supply facilities in rural areas to be built and reconstructed in 2006 at the expense of these targeted development transfers is determined by the Government of the Republic of Kazakhstan.

     Article 28. To provide in the republican budget for 2006 targeted development transfers to regional budgets, budgets of Astana and Almaty in the amount of 5,944,048 thousand tenge for the construction of particularly important educational and healthcare facilities in cities.       The list of particularly important educational and healthcare facilities in cities to be built and reconstructed at the expense of the republican budget in 2006 is determined by the Government of the Republic of Kazakhstan. <*>       The footnote.      Article 29. To provide in the republican budget for 2006 targeted development transfers to regional budgets, budgets of Astana and Almaty in the amount of 1,000,000 thousand tenge for the construction and reconstruction of preschool organizations.       The list of preschool institutions to be built and reconstructed at the expense of the republican budget in 2006 is determined by the Government of the Republic of Kazakhstan.

     Article 30. To provide 1,350,171 thousand tenge as part of the expenses of the Ministry of Agriculture of the Republic of Kazakhstan for state support of the development of the agro-industrial complex, including for financing, in accordance with the procedure determined by the decisions of the Government of the Republic of Kazakhstan, activities related to: reimbursement of the interest rate on financial leasing of agricultural machinery - 197,743 thousand tenge;       reimbursement of the interest rate on financial leasing of equipment for agricultural processing enterprises, - KZT 12,428 thousand; insurance support in crop production, - KZT 100,000 thousand; subsidizing the interest rate on loans issued by second-tier banks to agricultural processing enterprises to replenish their working capital, - 1 KZT 1,000,000 thousand; subsidizing the development of production management systems and the agricultural market, - KZT 40,000 thousand.

     Article 31. To provide in the republican budget for 2006 official transfers transferred to the National Fund of the Republic of Kazakhstan in the amount of 10,617,223 thousand tenge by July 1, 2006. <*>       The footnote.      Article 32. To approve the reserve of the Government of the Republic of Kazakhstan for 2006 in the amount of KZT 19,437,035 thousand. <*>       The footnote. Article 32 was amended by the Law of the Republic of Kazakhstan dated July 5, 2006 No. 159 (effective January 1, 2006).  

     Article 33. To provide in the republican budget for 2006 for the fulfillment of obligations of previous years 1,632,442 thousand tenge, including:       To the Ministry of Internal Affairs of the Republic of Kazakhstan - 1,424,418 thousand tenge for the production of driver's licenses, documents and license plates for state registration of vehicles; to the Ministry of Foreign Affairs of the Republic of Kazakhstan - 182,908 thousand tenge for the purchase of real estate owned by the Republic of Kazakhstan abroad;       To the Ministry of Emergency Situations of the Republic of Kazakhstan - 25,116 thousand tenge for repayment of accounts payable of previous years. <*>       The footnote.      Article 34. To provide targeted development transfers to regional budgets, budgets of Astana and Almaty cities in the republican budget for 2006 for the implementation of the State Housing Construction Program for 2005-2007:       for the construction of housing of the state communal housing stock in the amount of KZT 6,200,000 thousand; for the development and improvement of engineering and communication infrastructure in the amount of KZT 20,000,000 thousand. The distribution and use of these targeted development transfers are determined by the Government of the Republic of Kazakhstan.

Article 35. To provide in the republican budget for 2006 22 000 000 thousand tenge for crediting regional budgets, budgets of the cities of Astana and Almaty for housing construction at a zero interest rate as part of the implementation of  The State Housing Construction Program for 2005-2007 in accordance with the procedure determined by the Government of the Republic of Kazakhstan.

     Article 36. To provide in the republican budget for 2006 funds in the amount of 149,806 thousand tenge for the payment of premiums on deposits in housing construction savings. <*>       The footnote.      Article 37. To provide 49,224 thousand tenge in the republican budget for 2006 for the payment of the exchange rate difference on 2005 payments of borrowers of preferential housing loans received through the closed joint-stock company Zhilstroybank. <*>       The footnote.      Article 38. To take into account that the expenses of the Ministry of Emergency Situations of the Republic of Kazakhstan for the formation and storage of the state material reserve include funds in the amount of 1,850,979 thousand tenge for the refreshment of material assets of the state material reserve, reflecting the amount from the sale of material assets issued in the order of refreshment in the revenues of the republican budget.

     Article 40. To establish that from January 1, 2006, the requirements of the Government of the Republic of Kazakhstan to legal entities liquidated as of January 1, 2006 in accordance with the legislation of the Republic of Kazakhstan, for loans and funds allocated to fulfill obligations under state guarantees, according to the list of legal entities and amounts of debt determined by the Government of the Republic of Kazakhstan, cease.

     Article 41. To establish that from January 1, 2006, the requirements of the Government of the Republic of Kazakhstan to JSC Fund for Financial Support of Agriculture for centralized (directive) loans provided to borrowers - legal entities that were liquidated as of January 1, 2006 in accordance with the legislation of the Republic of Kazakhstan will cease.

     Article 42. To provide in the republican budget for 2006 3,699,779 thousand tenge for repayment and servicing of loans guaranteed by the state.

     Article 43. To set a limit on the provision of state guarantees of the Republic of Kazakhstan in 2006 in the amount of 31,750,000 thousand tenge.

     Article 44. To set the government debt limit as of December 31, 2006 in the amount of 787,000,000 thousand tenge.

     Article 45. To approve the list of budget programs for the development of the republican budget for 2006, divided into budget programs aimed at the implementation of budget investment projects (programs) and the formation or increase of the authorized capital of legal entities, according to Appendix 5.

     Article 46. To approve the list of republican budget programs that are not subject to sequestration in the process of executing the republican budget for 2006, according to Appendix 6.       To establish that in the process of executing local budgets for 2006, local budget programs are not subject to sequestration in accordance with Appendix 7.

     Article 47. This Law shall enter into force on January 1, 2006.
