Absence of an administrative offense

Exemption from administrative liability due to insignificance in the absence of an administrative offense is also carried out by the appellate instance. Thus, by a resolution of the Tyulkub District Court of the Turkestan region dated August 1, 2019, IP V. was brought to administrative responsibility under part 3 of Article 462 of the Administrative Code (for failure to comply with instructions on time and failure to eliminate violations in the field of sanitary and epidemiological welfare of the population and hygienic requirements).  As follows from the case file, 5 out of 6 violations were eliminated, one violation - the receipt of a sanitary and epidemiological conclusion was not eliminated on time, due to circumstances beyond her control, the suspension of the issuance of conclusions by the authorized body during the specified period (updating and updating the GBD "E-licensing" system).

By a decision of the judicial board for civil cases dated September 3, 2019, the decision of the court of first instance was canceled, the proceedings were terminated for insignificance, while the court of appeal concludes that there were no violations on the part of the sole proprietor, in such circumstances, the proceedings were to be terminated for lack of an administrative offense.
