Since 2021, Dr. Bekaeva (hereinafter referred to as the employee) has worked at MKS LLP (hereinafter referred to as the employer) as a "storekeeper".

On April 10, 2020, an accident occurred with an employee at the workplace, namely, on the territory of the employer in a warehouse of finished products, the driver of an electric loader (Kara) With.... B., while performing his duties, driving in reverse, hit an employee (warehouse manager) Dr. E.B., who received bodily injuries, which, according to the forensic medical examination, was established as moderate damage to health.

On May 22, 2024, after the formation of the Accident investigation Commission, the employer issued Act No. 1 on labor-related accidents. The employer is responsible for ensuring occupational safety and health and constantly carries out explanatory work on compliance with the rules and regulations on occupational safety and health. The Employer's degree of guilt in this accident is 100%.

Earlier, the employer sent the employee notification No. 88 dated 03/04/2025 on termination of the employment contract in accordance with subparagraph 6 of paragraph 1 of Article 52 of the Labor Code of the Republic of Kazakhstan.

According to clause 3, Article 61 of the Labor Code of the Republic of Kazakhstan, a copy of the employer's act on termination of the employment contract is handed to the employee or sent to him by registered mail with a notification of its delivery within three working days from the date of publication of the employer's act.

However, to this day, the employee has not read the order to terminate the employment contract. In accordance with subparagraph 2), paragraph 3, Article 76 of the Law of the Republic of Kazakhstan "On Advocacy and Legal Assistance" in order to provide qualified legal assistance and on the basis of legal request No. 5/05 dated May 5, 2025, I requested from MKS LLP a copy of the order to terminate the employment contract with Dr. E.B. Within 10 working days.

However, to date, the employer has not provided a written response to the legal request No. 5/05 dated May 5, 2025, and thus has not provided an order to terminate the employment contract with the employee Dr. E.B.

According to paragraph 1.4, Article 194 of the Labor Code of the Republic of Kazakhstan, state labor inspectors are required to: monitor compliance with the labor legislation of the Republic of Kazakhstan, promptly consider appeals from employees and employers regarding the application of labor legislation of the Republic of Kazakhstan.

Based on the above and in accordance with art. 195 of the Labor Code of the Republic of Kazakhstan,

I beg:

 

·         To bring to administrative responsibility MKS LLP for violation of the Labor Code of the Republic of Kazakhstan;

·         To appoint an audit in relation to MKS LLP for compliance with the requirements of the labor legislation of the Republic of Kazakhstan, as well as to conduct a legal assessment of the legality of the order to terminate the employment contract with the employee Dr. E.B., issued by MKS LLP.
