about performing an action ***
On September 25, 2020, near my house (the plaintiff), located at 11 A-10 Street, Nur-Sultan, Almaty district, Company X JSC (the defendant, the administrative body) installed a road sign prohibiting travel, which prevents access to the passage through the public road. Bypassing this road sign via another route leads to additional costs (fuel and lubricants costs, etc.) and creates a risk of spoiling perishable goods (vegetables and fruits), since the alternative route is overloaded with traffic jams. On October 26, 2020, Company X JSC refused to remove the traffic prohibition sign No. 0XX... . The reason for the refusal was the conclusion of the person concerned.

I do not agree with this administrative action, I believe that my right to free movement along the specified road, which is stipulated by law, has been violated, which prevents me from carrying out business activities. On January 20, 2021, the plaintiff filed a complaint with a higher authority****, as a result of which the complaint was dismissed. Therefore, the plaintiff appeals to the administrative court. By virtue of article 134 of the Administrative Procedural Procedure Code of the Republic of Kazakhstan (hereinafter referred to as the APPC), in a claim for an action, the plaintiff may require certain actions to be performed or refrain from such actions that are not aimed at adopting an administrative act. Guided by Articles 5-16, 131, 133 of the CPC, I ASK the COURT to force the defendant, JSC Company X, to remove (dismantle) the traffic prohibition sign installed on the road section along A-10 Street (near house No. 11) (15 km. section of the Nur-Sultan-Temirtau highway).
Distribute the court costs. Applications: 1) copies of the statement of claim and the documents attached to it – for __ L.; 2) a document confirming payment of the state fee (or confirming the basis for the plaintiff's exemption from payment) – for __ L.; 3) a power of attorney or other document certifying the powers of the representative (if the statement of claim is filed by the representative) – for __ 4) documents confirming the circumstances on which the plaintiff bases his claims (in relation to this claim, a copy of the disputed order), etc. – on __ L. 5) a document confirming compliance with the pre–trial dispute settlement procedure - for __ L.; 6) other documents – for __ L.; 7) copies of the plaintiff's identity document – for __ L.
